Cita starp\u0101 pie\u0146emtie groz\u012bjumi paredz \u0161\u0101das str\u012bd\u012bgas normas:<\/p>\n<ol>\n<li> Papildin\u0101t 9.panta astoto da\u013cu ar noteikumu, ka no dali\u0304bas iepirkuma\u0304 tiek izsle\u0304gts ta\u0304ds pretendents, kas ir zemu nodokl\u0327u vai beznodokl\u0327u valsti\u0304 vai teritorija\u0304 reg\u0327istre\u0304ts uzn\u0327e\u0304mums. \u0160is pants attiecas uz t.s. \u201cmazajiem iepirkumiem\u201d, proti &#8211; ja publiska pieg\u0101des l\u012bguma vai publiska pakalpojuma l\u012bguma paredzam\u0101 l\u012bgumcena ir 10 000 euro vai liel\u0101ka, bet maz\u0101ka par 42 000 euro, un publiska b\u016bvdarbu l\u012bguma paredzam\u0101 l\u012bgumcena ir 20 000 euro vai liel\u0101ka, bet maz\u0101ka par 170 000 euro.\n<li> Papildin\u0101t 42.panta pirmo da\u013cu ar vair\u0101kiem jauniem punktiem, kas nosaka, ka no dal\u012bbas iepirkuma proced\u016br\u0101 j\u0101izsl\u0113dz t\u0101ds kandid\u0101ts vai pretendents, kas (a) ir zemu nodokl\u0327u vai beznodokl\u0327u valsti\u0304 vai teritorija\u0304 reg\u0327istre\u0304ts uzn\u0327e\u0304mums, (b) kas ir reg\u0327istre\u0304ts Latvijas Republika\u0304, kura\u0304 vaira\u0304k par 25 % kapita\u0304ldal\u0327u (akciju) ture\u0304ta\u0304js ir zemu nodokl\u0327u vai beznodokl\u0327u valsti\u0304 vai teritorija\u0304 reg\u0327istre\u0304ts uzn\u0327e\u0304mums un (c) kura ka\u0304ds no pieda\u0304va\u0304juma\u0304 nora\u0304di\u0304tajiem apaks\u030cuzn\u0327e\u0304me\u0304jiem ir zemu nodokl\u0327u vai beznodokl\u0327u valsti\u0304 vai teritorija\u0304 reg\u0327istre\u0304ts uzn\u0327e\u0304mums.\n<\/ol>\n<p><!--more--><br \/>\nStr\u012bd\u012bg\u0101s normas pirms likumprojekta izskat\u012b\u0161anas Saeim\u0101 3. (gal\u012bgaj\u0101) las\u012bjum\u0101 ierosin\u0101ja Nacion\u0101l\u0101 apvien\u012bba \u201cVisu Latvijai!\u201d-\u201cT\u0113vzemei un Br\u012bv\u012bbai\/LNNK\u201d<sup><a href=\"#fn1\" id=\"ref1\">i<\/a><\/sup>, priek\u0161likumu motiv\u0113jot ar v\u0113r\u0161anos pret izvair\u012b\u0161anos no nodok\u013cu maks\u0101\u0161anas un \u0161\u0137ietamo priek\u0161roc\u012bbu likvid\u0113\u0161anu zemo nodok\u013cu vai beznodok\u013cu valst\u012bs vai teritorij\u0101s re\u0123istr\u0113t\u0101m person\u0101m: \u201c<i>[..]ja zemu nodok\u013cu vai beznodok\u013cu valstu un teritoriju personas veic saimniecisko darb\u012bbu, izmantojot past\u0101v\u012bgo p\u0101rst\u0101vniec\u012bbu Latvij\u0101, past\u0101v gr\u016bt\u012bbas iekas\u0113t nodok\u013cus par Latvij\u0101 g\u016btajiem ien\u0101kumiem, jo bie\u017ei vien ar zemu nodok\u013cu vai beznodok\u013cu valst\u012bm un teritorij\u0101m nepast\u0101v inform\u0101cijas apmai\u0146a un nav administrat\u012bv\u0101s sadarb\u012bbas meh\u0101nisma, k\u0101 ar\u012b uz\u0146\u0113mumu faktiskie \u012bpa\u0161nieki, likumiskie p\u0101rst\u0101vji vai paties\u0101 labuma guv\u0113ji bie\u017ei nav zin\u0101mi. \u0160\u0101dos gad\u012bjumos past\u0101v iesp\u0113ja izvair\u012bties no nodok\u013cu nomaksas un \u0161\u012bs personas, sal\u012bdzinot ar Latvijas un citu valstu, ar kur\u0101m Latvijai ir nosl\u0113gtas nodok\u013cu konvencijas un nodro\u0161in\u0101ta savstarp\u0113j\u0101 administrat\u012bv\u0101 pal\u012bdz\u012bba, rezidentiem, ir izdev\u012bg\u0101k\u0101 st\u0101vokl\u012b.