Finan\u0161u ministrija ir sagatavojusi jauno normat\u012bvo aktu s\u0101kotn\u0113jos projektus, ta\u010du ir skaidrs, ka past\u0101v virkne jaut\u0101jumu, kuriem b\u016bs nepiecie\u0161ams detaliz\u0113t\u0101ks regul\u0113jums. \u0160aj\u0101 sakar\u0101 ir lietder\u012bgi iel\u016bkoties atsevi\u0161\u0137\u0101s Eiropas Komisijas un Eiropas Savien\u012bbas Tiesas (EST) nor\u0101d\u0113s, lai apsv\u0113rtu jaut\u0101jumus, par kuriem b\u016btu nepiecie\u0161ama pla\u0161\u0101ka diskusija.<\/p>\n<p>K\u0101d\u0101 no turpm\u0101kajiem \u017eurn\u0101la numuriem pl\u0101nojam apl\u016bkot citu ES dal\u012bbvalstu pirmo pieredzi saist\u012bb\u0101 ar \u0161o ES direkt\u012bvu p\u0101r\u0146em\u0161anu. Savuk\u0101rt \u0161aj\u0101 rakst\u0101 s\u012bk\u0101k apl\u016bkosim Eiropas Savien\u012bbas instit\u016bciju \u2013 Eiropas Komisijas un EST \u2013 sniegt\u0101s nor\u0101des, kas \u0161o procesu var sekm\u0113t.<\/p>\n<p><strong><font size=\"4\" color=\"#2d5986\">Eiropas Komisijas sagatavotais &#8220;lakmusa pap\u012brs&#8221;<\/font><\/strong><\/p>\n<p>Aizvad\u012bt\u0101 gada nogal\u0113 Eiropas Komisija ir public\u0113jusi publisko iepirkumu efektivit\u0101tes r\u0101d\u012bt\u0101ju apkopojumu par 2014. gadu (Single Market Scoreboard. Public Procurement), kur\u0101 ES dal\u012bbvalstis ir savstarp\u0113ji sal\u012bdzin\u0101tas p\u0113c r\u0101d\u012bt\u0101jiem, kuri atspogu\u013co to, cik liel\u0101 m\u0113r\u0101 pas\u016bt\u012bt\u0101ji, veicot iepirkumus, ieg\u016bst augst\u0101ku ieguld\u012bjumam atbilsto\u0161u v\u0113rt\u012bbu (value for money). K\u0101 zin\u0101ms, atbilsto\u0161i Publisko iepirkumu likumam viens no publisk\u0101 iepirkumu proced\u016bru m\u0113r\u0137iem ir nodro\u0161in\u0101t valsts un pa\u0161vald\u012bbu l\u012bdzek\u013cu efekt\u012bvu izmanto\u0161anu. T\u0101p\u0113c min\u0113tais apkopojums ir izmantojams, lai izdar\u012btu secin\u0101jumus, cik efekt\u012bvi valstij ir izdevies sasniegt \u0161o izvirz\u012bto m\u0113r\u0137i.<br \/>\n<!--more--><\/p>\n<p>Diem\u017e\u0113l j\u0101atz\u012bst, ka \u0161\u012b apkopojuma rezult\u0101ti Latvijai nav glaimojo\u0161i, jo taj\u0101 secin\u0101ts, ka Latvijas sniegums kopum\u0101 ir bijis neapmierino\u0161s.<\/p>\n<p>At\u0161\u0137ir\u012bb\u0101 no l\u012bdz\u012bgiem apkopojumiem, kas veikti iepriek\u0161\u0113jos gados un kuros \u0146emts v\u0113r\u0101 un sal\u012bdzin\u0101ts ES dal\u012bbvalstu sniegums tr\u012bs poz\u012bcij\u0101s, Eiropas Komisijas apkopojum\u0101 par 2014. gadu ir v\u0113rt\u0113ti se\u0161i atsevi\u0161\u0137i krit\u0113riji. Proti, ir v\u0113rt\u0113ts tas, (1) cik bie\u017ei iepirkuma proced\u016br\u0101s l\u012bgumsl\u0113g\u0161anas ties\u012bbas ir pie\u0161\u0137irtas vien\u012bgajam pretendentam, kur\u0161 taj\u0101s piedal\u012bjies, (2) k\u0101da ir to iepirkumu proporcija, kur\u0101s l\u012bgumi ir sl\u0113gti, neizsludinot iepirkuma proced\u016bru, (3) cik bie\u017ei iepirkuma proced\u016bra izsludin\u0101ta kop\u012bgi vair\u0101ku pas\u016bt\u012bt\u0101ju vajadz\u012bb\u0101m, (4) k\u0101ds ir to iepirkumu proced\u016bru \u012bpatsvars, kur\u0101s pied\u0101v\u0101juma izv\u0113les krit\u0113rijs ir zem\u0101k\u0101 cena, (5) k\u0101d\u0101 termi\u0146\u0101 