SKA-1367\/2016 <\/i><\/p>\n<p>Pagaidu aizsardz\u012bbas vajadz\u012bbai ir j\u0101b\u016bt v\u0113rstai uz pa\u0161u pieteic\u0113ju un t\u0101s subjekt\u012bvo ties\u012bbu aizsardz\u012bbu, t\u0101d\u0113\u013c noz\u012bme ir zaud\u0113jumu ra\u0161an\u0101s riskam tie\u0161i pa\u0161ai pieteic\u0113jai. <!--more-->Otrk\u0101rt, t\u0101 k\u0101 pieteic\u0113jai pa\u0161ai ir vislab\u0101k zin\u0101ms, k\u0101di zaud\u0113jumi tai rad\u012bsies, tai ir pien\u0101kums tos pamatot un nor\u0101d\u012bt l\u016bgum\u0101 par pagaidu aizsardz\u012bbu. Apl\u016bkojam\u0101 situ\u0101cij\u0101 pieteic\u0113ja visp\u0101r\u012bgi nor\u0101da, ka sarunu proced\u016bras turpin\u0101\u0161ana var\u0113tu rad\u012bt b\u016btiskus zaud\u0113jumus pieteic\u0113jai. Pieteic\u0113ja nekonkretiz\u0113, k\u0101di zaud\u0113jumi, k\u0101d\u0101 apm\u0113r\u0101 un k\u0101d\u0113\u013c t\u0101s gad\u012bjum\u0101 tie b\u016btu uzskat\u0101mi par b\u016btiskiem. SKA-1335\/2016 <\/i><\/p>\n<p>Jaut\u0101jums par pagaidu aizsardz\u012bbas l\u016bguma virz\u012bbu (atteik\u0161anos to pie\u0146emt) pamatoti izlemts vienpersoniski. Nav str\u012bda, ka atbilsto\u0161i Publisko iepirkumu likuma 85. pantam lieta Administrat\u012bvaj\u0101 rajona ties\u0101 izskat\u0101ma kole\u0123i\u0101li triju tiesne\u0161u sast\u0101v\u0101 un \u0161\u0101d\u0101 pa\u0161\u0101 k\u0101rt\u012bb\u0101 izskat\u0101ms ar\u012b pagaidu aizsardz\u012bbas l\u016bgums p\u0113c b\u016bt\u012bbas. Tom\u0113r min\u0113t\u0101 ties\u012bbu norma neskar ne pieteikuma, ne pagaidu aizsardz\u012bbas l\u016bguma virz\u012bbas izlem\u0161anu. \u0160\u0101di l\u0113mumi pie\u0146emami visp\u0101r\u0113j\u0101 Administrat\u012bv\u0101 procesa likum\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101, proti, vienpersoniski.<br \/>\n<i>AT ALD 2016. gada 24. oktobra l\u0113mums liet\u0101 Nr. SKA-1510\/2016 <\/i><\/p>\n<p>Ja iepirkuma proced\u016bra ir veikta un t\u0101s rezult\u0101t\u0101 ar\u012b nosl\u0113gts iepirkuma l\u012bgums, tad Iepirkumu uzraudz\u012bbas biroja l\u0113mums, ar kuru pas\u016bt\u012bt\u0101jas l\u0113mums atst\u0101ts negroz\u012bts, ir izpild\u012bts un zaud\u0113jis sp\u0113ku. Tiesa, izskatot \u0161o lietu p\u0113c b\u016bt\u012bbas, nevar\u0113s tais\u012bt spriedumu par administrat\u012bv\u0101 akta atcel\u0161anu, bet var\u0113s tikai v\u0113rt\u0113t t\u0101 tiesiskumu. Savuk\u0101rt nosl\u0113gt\u0101 l\u012bguma vai t\u0101 izpildes atcel\u0161ana nav \u0161\u012bs lietas priek\u0161mets un ir \u0101rpus pieteikt\u0101 pras\u012bjuma robe\u017e\u0101m. T\u0101p\u0113c l\u016bgtais pagaidu aizsardz\u012bbas l\u012bdzeklis (aptur\u0113t Iepirkumu uzraudz\u012bbas biroja l\u0113muma izpildi, t. i., aizliedzot pas\u016bt\u012bt\u0101jai turpin\u0101t sarunu proced\u016bru