<\/i>\u201c<\/p>\n<p>Atbild\u012bg\u0101 komisija \u2013 Saeimas Tautsaimniec\u012bbas, agr\u0101r\u0101s, vides un re\u0123ion\u0101l\u0101s politikas komisija \u2013 str\u012bd\u012bg\u0101s normas neatbalst\u012bja<sup><a href=\"#fn2\" id=\"ref2\">ii<\/a><\/sup>. Ta\u010du Saeimas plen\u0101rs\u0113d\u0113 par str\u012bd\u012bgaj\u0101m norm\u0101m notika atsevi\u0161\u0137i balsojumi, kuros tie tika pie\u0146emti, k\u0101 ar\u012b ar 46 bals\u012bm \u201cpar\u201d, 6 bals\u012bm \u201catturas\u201d un 1 balsi \u201cpret\u201d tika pie\u0146emts viss likumprojekts kopum\u0101. <\/p>\n<p>Valsts prezidents likumprojektu neizsludin\u0101ja. T\u0101 viet\u0101 Valsts prezidents 2018. gada 9. febru\u0101r\u012b piepras\u012bja Saeimu likumprojektu otrreiz caurl\u016bkot<sup><a href=\"#fn3\" id=\"ref3\">iii<\/a><\/sup>. \u0160\u012b raksta tap\u0161anas br\u012bd\u012b Saeimas likumprojektu re\u0123istr\u0101 atrodama inform\u0101cija, ka priek\u0161likumus likumprojektam var iesniegt l\u012bdz 2018. gada 30. martam, bet Saeimas plen\u0101rs\u0113d\u0113 likumprojektu pl\u0101nots izskat\u012bt 2018. gada 19. apr\u012bl\u012b.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Valsts prezidenta paustie iebildumi pret str\u012bd\u012bgaj\u0101m norm\u0101m<\/span><\/strong><\/p>\n<p>Nos\u016btot likumprojektu atpaka\u013c Saeimai, Valsts prezidents vienlaic\u012bgi pauda konkr\u0113tus iebildumus, kam Saeimai b\u016btu j\u0101piev\u0113r\u0161 uzman\u012bba. \u0160os iebildumus var iedal\u012bt div\u0101s da\u013c\u0101s.<\/p>\n<p>Pirmk\u0101rt, Valsts prezidents atk\u0101rtoti pauda iebildumus pret to, ka Saeim\u0101 likumprojektos, kas tiek virz\u012bti izskat\u012b\u0161anai 3. (gal\u012bgaj\u0101) las\u012bjum\u0101, tiek iestr\u0101d\u0101ti konceptu\u0101li jauni, b\u016btiski groz\u012bjumi, jo \u0161is likumprojekts, t\u0101pat k\u0101 vair\u0101ki citi likumprojekti, ko Valsts prezidents ir nodevis Saeimai otrreiz\u0113jai caurl\u016bko\u0161anai agr\u0101k, liecina, ka tie\u0161i uz 3. (gal\u012bgo) las\u012bjumu likumprojektos tiek iestr\u0101d\u0101ti sasteigti, nep\u0101rdom\u0101ti un l\u012bdz galam neizstr\u0101d\u0101ti priek\u0161likumi. <\/p>\n<p>Otrk\u0101rt, Valsts prezidents min\u0113ja konkr\u0113tus aspektus, kam Saeimai j\u0101piev\u0113r\u0161 uzman\u012bba, veicot likumprojekta otrreiz\u0113jo caurl\u016bko\u0161anu:<\/p>\n<ol>\n<li> Pausts uzskats, ka PIL p\u0101r\u0146emt\u0101s Direkt\u012bvas 2014\/24\/ES 57. pant\u0101 ir ietverts izsme\u013co\u0161s kandid\u0101tu un pretendentu izsl\u0113g\u0161anas gad\u012bjumu uzskait\u012bjums, kam likumdev\u0113js nevar patva\u013c\u012bgi pievienot papildus gad\u012bjumus. \u0160aj\u0101 uzskait\u012bjum\u0101 nav min\u0113ti str\u012bd\u012bgaj\u0101s norm\u0101s ietvertie apst\u0101k\u013ci.\n<li> Atbilsto\u0161i L\u012bgumam par Eiropas savien\u012bbas (ES) darb\u012bbu, diskrimin\u0101cija p\u0113c pieg\u0101d\u0101t\u0101ja re\u0123istr\u0101cijas vietas nav pie\u013caujama.