Sal\u012bdzinot datus, ir skaidri redzams, ka IeVP saska\u0146\u0101 ar Ministru kabineta (MK) noteikumiem iev\u0113rojusi za\u013c\u0101 iepirkuma pras\u012bbas un izv\u0113l\u0113tie pied\u0101v\u0101jumi cenas zi\u0146\u0101 ne vienm\u0113r atbilst saimnieciski izdev\u012bg\u0101k\u0101s cenas krit\u0113rijam, ta\u010du za\u013c\u0101 iepirkuma vadl\u012bnij\u0101m gan. Savuk\u0101rt BKUS bijusi taup\u012bg\u0101ka un iepirkum\u0101 pietur\u0113jusies pie saimnieciski izdev\u012bg\u0101k\u0101s cenas. Vai tie\u0161\u0101m ieslodz\u012btie peln\u012bju\u0161i biolo\u0123isk\u0101s olas un maizi, bet b\u0113rni slimn\u012bc\u0101 ne? \u00a0<!--more-->Izr\u0101d\u0101s, ka Publisk\u0101 iepirkuma likums (PIL) un MK noteikumi paredz za\u013co iepirkumu vis\u0101m valsts iest\u0101d\u0113m, s\u0101kot no konkr\u0113tas summas, kas strikti iev\u0113rots IeVP iepirkum\u0101, ta\u010du BKUS iepirkum\u0101 ne.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Likuma priek\u0161\u0101 visi vienl\u012bdz\u012bgi<\/font><\/strong><\/p>\n<p>K\u0101 skaidro Zemkop\u012bbas ministrijas Tirgus un tie\u0161\u0101 atbalsta departament\u0101, saska\u0146\u0101 ar MK 28.10.2014. noteikumiem Nr. 673 \u201cNoteikumi par vides krit\u0113riju piem\u0113ro\u0161anu un pied\u0101v\u0101juma izv\u0113les krit\u0113riju noteik\u0161anu p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumiem\u201d valsts un pa\u0161vald\u012bbu iest\u0101d\u0113m oblig\u0101ti ir j\u0101piem\u0113ro za\u013c\u0101 publisk\u0101 iepirkuma (ZPI) principi un pras\u012bbas p\u0101rtikas produktu pieg\u0101\u017eu un \u0113din\u0101\u0161anas pakalpojumu iepirkumos, ja tie p\u0101rsniedz 42 t\u016bksto\u0161us eiro. ZPI sist\u0113ma paredz to, ka iepirkum\u0101 oblig\u0101ti j\u0101izv\u0113las p\u0101rtikas produkti, kas nesatur \u0123en\u0113tiski modific\u0113tos organismus, nesast\u0101v no tiem un nav ra\u017eoti no tiem, k\u0101 ar\u012b papildus j\u0101izv\u0113las v\u0113l vismaz divas no vair\u0101k\u0101m ZPI pras\u012bb\u0101m, piem\u0113ram, izv\u0113l\u0113ties biolo\u0123iskos produktus, nacion\u0101l\u0101s p\u0101rtikas kvalit\u0101tes sh\u0113mas vai t\u0101s produktu kvalit\u0101tes r\u0101d\u012bt\u0101jiem, lauksaimniec\u012bbas produktu integr\u0113t\u0101s audz\u0113\u0161anas pras\u012bb\u0101m atbilsto\u0161us produktus u. c. MK noteikumi Nr. 673 paredz saimnieciski visizdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma izv\u0113les krit\u0113rija piem\u0113ro\u0161anu p\u0101rtikas iepirkumiem. Ta\u010du, ja tehniskaj\u0101 specifik\u0101cij\u0101 jau ir iek\u013cautas ZPI atbilsto\u0161as pras\u012bbas, tad var piem\u0113rot tikai cenas krit\u0113riju. Tikt\u0101l viss skaidrs, turkl\u0101t \u0161ie noteikumi attiecas uz vis\u0101m valsts un pa\u0161vald\u012bbu iest\u0101d\u0113m, tostarp ieslodz\u012bjuma viet\u0101m un slimn\u012bc\u0101m. Tad k\u0101p\u0113c IeVP \u0161os nosac\u012bjumus var un grib iev\u0113rot, izsludinot za\u013co iepirkumu, bet BKUS ne?