un sl\u0113gt l\u012bgumu par jaunb\u016bves b\u016bvprojekta izstr\u0101di un autoruzraudz\u012bbu) p\u0101rsniedz pras\u012bjuma robe\u017eas. \u0160\u0101ds pagaidu aizsardz\u012bbas l\u016bgums ir atz\u012bstams par nepie\u013caujamu un t\u0101 izskat\u012b\u0161ana p\u0113c b\u016bt\u012bbas ir atsak\u0101ma analo\u0123iski k\u0101 gad\u012bjumos, kuros nav pie\u013caujams pieteikums (<i>Administrat\u012bv\u0101 procesa likuma 191. panta pirm\u0101s da\u013cas 1. punkts<\/i>), bet, ja l\u016bgums ir pie\u0146emts izskat\u012b\u0161anai un v\u0113l\u0101k k\u013cuvis nepie\u013caujams, jo tiesved\u012bbas laik\u0101 nosl\u0113gts iepirkuma l\u012bgums, attiec\u012bgaj\u0101 jaut\u0101jum\u0101 ir izbeidzama tiesved\u012bba, p\u0113c analo\u0123ijas piem\u0113rojot Administrat\u012bv\u0101 procesa likuma 185.1panta sesto da\u013cu.<br \/>\n<i>AT ALD 2016. gada 15. decembra l\u0113mums liet\u0101 Nr. SKA-1609\/2016 <\/i><\/p>\n<p>Lai ar\u012b liet\u0101 p\u0101rs\u016bdz\u0113tais l\u0113mums paredz iepirkuma proced\u016bras turpin\u0101\u0161anos, pagaidu aizsardz\u012bbas piem\u0113ro\u0161anas jaut\u0101juma ietvaros ir b\u016btiski, ka pas\u016bt\u012bt\u0101js pirms pagaidu aizsardz\u012bbas l\u016bguma izskat\u012b\u0161anas jau pie\u0146\u0113mis jaunu l\u0113mumu, ar kuru noteikts iepirkuma uzvar\u0113t\u0101js. \u0160\u0101dos apst\u0101k\u013cos biroja l\u0113muma darb\u012bbas aptur\u0113\u0161ana pati par sevi nesasniegtu pagaidu aizsardz\u012bbas m\u0113r\u0137i \u2013 nodro\u0161in\u0101t, ka pirms tiesved\u012bbas nosl\u0113g\u0161an\u0101s netiktu pabeigta iepirkuma proced\u016bra, jo l\u012bguma nosl\u0113g\u0161ana pamat\u0101 izriet no v\u0113l\u0101k pie\u0146emt\u0101 pas\u016bt\u012bt\u0101ja l\u0113muma. Uz p\u0101rs\u016bdz\u0113t\u0101 l\u0113muma b\u016btisko ietekmi uz iepirkumu kopum\u0101 nor\u0101da ar\u012b apst\u0101klis, ka pieteic\u0113jas tiesisk\u0101s intereses uz taisn\u012bgu iepirkuma norisi nevar tikt nodro\u0161in\u0101tas ar atsevi\u0161\u0137u v\u0113l\u0101k pie\u0146emt\u0101 pas\u016bt\u012bt\u0101ja l\u0113muma p\u0101rs\u016bdz\u0113\u0161anu ties\u0101. Publisko iepirkumu likuma 83.<sup>1<\/sup> panta pirm\u0101s da\u013cas 2. punkts paredz Iepirkumu uzraudz\u012bbas biroja ties\u012bbas atst\u0101t bez izskat\u012b\u0161anas atk\u0101rtoti iesniegtu s\u016bdz\u012bbu uz t\u0101da pa\u0161a pamata un par to pa\u0161u priek\u0161metu (attiec\u012bgs l\u0113mums pie\u0146emts ar\u012b izskat\u0101maj\u0101 liet\u0101). Savuk\u0101rt \u0161\u0101da l\u0113muma p\u0101rs\u016bdz\u012bbas gad\u012bjum\u0101 tiesa prim\u0101ri v\u0113rt\u0113tu, vai birojam bijis pamats s\u016bdz\u012bbas atst\u0101\u0161anai bez virz\u012bbas, un apstiprino\u0161a secin\u0101juma gad\u012bjum\u0101 nepiev\u0113rstos