\n<li> Ministru kabineta noteikto zemu nodok\u013cu un beznodok\u013cu valstu un teritoriju sarakst\u0101 ietilpst ar\u012b t\u0101das, kas ietilpst ES, k\u0101 ar\u012b t\u0101das, kas ir Pasaules Tirdzniec\u012bbas organiz\u0101cijas Nol\u012bguma par valsts iepirkumu dal\u012bbnieces, kam nevar izvirz\u012bt stingr\u0101kas pras\u012bbas k\u0101 citiem tirgus dal\u012bbniekiem.\n<li> J\u0101p\u0101rliecin\u0101s, vai str\u012bd\u012bg\u0101s ties\u012bbu normas var efekt\u012bvi piem\u0113rot.\n<li> Str\u012bd\u012bg\u0101s ties\u012bbu normas rada nevienl\u012bdz\u012bgu attieksmi pret Latvij\u0101 un \u0101rvalst\u012bs re\u0123istr\u0113tiem kandid\u0101tiem un pretendentiem.\n<li> J\u0101nodro\u0161ina atbilst\u012bba juridisk\u0101s tehnikas pras\u012bb\u0101m.\n<\/ol>\n<p>Kaut ar\u012b katrs no min\u0113tajiem iebildumiem ir izv\u0113rsta koment\u0101ra v\u0113rts, \u0161aj\u0101 koment\u0101r\u0101 pamat\u0101 piev\u0113rs\u012b\u0161os jaut\u0101jumam par groz\u012bjumu atbilst\u012bbu L\u012bguma par ES darb\u012bbu, Direkt\u012bvai 2014\/24\/ES<sup><a href=\"#fn4\" id=\"ref4\">iv<\/a><\/sup> un Pasaules Tirdzniec\u012bbas organiz\u0101cijas Nol\u012bgumam par valsts iepirkumu.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Eiropas Savien\u012bbas direkt\u012bv\u0101s ietverto izsl\u0113g\u0161anas noteikumu (ne)izsme\u013co\u0161ais raksturs<\/span><\/strong><\/p>\n<p>Eiropas Savien\u012bbas tiesa vair\u0101kk\u0101rt ir v\u0113rt\u0113jusi dal\u012bbvalstu likumos noteiktos kandid\u0101tu un pretendentu izsl\u0113g\u0161anas noteikumus, kas ir at\u0161\u0137\u012bru\u0161ies no ES direkt\u012bv\u0101s noteiktajiem. Eiropas Savien\u012bbas tiesas viedoklis ir, ka to izsl\u0113g\u0161anas krit\u0113riju uzskait\u012bjums, kuru d\u0113\u013c kandid\u0101tu vai pretendentu var izsl\u0113gt no piedal\u012b\u0161an\u0101s iepirkuma proced\u016br\u0101, kas attiecas uz kandid\u0101ta vai pretendenta profesion\u0101lo kvalit\u0101ti, ir izsme\u013co\u0161s un dal\u012bbvalst\u012bm nav ties\u012bbas noteikt papildus izsl\u0113g\u0161anas krit\u0113rijus (apvienot\u0101s lietas C-226\/04 un C-228\/04 <i>La Cascina and Others<\/i> [2006] ECR I-1347, 22. rindkopa, lieta C\u2011213\/07 <i>Michaniki<\/i> [2008] ECR I-09999, 43. rindkopa un lieta C-74\/09 <i>B\u00e2timents et Ponts Construction and WISG Produktionsservice<\/i> [2010] ECR I-7271, 43. rindkopa).<\/p>\n<p>Apl\u016bkojot direkt\u012bvas 93\/37\/EEK 24. panta pirmo da\u013cu un direkt\u012bvas 2004\/18\/EK 45. panta otro da\u013cu, par ko Eiropas Savien\u012bbas tiesas spriedumi ir tais\u012bti, j\u0101secina, ka ar izsl\u0113g\u0161anas krit\u0113rijiem, kas attiecas uz profesion\u0101lo kvalit\u0101ti, kuru uzskait\u012bjums ir izsme\u013co\u0161s, ES tiesa saprot: (1) bankrots, likvid\u0101cija, komercdarb\u012bbas izbeig\u0161ana, (2) noris bankrota vai likvid\u0101cijas process, (3) ar sp\u0113k\u0101 st\u0101ju\u0161os nol\u0113mumu ir konstat\u0113ts profesion\u0101l\u0101s \u0113tikas p\u0101rk\u0101pums, (4) jebk\u0101d\u0101 veid\u0101 pier\u0101d\u012bts, ka ir izdar\u012bts smags profesion\u0101l\u0101s \u0113tikas p\u0101rk\u0101pums, (5) nav izpild\u012btas soci\u0101lo iemaksu saist\u012bbas, (6) nav izpild\u012btas nodok\u013cu nomaksu saist\u012bbas, (6) vaina nopietn\u0101 t\u0101das inform\u0101cijas sagroz\u012b\u0161an\u0101 vai nesnieg\u0161an\u0101, kas pras\u012bta iepirkum\u0101.