T\u0101 ir v\u0113rsta uz to, lai pied\u0101v\u0101jums atbilstu pas\u016bt\u012bt\u0101ja iecer\u0113m un tas sa\u0146emtu iepirkuma priek\u0161metam atbilsto\u0161u un kvalitat\u012bvu izpild\u012bjumu.<br \/>\n<i>AT ALD 2016. gada 17. maija r\u012bc\u012bbas s\u0113des l\u0113mums liet\u0101 Nr. SKA-108\/2016<\/i><\/p>\n<p>Pretendentiem izvirz\u012bto kvalifik\u0101cijas pras\u012bbu noteik\u0161ana ir tie\u0161i pas\u016bt\u012bt\u0101ja r\u012bc\u012bbas br\u012bv\u012bba. SKA-108\/2016<\/i><\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Iepirkumu uzraudz\u012bbas biroja p\u0101rbaudes robe\u017eas<\/span><\/strong><\/p>\n<p>Publisko iepirkumu likuma 81. panta 7.\u00a0punkt\u0101 noteikts, ka Iepirkumu uzraudz\u012bbas birojs izskata iesniegumus par iepirkuma proced\u016bras p\u0101rk\u0101pumiem. Atbilsto\u0161i Publisko iepirkumu likuma 83.\u00a0panta ceturt\u0101s da\u013cas 3.\u00a0punktam iesniegum\u0101 Iepirkumu uzraudz\u012bbas birojam par pas\u016bt\u012bt\u0101ja vai iepirkumu komisijas darb\u012bbu ietverami fakti, par kuriem iesniegts iesniegums, nor\u0101dot p\u0101rk\u0101pumu. Min\u0113t\u0101 likuma 84.\u00a0panta sest\u0101 da\u013ca noteic, ka komisija izv\u0113rt\u0113 iesniegumu, pamatojoties uz t\u0101 iesniedz\u0113ja un [iesnieguma izskat\u012b\u0161anas s\u0113des] dal\u012bbnieku min\u0113tajiem faktiem, pas\u016bt\u012bt\u0101ja paskaidrojumiem un eksperta viedokli vai atzinumu. Savuk\u0101rt liet\u0101 piem\u0113rotais likuma 83.<sup>1<\/sup>\u00a0panta pirm\u0101s da\u013cas 3.\u00a0punkts paredz biroja ties\u012bbas atst\u0101t iesniegumu bez izskat\u012b\u0161anas, ja iesniegum\u0101 ietvert\u0101s zi\u0146as ir ac\u012bmredzami nepietiekamas iesniedz\u0113ja pras\u012bbas apmierin\u0101\u0161anai vai iesniegums ir ac\u012bmredzami noraid\u0101ms p\u0113c b\u016bt\u012bbas. Papildus tam min\u0113t\u0101s da\u013cas 2.\u00a0punkts paredz biroja ties\u012bbas atst\u0101t iesniegumu bez izskat\u012b\u0161anas, ja jau iepriek\u0161 ticis iesniegts un izskat\u012bts iesniegums attiec\u012bb\u0101 uz iepirkuma proced\u016bru par to pa\u0161u priek\u0161metu un uz t\u0101 pa\u0161a pamata. No min\u0113taj\u0101m norm\u0101m izriet skaidra sist\u0113ma, ka Iepirkumu uzraudz\u012bbas birojs, izskatot iesniegumu (vai atst\u0101jot to bez izskat\u012b\u0161anas), ir saist\u012bts ar iesniegum\u0101 nor\u0101d\u012bto p\u0101rk\u0101puma pamatu, t.\u00a0i., faktiem par noteikt\u0101 veid\u0101 izpaudu\u0161os p\u0101rk\u0101pumu.<br \/>\n<i>AT ALD 2016. gada 22. febru\u0101ra spriedums liet\u0101 Nr. SKA-292\/2016<\/i><\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Nosl\u0113gt\u0101 l\u012bguma atz\u012b\u0161ana par sp\u0113k\u0101 neeso\u0161u vai termi\u0146a sa\u012bsin\u0101\u0161ana<\/span><\/strong><\/p>\n<p>Likumdev\u0113js, iek\u013caujot Publisko iepirkumu likum\u0101 XII1\u00a0noda\u013cu, izv\u0113l\u0113j\u0101s nodot administrat\u012bvajai tiesai ties\u012bbas lemt par priv\u0101ttiesisku iepirkuma l\u012bgumu tikai konkr\u0113tos Publisko iepirkumu likuma 85.<sup>2<\/sup>\u00a0panta pirmaj\u0101 da\u013c\u0101 uzskait\u012btos gad\u012bjumos. Neviens no \u0161aj\u0101 pant\u0101 uzskait\u012btajiem gad\u012bjumiem neattiecas uz tiem iepirkumiem, kas veicami Publisko iepirkumu likuma 8.<sup>2<\/sup>\u00a0pant\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101 (proti, uz &#8220;mazajiem&#8221; iepirkumiem, kuriem nepiem\u0113ro likum\u0101 regul\u0113t\u0101s iepirkuma proced\u016bras). SKA-882\/2016<\/i><\/p>\n<p>Eiropas Savien\u012bbas likumdev\u0113js ir devis nor\u0101des dal\u012bbvalstu likumdev\u0113jam pan\u0101kt to, ka iepirkumu l\u012bgumi netiek nosl\u0113gti, kam\u0113r nav beidzies nogaid\u012b\u0161anas termi\u0146\u0161. Sankcij\u0101m j\u0101b\u016bt pat tad, ja iepirkuma proced\u016br\u0101 ir pie\u013cauti tikai form\u0101li p\u0101rk\u0101pumi, kas nav ietekm\u0113ju\u0161i iepirkumu p\u0113c b\u016bt\u012bbas.