t\u0101l\u0101kai argumentu p\u0101rbaudei p\u0113c b\u016bt\u012bbas. Proti, p\u0101rs\u016bdzot ties\u0101 gal\u012bgo pas\u016bt\u012bt\u0101ja l\u0113mumu, pieteic\u0113jas atk\u0101rtoti izteikti argumenti par \u0161\u0101 l\u0113muma prettiesiskumu saist\u012bb\u0101 ar pretendenta nepamatotu neizsl\u0113g\u0161anu no iepirkuma netiktu v\u0113rt\u0113ti p\u0113c b\u016bt\u012bbas. \u0160\u0101dos apst\u0101k\u013cos par efekt\u012bvu pagaidu aizsardz\u012bbas l\u012bdzekli liet\u0101 atz\u012bstams t\u0101ds pagaidu noregul\u0113jums, kas aptur t\u0101l\u0101ku no l\u0113muma izrieto\u0161u iepirkuma norisi un noteic konkr\u0113tus aizliegumus (l\u012bguma nosl\u0113g\u0161anu) tiesved\u012bbas laik\u0101. \u0160\u0101ds l\u012bdzeklis nep\u0101rsniedz pras\u012bjuma robe\u017eas, jo p\u0101rs\u016bdz\u0113tais l\u0113mums attiecas uz visu turpm\u0101ko iepirkuma norisi l\u012bdz t\u0101s pabeig\u0161anai ar pas\u016bt\u012bt\u0101ja l\u0113muma izpildi.<br \/>\n<i>AT ALD 2017. gada 3. febru\u0101ra l\u0113mums liet\u0101 Nr. SKA-724\/2017 <\/i><\/p>\n<p>Izskatot lietu par Iepirkumu uzraudz\u012bbas biroja l\u0113muma atz\u012b\u0161anu par prettiesisku, tiesa atbilsto\u0161i Administrat\u012bv\u0101 procesa likuma 253. panta ceturtajai da\u013cai lems vien\u012bgi par l\u0113muma tiesiskumu, bet ne par l\u0113muma atcel\u0161anu vai atz\u012b\u0161anu par sp\u0113k\u0101 neeso\u0161u. T\u0101d\u0113j\u0101di, at\u0161\u0137ir\u012bb\u0101 no administrat\u012bv\u0101 akta atcel\u0161anas vai atz\u012b\u0161anas par sp\u0113k\u0101 neeso\u0161u panta otraj\u0101 da\u013c\u0101 min\u0113tajos gad\u012bjumos, ar spriedumu netiks ietekm\u0113ta l\u0113muma es\u012bba un netiks rad\u012bts jauns tiesiskais st\u0101voklis. L\u012bdz ar to tiesai neb\u016bs pamata lemt par iepriek\u0161\u0113j\u0101 st\u0101vok\u013ca atjauno\u0161anu, jo tiesas spriedums to neietekm\u0113s.<br \/>\n<i>AT ALD 2016. gada 24. oktobra l\u0113mums liet\u0101 Nr. SKA-1510\/2016 <\/i><\/p>\n<p>Iepirkumu uzraudz\u012bbas biroja l\u0113muma izpildes kontekst\u0101 ir b\u016btiska tie\u0161i l\u012bguma nosl\u0113g\u0161ana, nevis sp\u0113k\u0101 st\u0101\u0161an\u0101s laiks vai, piem\u0113ram, l\u012bguma izpildes stadija. Ar p\u0101rs\u016bdz\u0113to Iepirkumu uzraudz\u012bbas biroja l\u0113mumu pas\u016bt\u012bt\u0101jai at\u013cauts sl\u0113gt l\u012bgumus ar izv\u0113l\u0113tajiem uzvar\u0113t\u0101jiem. L\u0113mums tiek izpild\u012bts, kad pa\u0161vald\u012bba izmanto \u0161\u012bs savas ties\u012bbas \u2013 lemj par l\u012bguma nosl\u0113g\u0161anu. L\u0113muma izpildes kontekst\u0101 nav noz\u012bmes pa\u0161a l\u012bguma nosac\u012bjumiem, bet gan faktam, ka l\u0113muma adres\u0101ts izmantojis tam atz\u012bt\u0101s ties\u012bbas sl\u0113gt l\u012bgumu.