<\/p>\n<p>Vienlaic\u012bgi ES tiesa ir atzinusi, ka p\u0101r\u0113jos gad\u012bjumos, kas nav saist\u012bti ar kandid\u0101ta vai pretendenta profesion\u0101lo kvalit\u0101ti, dal\u012bbvalstis ir ties\u012bgas pie\u0146emt materi\u0101lo ties\u012bbu normas, kuru m\u0113r\u0137is ir it \u012bpa\u0161i nodro\u0161in\u0101t, ka publisko iepirkumu jom\u0101 tiek iev\u0113rots vienl\u012bdz\u012bgas attieksmes princips attiec\u012bb\u0101 pret visiem pretendentiem un p\u0101rskat\u0101m\u012bbas princips, kas ir ES direkt\u012bvu par PIL sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas proced\u016br\u0101m pamat\u0101, tom\u0113r iev\u0113rojot nosac\u012bjumu, ka tiek iev\u0113rots sam\u0113r\u012bguma princips (apvienot\u0101s lietas C\u201121\/03 un C\u201134\/03 <i>Fabricom<\/i> [2005] ECR I-01559, 25.-36. rindkopa, lieta C\u2011213\/07 <i>Michaniki<\/i> [2008] ECR I-09999, 44.-69. rindkopa, lieta C-538\/07 <i>Assitur<\/i> [2009] ECR I-4219, 21.-33. rindkopa). T\u0101d\u0113j\u0101di j\u0101secina, ka dal\u012bbvalst\u012bm ir ierobe\u017eotas ties\u012bbas noteikt papildus izsl\u0113g\u0161anas krit\u0113rijus tiem, kas noteikti Direkt\u012bvas 2014\/24\/ES 57. pant\u0101.<\/p>\n<p>No iepriek\u0161 min\u0113t\u0101s ES tiesas judikat\u016bras ar\u012b var secin\u0101t, ka ES tiesas v\u0113rt\u0113jum\u0101 tiesiskais regul\u0113jums, kas ir balst\u012bts uz neapstr\u012bdamu prezumpciju, p\u0101rk\u0101pj sam\u0113r\u012bguma principu, jo tas nedod kandid\u0101tiem un pretendentiem iesp\u0113ju pier\u0101d\u012bt, ka vi\u0146u gad\u012bjum\u0101 nepast\u0101v patiess risks, ka var tikt apdraud\u0113ta p\u0101rskat\u0101m\u012bba un trauc\u0113ta konkurence kandid\u0101tu un pretendentu vid\u016b. L\u012bdz ar to visos \u0161\u012b raksta autoram zin\u0101majos gad\u012bjumos, kad ES tiesai ir bijis j\u0101v\u0113rt\u0113 k\u0101ds dal\u012bbvalsts likumos noteikts kandid\u0101tu un pretendentu izsl\u0113g\u0161anas noteikums, kas ir ticis noteikts papildus direkt\u012bv\u0101s noteiktajiem krit\u0113rijiem, un ir paredz\u0113jis k\u0101du neapstr\u012bdamu prezumpciju (respekt\u012bvi \u2013 kandid\u0101tam vai pretendentam nav dotas iesp\u0113jas apliecin\u0101t, ka izsl\u0113g\u0161anas krit\u0113rija pamat\u0101 eso\u0161ie riski konkr\u0113t\u0101 kandid\u0101ta vai pretendenta gad\u012bjum\u0101 neiest\u0101sies), ES tiesa t\u0101du tiesisko regul\u0113jumu atzinusi par neatbilsto\u0161u sam\u0113r\u012bguma principam. