Ta\u010du svar\u012bgi ir nepalikt tikai pie principa nostiprin\u0101\u0161anas normat\u012bvaj\u0101 regul\u0113jum\u0101. Bez skaidriem un saprotamiem saimnieciska izdev\u012bguma krit\u0113rijiem publiskajos iepirkumos lab\u0101kaj\u0101 gad\u012bjum\u0101 domin\u0113s tie pa\u0161i &#8220;l\u0113t\u0101kie pied\u0101v\u0101jumi&#8221;. Tamd\u0113\u013c &#8220;Latvijas B\u016bvuz\u0146\u0113m\u0113ju partner\u012bba&#8221; kop\u0101 ar vado\u0161ajiem b\u016bvniec\u012bbas nozares un publisko iepirkumu ekspertiem patlaban gatavo vienk\u0101r\u0161u, skaidru un vispus\u012bgu metodolo\u0123iju saimnieciski izdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma v\u0113rt\u0113\u0161anai, kas b\u016bs k\u0101 rekomend\u0101cija pas\u016bt\u012bt\u0101jiem, lai atvieglotu darbu publisko iepirkumu organiz\u0113\u0161an\u0101.<\/p>\n<p>Otrs svar\u012bgs jaut\u0101jums ir b\u016bvkomersantu klasifikatora sasaiste ar Publisko iepirkumu likumu. B\u016bvuz\u0146\u0113m\u0113ji redz, ka ar klasifikatora ievie\u0161anu vajadz\u0113tu daudz strauj\u0101k virz\u012bties uz priek\u0161u\u00a0\u2013 v\u0113l pirms 2019. gada. B\u016bvkomersantu klasifik\u0101cija, pirmk\u0101rt, b\u016bs liels solis b\u016bvdarbu iepirkumu procesa vienk\u0101r\u0161o\u0161anai. Pas\u016bt\u012bt\u0101jiem vairs nevajadz\u0113s v\u0113rt\u0113t pretendentu pieredzi un kvalifik\u0101ciju katr\u0101 izsludin\u0101taj\u0101 iepirkum\u0101. Otrk\u0101rt, klasifik\u0101cija efekt\u012bvi un objekt\u012bvi nov\u0113rt\u0113 katra b\u016bvuz\u0146\u0113m\u0113ja kvalifik\u0101ciju, pieredzi un ilgtsp\u0113ju, t\u0101d\u0113j\u0101di l\u012bdz minimumam samazinot riskus, kas saist\u012bti ar dro\u0161\u012bbu un kvalit\u0101ti. T\u0101pat b\u016bs liel\u0101ka dro\u0161\u012bba, ka b\u016bvkomersanta sniegt\u0101s garantijas b\u016bs patie\u0161\u0101m izmantojamas, jo b\u016bvkomersants, kas veicis darbus, neb\u016bs vienas dienas uz\u0146\u0113mums.<\/p>\n<p>Vienlaikus nozares uz\u0146\u0113mumi konceptu\u0101li iebilst pret likuma normu, kas \u013cauj pas\u016bt\u012bt\u0101jam tr\u012bs gadus izsl\u0113gt komersantu no dal\u012bbas publiskajos iepirkumos, ja pas\u016bt\u012bt\u0101js agr\u0101k ir vienpus\u0113ji atk\u0101pies no l\u012bguma. Tas neliecina, ka valsts uzticas pat tiem uz\u0146\u0113m\u0113jiem, kuri ir iek\u013cauti t.\u00a0s. Baltaj\u0101 sarakst\u0101.<\/p>\n<p>Eiropas Savien\u012bbas jaun\u0101 Publisko iepirkumu direkt\u012bva (2014\/24\/ES) k\u0101 pied\u0101v\u0101juma izv\u0113les pamatkrit\u0113riju paredz saimnieciski visizdev\u012bg\u0101ko pied\u0101v\u0101jumu. Pied\u0101v\u0101juma ar viszem\u0101ko cenu gad\u012bjum\u0101 pas\u016bt\u012bt\u0101js paredz v\u0113rt\u0113t tikai vienu no produkta \u012bpa\u0161\u012bb\u0101m\u00a0\u2013 cenu. Tas samazina kop\u0113jo kvalit\u0101tes l\u012bmeni, konkur\u0113tsp\u0113j\u012bgu pied\u0101v\u0101jumu kl\u0101stu, ar\u012b invest\u012bciju apjomu valst\u012b kopum\u0101. Iz\u0161\u0137iro\u0161a loma caursp\u012bd\u012bguma nodro\u0161in\u0101\u0161an\u0101 un korupcijas nov\u0113r\u0161an\u0101 ir e-sist\u0113mai. Bie\u017ei laiks starp iepirkuma s\u0101k\u0161anu un kataloga public\u0113\u0161anu aiz\u0146em gandr\u012bz gadu, k\u0101 d\u0113\u013c pied\u0101v\u0101jumi jau ir k\u013cuvu\u0161i neaktu\u0101li un praktiski nelietojami. T\u0101ds\u00a0pats liktenis var piemekl\u0113t ar\u012b e-sist\u0113mu.