Iesp\u0113jams, R\u012bg\u0101 no 2019. gada tiktu apdraud\u0113ta pasa\u017eieru turpm\u0101k\u0101 p\u0101rvad\u0101\u0161ana ar mikroautobusiem, un pa\u0161reiz \u201cR\u012bgas satiksme\u201d sarunu proced\u016br\u0101 ir noteikusi divus pretendentus &#8211; SIA \u201cR\u012bgas mikroautobusu satiksme\u201d un personu apvien\u012bbu \u201cLiep\u0101jas autobusu parks\u201d\/AS \u201cNordeka\u201d. No abiem pretendentiem \u201cR\u012bgas satiksme\u201d sagaida pied\u0101v\u0101jumus, lai noteiktu uzvar\u0113t\u0101ju. Personu apvien\u012bba \u201cLiep\u0101jas autobusu parks\u201d\/AS \u201cNordeka\u201d jau se\u0161as reizes Iepirkumu uzraudz\u012bbas biroj\u0101 (IUB) p\u0101rs\u016bdz\u0113jusi iepirkuma nolikumu.<\/b><\/p>\n<p>Iepirkumam \u201cPar apak\u0161uz\u0146\u0113muma l\u012bguma nosl\u0113g\u0161anu par sabiedrisk\u0101 transporta pakalpojumu snieg\u0161anu\u00a0R\u012bgas\u00a0pils\u0113tas t\u012bkla da\u013cas mar\u0161rutos\u201d kvalific\u0113ju\u0161ies pilnsabiedr\u012bba \u201cR\u012bgas mikroautobusu satiksme\u201d (RMS) un divu uz\u0146\u0113mumu personu apvien\u012bba, kur\u0101 apvienotas a\/s &#8220;Liep\u0101jas autobusu parks&#8221; un SIA &#8220;Nordeka&#8221;. RS un RMS bija nosl\u0113gu\u0161i papildvieno\u0161anos l\u012bdz 2020. gada 30. oktobrim. Iepirkuma l\u012bgumam bija j\u0101st\u0101jas sp\u0113k\u0101 jau \u0161\u0101 gada 1. maij\u0101. Agr\u0101k bija izsludin\u0101ta sarunu proced\u016bra, tom\u0113r RS nosl\u0113dza min\u0113to papildvieno\u0161anos ar RMS. &#8220;Liep\u0101jas Autobusu parks&#8221; to apstr\u012bd\u0113ja, un Augst\u0101k\u0101 tiesa noteica, ka papildvieno\u0161an\u0101s ir sp\u0113k\u0101 l\u012bdz 2019. gada 1. janv\u0101rim. Augst\u0101k\u0101 tiesa uzdeva no n\u0101kam\u0101 gada aptur\u0113t RS un RMS starp\u0101 nosl\u0113gto papildvieno\u0161anos par paaugstin\u0101ta servisa sabiedrisk\u0101 transporta pakalpojumu l\u012bguma termi\u0146a pagarin\u0101\u0161anu.<br \/>\n<!--more--><br \/>\nAugst\u0101k\u0101 tiesa atzina, ka liet\u0101 apstr\u012bd\u0113t\u0101 papildu vieno\u0161an\u0101s ir \u201cpirm\u0161\u0137ietami prettiesiska\u201d. T\u0101 noteica, ka \u0161\u012bs vieno\u0161an\u0101s darb\u012bba ir apturama no 2019. gada 1. janv\u0101ra.