Ta\u010du l\u016bdzu las\u012bt\u0101jus \u0146emt v\u0113r\u0101, ka t\u0101l\u0101k paust\u0101s atzi\u0146as ir mani person\u012bgie secin\u0101jumi, nevis pilnv\u0113rt\u012bgs juridisks padoms.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Zem\u0101k\u0101 cena k\u0101 pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113rijs<\/span><\/strong><\/p>\n<p>Latvijas jaunajos Publisko iepirkumu likum\u0101 un Sabiedrisko pakalpojumu sniedz\u0113ju iepirkumu likum\u0101 cenu k\u0101 vien\u012bgo pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113riju at\u013cauts izmantot tikai atsevi\u0161\u0137os noteiktos gad\u012bjumos: 1) t.s. \u201cmazajos iepirkumos\u201d, 2) ja tiek veikts soci\u0101lo un citu \u012bpa\u0161o pakalpojumu iepirkums, kas noteikti likumu 2.pielikumos vai 3) ja sagatavot\u0101 tehnisk\u0101 specifik\u0101cija ir detaliz\u0113ta un citiem krit\u0113rijiem nav b\u016btiskas noz\u012bmes pied\u0101v\u0101juma izv\u0113l\u0113.<br \/>\n<!--more--><br \/>\nLietuv\u0101 cenas k\u0101 vien\u012bg\u0101 pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113rija izmanto\u0161ana nav tik ierobe\u017eota. Cena k\u0101 vien\u012bgais izv\u0113rt\u0113\u0161anas krit\u0113rijs var tikt izmantota liel\u0101kaj\u0101 da\u013c\u0101 iepirkumu. Ta\u010du Lietuv\u0101 ir cits ierobe\u017eojums, proti, ir noteikts, ka iepirkumu, kuros cenu izmanto k\u0101 vien\u012bgo izv\u0113rt\u0113\u0161anas krit\u0113riju, kop\u0113jais \u012bpatsvars nedr\u012bkst p\u0101rsniegt 70% no konkr\u0113t\u0101 pas\u016bt\u012bt\u0101ja visu iepirkumu v\u0113rt\u012bbas gada laik\u0101.<\/p>\n<p>Igaunij\u0101 zem\u0101k\u0101s cenas k\u0101 vien\u012bg\u0101 pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113rija izmanto\u0161anai nav likum\u0101 noteiktu ierobe\u017eojumu.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Nepamatoti l\u0113ta pied\u0101v\u0101juma v\u0113rt\u0113\u0161ana<\/span><\/strong><\/p>\n<p>Latvij\u0101 vairs nav noteikts neviens gad\u012bjums, kad oblig\u0101ti j\u0101v\u0113rt\u0113 nepamatoti l\u0113ta pied\u0101v\u0101juma esam\u012bba, proti &#8211; jaunajos likumos vairs nav pras\u012bbas oblig\u0101ti v\u0113rt\u0113t nepamatoti l\u0113ta pied\u0101v\u0101juma esam\u012bbu tad, ja kandid\u0101ta vai pretendenta, vai to apak\u0161uz\u0146\u0113m\u0113ju, darbinieku stundas tarifa likme nesasniedz vid\u0113jo stundas tarifa likmi konkr\u0113taj\u0101 profesiju grup\u0101 valst\u012b.<\/p>\n<p>Interesanti, ka Igaunija, savuk\u0101rt, \u0161\u0101du oblig\u0101tu nepamatoti l\u0113ta pied\u0101v\u0101juma v\u0113rt\u0113\u0161anas gad\u012bjumu sav\u0101 jaunaj\u0101 likum\u0101 ir noteikusi. Iepriek\u0161 Igaunij\u0101 \u0161\u0101da pras\u012bba nepast\u0101v\u0113ja.<\/p>\n<p>Lietuv\u0101, savuk\u0101rt, ir noteikts, ka nepamatoti l\u0113ta pied\u0101v\u0101juma esam\u012bba j\u0101v\u0113rt\u0113, piem\u0113ram, ja pied\u0101v\u0101juma cena ir vair\u0101k k\u0101 par 30% l\u0113t\u0101ka par to pied\u0101v\u0101jumu vid\u0113jo cenu, kas nav izsl\u0113gti no t\u0101l\u0101k\u0101s v\u0113rt\u0113\u0161anas un kas nep\u0101rsniedz pl\u0101noto l\u012bgumcenu.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Oblig\u0101t\u0101s un izv\u0113les izsl\u0113g\u0161anas pras\u012bbas<\/span><\/strong><\/p>\n<p>Izmantojot 2014.gad\u0101 pie\u0146emto Eiropas Savien\u012bbas direkt\u012bvu iepirkumu jom\u0101 dot\u0101s iesp\u0113jas, gan Latvija, gan Lietuva un Igaunija savos jaunajos likumos ir ieviesu\u0161as gan oblig\u0101tos kandid\u0101tu un pretendentu izsl\u0113g\u0161anas gad\u012bjumus, gan ar\u012b t.s. izv\u0113les izsl\u0113g\u0161anas gad\u012bjumus, proti \u2013 ko pas\u016bt\u012bt\u0101js vai sabiedrisko pakalpojumu sniedz\u0113js pats var izv\u0113l\u0113ties piem\u0113rot, vai nepiem\u0113rot. Ta\u010du starp valst\u012bm past\u0101v at\u0161\u0137ir\u012bbas.<\/p>\n<p>Latvija savos jaunajos likumos pas\u016bt\u012bt\u0101jiem un sabiedrisko pakalpojumu sniedz\u0113jiem ir devusi tr\u012bs izv\u0113les iesp\u0113jas, kad kandid\u0101ti vai pretendenti var\u0113tu tikt izsl\u0113gti no dal\u012bbas iepirkum\u0101: 1) ja kandid\u0101ts vai pretendents, vai noteiktas ar vi\u0146u saist\u012btas personas nav pild\u012bju\u0161as k\u0101du iepirkumu l\u012bgumu ar \u0161o konkr\u0113to pas\u016bt\u012bt\u0101ju, 2) ja l\u012bgums nav pild\u012bts ar k\u0101du citu pas\u016bt\u012bt\u0101ju vai publisko partneri un to ir atzinusi tiesa un 3) ja ir biju\u0161i smagi profesion\u0101l\u0101s darb\u012bbas p\u0101rk\u0101pumi.<\/p>\n<p>Lietuv\u0101, savuk\u0101rt, pie izv\u0113les izsl\u0113g\u0161anas gad\u012bjumiem ir ierindoti ar\u012b vides ties\u012bbu p\u0101rk\u0101pumi, soci\u0101lo vai darba ties\u012bbu p\u0101rk\u0101pumi, maks\u0101tnesp\u0113ja. Latvij\u0101, k\u0101 zin\u0101m, noteikti darba ties\u012bbu p\u0101rk\u0101pumi un maks\u0101tnesp\u0113ja ir pie oblig\u0101tajiem izsl\u0113g\u0161anas gad\u012bjumiem. Papildus tam, pret\u0113ji Latvijai, l\u012bgumu iepriek\u0161\u0113ja neizpilde Lietuv\u0101 ir noteikta k\u0101 oblig\u0101ts izsl\u0113g\u0161anas gad\u012bjums.
