T\u0101 mums k\u0101 Eiropas Savien\u012bbas (ES) dal\u012bbvalstij ir j\u0101p\u0101r\u0146em sav\u0101 tiesiskaj\u0101 regul\u0113jum\u0101. Provizoriskais jaun\u0101 PIL pie\u0146em\u0161anas laiks ir \u0161\u0101 gada apr\u012blis. Uzreiz j\u0101saka, ka jau ar eso\u0161o regul\u0113jumu esam g\u0101ju\u0161i roku rok\u0101 ar jaun\u0101kaj\u0101m ES tiesas atzi\u0146\u0101m, kas ir nostiprin\u0101tas ar Direkt\u012bvas 2014\/24\/ES norm\u0101m. T\u0101p\u0113c liela da\u013ca jaun\u0101 PIL nosac\u012bjumu paredz\u0113ti t\u0101di pa\u0161i k\u0101 eso\u0161aj\u0101 regul\u0113jum\u0101, tie nav kardin\u0101li at\u0161\u0137ir\u012bgi. Tom\u0113r gaid\u0101mas ar\u012b vair\u0101kas noz\u012bm\u012bgas at\u0161\u0137ir\u012bbas, kas nes\u012bs p\u0101rmai\u0146as iepirkuma proced\u016br\u0101s gan pas\u016bt\u012bt\u0101jiem, gan pieg\u0101d\u0101t\u0101jiem. <\/p>\n<p>Viena no probl\u0113m\u0101m, ar ko iepirkumos ir j\u0101saskaras pas\u016bt\u012bt\u0101jiem, ir ierobe\u017eota iesp\u0113ja sliktas reput\u0101cijas d\u0113\u013c izsl\u0113gt pieg\u0101d\u0101t\u0101ju no iepirkuma proced\u016bras. Tom\u0113r reput\u0101cija nav viennoz\u012bm\u012bgi p\u0101rbaud\u0101ms nosac\u012bjums. T\u0101p\u0113c jaunais regul\u0113jums paredz to, ka pas\u016bt\u012bt\u0101js var\u0113s izsl\u0113gt no iepirkuma proced\u016bras pretendentu, ja kompetent\u0101s iest\u0101des b\u016bs konstat\u0113ju\u0161as, ka \u0161is uz\u0146\u0113m\u0113js ir veicis nopietnus administrat\u012bvus p\u0101rk\u0101pumus sav\u0101 nozar\u0113. Piem\u0113ram, veicis b\u016btiskus darba ties\u012bbu, darba dro\u0161\u012bbas, autorties\u012bbu vai citus p\u0101rk\u0101pumus. Lai ar\u012b \u0161is nosac\u012bjums neb\u016bs oblig\u0101ts visos gad\u012bjumos, pas\u016bt\u012bt\u0101ja zi\u0146\u0101 b\u016bs tas, vai \u0161o krit\u0113riju ietvert nolikum\u0101 vai ne. <\/p>\n<p>T\u0101pat b\u016bs iesp\u0113ja izsl\u0113gt no iepirkuma proced\u016bras pretendentu, kur\u0161 jau iepriek\u0161 nav pild\u012bjis iepirkuma l\u012bguma nosac\u012bjumus pie \u0161\u012b pa\u0161a pas\u016bt\u012bt\u0101ja, un tamd\u0113\u013c pas\u016bt\u012bt\u0101js ir vienpus\u0113ji atk\u0101pies no iepirkuma l\u012bguma, vai ar\u012b nav pild\u012bjis iepirkuma l\u012bgumu pie cita pas\u016bt\u012bt\u0101ja, bet tikai gad\u012bjum\u0101, ja ar tiesas spriedumu ir atz\u012bta uz\u0146\u0113m\u0113ja vaina l\u012bguma neizpild\u0113. Jaunais regul\u0113jums paredz, ka tas b\u016bs attiecin\u0101ms tikai uz pre\u010du pieg\u0101d\u0113m un ar\u012b tikai gad\u012bjum\u0101, kad citiem faktoriem (piem\u0113ram, pieg\u0101des veidam, ekspluat\u0101cijas izmaks\u0101m, uzst\u0101d\u012b\u0161anai utt.) k\u0101 vien\u012bgi cenai nav b\u016btiskas noz\u012bmes. P\u0101r\u0113jos iepirkumos pas\u016bt\u012bt\u0101jam b\u016bs j\u0101izv\u0113rt\u0113, kura pretendenta pied\u0101v\u0101jums ir saimnieciski izdev\u012bg\u0101kais. Liel\u0101 m\u0113r\u0101 tas ir solis pret\u012b kvalitat\u012bv\u0101kam un resursu zi\u0146\u0101 efekt\u012bv\u0101kam rezult\u0101tam. <\/p>\n<p>Nav nosl\u0113pums, ka iepirkuma proced\u016bras reiz\u0113m ir smagn\u0113jas un laikietilp\u012bgas, it \u012bpa\u0161i gad\u012bjumos, kad pas\u016bt\u012bt\u0101jam nepiecie\u0161ams operat\u012bvi atrisin\u0101t k\u0101du jaut\u0101jumu. Tom\u0113r j\u0101atceras, ka PIL nav tas normat\u012bvais akts, kam b\u016btu j\u0101risina probl\u0113mjaut\u0101jumi, kas prim\u0101ri b\u016btu j\u0101k\u0101rto b\u016bvniec\u012bbas vai citu jomu ties\u012bbu aktu ietvaros. <\/p>\n<p>Tuv\u0101kaj\u0101 laik\u0101 tiks organiz\u0113ta likumprojekta &#8220;Publisko iepirkumu likums&#8221; izstr\u0101d\u0113 iesaist\u012bt\u0101s darba grupas san\u0101ksme, taj\u0101 tiks apspriesti iesniegtie iebildumi un priek\u0161likumi, t\u0101l\u0101k jau sekos saska\u0146o\u0161ana atbilsto\u0161i Ministru kabineta k\u0101rt\u012bbas rullim.  <\/p>\n<p>Lai ar\u012b jaunais PIL regul\u0113jums daudzus iepirkumu aspektus padar\u012bs saprotam\u0101kus, j\u0101atceras, ka tikai ide\u0101lu scen\u0101riju nekad neb\u016bs. Pas\u016bt\u012bt\u0101js vienm\u0113r ir atbild\u012bgs par to, cik r\u016bp\u012bgi veicis iepirkuma priek\u0161izp\u0113ti, cik prec\u012bzi defin\u0113jis krit\u0113rijus, k\u0101 izv\u0113l\u0113jies izpild\u012bt\u0101ju, k\u0101 seko l\u012bguma izpildei un vai r\u012bkojas k\u0101 atbild\u012bgs un r\u016bp\u012bgs saimnieks.