<\/p>\n<p>Augst\u0101k\u0101 tiesa ar\u012b piem\u0113roja pagaidu aizsardz\u012bbu un aptur\u0113ja starp SIA\u00a0\u201eR\u012bgas\u00a0satiksme\u201d un pilnsabiedr\u012bbu\u00a0\u201eR\u012bgas\u00a0mikroautobusu\u00a0satiksme\u201d 2017. gada 31. maij\u0101 nosl\u0113gt\u0101s papildu vieno\u0161an\u0101s pie 2013. gada 4. janv\u0101ra l\u012bguma darb\u012bbu no 2019. gada 1. janv\u0101ra, izskatot blakus s\u016bdz\u012bbu par rajona tiesas l\u0113mumu, koment\u0113 Augst\u0101k\u0101s tiesas Administrat\u012bvo lietu departamenta priek\u0161s\u0113d\u0113t\u0101ja Veronika Kr\u016bmi\u0146a.<\/p>\n<p>\u201cProcesa dal\u012bbnieks jebkur\u0101 laik\u0101 var iesniegt l\u016bgumu, ar\u012b atk\u0101rtotu l\u016bgumu, par pagaidu aizsardz\u012bbas l\u012bdzek\u013ca piem\u0113ro\u0161anu, atcel\u0161anu vai groz\u012b\u0161anu tai tiesai, kuras tiesved\u012bb\u0101 atrodas lieta. Krongorns: <\/b>\u2013 Situ\u0101cija ir absurda. 2017. gada apr\u012bl\u012b &#8220;R\u012bgas Satiksme&#8221; (RS) l\u0113ma p\u0101rtraukt \u0161o iepirkumu bez jebk\u0101da tiesiska pamatojuma un nol\u0113ma prettiesiski pagarin\u0101t 2013. gad\u0101 nosl\u0113gto l\u012bgumu ar R\u012bgas Mikroautobusu satiksmi (RMS). Tas notika br\u012bd\u012b, kad LAP\/Nordeka k\u0101 kandid\u0101ts bija iesniedzis s\u016bdz\u012bbas IUB par nepiln\u012bb\u0101m konkursa nolikum\u0101, kuras Iepirkumu uzraudz\u012bbas birojs (IUB) piln\u012bb\u0101 vai da\u013c\u0113ji ar\u012b atzina par pamatot\u0101m. Tas noz\u012bm\u0113, ka iepirkuma nolikums bija j\u0101preciz\u0113 un j\u0101izsludina pa jaunu. L\u012bdz pat Augst\u0101k\u0101s tiesas (AT) l\u0113mumam, \u0161\u0101 gada febru\u0101r\u012b, visi bija aizmirsu\u0161i par \u0161\u0101da iepirkuma esam\u012bbu, un RMS turpin\u0101ja un v\u0113l l\u012bdz 2019. gada 1. janv\u0101rim turpin\u0101s sniegt \u0161os pakalpojumus.<br \/>\nPublisko iepirkumu praks\u0113 t\u0101 nav pie\u0146emama situ\u0101cija, kad pas\u016bt\u012bt\u0101js izstr\u0101d\u0101 iepirkuma nolikumu, lai privili\u0123\u0113t\u0101 st\u0101vokl\u012b nost\u0101d\u012btu k\u0101du konkr\u0113tu kandid\u0101tu, turkl\u0101t klaji ignor\u0113jot IUB l\u0113mumus. \u012apa\u0161i situ\u0101cij\u0101, kad iepirkuma pas\u016bt\u012bt\u0101js ir liel\u0101k\u0101s pa\u0161vald\u012bbas uz\u0146\u0113mums un netie\u0161\u0101 veid\u0101 pati R\u012bgas dome. <\/p>\n<p><b>\u2013 J\u016bs piedalieties konkurs\u0101 un jau vair\u0101kk\u0101rt esat apstr\u012bd\u0113ju\u0161i konkursa nolikumu. K\u0101d\u0113\u013c?<br \/>\nL. Krongorns:<\/b> \u2013 Skaidrs ir tas, ka LAP\/Nordeka \u0161\u012bs s\u016bdz\u012bbas negatavo, lai kav\u0113tu konkursa gaitu, bet lai c\u012bn\u012btos par vienl\u012bdz\u012bg\u0101m iesp\u0113j\u0101m katram pretendentam.
