Direkt\u012bv\u0101s paredz\u0113ts, piem\u0113ram, samazin\u0101t slogu mazajiem un vid\u0113jiem uz\u0146\u0113mumiem, noteikt saimnieciski visizdev\u012bg\u0101ko pied\u0101v\u0101jumu k\u0101 pamata krit\u0113riju uzvar\u0113t\u0101ja noteik\u0161anai, \u0146emt v\u0113r\u0101 energoefektivit\u0101tes r\u0101d\u012bt\u0101jus un dz\u012bves cikla izmaksas, ieviest iepirkumu veik\u0161anu elektroniski, k\u0101 ar\u012b padar\u012bt elast\u012bg\u0101kas iepirkuma proced\u016bras. Dal\u012bbvalst\u012bm bija pien\u0101kums direkt\u012bvu pras\u012bbas ieviest nacion\u0101laj\u0101 regul\u0113jum\u0101 l\u012bdz 2016.\u00a0gada 18.\u00a0apr\u012blim.<\/p>\n<p>Latvij\u0101 vair\u0101kas jauno direkt\u012bvu pras\u012bbas tika ieviestas nacion\u0101laj\u0101 regul\u0113jum\u0101 jau iepriek\u0161, ta\u010du citu groz\u012bjumu veik\u0161ana kav\u0113j\u0101s saist\u012bb\u0101 ar jauna Publisko iepirkumu likuma (PIL) un Sabiedrisko pakalpojumu sniedz\u0113ju iepirkuma likuma (SPSIL) izstr\u0101di un saska\u0146o\u0161anu. Publiskaj\u0101 telp\u0101 saist\u012bb\u0101 ar kav\u0113\u0161anos pat izskan\u0113ja aicin\u0101jums pas\u016bt\u012bt\u0101jiem attur\u0113ties no jaunu iepirkumu izsludin\u0101\u0161anas, lai tie nenon\u0101k pretrun\u0101 ar jauno direkt\u012bvu pras\u012bb\u0101m. Lai nov\u0113rstu \u0161o probl\u0113mu, Saeima 2016.\u00a0gada 12.\u00a0maij\u0101 pie\u0146\u0113ma likumu groz\u012bjumus, kas st\u0101j\u0101s sp\u0113k\u0101 20.\u00a0maij\u0101. Jaunais regul\u0113jums paredz vair\u0101kas izmai\u0146as PIL un SPSIL regul\u0113jum\u0101.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Izmai\u0146as kandid\u0101tu izsl\u0113g\u0161anas nosac\u012bjumos<\/font><\/strong><\/p>\n<p>L\u012bdz\u0161in\u0113j\u0101 k\u0101rt\u012bba paredz\u0113ja, ka kandid\u0101tam nedr\u012bkst\u0113ja b\u016bt nodok\u013cu par\u0101di br\u012bd\u012b, kad iepirkums tika izsludin\u0101ts vai tika pie\u0146emts l\u0113mums par t\u0101 uzs\u0101k\u0161anu. Jaunais PIL regul\u0113jums noteic, ka pied\u0101v\u0101jums netiek izskat\u012bts, ja nodok\u013cu par\u0101ds, kas p\u0101rsniedz 150 eiro, bijis pied\u0101v\u0101jumu iesnieg\u0161anas termi\u0146a p\u0113d\u0113j\u0101 dien\u0101. Nemain\u012bgs paliek nosac\u012bjums, ka l\u012bgums netiek sl\u0113gts ar pretendentu, kam b\u016btu pie\u0161\u0137iramas l\u012bguma sl\u0113g\u0161anas ties\u012bbas, ja l\u0113muma pie\u0146em\u0161anas dien\u0101 tam ir nodok\u013cu par\u0101ds, kas p\u0101rsniedz 150 eiro. Min\u0113t\u0101 k\u0101rt\u012bba dos iesp\u0113ju pier\u0101d\u012bt nodok\u013cu par\u0101du neesam\u012bbu kandid\u0101tiem, kuriem datub\u0101ze