Piem\u0113ram, jaunais Publisko iepirkumu likums neapraksta iepirkuma proced\u016bru norises k\u0101rt\u012bbu; to un ar\u012b daudzus citus aspektus noteiks Ministru kabinets. Jau \u0161obr\u012bd Ministru kabineta t\u012bmek\u013ca vietn\u0113 publiski ir pieejami Ministru kabineta noteikumu projekti par \u0161\u0101diem aspektiem:<\/p>\n<ol>\n<li> Iepirkuma proced\u016bru un metu konkursa norises k\u0101rt\u012bba.\n<li> Iesnieguma par iepirkuma proced\u016bras p\u0101rk\u0101pumiem depoz\u012bta samaksas vai iesnieg\u0161anas un atmaks\u0101\u0161anas k\u0101rt\u012bba.\n<li> Publisko iepirkumu pazi\u0146ojumi un to sagatavo\u0161anas k\u0101rt\u012bba.\n<li> Par transportl\u012bdzek\u013cu kategorij\u0101m, uz kur\u0101m iepirkumos attiecin\u0101mas \u012bpa\u0161as pras\u012bbas, un transportl\u012bdzek\u013cu darbm\u016b\u017ea ekspluat\u0101cijas izmaksu apr\u0113\u0137in\u0101\u0161anas metodika.\n<\/ol>\n<p>Vides aizsardz\u012bbas un re\u0123ion\u0101l\u0101s att\u012bst\u012bbas ministrija gatavo ar\u012b Ministru kabineta noteikumu projektu par pras\u012bb\u0101m za\u013cajam publiskajam iepirkumam un \u0161\u012b iepirkuma piem\u0113ro\u0161anas k\u0101rt\u012bbu.<br \/>\nTa\u010du jau \u0161obr\u012bd viennoz\u012bm\u012bgi var apgalvot, ka jaunais publisko iepirkumu tiesiskais regul\u0113jums satur gan virkni jaunin\u0101jumu, gan ar\u012b nians\u0113t\u0101ku un detaliz\u0113t\u0101ku tiesisko regul\u0113jumu daudziem jau zin\u0101miem publisko iepirkumu aspektiem.<br \/>\n\u00a0<!--more--><br \/>\nPie b\u016btisk\u0101kajiem jaunin\u0101jumiem, kas j\u0101\u0146em v\u0113r\u0101 pas\u016bt\u012bt\u0101jiem, es v\u0113l\u0113tos min\u0113t \u0161\u0101dus:<\/p>\n<ol>\n<li> Ieviesta jauna iepirkuma proced\u016bra\u00a0\u2013 inov\u0101ciju partner\u012bbas proced\u016bra. \u0160aj\u0101 proced\u016br\u0101 kandid\u0113t var\u0113s ikviens pieg\u0101d\u0101t\u0101js, bet pied\u0101v\u0101jumu iesniegt var\u0113s tikai tie kandid\u0101ti, ko pas\u016bt\u012bt\u0101js uzaicin\u0101s. \u0160\u012b proced\u016bra ir rad\u012bta, lai izveidotu ilgtermi\u0146a inov\u0101cijas partner\u012bbu jauna inovat\u012bva produkta, pakalpojuma vai b\u016bvdarbu izstr\u0101dei un turpm\u0101kai ieg\u0101dei.\n<li> B\u016btiskas izmai\u0146as notiku\u0161as likuma piem\u0113ro\u0161anas iz\u0146\u0113mumos, kur par\u0101d\u012bju\u0161ies vair\u0101ki jauni iz\u0146\u0113mumi, kad pas\u016bt\u012bt\u0101ji ir ties\u012bgi nepiem\u0113rot Publisko iepirkumu likumu.