Likum\u0101 ir teikts, ka nodok\u013cu nomaksas p\u0101rbaude ir j\u0101veic br\u012bd\u012b, kad pie\u0146emts l\u0113mums par iesp\u0113jamu iepirkuma l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu, un tas noz\u012bm\u0113, ka \u0161\u0101da p\u0101rbaude ir j\u0101veic tad, kad ir piln\u012bb\u0101 pabeigta pied\u0101v\u0101juma izv\u0113rt\u0113\u0161ana un ir konstat\u0113jams, ka konkr\u0113tais pied\u0101v\u0101jums atbilst vis\u0101m pras\u012bb\u0101m un ir saimnieciski visizdev\u012bg\u0101kais. Gad\u0101s, ka \u0161o p\u0101rbaudi nesaprotamu iemeslu d\u0113\u013c veic cit\u0101 laik\u0101, piem\u0113ram, pirms l\u016bguma sniegt skaidrojumu par k\u0101du no iesniegtajiem dokumentiem, vai ar\u012b p\u0101rbaudi visp\u0101r neveic un par uzvar\u0113t\u0101ju atz\u012bst nodok\u013cu par\u0101dnieku. <\/p>\n<p>\u012as\u0101 laika posm\u0101 CFLA  ir konstat\u0113jusi tr\u012bs \u0161\u0101dus gad\u012bjumus, un \u0161\u0101 iemesla d\u0113\u013c esam iecer\u0113ju\u0161i par \u0161o t\u0113mu m\u016bsu t\u012bmek\u013ca vietn\u0113 ievietot papildu skaidrojumu. <\/p>\n<p><b>&#8211; Vai iepirkuma dal\u012bbniekiem gr\u016bt\u012bbas sag\u0101d\u0101ja jauno iepirkuma likumu st\u0101\u0161an\u0101s sp\u0113k\u0101? <\/b><br \/>\n&#8211; Mums ir vair\u0101ki nov\u0113rojumi. Daudzi pas\u016bt\u012bt\u0101ji nav paman\u012bju\u0161i, ka iepirkumos zem ES sliek\u0161\u0146iem nedr\u012bkst piepras\u012bt iesniegt kvalit\u0101tes vad\u012bbas (ISO) vai vides vad\u012bbas (EMAS) sist\u0113mas sertifik\u0101tus. Agr\u0101k \u0161\u0101da nosac\u012bjuma nebija, l\u012bdz ar to konstat\u0113jam, ka daudzi pas\u016bt\u012bt\u0101ji nav to iev\u0113roju\u0161i un turpina piepras\u012bt ISO vai EMAS sertifik\u0101tus k\u0101 apliecin\u0101jumus ieviestaj\u0101m kvalit\u0101tes vai vides vad\u012bbas sist\u0113m\u0101m. Aicin\u0101m pas\u016bt\u012bt\u0101jus noteikt pras\u012bbas par ieviestajiem kvalit\u0101tes vai vides vad\u012bbas pas\u0101kumiem visp\u0101r\u012bg\u0101k, neminot konkr\u0113tus sertifik\u0101tus, lai nerad\u012btu slogu maziem un vid\u0113jiem uz\u0146\u0113m\u0113jiem. <\/p>\n<p>V\u0113l b\u016btiski atcer\u0113ties, ka ar\u012b l\u012bguma saist\u012bbu izpildes vai garantijas saist\u012bbu nodro\u0161in\u0101jumu nedr\u012bkst piepras\u012bt konkr\u0113t\u0101 form\u0101, l\u012bdz\u012bgi k\u0101 tas l\u012bdz jaun\u0101 likuma pie\u0146em\u0161anai bija noteikts attiec\u012bb\u0101 uz pied\u0101v\u0101juma nodro\u0161in\u0101jumu. \u0160obr\u012bd jebkura nodro\u0161in\u0101juma veidu var izv\u0113l\u0113ties pretendents, l\u012bdz ar to iepirkuma dokument\u0101cij\u0101 var noteikt tikai pras\u012bbas nodro\u0161in\u0101jumam, bet ne t\u0101 formai. <\/p>\n<p>T\u0101pat j\u0101piemin \u2013 attiec\u012bb\u0101 uz personu apvien\u012bb\u0101m k\u0101 pretendentiem patlaban likum\u0101 ir skaidri noteikts, ka