Vienlaic\u012bgi attiec\u012bb\u0101 uz publiski izskan\u0113ju\u0161o inform\u0101ciju, nor\u0101d\u0101m \u2013 RP SIA \u201cR\u012bgas satiksme\u201d par cietu\u0161o personu pieteic\u0101s atbilsto\u0161i izmekl\u0113\u0161anas iest\u0101\u017eu nor\u0101d\u012btajam, ka saist\u012bb\u0101 ar t.s. nanotehnolo\u0123isko virsmu apstr\u0101des \u0137\u012bmisko l\u012bdzek\u013cu pieg\u0101d\u0113m \u201cR\u012bgas satiksme\u201d ir noticis noziedz\u012bgs nodar\u012bjums. Piesak\u0101majai mantisk\u0101 kait\u0113juma (zaud\u0113jumu) summai ir j\u0101b\u016bt noskaidrotai un pamatotai ar konkr\u0113tiem pier\u0101d\u012bjumiem par konkr\u0113tiem faktiem. T.i. Saska\u0146\u0101 ar Krimin\u0101lprocesa likuma 95. panta un 96. panta noteikumiem jaut\u0101jumu par cietu\u0161\u0101 statusa pie\u0161\u0137ir\u0161anu un iesp\u0113jam\u0101 kait\u0113juma kompens\u0101cijas iesnieg\u0161anas nepiecie\u0161am\u012bbu un t\u0101 pamatot\u012bbu pie\u0146emsim l\u012bdz tiesas izmekl\u0113\u0161anas s\u0101kumam,\u201d apliecina RP SIA \u201cR\u012bgas satiksme\u201d Sabiedrisko attiec\u012bbu noda\u013cas vad\u012bt\u0101ja Baiba Barta\u0161evi\u010da.<\/p>\n<p><!--more--><\/p>\n<p>Septembr\u012b ir pabeigts pirmstiesas krimin\u0101lprocess, apliecina Organiz\u0113t\u0101s noziedz\u012bbas un citu nozaru specializ\u0113t\u0101s prokurat\u016bras prokurors Dainis \u0160teinbergs. Tiek veikts tehniskais darbs, nodro\u0161inot krimin\u0101llietas materi\u0101lu kopijas izsnieg\u0161anai aps\u016bdz\u0113tajiem un cietu\u0161ajiem. Saska\u0146\u0101 ar Krimin\u0101lprocesa likuma 412. panta desmito da\u013cu p\u0113c krimin\u0101llietas materi\u0101lu kopiju izsnieg\u0161anas un sa\u0146emot inform\u0101ciju no aps\u016bdz\u0113tiem par to, vai vi\u0146\u0161 v\u0113las aizst\u0101vja piedal\u012b\u0161anos lietas izties\u0101\u0161an\u0101, kuras personas, p\u0113c aizst\u0101v\u012bbas dom\u0101m, b\u016btu izsaucamas uz tiesas s\u0113di un\/vai aps\u016bdz\u0113tais piekr\u012bt iesp\u0113jai, ka krimin\u0101llietu aps\u016bdz\u012bb\u0101 vai t\u0101s patst\u0101v\u012bg\u0101 da\u013c\u0101 tiesa izskata bez pier\u0101d\u012bjumu p\u0101rbaudes, prokurors pie\u0146em l\u0113mumu par krimin\u0101llietas nodo\u0161anu tiesai.<\/p>\n<p>&nbsp;<\/p>\n<p><b>RP SIA \u201cR\u012bgas satiksme\u201d (RS) krimin\u0101lliet\u0101 saist\u012bb\u0101 ar nanotehnolo\u0123isko virsmu apstr\u0101des \u0137\u012bmisko l\u012bdzek\u013cu pieg\u0101d\u0113m prokurat\u016bra atzinusi par cietu\u0161o. Vai b\u016btu lo\u0123iski, ka no RS puses tiktu pieteikta kait\u0113juma kompens\u0101cija?<\/b><\/p>\n<p><b>D.