\n<li> Pas\u016bt\u012bt\u0101ji ar\u012b var\u0113s b\u016bt pieg\u0101d\u0101t\u0101ji, respekt\u012bvi, pied\u0101v\u0101t veikt b\u016bvdarbus, pieg\u0101d\u0101t preces vai sniegt pakalpojumus. Ta\u010du vienlaikus j\u0101\u0146em v\u0113r\u0101 ar\u012b izmai\u0146as, ko jaunais likums ievie\u0161 attiec\u012bb\u0101 uz pas\u016bt\u012bt\u0101ju savstarp\u0113jiem iepirkumu l\u012bgumiem, kas papla\u0161ina pas\u016bt\u012bt\u0101ju iesp\u0113jas veikt iepirkumus no citiem pas\u016bt\u012bt\u0101jiem un to kontrol\u0113 eso\u0161ajiem vai kontrol\u0113jo\u0161ajiem komersantiem vai pas\u016bt\u012bt\u0101jiem, nepiem\u0113rojot Publisko iepirkumu likumu.\n<li> Paaugstin\u0101ti l\u012bgumcenu sliek\u0161\u0146i, s\u0101kot ar kuriem j\u0101piem\u0113ro Publisko iepirkumu likum\u0101 noteikt\u0101s iepirkuma proced\u016bras. Pieg\u0101\u017eu un pakalpojumu gad\u012bjum\u0101 likum\u0101 noteikt\u0101s iepirkuma proced\u016bras j\u0101piem\u0113ro, ja paredzam\u0101 l\u012bgumcena ir 10\u00a0000 eiro (\u0161obr\u012bd\u00a0\u2013 4000 eiro), bet b\u016bvdarbu l\u012bguma gad\u012bjum\u0101\u00a0\u2013 20\u00a0000 eiro (\u0161obr\u012bd 14\u00a0000 eiro).\n<li> Detaliz\u0113t\u0101k regul\u0113ti ar centraliz\u0113to iepirkumu instit\u016bciju veiktajiem iepirkumiem saist\u012btie aspekti. Vienlaikus ir paaugstin\u0101ta kop\u012bg\u0101 l\u012bgumcena pre\u010du un pakalpojumu grup\u0101s, ko sasniedzot tie\u0161\u0101s p\u0101rvaldes un pa\u0161vald\u012bbu iest\u0101d\u0113m iest\u0101jas pien\u0101kums noteiktas preces un pakalpojumus pirkt no Ministru kabineta noteiktas centraliz\u0113to iepirkumu instit\u016bcijas. Tie\u0161\u0101s p\u0101rvaldes iest\u0101d\u0113m paaugstin\u0101tais l\u012bgumcenas slieksnis ir 1000 eiro (\u0161obr\u012bd\u00a0\u2013 150 eiro), bet pa\u0161vald\u012bbu iest\u0101d\u0113m\u00a0\u2013 10\u00a0000 eiro (\u0161obr\u012bd\u00a0\u2013 4000 eiro).\n<li> Papildus centraliz\u0113to iepirkumu instit\u016bciju veiktajiem iepirkumiem likum\u0101 ir ieviesta iesp\u0113ja vair\u0101kiem pas\u016bt\u012bt\u0101jiem no da\u017e\u0101d\u0101m Eiropas Savien\u012bbas dal\u012bbvalst\u012bm kop\u012bgi pie\u0161\u0137irt iepirkuma l\u012bguma sl\u0113g\u0161anas ties\u012bbas, nosl\u0113gt visp\u0101r\u012bgo vieno\u0161anos vai izmantot dinamisko iepirkumu sist\u0113mu.\n<li> Pas\u016bt\u012bt\u0101jiem noteikts pien\u0101kums m\u0113ne\u0161a laik\u0101 no gadsk\u0101rt\u0113j\u0101 bud\u017eeta apstiprin\u0101\u0161anas dienas public\u0113t inform\u0101ciju par pl\u0101notajiem iepirkumiem un iepirkuma proced\u016br\u0101m.\n<li> Pas\u016bt\u012bt\u0101jiem, sagatavojot iepirkumu, b\u016bs j\u0101\u0146em v\u0113r\u0101 za\u013c\u0101 publisk\u0101 iepirkuma pras\u012bbas, ko noteiks Ministru kabinets.