nedr\u012bkst pras\u012bt noteiktu sadarb\u012bbas veidu \u2013 ne pirms pied\u0101v\u0101jumu iesnieg\u0161anas, ne ar\u012b p\u0113c iepirkuma l\u012bguma sl\u0113g\u0161anas. T\u0101tad, personu apvien\u012bba var izv\u0113l\u0113ties \u2013 sl\u0113gt savstarp\u0113j\u0101s sadarb\u012bbas l\u012bgumu vai izveidot person\u0101lsabiedr\u012bbu k\u0101 juridisku personu. Da\u017ek\u0101rt pas\u016bt\u012bt\u0101ji nepareizi formul\u0113 nosac\u012bjumus iepirkuma dokument\u0101cij\u0101, pieprasot l\u012bdz l\u012bguma sl\u0113g\u0161anai nodibin\u0101t person\u0101lsabiedr\u012bbu. L\u012bdz ar to tas var\u0113tu rad\u012bt risku, ka t\u0101d\u0113j\u0101di pretendenti, kuri v\u0113las start\u0113t personu apvien\u012bb\u0101, tiek attur\u0113ti no piedal\u012b\u0161an\u0101s iepirkum\u0101, jo tie nev\u0113las viena l\u012bguma izpildei veidot juridisku personu, \u0146emot v\u0113r\u0101 to, ka tas ir saist\u012bts ar zin\u0101mu administrat\u012bvo slogu \u2013 j\u0101re\u0123istr\u0113jas Uz\u0146\u0113mumu re\u0123istr\u0101, j\u0101maks\u0101 par re\u0123istr\u0113\u0161anu, v\u0113l\u0101k uz\u0146\u0113mums j\u0101likvid\u0113. <\/p>\n<p><b>&#8211; K\u0101das v\u0113l ir rakstur\u012bg\u0101k\u0101s k\u013c\u016bdas ES fondu projektos un iepirkumos?<\/b><br \/>\n&#8211; M\u016bsu aicin\u0101jums b\u016btu \u013coti r\u016bp\u012bgi sekot l\u012bdzi, lai l\u012bgumu izpild\u0113 nomain\u012btie speci\u0101listi atbilst iepirkuma dokument\u0101cij\u0101 noteiktaj\u0101m pras\u012bb\u0101m. Nereti pas\u016bt\u012bt\u0101js dom\u0101, ka ar l\u012bguma nosl\u0113g\u0161anu vi\u0146am visa atbild\u012bba beidzas. T\u0101 nav.  Atbild\u012bba turpin\u0101s l\u012bdz l\u012bguma izpildei. Patlaban ir \u013coti daudz da\u017e\u0101du ce\u013cu b\u016bves, ielu atjauno\u0161anas un l\u012bdz\u012bgu projektu, kur da\u017e\u0101diem viena ce\u013ca posmiem ir katram savs tehniskais projekts. L\u012bdz ar to pas\u016bt\u012bt\u0101js da\u017ek\u0101rt nolemj, ka ar\u012b b\u016bvdarbus t\u0101p\u0113c var iepirkt vai nepiecie\u0161ams iepirkt atsevi\u0161\u0137i. T\u0101 nav. T\u0101 k\u0101 t\u0101 ir vienota ekonomisk\u0101 vajadz\u012bba, \u0161\u0101d\u0101 gad\u012bjum\u0101 ir j\u0101veic iepirkums atbilsto\u0161i abu posmu kop\u0113jai l\u012bguma cenai. P\u0113c Ministru kabineta noteikumiem mums k\u0101 ES fondu projektu uzraugiem ir j\u0101izv\u0113rt\u0113 katra l\u012bguma cenas atbilst\u012bba tirgus cenai. \u0160aj\u0101 p\u0101rbaud\u0113 balst\u0101mies uz pieejamo inform\u0101ciju citos projektos, k\u0101 ar\u012b pa\u0161i veicam tirgus izp\u0113ti. M\u0113s esam paman\u012bju\u0161i, ka da\u017eiem uz\u0146\u0113mumiem to veiktaj\u0101 tirgus izp\u0113t\u0113 aptauj\u0101ti vai konkurs\u0101 piedal\u0101s uz\u0146\u0113mumi, kas re\u0101li tirg\u016b nedarbojas vai nedarbojas nozar\u0113, kur sludin\u0101ts iepirkums.