<\/p>\n<p>Iepirkumu uzraudz\u012bbas birojs (IUB) nor\u0101da, ka MK noteikumi Nr. 673 ir izdoti saska\u0146\u0101 ar PIL 17. panta vienpadsmito da\u013cu un 46. panta piekto da\u013cu. PIL 17. panta vienpadsmitaj\u0101 da\u013c\u0101 rakst\u012bts, ka Ministru kabinets nosaka pras\u012bbas publiskajam iepirkumam, kur\u0101 izmanto vides krit\u0113rijus, to piem\u0113ro\u0161anas k\u0101rt\u012bbu p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumiem. Savuk\u0101rt PIL 46. panta piektaj\u0101 da\u013c\u0101 rakst\u012bts, ka Ministru kabinets nosaka za\u013caj\u0101 publiskaj\u0101 iepirkum\u0101 piem\u0113rojamos pied\u0101v\u0101juma izv\u0113les krit\u0113rijus p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumiem. \u0145emot v\u0113r\u0101 noteikumu 2. punktu, kas nosaka, ka \u0161ie noteikumi attiecas uz p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumiem, kurus veic, piem\u0113rojot PIL 8. panta pirmaj\u0101 da\u013c\u0101 noteikt\u0101s iepirkuma proced\u016bras, noteikumu pras\u012bbu piem\u0113ro\u0161ana atkl\u0101t\u0101 konkurs\u0101 par p\u0101rtikas produktu pieg\u0101di uzskat\u0101ma par oblig\u0101tu. Tom\u0113r vienlaikus birojs nor\u0101da, ka sp\u0113k\u0101 eso\u0161ais normat\u012bvo aktu regul\u0113jums \u0161\u0101d\u0101 situ\u0101cij\u0101 ne\u013cauj konstat\u0113t p\u0101rk\u0101pumu, par kuru saska\u0146\u0101 ar Administrat\u012bvo p\u0101rk\u0101pumu kodeksu iepirkuma veic\u0113jam b\u016btu piem\u0113rojams administrat\u012bvais sods par neatbilsto\u0161as iepirkuma proced\u016bras veik\u0161anu, proti, p\u0101rtikas produktu iepirkumu, nepiem\u0113rojot noteikumu pras\u012bbas.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">B\u0113rnu \u0113dienkarte uz iepirc\u0113ju sirdsapzi\u0146as<\/font><\/strong><\/p>\n<p>BKUS iepirkum\u0101 pie \u201cPied\u0101v\u0101juma izv\u0113les krit\u0113riji\u201d nor\u0101d\u012bts, ka izv\u0113les krit\u0113rijs ir tr\u012bs pretendentu pied\u0101v\u0101jumi ar viszem\u0101ko cenu katr\u0101 iepirkuma priek\u0161meta poz\u012bcij\u0101, kam\u0113r IeVP iepirkum\u0101 pie \u201cPied\u0101v\u0101juma izv\u0113les krit\u0113riji\u201d saska\u0146\u0101 ar ZPI nor\u0101d\u012bti pieci krit\u0113riji: viszem\u0101k\u0101 nosac\u012bt\u0101 l\u012bgumcena, pre\u010du daudzums, kas atbilst biolo\u0123isk\u0101s lauksaimniec\u012bbas vai lauksaimniec\u012bbas produktu integr\u0113t\u0101s audz\u0113\u0161anas pras\u012bb\u0101m, vai prec\u0113m ir \u201cZa\u013c\u0101s karot\u012btes\u201d z\u012bme, pre\u010du \u012bpatsvars, kuras tiek