Neraugoties uz vair\u0101kiem Iepirkumu uzraudz\u012bbas biroja l\u0113mumiem, k\u0101 ar\u012b Augst\u0101k\u0101s tiesas 2014. gada 9. maija spriedumu liet\u0101 SKA-287\/2014, kur\u0101 risin\u0101ti ar Publisko iepirkumu likuma 41. panta tre\u0161\u0101s da\u013cas un 42. panta tre\u0161\u0101s da\u013cas piem\u0113ro\u0161anu saist\u012bti jaut\u0101jumi, praks\u0113 \u0161aj\u0101 sakar\u0101 joproj\u0101m past\u0101v daudz neskaidr\u012bbu, jo \u012bpa\u0161i attiec\u012bb\u0101 uz pier\u0101d\u012bjumiem, k\u0101dus pas\u016bt\u012bt\u0101js ir ties\u012bgs piepras\u012bt no pieg\u0101d\u0101t\u0101ja, lai p\u0101rliecin\u0101tos, ka pieg\u0101d\u0101t\u0101ja r\u012bc\u012bb\u0101 b\u016bs iepirkuma l\u012bguma izpildei nepiecie\u0161amie resursi, uz kuriem tas balst\u012bjies, iesniedzot pied\u0101v\u0101jumu.<\/p>\n<p>EST spriedums SIA &#8220;Ostas celtnieks&#8221; liet\u0101 sniedz b\u016btiskas atzi\u0146as, kas liks main\u012bt Latvij\u0101 \u0161obr\u012bd past\u0101vo\u0161o praksi publiskajos iepirkumos.<\/p>\n<p><strong><font size=\"5\" color=\"#2d5986\">\u012ass faktisko apst\u0101k\u013cu izkl\u0101sts<\/font><\/strong><\/p>\n<p>2011. gada novembr\u012b Talsu novada pa\u0161vald\u012bba izsludin\u0101ja atkl\u0101tu konkursu par ielu infrastrukt\u016bras uzlabo\u0161anu (turpm\u0101k\u00a0\u2013 konkurss). Konkursa nolikuma 9.5. punkts noteica, ka konkr\u0113t\u0101 l\u012bguma izpildei, lai pier\u0101d\u012btu atbilst\u012bbu kvalifik\u0101cijas pras\u012bb\u0101m, pretendents dr\u012bkst balst\u012bties uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m neatkar\u012bgi no savstarp\u0113jo attiec\u012bbu tiesisk\u0101 rakstura. \u0160\u0101d\u0101 gad\u012bjum\u0101 pretendentam j\u0101nor\u0101da visi uz\u0146\u0113m\u0113ji un j\u0101pier\u0101da, ka vi\u0146a r\u012bc\u012bb\u0101 b\u016bs nepiecie\u0161amie resursi, iesniedzot \u0161o uz\u0146\u0113m\u0113ju un pretendenta parakst\u012btu apliecin\u0101jumu vai vieno\u0161anos par sadarb\u012bbu un resursu nodo\u0161anu pretendenta r\u012bc\u012bb\u0101 konkr\u0113t\u0101 l\u012bguma izpildei, k\u0101 ar\u012b\u00a0\u2013 apliecin\u0101jumu par gatav\u012bbu sl\u0113gt sabiedr\u012bbas l\u012bgumu. Savuk\u0101rt gad\u012bjum\u0101, ja ar \u0161\u0101du pretendentu, kur\u0161 \u0161\u012b l\u012bguma izpildei balst\u0101s uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m, tiks nolemts sl\u0113gt iepirkuma l\u012bgumu, tad pirms iepirkuma l\u012bguma nosl\u0113g\u0161anas pretendentam ar \u0161\u0101diem uz\u0146\u0113m\u0113jiem ir j\u0101nosl\u0113dz sabiedr\u012bbas l\u012bgums Civillikuma 2241.