uzr\u0101da nodok\u013cu par\u0101du iepirkuma izsludin\u0101\u0161anas dien\u0101. <\/p>\n<p>T\u0101pat tiek papildin\u0101ti izsl\u0113g\u0161anas nosac\u012bjumi attiec\u012bb\u0101 uz kandid\u0101ta vai pretendenta valdes un padomes locek\u013ciem, prok\u016bristiem un fili\u0101les pilnvarotaj\u0101m person\u0101m, papildinot noziedz\u012bgu nodar\u012bjumu uzskait\u012bjumu ar 1) prettiesiska labuma piepras\u012b\u0161anu, pie\u0146em\u0161anu un do\u0161anu, tirgo\u0161anos ar ietekmi un 2) cilv\u0113ku tirdzniec\u012bbu.<br \/>\n<!--more--><br \/>\nVienlaikus tiek ieviests jauns instruments\u00a0\u2013 pieg\u0101d\u0101t\u0101ju uzticam\u012bbas atjauno\u0161ana. Proti, ja kandid\u0101ts atbilst k\u0101dam no PIL 39.<sup>1<\/sup>\u00a0panta pirm\u0101s da\u013cas 1., 2., 3., 4., 6. vai 7.\u00a0punkt\u0101 min\u0113tajiem izsl\u0113g\u0161anas gad\u012bjumiem, tas kop\u0101 ar pieteikumu iesniedz skaidrojumu un pier\u0101d\u012bjumus par savu labo\u0161anos (kait\u0113juma atl\u012bdzin\u0101\u0161anu, sadarbo\u0161anos ar izmekl\u0113\u0161anas iest\u0101d\u0113m un veiktajiem tehniskajiem, organizatoriskajiem vai person\u0101lvad\u012bbas pas\u0101kumiem), lai pier\u0101d\u012btu savu uzticam\u012bbu un nov\u0113rstu t\u0101du pa\u0161u un l\u012bdz\u012bgu gad\u012bjumu atk\u0101rto\u0161anos n\u0101kotn\u0113. Ja pas\u016bt\u012bt\u0101js veiktos pas\u0101kumus uzskata par pietiekamiem, tas neizsl\u0113dz kandid\u0101tu no dal\u012bbas iepirkum\u0101. Pas\u016bt\u012bt\u0101jam ir ar\u012b ties\u012bbas l\u016bgt kompetentaj\u0101m iest\u0101d\u0113m atzinumus par veikto pas\u0101kumu pietiekam\u012bbu uzticam\u012bbas atjauno\u0161anai.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Eiropas vienotais iepirkumu proced\u016bras dokuments<\/font><\/strong><\/p>\n<p>Pied\u0101v\u0101jumu iesnieg\u0161ana turpm\u0101k b\u016bs vienk\u0101r\u0161\u0101ka, jo PIL un SPSIL paredz, ka pas\u016bt\u012bt\u0101js k\u0101 s\u0101kotn\u0113jo pier\u0101d\u012bjumu kandid\u0101ta atbilst\u012bbai pie\u0146em Eiropas vienoto iepirkuma proced\u016bras dokumentu.<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup> Paredz\u0113ts, ka ori\u0123in\u0101lie dokumenti savas atbilst\u012bbas pier\u0101d\u012b\u0161anai b\u016bs j\u0101iesniedz vien\u012bgi pretendentam, kas b\u016bs atz\u012bts par potenci\u0101lo uzvar\u0113t\u0101ju. Vienlaikus pas\u016bt\u012bt\u0101jam tiek paredz\u0113tas ties\u012bbas jebkur\u0101 iepirkuma proced\u016bras stadij\u0101 pras\u012bt, lai kandid\u0101ts iesniedz visus dokumentus vai da\u013cu no tiem, kas apliecina kandid\u0101ta atbilst\u012bbu nolikuma pras\u012bb\u0101m. Pas\u016bt\u012bt\u0101jam