Tie paredz, ka, nos\u016btot pazi\u0146ojumu pieg\u0101d\u0101t\u0101jam, pas\u016bt\u012bt\u0101jam ir ties\u012bbas atk\u0101pties no iepirkuma l\u012bguma vienpus\u0113j\u0101 k\u0101rt\u0101, ja: (1) taj\u0101 veikti b\u016btiski groz\u012bjumi, kas nav pie\u013caujami atbilsto\u0161i PIL; (2) iepirkuma l\u012bgums nav nosl\u0113gts atbilsto\u0161i iepirkuma dokument\u0101cij\u0101 paredz\u0113tajiem noteikumiem, vai ir b\u016btiski main\u012bti iepirkuma l\u012bguma projekta noteikumi; (3) pieg\u0101d\u0101t\u0101js bija izsl\u0113dzams no iepirkuma proced\u016bras, jo iepirkuma l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas br\u012bd\u012b uz to bija attiecin\u0101mi PIL 42. panta pirmaj\u0101 da\u013c\u0101 noteiktie krit\u0113riji; (4) atbilsto\u0161i Eiropas Savien\u012bbas Tiesas (turpm\u0101k \u2013 EST) atzinumam, pieg\u0101d\u0101t\u0101jam nevajadz\u0113ja tikt pie\u0161\u0137irt\u0101m iepirkuma l\u012bguma sl\u0113g\u0161anas ties\u012bb\u0101m likum\u0101 noteikto pien\u0101kumu p\u0101rk\u0101puma d\u0113\u013c. Tom\u0113r ir iesp\u0113jams atz\u012bt to, ka patlaban ir sare\u017e\u0123\u012bti pilnv\u0113rt\u012bgi nov\u0113rt\u0113t \u0161o normu pielieto\u0161anu un ar to saist\u012bto problem\u0101tiku, \u0146emot v\u0113r\u0101, ka v\u0113l nav izveidojusies tiesu prakse.<\/p>\n<p>Ir iesp\u0113jams konstat\u0113t, ka ar iepirkumu l\u012bgumu izbeig\u0161anu saist\u012btais normat\u012bvais regul\u0113jums tika pie\u0146emts relat\u012bvi nesen ne tikai nacion\u0101lo ties\u012bbu aktu, bet ar\u012b Eiropas Savien\u012bbas ties\u012bbu aktu gad\u012bjum\u0101 \u2013 l\u012bdz ar publisko iepirkumu direkt\u012bvu<sup><a href=\"#fn2\" id=\"ref2\">2, 3<\/a><\/sup> sp\u0113k\u0101 st\u0101\u0161anos 2014. gad\u0101. Vadl\u012bnijas attiec\u012bb\u0101 uz iepirkumu l\u012bgumu termi\u0146iem EST noteica spriedum\u0101 Komisija pret V\u0101ciju [C-503\/04, 2007]<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>, nosakot liegumu sl\u0113gt iepirkumu l\u012bgumus uz nesam\u0113r\u012bgi ilgu laiku, jo t\u0101d\u0113j\u0101di citiem pieg\u0101d\u0101t\u0101jiem tiek liegta iesp\u0113ja veikt pieg\u0101des par iesp\u0113jami zem\u0101ku l\u012bgumcenu. Nosakot ierobe\u017eojumu \u0161\u0101diem l\u012bgumiem, EST nodro\u0161in\u0101ja pamatu tos izbeigt. Tom\u0113r j\u0101atz\u012bst, ka kopum\u0101 uz \u0161o br\u012bdi ar\u012b Eiropas Savien\u012bbas judikat\u016br\u0101 tr\u016bkst tiesu prakses attiec\u012bb\u0101 uz iepirkumu l\u012bgumu pirmstermi\u0146a izbeig\u0161anu. Neskatoties uz to, starptautisko un Eiropas ties\u012bbu zin\u0101tnieki ir v\u0113rsu\u0161i uzman\u012bbu uz potenci\u0101lo problem\u0101tiku, kas saist\u0101s ar ES normat\u012bvo regul\u0113jumu. Autora skat\u012bjum\u0101 t\u0101 vismaz da\u013c\u0113ji var\u0113tu b\u016bt attiecin\u0101ma ar\u012b uz Latvijas likumdo\u0161anu. <\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Ar normat\u012bvo regul\u0113jumu saist\u012bt\u0101 iesp\u0113jam\u0101 problem\u0101tika<\/span><\/strong><\/p>\n<p>Direkt\u012bvas 2014\/24\/ES 73. pant\u0101 noteikts, ka dal\u012bbvalst\u012bm