pas\u016bt\u012bt\u0101ji pie\u0146em l\u0113mumu par iepirkuma proced\u016bras rezult\u0101tiem, k\u0101 ar\u012b (6) cik kvalitat\u012bvi (pla\u0161i) ir pas\u016bt\u012bt\u0101ju public\u0113tie pazi\u0146ojumi par iepirkumu proced\u016br\u0101m. Lai gan Eiropas Komisijas apkopojum\u0101 ir \u0146emti v\u0113r\u0101 tikai \u0161ie atsevi\u0161\u0137i izraudz\u012btie krit\u0113riji, nev\u0113rt\u0113jot t\u0101dus aspektus k\u0101, piem\u0113ram, iepirkuma proced\u016bru administrat\u012bvais slogs, korupcijas riski taj\u0101s, pas\u016bt\u012bt\u0101ja piesaist\u012bt\u0101 person\u0101la kvalifik\u0101cija u.c., tom\u0113r ar\u012b \u0161ie dati ir uzskat\u0101mi par pietiekami reprezentat\u012bviem, lai no tiem var\u0113tu izdar\u012bt da\u017eus secin\u0101jumus.<\/p>\n<p>Proti, zem\u0101kais v\u0113rt\u0113jums Latvijai sal\u012bdzin\u0101jum\u0101 ar p\u0101r\u0113j\u0101m ES dal\u012bbvalst\u012bm ir t\u0101dos b\u016btiskos iepirkuma proced\u016bru efektivit\u0101tes r\u0101d\u012bt\u0101jos k\u0101 (1) iepirkuma proced\u016bru \u012bpatsvars, kur\u0101s piedal\u012bjies tikai viens pretendents, (2) sal\u012bdzino\u0161i augst\u0101 to l\u012bgumu proporcija, kas nosl\u0113gti, neizsludinot iepirkuma proced\u016bras, k\u0101 ar\u012b (3) sam\u0113r\u0101 lielais iepirkuma proced\u016bru skaits, kur\u0101s l\u012bgumsl\u0113g\u0161anas ties\u012bbas pie\u0161\u0137irtas, izraugoties pied\u0101v\u0101jumu ar zem\u0101ko cenu. Min\u0113tais \u013cauj secin\u0101t, ka Latvij\u0101 r\u012bkotaj\u0101s iepirkumu proced\u016br\u0101s nereti nepietiekami tiek nodro\u0161in\u0101ta pieg\u0101d\u0101t\u0101ju br\u012bva konkurence, netiek iev\u0113rots iepirkuma proced\u016bru atkl\u0101tums, k\u0101 ar\u012b publiskais sektors p\u0101r\u0101k bie\u017ei izv\u0113las pied\u0101v\u0101jumus atbilsto\u0161i pretendentu pied\u0101v\u0101tajai zem\u0101kajai cenai, t\u0101d\u0113j\u0101di \u0161\u012b iepirkuma rezult\u0101t\u0101 neg\u016bstot maksim\u0101lo labumu (value for money). J\u0101atz\u012bst, ka par \u0161iem jaut\u0101jumiem ir daudz dzird\u0113ts un diskut\u0113ts, jo \u012bpa\u0161i no uz\u0146\u0113m\u0113ju puses, tom\u0113r \u0161obr\u012bd ir pieejami konkr\u0113ti dati, kas \u0161os nov\u0113rojumus pamato.<\/p>\n<p>No otras puses, p\u0101rm\u0113r\u012bgam satraukumam ar\u012b nav pamata, jo l\u012bdz\u012bgu neapmierino\u0161u v\u0113rt\u0113jumu ir ieguvu\u0161as v\u0113l vair\u0101k nek\u0101 desmit citas ES dal\u012bbvalstis, tai skait\u0101 Sp\u0101nija, It\u0101lija, ar\u012b \u2013 Igaunija un vair\u0101kas citas Austrumeiropas valstis. Vienlaikus ar\u012b j\u0101atz\u012bm\u0113, ka pati Eiropas Komisija ir atzinusi, \u0161is publisko iepirkumu efektivit\u0101tes r\u0101d\u012bt\u0101ju apkopojums ir pietiekami vienk\u0101r\u0161ots un visp\u0101r\u012bgs, tom\u0113r tas uzskat\u0101mi \u013cauj sal\u012bdzin\u0101t situ\u0101ciju ES dal\u012bbvalst\u012bs un demonstr\u0113 &#8220;pacientu vid\u0113jo temperat\u016bru pal\u0101t\u0101&#8221;.<\/p>\n<p>To, vai vald\u012bba no \u0161\u012b Eiropas Komisijas apkopojuma izdar\u012bs k\u0101dus secin\u0101jumus, r\u0101d\u012bs laiks. J\u0101nov\u0113l sekmes \u0161o m\u0113r\u0137u \u012bsteno\u0161an\u0101!