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Groz\u012bjumos ietverto izsl\u0113g\u0161anas noteikumu tiesiskums<\/span><\/strong><\/p>\n<p>K\u0101 tas tika nor\u0101d\u012bts groz\u012bjumu pamatojum\u0101, tie ir izstr\u0101d\u0101ti nol\u016bk\u0101 likvid\u0113t priek\u0161roc\u012bbas zemo nodok\u013cu vai beznodok\u013cu valst\u012bs vai teritorij\u0101s re\u0123istr\u0113t\u0101m person\u0101m, k\u0101das t\u0101m, iesp\u0113jams, rodas no nodok\u013cu nemaks\u0101\u0161anas. <\/p>\n<p>\u0160\u012b mot\u012bva kontekst\u0101 j\u0101atz\u012bm\u0113, ka gan Direkt\u012bvas 2014\/24\/ES 57. panta otraj\u0101 da\u013c\u0101, gan, it \u012bpa\u0161i, PIL 42. panta pirm\u0101s da\u013cas otraj\u0101 punkt\u0101 ir noteikts, ka kandid\u0101ts un pretendents ir izsl\u0113dzami no dal\u012bbas iepirkuma proced\u016br\u0101, ja ir konstat\u0113ts, ka kandid\u0101tam pieteikumu un pretendentam pied\u0101v\u0101jumu iesnieg\u0161anas termi\u0146a p\u0113d\u0113j\u0101 dien\u0101 vai dien\u0101, kad pie\u0146emts l\u0113mums par iesp\u0113jamu iepirkuma l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu, Latvij\u0101 vai valst\u012b, kur\u0101 tas re\u0123istr\u0113ts vai kur\u0101 atrodas t\u0101 past\u0101v\u012bg\u0101 dz\u012bvesvieta, ir nodok\u013cu par\u0101di, tai skait\u0101 valsts soci\u0101l\u0101s apdro\u0161in\u0101\u0161anas oblig\u0101to iemaksu par\u0101di, kas kopsumm\u0101 k\u0101d\u0101 no valst\u012bm p\u0101rsniedz 150 euro. J\u0101atz\u012bm\u0113 ar\u012b, ka nodok\u013cu un soci\u0101lo iemaksu par\u0101di ES tiesas judikat\u016br\u0101, uz ko ir izdar\u012bta atsauce iepriek\u0161, ietilpst to izsl\u0113g\u0161anas krit\u0113riju uzskait\u012bjum\u0101, kas attiecas uz kandid\u0101ta vai pretendenta profesion\u0101lo kvalit\u0101ti, kas ir izsme\u013co\u0161s un ko dal\u012bbvalst\u012bm nav ties\u012bbu papildin\u0101t. L\u012bdz ar to j\u0101secina, ka Direkt\u012bvas 2014\/24\/ES 57. pant\u0101 ietvertais izsme\u013co\u0161ais uzskait\u012bjums ne\u013cauj Latvijai ieviest v\u0113l vienu kandid\u0101tu un pretendentu izsl\u0113g\u0161anas krit\u0113riju, kas saist\u012bts ar nodok\u013cu vai soci\u0101lo iemaksu nemaks\u0101\u0161anu. Vienlaic\u012bgi j\u0101atz\u012bm\u0113, ka, form\u0101li skatoties, Direkt\u012bvas 2014\/24\/ES 57. pants ir piem\u0113rojams tikai tad, ja iepirkuma v\u0113rt\u012bba ir liel\u0101ka nek\u0101 ES noteiktie l\u012bgumcenu sliek\u0161\u0146i. L\u012bdz ar to neb\u016btu pie\u013caujami rosin\u0101tie groz\u012bjumi PIL 42. pant\u0101, ta\u010du var\u0113tu t\u0101l\u0101k diskut\u0113t par groz\u012bjumu pie\u013caujam\u012bbu PIL 9. pant\u0101, paturot pr\u0101t\u0101, ka ar\u012b uz t.s. \u201cmazajiem iepirkumiem\u201d, kas tagad ir regul\u0113ti PIL 9. pant\u0101, attiecas L\u012bguma par Eiropas Savien\u012bbas darb\u012bbu principi<sup><a href=\"#fn5\" id=\"ref5\">v<\/a><\/sup>.<\/p>\n<p>Otrk\u0101rt, j\u0101\u0146em v\u0113r\u0101, ka kop\u0161 2004. gada 1. maija Latvijai ir saisto\u0161s Pasaules Tirdzniec\u012bbas organiz\u0101cijas Nol\u012bgums par valsts iepirkumu (1994. gada redakcij\u0101), bet kop\u0161 2014. gada 6. apr\u012b\u013ca ES, attiec\u012bb\u0101 uz t\u0101s dal\u012bbvalst\u012bm, tai skait\u0101 Latviju, ir Pasaules Tirdzniec\u012bbas organiz\u0101cijas Nol\u012bguma par valsts iepirkumu (p\u0101rstr\u0101d\u0101taj\u0101 redakcij\u0101) dal\u012bbniece.