\n<li> J\u0101\u0146em v\u0113r\u0101 ar noteiktiem iepriek\u0161\u0113jiem sodiem saist\u012bti ierobe\u017eojumi sod\u012bt\u0101s personas iek\u013caut iepirkuma komisijas sast\u0101v\u0101. Iz\u0146\u0113mumus no \u0161\u012b visp\u0101r\u012bg\u0101 pien\u0101kuma noteiks Ministru kabinets.\n<li> Iepirkuma proced\u016bras zi\u0146ojums b\u016bs j\u0101public\u0113 pas\u016bt\u012bt\u0101ja profil\u0101.\n<li> Izzi\u0146as un citi dokumenti no \u0101rvalsts instit\u016bcij\u0101m pas\u016bt\u012bt\u0101jam b\u016bs j\u0101pie\u0146em un j\u0101atz\u012bst, ja tie b\u016bs izdoti ne agr\u0101k k\u0101 se\u0161us m\u0113ne\u0161us pirms iesnieg\u0161anas dienas, ja vien izzi\u0146as vai dokumenta izdev\u0113js neb\u016bs nor\u0101d\u012bjis \u012bs\u0101ku t\u0101 der\u012bguma termi\u0146u. \u0160obr\u012bd izzi\u0146u un citu dokumentu der\u012bguma termi\u0146\u0161 ir noteikts\u00a0\u2013 viens m\u0113nesis. Ta\u010du Latvijas instit\u016bciju izzi\u0146as un dokumenti b\u016bs der\u012bgi t\u0101pat k\u0101 l\u012bdz \u0161im\u00a0\u2013 vienu m\u0113nesi.\n<li> Izsl\u0113g\u0161anas un virkne citu noteikumu j\u0101piem\u0113ro apak\u0161uz\u0146\u0113m\u0113jiem, kuru veicamo b\u016bvdarbu vai sniedzamo pakalpojumu v\u0113rt\u012bba ir vismaz 10 procenti no kop\u0113j\u0101s l\u012bguma v\u0113rt\u012bbas. \u0160obr\u012bd \u0161is slieksnis ir 20% no l\u012bguma v\u0113rt\u012bbas.\n<li> Noteikts jauns kandid\u0101tu un pretendentu izsl\u0113g\u0161anas noteikums\u00a0\u2013 smags profesion\u0101l\u0101s darb\u012bbas p\u0101rk\u0101pums. Likums nenosaka, kas j\u0101saprot ar smagu profesion\u0101l\u0101s darb\u012bbas p\u0101rk\u0101pumu. To noteiks Ministru kabinets.\n<li> Ja pieg\u0101d\u0101t\u0101js balst\u012bsies uz citas personas saimnieciskaj\u0101m un finansi\u0101laj\u0101m iesp\u0113j\u0101m, pas\u016bt\u012bt\u0101js var\u0113s pras\u012bt, lai pieg\u0101d\u0101t\u0101js un persona, uz kuras iesp\u0113j\u0101m tas balst\u0101s, ir solid\u0101ri atbild\u012bgi par l\u012bguma izpildi.\n<li> Inform\u0101ciju par veiktajiem b\u016bvdarbiem, pieg\u0101d\u0113m un pakalpojumiem, lai p\u0101rbaud\u012btu pieg\u0101d\u0101t\u0101ja tehnisk\u0101s un profesion\u0101l\u0101s sp\u0113jas, var\u0113s pras\u012bt par ilg\u0101ku laika periodu nek\u0101 \u0161obr\u012bd noteiktais piecu vai tr\u012bs gadu periods.\n<li> Ierobe\u017eota cenas k\u0101 pied\u0101v\u0101jumu izv\u0113rt\u0113\u0161anas krit\u0113rija izmanto\u0161ana, liel\u0101ku noz\u012bmi pie\u0161\u0137irot krit\u0113rijam\u00a0\u2013 saimnieciski visizdev\u012bg\u0101kais pied\u0101v\u0101jums. Pas\u016bt\u012bt\u0101ji pied\u0101v\u0101jumu sal\u012bdzin\u0101\u0161anai un izv\u0113rt\u0113\u0161anai b\u016bs ties\u012bgi izmantot tikai cenu t.