pieg\u0101d\u0101tas atk\u0101rtoti izmantojam\u0101 prim\u0101raj\u0101 iepakojum\u0101 vai p\u0101rstr\u0101dei paredz\u0113taj\u0101 iepakojum\u0101, pre\u010du daudzums, kas tiek pieg\u0101d\u0101ts, izmantojot autotransportu ar oglek\u013ca dioks\u012bda emisijas un pies\u0101r\u0146ot\u0101ju \u2013 sl\u0101pek\u013ca oks\u012bdu, met\u0101nu nesaturo\u0161o og\u013c\u016bde\u0146ra\u017eu un cieto da\u013ci\u0146u \u2013 daudzumu, kas nep\u0101rsniedz EURO 5 standartus, k\u0101 ar\u012b pre\u010du daudzums ar \u201cBordo karot\u012btes\u201d z\u012bmi. P\u0101rtikas un veterin\u0101r\u0101 dienesta (PVD) kompetenc\u0113 ir pieg\u0101d\u0101t\u0101ju p\u0101rbaude un anal\u012bze situ\u0101cij\u0101s, kad konstat\u0113ti p\u0101rk\u0101pumi za\u013c\u0101 iepirkuma pieg\u0101\u017eu ietvaros. Savuk\u0101rt situ\u0101cij\u0101s, kad pas\u016bt\u012bt\u0101js p\u0101rk\u0101pis PIL vai MK noteikumos min\u0113t\u0101s pras\u012bbas, p\u0101rbaudes var veikt Iepirkumu uzraudz\u012bbas birojs.<\/p>\n<p>K\u0101 nor\u0101da Valsts re\u0123ion\u0101l\u0101s att\u012bst\u012bbas a\u0123ent\u016bras (VRAA) Elektronisko iepirkumu departamenta kancelejas, p\u0101rtikas pre\u010du un m\u0113be\u013cu kataloga vad\u012bt\u0101ja Astra B\u0113rzi\u0146a, iepaz\u012bstoties ar BKUS iepirkuma dokument\u0101ciju, nav skaidrs, k\u0101p\u0113c nav piem\u0113roti MK noteikumi Nr. 172 \u201cPar uztura norm\u0101m izgl\u012bt\u012bbas iest\u0101\u017eu izgl\u012btojamiem, soci\u0101l\u0101s apr\u016bpes un soci\u0101l\u0101s rehabilit\u0101cijas instit\u016bciju klientiem un \u0101rstniec\u012bbas iest\u0101\u017eu pacientiem\u201d, kas paredz b\u016btiskus ierobe\u017eojumus da\u017e\u0101diem p\u0101rtikas produktiem. \u201cPiem\u0113ram, \u0161eit min\u0113ts kafijas dz\u0113riens. Ja ar to dom\u0101ta \u0161\u0137\u012bsto\u0161\u0101 kafija, tad t\u0101 saska\u0146\u0101 ar 172. noteikumiem ir aizliegta, t\u0101pat gar\u0161vielu mais\u012bjums \u2013 ja tehniskaj\u0101 specifik\u0101cij\u0101 nav nor\u0101d\u012bts, ka t\u0101 sast\u0101v\u0101 nedr\u012bkst b\u016bt virkne E vielu un s\u0101ls, tad pieg\u0101d\u0101t\u0101js var pieg\u0101d\u0101t jebko. T\u0101pat \u017e\u0101v\u0113tie aug\u013ci \u2013 piem\u0113ram, vair\u0101kums pirmsskolas izgl\u012bt\u012bbas iest\u0101\u017eu no \u017e\u0101v\u0113tiem aug\u013ciem ir atteiku\u0161\u0101s visp\u0101r, jo 90% gad\u012bjumu tajos ir vanil\u012bns un s\u0113ra dioks\u012bds, kas ar\u012b ir pret 172. noteikumiem,\u201d skaidro Astra B\u0113rzi\u0146a. T\u0101pat vi\u0146a pau\u017e izbr\u012bnu, k\u0101p\u0113c da\u013ca produktu poz\u012bciju nav iepirktas, izmantojot elektronisko katalogu, kas \u013cautu ietaup\u012bt gan laiku, gan l\u012bdzek\u013cus iepirc\u0113jiem.