gan ir liegts piepras\u012bt t\u0101dus dokumentus un inform\u0101ciju, kas ir pieejama publisk\u0101s datub\u0101z\u0113s. P\u0113c b\u016bt\u012bbas \u0161is vienotais dokuments ir kandid\u0101ta pieteikuma anketa, kas uz\u0146\u0113m\u0113jiem atvieglos pied\u0101v\u0101jumu iesnieg\u0161anu iepirkumos, k\u0101 ar\u012b dal\u012bbu citu valstu iepirkumos, \u0146emot v\u0113r\u0101, ka \u0161is dokuments ir vienots vis\u0101m dal\u012bbvalst\u012bm.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Izmai\u0146as B da\u013cas pakalpojumos<\/font><\/strong><\/p>\n<p>Jaun\u0101s direkt\u012bvas groza to pakalpojumu sarakstu, kam piem\u0113rojama atvieglota iepirkuma veik\u0161anas k\u0101rt\u012bba jeb t\u0101 saucamajiem B da\u013cas pakalpojumiem. \u0160ie pakalpojumi tiek uzskait\u012bti PIL un SPSIL 2.\u00a0pielikum\u0101 &#8220;Soci\u0101lie un citi \u012bpa\u0161i pakalpojumi&#8221;. B\u016bt\u012bb\u0101 ar groz\u012bjumiem no saraksta tiek izsl\u0113gta virkne l\u012bdz \u0161im taj\u0101 ietverto pakalpojumu, ta\u010du vienlaikus pa\u0161laik netiek main\u012bta iepirkumu veik\u0161anas k\u0101rt\u012bba tiem pakalpojumiem, kas ir nor\u0101d\u012bti PIL un SPSIL 2.\u00a0pielikum\u0101 un kuru paredzam\u0101 l\u012bgumcena ir maz\u0101ka par 750\u00a0000\u00a0eiro.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Citas izmai\u0146as<\/font><\/strong><\/p>\n<p>Groz\u012bjumi paredz ar\u012b vair\u0101kus citus jaunumus. Turpm\u0101k PIL intere\u0161u konflikta aizliegums tiek attiecin\u0101ts ne tikai uz iepirkumu komisijas locek\u013ciem un ekspertiem, bet ar\u012b iepirkumu dokument\u0101cijas sagatavot\u0101ju. Savuk\u0101rt iepirkumos, kas tiek veikti SPSIL k\u0101rt\u012bb\u0101, komisijas locek\u013ci netiks uzskat\u012bti par valsts amatperson\u0101m likuma &#8220;Par intere\u0161u konflikta nov\u0113r\u0161anu valsts amatpersonu darb\u012bb\u0101&#8221; izpratn\u0113.<\/p>\n<p>Gad\u012bjumos, kad apak\u0161uz\u0146\u0113m\u0113js, kura paredz\u0113to darbu vai sniedzamo pakalpojumu v\u0113rt\u012bba ir vismaz 20% no l\u012bguma v\u0113rt\u012bbas, vai persona, uz kura sp\u0113j\u0101m kandid\u0101ts balst\u0101s, neatbilst PIL un SPSIL izsl\u0113g\u0161anas nosac\u012bjumiem, pas\u016bt\u012bt\u0101js piepras\u012bs pretendentam nomain\u012bt \u0161o personu pret atbilsto\u0161u. Ja pretendents to neizdar\u012bs 10 darbdienu laik\u0101, tad pas\u016bt\u012bt\u0101js izsl\u0113gs pretendentu no dal\u012bbas iepirkum\u0101.