<\/p>\n<p>Vienlaikus j\u0101atz\u012bm\u0113, ka, turpinot \u017eurn\u0101la &#8220;Iepirkumi&#8221; iepriek\u0161\u0113j\u0101 numur\u0101<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup> aizs\u0101kto t\u0113mu par EST praksi saist\u012bb\u0101 ar aizliegumu pas\u016bt\u012bt\u0101jam izvirz\u012bt nepamatotas pras\u012bbas, ierobe\u017eojot pieg\u0101d\u0101t\u0101ju br\u012bvu un vienl\u012bdz\u012bgu dal\u012bbu iepirkumu proced\u016br\u0101s, 2016. gada 3. mart\u0101 ir public\u0113ti EST \u0123ener\u0101ladvok\u0101ta M.Vatel\u0113 secin\u0101jumi &#8220;Ambisig&#8221; liet\u0101 Nr.C-46\/15, kam gad\u012bjum\u0101, ja tiem v\u0113l\u0101k pievienosies ar\u012b EST, b\u016bs noz\u012bme, ievie\u0161ot jaun\u0101s 2014. gada ES publisko iepirkumu direkt\u012bvas.<\/p>\n<p>Konkr\u0113taj\u0101 liet\u0101 EST b\u016bs j\u0101skata jaut\u0101jums par pas\u016bt\u012bt\u0101ja ties\u012bb\u0101m izvirz\u012bt papildu pras\u012bbas pretendentiem attiec\u012bb\u0101 uz apliecin\u0101jumiem, kas iesniedzami, lai pier\u0101d\u012btu pretendentu tehnisk\u0101s un profesion\u0101l\u0101s sp\u0113jas. Proti, iepirkuma proced\u016bras nolikum\u0101 pas\u016bt\u012bt\u0101js ir noteicis pras\u012bbu pretendentiem iesniegt klienta deklar\u0101ciju, kas izdota uz apz\u012bmogotas uz\u0146\u0113muma veidlapas, kas apliecina, ka pretendents ir ieviesis vides p\u0101rvald\u012bbas un\/vai kvalit\u0101tes sist\u0113mu atbilsto\u0161i konkr\u0113tam iepirkuma dokument\u0101cijai pievienotas deklar\u0101cijas paraugam. Ta\u010du vienlaikus pas\u016bt\u012bt\u0101js nav \u0146\u0113mis v\u0113r\u0101, ka praks\u0113 var b\u016bt situ\u0101cijas, kad pretendentam nav iesp\u0113ju no tre\u0161\u0101s personas \u2013 sava iepriek\u0161\u0113j\u0101 klienta, kas nav publisko ties\u012bbu subjekts, \u2013 sa\u0146emt pas\u016bt\u012bt\u0101ja izvirz\u012btaj\u0101m specifiskaj\u0101m pras\u012bb\u0101m atbilsto\u0161u apliecin\u0101jumu, jo neviens normat\u012bvais akts nemaz neparedz klientam t\u0101du sagatavot un sniegt.<\/p>\n<p>Jaut\u0101jumus, kas attiecas uz pier\u0101d\u012bjumiem, ar kuriem pretendents var apliecin\u0101t savas tehnisk\u0101s un profesion\u0101l\u0101s sp\u0113jas, \u0161obr\u012bd regul\u0113 Eiropas Parlamenta un Padomes Direkt\u012bvas 2004\/18\/EK 48. panta 2. punkts, kas paredz \u0161o pier\u0101d\u012b\u0161anas l\u012bdzek\u013cu izsme\u013co\u0161u uzskait\u012bjumu un cita starp\u0101 noteic, ka pretendenta tehnisk\u0101s iesp\u0113jas var pier\u0101d\u012bt ar iepriek\u0161\u0113jos trijos gados veikto galveno pieg\u0101\u017eu vai sniegto pakalpojumu uzskait\u012bjumu, nor\u0101dot summas, realiz\u0101cijas laiku un sa\u0146\u0113m\u0113jus gan valsts, gan priv\u0101taj\u0101 sektor\u0101. Pieg\u0101\u017eu veik\u0161anu un pakalpojumu snieg\u0161anu pier\u0101da \u0161\u0101di: (i) ja sa\u0146\u0113m\u0113js ir l\u012bgumsl\u0113dz\u0113ja iest\u0101de \u2013 ar apliecin\u0101jumiem, kurus izsniegusi vai ar parakstu apstiprin\u0101jusi attiec\u012bg\u0101 kompetent\u0101 iest\u0101de, bet (ii) ja sa\u0146\u0113m\u0113js bijis priv\u0101ts pirc\u0113js \u2013 ar \u0161\u012b pirc\u0113ja apliecin\u0101jumu vai, ja t\u0101da nav, ar pa\u0161a pretendenta sniegtu apliecin\u0101jumu (deklar\u0101ciju).