<\/p>\n<p>BKUS Iepirkumu un l\u012bgumu da\u013cas vad\u012bt\u0101js M\u0101ris Ignatovi\u010ds vair\u0101kas ned\u0113\u013cas vilcin\u0101j\u0101s ar atbildi, atrun\u0101joties ar aiz\u0146emt\u012bbu un faktu, ka ar min\u0113to iepirkumu nodarbojusies kol\u0113\u0123e, kura BKUS vairs nestr\u0101d\u0101. Ar \u0161o jaut\u0101jumu v\u0113r\u0161oties LR Vesel\u012bbas ministrij\u0101, jau taj\u0101 pa\u0161\u0101 dien\u0101 \u017eurn\u0101ls \u201cIepirkumi\u201d sa\u0146\u0113ma atbildi, ka jaut\u0101jums dele\u0123\u0113ts BKUS, un nedaudz v\u0113l\u0101k ar\u012b atbildes no pa\u0161as slimn\u012bcas.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Ar da\u017eiem krit\u0113rijiem pietiek<\/font><\/strong><\/p>\n<p>Koment\u0113jot situ\u0101ciju, M\u0101ris Ignatovi\u010ds uzsver, ka iepirkums izsludin\u0101ts saska\u0146\u0101 ar sp\u0113k\u0101 eso\u0161ajiem noteikumiem, turkl\u0101t ieg\u0101d\u0101ta ar\u012b biolo\u0123isk\u0101 produkcija: \u201cVSIA \u201cB\u0113rnu kl\u012bnisk\u0101 universit\u0101tes slimn\u012bca\u201d, veicot p\u0101rtikas produktu iepirkumu (ID Nr. BKUS 2016\/31), atkl\u0101t\u0101 konkursa nolikum\u0101 iek\u013c\u0101vusi virkni pras\u012bbu, ko paredz MK 28.10.2014. noteikumi Nr. 673. Nolikum\u0101 iek\u013cautas pras\u012bbas attiec\u012bb\u0101 uz \u0113diena gatavo\u0161anu, dodot priek\u0161roku svaigiem un sezon\u0101liem p\u0101rtikas produktiem, p\u0101rtikas produktu pieg\u0101des iepirkuma dal\u012bjumu da\u013c\u0101s, \u0146emot v\u0113r\u0101 aug\u013cu un d\u0101rze\u0146u sezonalit\u0101ti un pieejam\u012bbu tirg\u016b, pras\u012bbas, lai pretendents nor\u0101da p\u0101rtikas produktu ra\u017eot\u0101ju vai audz\u0113t\u0101ju, izcelsmes valsti, un citas pras\u012bbas, ko paredz \u0161ie noteikumi. B\u0113rnu slimn\u012bcai ar\u012b 2016. gada iepirkuma ietvaros tiek pieg\u0101d\u0101ti biolo\u0123iskaj\u0101 lauksaimniec\u012bb\u0101 audz\u0113ti p\u0101rtikas produkti, k\u0101 ar\u012b produkti ar \u201cZa\u013c\u0101s karot\u012btes\u201d z\u012bmi. Produkti atbilst MK 172. noteikumiem. Produkti ir svaigi, kvalitat\u012bvi un vesel\u012bgi.\u201d Vi\u0146\u0161 ar\u012b uzsver, ka BKUS iepirkumu izsludin\u0101jusi un \u012bstenojusi saska\u0146\u0101 ar sp\u0113k\u0101 eso\u0161o likumdo\u0161anu (\u201cIepirkumi\u201d jau iepriek\u0161 rakst\u012bja, ka jaunais Publisko iepirkumu likums ar nov\u0113lo\u0161anos st\u0101sies sp\u0113k\u0101 2017. gada 1. mart\u0101, kaut gan iepriek\u0161\u0113jais likums tehniski jau ir zaud\u0113jis sp\u0113ku 2016. gad\u0101): \u201cT\u0101pat nolikums paredz p\u0101rtikas produktu pieg\u0101di atbilsto\u0161i Latvijas Republik\u0101 un Eiropas Savien\u012bb\u0101 sp\u0113k\u0101 eso\u0161o normat\u012bvo aktu pras\u012bb\u0101m, taj\u0101 skait\u0101 pretendenta darb\u012bbai