<\/p>\n<p>Turpm\u0101k tiek noteikts ierobe\u017eojums pras\u012bbai p\u0113c finan\u0161u apgroz\u012bjuma apm\u0113ra kandid\u0101tam. Proti, pas\u016bt\u012bt\u0101js gada minim\u0101lo finan\u0161u apgroz\u012bjumu var noteikt ne liel\u0101ku par div\u0101m paredzamo l\u012bgumcenu v\u0113rt\u012bb\u0101m. Iz\u0146\u0113muma gad\u012bjumos, kad pas\u016bt\u012bt\u0101js to \u012bpa\u0161i pamato, apgroz\u012bjuma pras\u012bbu var paredz\u0113t liel\u0101ku, ja iepirkuma l\u012bguma izpilde ir saist\u012bta ar \u012bpa\u0161iem riskiem taj\u0101 paredz\u0113to darbu rakstura d\u0113\u013c.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">P\u0113c k\u0101 j\u0101vad\u0101s iepirkumos, kas uzs\u0101kti l\u012bdz 19.\u00a0maijam<\/font><\/strong><\/p>\n<p>PIL un SPSIL P\u0101rejas noteikumos paredz\u0113ts, ka iepirkuma proced\u016bras, kas uzs\u0101ktas l\u012bdz 19.\u00a0maijam, tiek turpin\u0101tas saska\u0146\u0101 ar regul\u0113jumu, kas bija sp\u0113k\u0101 attiec\u012bg\u0101 iepirkuma izsludin\u0101\u0161anas dien\u0101. Vienlaikus, lai p\u0113c 18.\u00a0apr\u012b\u013ca s\u0101ktie iepirkumi, kas p\u0101rsniedz ES iepirkumu robe\u017ev\u0113rt\u012bbas (vismaz 5\u00a0225\u00a0000 eiro b\u016bvdarbu l\u012bgumiem un 135\u00a0000\u00a0eiro PIL iepirkumos vai 418\u00a0000 eiro SPSIL iepirkumos pieg\u0101des un pakalpojumu l\u012bgumiem), neb\u016btu pretrun\u0101 direkt\u012bvai, atsevi\u0161\u0137as PIL un SPSIL groz\u012bjumu normas ir j\u0101piem\u0113ro ar\u012b \u0161\u0101d\u0101m iepirkumu proced\u016br\u0101m.<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup> Tas nepiecie\u0161ams, lai nodro\u0161in\u0101tu \u0161\u0101du iepirkumu atbilst\u012bbu jaunaj\u0101m direkt\u012bv\u0101m, it \u012bpa\u0161i, ja iepirkumi ir saist\u012bti ar ES fondu l\u012bdzek\u013cu izmanto\u0161anu.<\/p>\n<p>Apskat\u012btie PIL un SPSIL groz\u012bjumi neievie\u0161 kardin\u0101las p\u0101rmai\u0146as iepirkumu jom\u0101, ta\u010du jauno pras\u012bbu pareiza piem\u0113ro\u0161ana var b\u016bt b\u016btiska iepirkumu sist\u0113mas uzlabo\u0161anai. Direkt\u012bvas paredz v\u0113l vair\u0101kus jaunin\u0101jumus iepirkumos, piem\u0113ram, jaunas iepirkumu proced\u016bras un \u012bs\u0101kus iepirkumu veik\u0161anas termi\u0146us, pre\u010du dz\u012bves cikla izmaksu \u0146em\u0161anu v\u0113r\u0101 un saimnieciski izdev\u012bg\u0101k\u0101 krit\u0113rija izmanto\u0161anu uzvar\u0113t\u0101ja noteik\u0161anai, za\u013co iepirkumu un energoefektivit\u0101tes r\u0101d\u012bt\u0101ju izmanto\u0161anu. <\/p>\n<p>T\u0101pat direkt\u012bvas paredz veicin\u0101t iepirkumu sadal\u012b\u0161anu lot\u0113s (da\u013c\u0101s), lai veicin\u0101tu mazo un vid\u0113jo uz\u0146\u0113mumu sp\u0113ju piedal\u012bties iepirkumos un izpild\u012bt \u0161\u0101das l\u012bgumu da\u013cas.
