No vienas puses, tai ir prevent\u012bva noz\u012bme, lai nodro\u0161in\u0101tu, ka iepirkuma proced\u016br\u0101 nepiedal\u0101s &#8220;uztic\u012bbu&#8221; zaud\u0113ju\u0161ie pretendenti, t\u0101d\u0113j\u0101di vienlaikus samazinot pas\u016bt\u012bt\u0101ja iesp\u0113jamo zaud\u0113jumu risku konkr\u0113t\u0101s iepirkuma proced\u016bras ietvaros. No pla\u0161\u0101ka pretendentu loka dal\u012bbas iepirkumu proced\u016br\u0101s ieguv\u0113ji ir gan pas\u016bt\u012bt\u0101ji, gan sabiedr\u012bba kopum\u0101, jo pas\u016bt\u012bt\u0101jiem ir pla\u0161\u0101kas iesp\u0113jas izv\u0113l\u0113ties visizdev\u012bg\u0101ko pied\u0101v\u0101jumu par iesp\u0113jami zem\u0101ko cenu, t\u0101d\u0113j\u0101di ietaupot ar\u012b nodok\u013cu maks\u0101t\u0101ju l\u012bdzek\u013cus. <\/p>\n<p>L\u012bdz ar to, pie\u0146emot jauno Direkt\u012bvu 2014\/24\/ES, ES likumdev\u0113js ir izv\u0113l\u0113jies dot iesp\u0113ju publiskajos iepirkumos piedal\u012bties ar\u012b tiem pretendentiem, kuriem iepriek\u0161 \u0161\u0101das ties\u012bbas bija liegtas, ar nosac\u012bjumu, ja tie sp\u0113j pier\u0101d\u012bt, ka ir veiku\u0161i nepiecie\u0161amos pas\u0101kumus, lai atjaunotu savu uzticam\u012bbu un nov\u0113rstu t\u0101du pa\u0161u vai l\u012bdz\u012bgu gad\u012bjumu atk\u0101rto\u0161anos n\u0101kotn\u0113.<\/p>\n<p><strong><font size=\"3\" color=\"#2d5986\">Kad past\u0101v pamats uzskat\u012bt, ka ir atjaunota pretendenta uzticam\u012bba? <\/font><\/strong><\/p>\n<p>Direkt\u012bvas 2014\/24\/ES 57. panta sestaj\u0101 da\u013c\u0101 noteikts, ka ikviens pretendents, kas non\u0101cis k\u0101d\u0101 no situ\u0101cij\u0101m, kur\u0101s past\u0101v pamats t\u0101 izsl\u0113g\u0161anai no turpm\u0101kas dal\u012bbas iepirkuma proced\u016br\u0101, ir ties\u012bgs iesniegt pier\u0101d\u012bjumus par to, ka \u0161\u0101 pretendenta veiktie pas\u0101kumi ir pietiekami, lai pier\u0101d\u012btu savu uzticam\u012bbu, neraugoties uz to, ka past\u0101v attiec\u012bgs izsl\u0113g\u0161anas pamats. \u0160aj\u0101 zi\u0146\u0101 Publisko iepirkumu likuma 39.3 pant\u0101 paredz\u0113tais regul\u0113jums ir l\u012bdz\u012bgs, ta\u010du papildus tiek paredz\u0113ts, ka kandid\u0101tam, pretendentam vai person\u0101lsabiedr\u012bbas biedram \u0161\u0101ds skaidrojums un pier\u0101d\u012bjumi ir j\u0101iesniedz uzreiz kop\u0101 ar pieteikumu vai pied\u0101v\u0101jumu. <\/p>\n<p>Rodas jaut\u0101jums \u2013 k\u0101dos apst\u0101k\u013cos b\u016btu pamats uzskat\u012bt, ka ir atjaunota pretendenta uzticam\u012bba un t\u0101d\u0113j\u0101di pretendents nav izsl\u0113dzams no dal\u012bbas iepirkum\u0101?