\u00a0s. mazajos iepirkumos, soci\u0101lo un citu \u012bpa\u0161o pakalpojumu iepirkumos vai, ja sagatavot\u0101 tehnisk\u0101 specifik\u0101cija ir detaliz\u0113ta un citiem krit\u0113rijiem nav b\u016btiska noz\u012bme pied\u0101v\u0101juma izv\u0113l\u0113.\n<li> Likums vairs nesatur daudzk\u0101rt kritiz\u0113to pas\u016bt\u012bt\u0101ja pien\u0101kumu v\u0113rt\u0113t, vai pied\u0101v\u0101jums nav nepamatoti l\u0113ts, ja pieg\u0101d\u0101t\u0101ja vai t\u0101 apak\u0161uz\u0146\u0113m\u0113ju darbinieku stundas tarifa likme nesasniedz noteiktu procentu no vid\u0113j\u0101s stundas tarifa likmes valst\u012b. Ta\u010du j\u0101seko l\u012bdzi, kas b\u016bs noteikts Ministru kabineta noteikumos.\n<li> Jaunais likums paredz, ka iepirkuma l\u012bgums var\u0113tu tikt sl\u0113gts ne tikai starp pas\u016bt\u012bt\u0101ju un pieg\u0101d\u0101t\u0101ju, bet ar\u012b ar apak\u0161uz\u0146\u0113m\u0113jiem. Likums ar\u012b nosaka, ka noteiktos apst\u0101k\u013cos p\u0113c apak\u0161uz\u0146\u0113m\u0113ju piepras\u012bjuma maks\u0101jumus par apak\u0161uz\u0146\u0113m\u0113ja sniegtajiem pakalpojumiem pas\u016bt\u012bt\u0101js var p\u0101rskait\u012bt tie\u0161i apak\u0161uz\u0146\u0113m\u0113jam. Vienlaikus ir padar\u012bti sare\u017e\u0123\u012bt\u0101ki apak\u0161uz\u0146\u0113m\u0113ju nomain\u012b\u0161anas noteikumi iepirkuma l\u012bguma izpildes laik\u0101.\n<li> Pas\u016bt\u012bt\u0101jam ir noteikts pien\u0101kums desmit darbdienu laik\u0101 p\u0113c dienas, kad st\u0101jas sp\u0113k\u0101 iepirkuma l\u012bgums vai t\u0101 groz\u012bjumi, sav\u0101 pirc\u0113ja profil\u0101 ievietot iepirkuma l\u012bguma vai visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s pamattekstu, vai uz visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s pamata nosl\u0113gta iepirkuma l\u012bguma tekstu, ja l\u012bgumcena ir vien\u0101da ar Ministru kabineta noteiktaj\u0101m l\u012bgumcenu robe\u017ev\u0113rt\u012bb\u0101m vai liel\u0101ka, vai noteiktu iepirkuma l\u012bguma groz\u012bjumu tekstu un groz\u012bjumu pamatojumu.\n<li> Jaunumi ir ar\u012b attiec\u012bb\u0101 uz iepirkuma l\u012bgumu groz\u012bjumu izdar\u012b\u0161anu. Pas\u016bt\u012bt\u0101js iepirkuma l\u012bgum\u0101 var noteikt ar\u012b citus gad\u012bjumus, kad tam b\u016bs ties\u012bbas vienpus\u0113ji atk\u0101pties no iepirkuma l\u012bguma.