<\/p>\n<p>Eiropas Komisija (EK) sav\u0101 jaun\u0101kaj\u0101 p\u0113t\u012bjum\u0101 par Eiropas Savien\u012bbas (ES) dal\u012bbvalstu praks\u0113m publisk\u0101 iepirkuma jom\u0101 Latvijai ir rekomend\u0113jusi ieviest gada iepirkumu pl\u0101nu publisko\u0161anas pras\u012bbu. LIKTA diskusiju par \u0161o jaut\u0101jumu inici\u0113ja jau likumprojekta izstr\u0101des darba grup\u0101 Finan\u0161u ministrij\u0101, tom\u0113r priek\u0161likums atbalstu neguva. Saska\u0146\u0101 ar EK veikto p\u0113t\u012bjumu par publisko iepirkumu regul\u0113juma piem\u0113ro\u0161anu IT jom\u0101 Latvij\u0101 IT iepirkumos (analiz\u0113ti programmat\u016bras iepirkumi 2011.\u00a0\u2013 2015.\u00a0g.) viens pretendents ir bijis 46% (ES vid\u0113ji\u00a0\u2013 32%) iepirkumu proced\u016bru. Min\u0113t\u0101 statistika liecina, ka past\u0101v konkurenci neveicino\u0161i faktori\u00a0\u2013 to vid\u016b ar\u012b nezi\u0146a, vai pas\u016bt\u012bt\u0101js paredz\u0113jis veikt regul\u0101rus iepirkumus vai vair\u0101kus atsevi\u0161\u0137us iepirkumus par l\u012bdz\u012bgu iepirkuma priek\u0161metu. Atsevi\u0161\u0137u publik\u0101ciju gad\u012bjum\u0101, neredzot kopainu, tirgus dal\u012bbniekiem nav iesp\u0113jams objekt\u012bvi nov\u0113rt\u0113t savu ekonomisko ieinteres\u0113t\u012bbu.<\/p>\n<p>Latvij\u0101 80% iepirkumu tiek piem\u0113rots zem\u0101k\u0101s cenas krit\u0113rijs. Past\u0101v pamatotas \u0161aubas, vai pla\u0161a pas\u016bt\u012bt\u0101ja izv\u0113les br\u012bv\u012bba*, izlemjot, vai piem\u0113rot tikai zem\u0101k\u0101s cenas krit\u0113riju, veicin\u0101s kvalitat\u012bv\u0101ku pakalpojumu un b\u016bvdarbu, t.\u00a0sk. IKT jom\u0101, iepirk\u0161anu. LIKTA un Latvijas Tirdzniec\u012bbas un r\u016bpniec\u012bbas kamera (LTRK) ir rosin\u0101ju\u0161as ties\u012bbas piem\u0113rot tikai zem\u0101k\u0101s cenas krit\u0113riju tikai publisku pieg\u0101\u017eu gad\u012bjum\u0101, ja ir izstr\u0101d\u0101ta detaliz\u0113ta tehnisk\u0101 specifik\u0101cija un citiem krit\u0113rijiem ir neb\u016btiska noz\u012bme pied\u0101v\u0101juma izv\u0113l\u0113.<\/p>\n<p>Lai sekm\u0113tu efekt\u012bv\u0101ku saimniecisk\u0101 izdev\u012bguma krit\u0113riju izmanto\u0161anu, LIKTA pa\u0161laik pilnveido savus priek\u0161likumus Iepirkumu uzraudz\u012bbas biroja &#8220;Saimnieciski visizdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma izv\u0113les krit\u0113riju piem\u0113ro\u0161anas publiskajos iepirkumos&#8221; vadl\u012bniju aktualiz\u0113\u0161anai.<\/p>\n<p>P\u0113c LIKTA un LTRK aicin\u0101juma, k\u0101 ar\u012b rea\u0123\u0113jot uz inform\u0101ciju, ka pas\u016bt\u012bt\u0101ji nav p\u0101rliecin\u0101ti, vai likums to at\u013cauj, likumprojekt\u0101 ir skaidri noteiktas pas\u016bt\u012bt\u0101ja ties\u012bbas iepirkuma l\u012bguma sagatavo\u0161an\u0101 izmantot nozaru ekspertu vai organiz\u0101ciju izstr\u0101d\u0101tas vadl\u012bnijas iepirkumu veik\u0161anai un l\u012bgumu sl\u0113g\u0161anai, k\u0101 ar\u012b standartl\u012bgumus.