p\u0101rtikas aprit\u0113 j\u0101b\u016bt atz\u012btai vai re\u0123istr\u0113tai P\u0101rtikas aprites uzraudz\u012bbas likum\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101, pre\u010du pieg\u0101de j\u0101nodro\u0161ina atbilsto\u0161i Latvijas Republik\u0101 un Eiropas Savien\u012bb\u0101 sp\u0113k\u0101 eso\u0161o normat\u012bvo aktu pras\u012bb\u0101m apr\u012bkotos transportl\u012bdzek\u013cos (piem\u0113ram, Eiropas Parlamenta un Padomes regulas (EK) Nr. 852\/2004 (2004. gada 29. apr\u012blis) par p\u0101rtikas produktu higi\u0113nu II pielikuma IV noda\u013cas pras\u012bb\u0101m). Nolikums paredz, ka pretendentam j\u0101b\u016bt pied\u0101v\u0101to p\u0101rtikas produktu ra\u017eot\u0101jam vai tam ir nepiecie\u0161am\u0101s ties\u012bbas p\u0101rdot ra\u017eot\u0101ja produkciju, kas izsl\u0113dz nezin\u0101mas izcelsmes produktu pieg\u0101di.\u201d<\/p>\n<p>Iepirkumu uzraudz\u012bbas birojs situ\u0101ciju koment\u0113, uzsverot, ka \u0113tiskas dabas jaut\u0101jumi nav biroja kompetenc\u0113 un ka p\u0113c b\u016bt\u012bbas BKUS iepirkum\u0101 p\u0101rk\u0101pumu nav. Vienlaikus IUB nor\u0101da, ka, neskatoties uz to, ka BKUS nav piln\u012bb\u0101 iev\u0113rojusi noteikumu Nr. 673 pras\u012bbas, j\u0101atz\u012bst, ka t\u0101s atkl\u0101ta konkursa dokument\u0101cij\u0101 tom\u0113r bija \u0146emti v\u0113r\u0101 da\u017ei no noteikumu 3. punkt\u0101 iek\u013cautajiem principiem, piem\u0113ram, ka tiek dota priek\u0161roka svaigiem un sezon\u0101liem p\u0101rtikas produktiem, k\u0101 ar\u012b princips, kas nosaka, ka, p\u0113rkot produktus, j\u0101izv\u0113las t\u0101di, kas iepakoti otrreiz\u0113ji p\u0101rstr\u0101d\u0101jam\u0101 iepakojum\u0101, kas tiek pie\u0146emts atk\u0101rtotai izmanto\u0161anai. L\u012bdz ar to birojs viennoz\u012bm\u012bgi nesecina, ka min\u0113t\u0101s iepirkuma proced\u016bras rezult\u0101t\u0101 BKUS ieg\u0101d\u0101jusies sliktas kvalit\u0101tes p\u0101rtikas produktus. Vienlaikus birojs nor\u0101da, ka pas\u016bt\u012bt\u0101ji, sagatavojot iepirkumu tehnisk\u0101s specifik\u0101cijas, jebkur\u0101 gad\u012bjum\u0101 taj\u0101s ietver da\u017e\u0101dus kvalit\u0101tes nosac\u012bjumus, lai sa\u0146emtu pied\u0101v\u0101jumu, kur\u0161 atbilst gan noteikt\u0101m pas\u016bt\u012bt\u0101ja kvalit\u0101tes pras\u012bb\u0101m, gan ar\u012b t\u0101 finansi\u0101laj\u0101m iesp\u0113j\u0101m.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Za\u013cais iepirkums prasa izgl\u012bto\u0161anos un piel\u0101go\u0161anos<\/font><\/strong><\/p>\n<p>IeVP sabiedrisko attiec\u012bbu speci\u0101liste In\u0101ra Mak\u0101rova lepojas, ka IeVP bijusi pirm\u0101 valsts iest\u0101de, kura ieviesusi ZPI sav\u0101s iepirkumu proced\u016br\u0101s un l\u012bdz \u0161im veiksm\u012bgi ar to str\u0101d\u0101.