\u0160teinbergs:<\/b> \u2013 Jebkuram krimin\u0101lproces\u0101 atz\u012btam cietu\u0161ajam ir ties\u012bbas, nevis pien\u0101kums iesniegt pieteikumu par rad\u012bt\u0101 kait\u0113juma kompens\u0101ciju. To cietu\u0161ais ir ties\u012bgs dar\u012bt l\u012bdz tiesas izmekl\u0113\u0161anas uzs\u0101k\u0161anai pirm\u0101s instances ties\u0101. Attiec\u012bb\u0101 uz SIA \u201eR\u012bgas Satiksme\u201d poz\u012bciju, t\u0101 ir vi\u0146u br\u012bva izv\u0113le piepras\u012bt, noties\u0101jo\u0161a sprieduma gad\u012bjum\u0101, no noties\u0101tiem \u0161o kait\u0113jumu vai n\u0113. Krimin\u0101lprocesa virz\u012bbu tas neietekm\u0113. Viens no krimin\u0101lprocesa pamatprincipiem ir ties\u012bbas uz kompens\u0101ciju par rad\u012bto kait\u0113jumu, kas nosaka, ka personai, kurai ar noziedz\u012bgu nodar\u012bjumu rad\u012bts kait\u0113jums, \u0146emot v\u0113r\u0101 t\u0101s mor\u0101lo aizsk\u0101rumu, fizisk\u0101s cie\u0161anas un mantisko zaud\u0113jumu, tiek garant\u0113tas procesu\u0101l\u0101s iesp\u0113jas mor\u0101las un materi\u0101las kompens\u0101cijas piepras\u012b\u0161anai un sa\u0146em\u0161anai. \u0160\u0101das procesu\u0101l\u0101s iesp\u0113jas piepras\u012bt materi\u0101lo kompens\u0101ciju SIA \u201eR\u012bgas Satiksme\u201d tika nodro\u0161in\u0101tas. Krimin\u0101lprocesa ietvaros tika risin\u0101ti mantiskie jaut\u0101jumi, tostarp, uzlikti aresti naudas l\u012bdzek\u013ciem un nekustamiem \u012bpa\u0161umiem, lai, noties\u0101jo\u0161a sprieduma gad\u012bjum\u0101 nodro\u0161in\u0101tu cietu\u0161ajiem nodar\u012bt\u0101 kait\u0113juma kompens\u0101cijas piedzi\u0146u. SIA \u201eR\u012bgas Satiksme\u201d, uzskatot, ka ir sa\u0146\u0113musi preces atbilsto\u0161i l\u012bguma pras\u012bb\u0101m, apmaks\u0101ja r\u0113\u0137inus piln\u0101 apm\u0113r\u0101, t\u0101d\u0113j\u0101di organiz\u0113t\u0101s grupas dal\u012bbnieki sa\u0146\u0113ma naudas l\u012bdzek\u013cus, kurus da\u013c\u0113ji v\u0113l\u0101k legaliz\u0113ja.<\/p>\n<p>\u2013 <b>T\u0101pat prokurors iepriek\u0161 izteicis br\u012bdin\u0101jumu R\u012bgas domei un RS saist\u012bb\u0101 ar RS\u00a0iepirkuma\u00a0proced\u016bru neatbilst\u012bbu likuma pras\u012bb\u0101m. Min\u0113tais likums reglament\u0113 iepirkuma proced\u016bras (atkl\u0101ts konkurss; sl\u0113gts konkurss; sarunu proced\u016bra, public\u0113jot dal\u012bbas uzaicin\u0101jumu; sarunu proced\u016bra, nepublic\u0113jot dal\u012bbas uzaicin\u0101jumu; konkursa dialogs; inov\u0101cijas partner\u012bbas proced\u016bra) sabiedrisko pakalpojumu sniedz\u0113jiem, ja l\u012bgumcena ir vien\u0101da ar Ministru kabineta noteiktaj\u0101m l\u012bgumcenu robe\u017ev\u0113rt\u012bb\u0101m vai liel\u0101ka (443 000 eiro pieg\u0101des un pakalpojumu l\u012bgumiem).