\n<\/ol>\n<p>Kandid\u0101tiem un pretendentiem savuk\u0101rt j\u0101piev\u0113r\u0161 uzman\u012bba vismaz \u0161\u0101diem jaunin\u0101jumiem:<\/p>\n<ol>\n<li> Pieg\u0101d\u0101t\u0101jiem b\u016bs liel\u0101ka r\u012bc\u012bbas br\u012bv\u012bba, izv\u0113loties juridisko formu pieg\u0101d\u0101t\u0101ju apvien\u012bbai. Proti, jaunais likums nosaka, ka apvien\u012bba, attiec\u012bb\u0101 uz kuru pie\u0146emts l\u0113mums sl\u0113gt iepirkuma l\u012bgumu, var p\u0113c savas izv\u0113les izveidoties atbilsto\u0161i pas\u016bt\u012bt\u0101ja noteiktajam juridiskajam statusam vai nosl\u0113gt sabiedr\u012bbas l\u012bgumu, vienojoties par apvien\u012bbas dal\u012bbnieku atbild\u012bbas sadal\u012bjumu.\n<li> Jaunais likums nosaka \u012bs\u0101ku termi\u0146u iesnieguma iesnieg\u0161anai Iepirkumu uzraudz\u012bbas biroj\u0101 par atkl\u0101ta konkursa un metu konkursa nolikum\u0101 un attiec\u012bgajos pazi\u0146ojumos par l\u012bgumu ietvertaj\u0101m pras\u012bb\u0101m no desmit dien\u0101m uz septi\u0146\u0101m dien\u0101m pirms pied\u0101v\u0101jumu un metu iesnieg\u0161anas termi\u0146a beig\u0101m.\n<li> Viens no visstr\u012bd\u012bg\u0101kajiem jaunin\u0101jumiem ir depoz\u012bta ievie\u0161ana, kas j\u0101samaks\u0101 noteiktos gad\u012bjumos pirms iesnieguma iesnieg\u0161anas Iepirkumu uzraudz\u012bbas biroj\u0101; pret\u0113j\u0101 gad\u012bjum\u0101 iesniegums netiks pie\u0146emts. Depoz\u012bts neb\u016bs j\u0101maks\u0101, ja iesniegum\u0101 tiks apstr\u012bd\u0113ta iepirkuma proced\u016bras p\u0101rtrauk\u0161anas (bet ne izbeig\u0161anas.\u00a0\u2013 Autora koment\u0101rs) likum\u012bba vai iepirkuma proced\u016bras dokumentos noteikt\u0101s pras\u012bbas. Depoz\u012bta apm\u0113rs ir 0,5 procenti no paredzam\u0101s l\u012bgumcenas, bet ne vair\u0101k k\u0101 15\u00a0000 eiro b\u016bvdarbu l\u012bguma gad\u012bjum\u0101 un 840 eiro publiska pakalpojuma l\u012bguma un pieg\u0101des l\u012bguma gad\u012bjum\u0101. Depoz\u012btu atmaks\u0101s atpaka\u013c iesnieguma iesniedz\u0113jam tikai likum\u0101 noteiktajos gad\u012bjumos, piem\u0113ram, p\u0113c tam, kad st\u0101sies sp\u0113k\u0101 pas\u016bt\u012bt\u0101jam nelabv\u0113l\u012bgs l\u0113mums vai iesniegums tiks atsaukts l\u012bdz t\u0101 izskat\u012b\u0161anai iesniegumu izskat\u012b\u0161anas komisij\u0101. Ta\u010du likums neparedz, ka depoz\u012btu atmaks\u0101s atpaka\u013c, ja iesniegumu izskat\u012b\u0161anas komisija iesniegumu noraid\u012bs, iz\u0146emot, ja v\u0113l\u0101k ar sp\u0113k\u0101 st\u0101ju\u0161os tiesas spriedumu b\u016bs uzdots depoz\u012btu atmaks\u0101t atpaka\u013c iesniedz\u0113jam.\n<\/ol>\n<p>Nobeigum\u0101 v\u0113los v\u0113lreiz akcent\u0113t, ka Publisko iepirkumu likums ir tikai da\u013ca no jaun\u0101 tiesisk\u0101 regul\u0113juma.