j\u0101nodro\u0161ina iesp\u0113ja l\u012bgumsl\u0113dz\u0113j\u0101m iest\u0101d\u0113m (pas\u016bt\u012bt\u0101jam) izbeigt iepirkuma l\u012bgumu t\u0101 sp\u0113k\u0101 esam\u012bbas laik\u0101. Vienlaic\u012bgi, k\u0101 tas augst\u0101k min\u0113ts, PIL 64. pant\u0101 ir noteiktas pas\u016bt\u012bt\u0101ja ties\u012bbas izbeigt l\u012bgumu pirms t\u0101 termi\u0146a, iest\u0101joties noteiktiem gad\u012bjumiem. Tom\u0113r past\u0101v neskaidr\u012bba un nenoteikt\u012bba attiec\u012bb\u0101 uz to, vai \u0161\u0101das ties\u012bbas tiks izmantotas iepirkuma l\u012bguma izpildes laik\u0101, iest\u0101joties k\u0101dam no likum\u0101 min\u0113tajiem gad\u012bjumiem. Proti, nav konsekvences attiec\u012bb\u0101 uz to, vai pas\u016bt\u012bt\u0101ja l\u0113mums izmantot likum\u0101 noteikt\u0101s ties\u012bbas tiks pie\u0146emts tikai pamatojoties uz attiec\u012bgo gad\u012bjumu iest\u0101\u0161anos, vai \u0161\u0101da l\u0113muma pamat\u0101 ir pie\u013caujami citi \u2013 skaidri nedefin\u0113ti un, iesp\u0113jams, uz nevienl\u012bdz\u012bbas pamata balst\u012bti krit\u0113riji. Savuk\u0101rt skatot min\u0113to kopsakar\u0101 ar Direkt\u012bvas 2014\/24\/ES 112. apsv\u0113rum\u0101 noteikto, kur\u0101 ir atsauce uz nepiecie\u0161am\u012bbu p\u0101rtraukt iepirkumu l\u012bgumu izpildi, iesp\u0113ja iepirkuma l\u012bgumu p\u0101rtraukt pirms termi\u0146a b\u016btu j\u0101uztver nevis k\u0101 ties\u012bbas, bet gan dr\u012bz\u0101k k\u0101 pien\u0101kums, lai vecin\u0101tu \u0161\u0101du ties\u012bbu izmanto\u0161anas konsekvenci. T\u0101d\u0113j\u0101di, piem\u0113ram, konstat\u0113jot to, ka iepirkuma l\u012bgums ir nosl\u0113gts pret\u0113ji iepirkuma dokument\u0101cijas noteikumiem, vai veicot taj\u0101 b\u016btiskus groz\u012bjumus, pus\u0113m b\u016btu iesp\u0113jams pa\u013cauties uz ties\u012bbu izmanto\u0161anas pien\u0101kumu un ar \u0161\u0101du l\u012bgumu piel\u012bgto saist\u012bbu izpildi.<\/p>\n<p>L\u012bdz\u012bgi publisko iepirkumu direkt\u012bvu noteikumiem, ar\u012b PIL 64. panta pirm\u0101s da\u013cas 3. punkt\u0101 ir paredz\u0113tas pas\u016bt\u012bt\u0101ja ties\u012bbas atk\u0101pties no iepirkuma l\u012bguma, ja  sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas br\u012bd\u012b uz pieg\u0101d\u0101t\u0101ju bija attiecin\u0101mi likum\u0101 noteiktie pretendentu izsl\u0113g\u0161anas noteikumi, piem\u0113ram, pieg\u0101d\u0101t\u0101jam ir nodok\u013cu par\u0101di vai ir pasludin\u0101ta pieg\u0101d\u0101t\u0101ja maks\u0101tnesp\u0113ja u.c. Tom\u0113r atsaucoties uz starptautisko un Eiropas ties\u012bbu zin\u0101tnieku min\u0113to, izsl\u0113g\u0161anas krit\u0113riju attiecin\u0101\u0161ana uz pieg\u0101d\u0101t\u0101ju sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas br\u012bd\u012b var neb\u016bt saisto\u0161a br\u012bd\u012b jeb laika posm\u0101, kad k\u0101ds no \u0161iem krit\u0113rijiem ir attiecin\u0101ms uz pieg\u0101d\u0101t\u0101ju l\u012bguma izpildes laik\u0101<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup>. \u012apa\u0161i b\u016btiski tas ir pieg\u0101d\u0101t\u0101ja maks\u0101tnesp\u0113jas kontekst\u0101.