\u00a0\u2013 2280. pant\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101. Konkursa nolikum\u0101 tika noteikts ar\u012b \u0161\u0101da sadarb\u012bbas l\u012bguma saturs, paredzot, ka l\u012bgum\u0101 j\u0101iek\u013cauj nosac\u012bjums, ka katrs dal\u012bbnieks ir solid\u0101ri atbild\u012bgs par iepirkuma l\u012bguma izpildi, j\u0101atspogu\u013co katra dal\u012bbnieka veicamo darbu da\u013ca, j\u0101nor\u0101da galvenais dal\u012bbnieks, kur\u0161 dal\u012bbnieku v\u0101rd\u0101 ir pilnvarots parakst\u012bt iepirkuma l\u012bgumu un vad\u012bs t\u0101 izpildi u.\u00a0tml.<br \/>\n<!--more--><br \/>\nUzskatot, ka \u0161\u0101da pras\u012bba par sabiedr\u012bbas l\u012bguma sl\u0113g\u0161anu neatbilst Publisko iepirkumu likumam, SIA &#8220;Ostas celtnieks&#8221; v\u0113rs\u0101s Iepirkumu uzraudz\u012bbas biroj\u0101, kur\u0161 ar 2012. gada 13. febru\u0101ra l\u0113mumu atzina, ka konkursa nolikuma 9.5. punkts ir tiesisks un pamatots. Nepiekr\u012btot \u0161\u0101dam l\u0113mumam, pretendents to p\u0101rs\u016bdz\u0113ja Administrat\u012bvaj\u0101 rajona ties\u0101, kura ar 2013. gada 7. maija spriedumu atzina konkursa nolikuma 9.5. punktu par prettiesisku, cikt\u0101l tas uzliek pretendentam oblig\u0101tu pien\u0101kumu iesniegt pas\u016bt\u012bt\u0101jam apliecin\u0101jumu par gatav\u012bbu sl\u0113gt sabiedr\u012bbas l\u012bgumu ar uz\u0146\u0113m\u0113jiem, uz kuru iesp\u0113j\u0101m pretendents balst\u0101s iepirkuma l\u012bguma izpildei, k\u0101 ar\u012b nosaka pras\u012bbu nosl\u0113gt \u0161\u0101du sabiedr\u012bbas l\u012bgumu vai izveidot pilnsabiedr\u012bbu. <\/p>\n<p>Izskatot \u0161o lietu kas\u0101cijas k\u0101rt\u012bb\u0101, Augst\u0101k\u0101s tiesas Administrat\u012bvo lietu departaments nol\u0113ma aptur\u0113t tiesved\u012bbu un uzdot EST \u0161\u0101du prejudici\u0101lu jaut\u0101jumu: &#8220;Vai Direkt\u012bv\u0101\u00a02004\/18 iek\u013caut\u0101s ties\u012bbu normas ir interpret\u0113jamas t\u0101d\u0113j\u0101di, ka t\u0101s, lai samazin\u0101tu l\u012bguma neizpildes risku, pie\u013cauj konkursa nolikum\u0101 izvirz\u012bt pras\u012bbu, atbilsto\u0161i kurai gad\u012bjum\u0101, ja ar pretendentu, kur\u0161 balst\u0101s uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m, tiks nolemts sl\u0113gt l\u012bgumu, pirms t\u0101 nosl\u0113g\u0161anas pretendentam ar \u0161iem uz\u0146\u0113m\u0113jiem j\u0101nosl\u0113dz sabiedr\u012bbas l\u012bgums (iek\u013caujot sabiedr\u012bbas l\u012bgum\u0101 konkr\u0113tus konkursa nolikum\u0101 atrun\u0101tus punktus) vai j\u0101dibina pilnsabiedr\u012bba?&#8221;<\/p>\n<p><strong><font size=\"5\" color=\"#2d5986\">EST spriedums liet\u0101 C-234\/14<\/font><\/strong><\/p>\n<p>Izskatot Augst\u0101k\u0101s tiesas l\u016bgumu, EST sav\u0101 2016. gada 14. janv\u0101ra spriedum\u0101 vispirms nor\u0101d\u012bja, ka direkt\u012bv\u0101s paredz\u0113to pretendenta ties\u012bbu balst\u012bties uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m m\u0113r\u0137is ir sekm\u0113t p\u0113c iesp\u0113jas pla\u0161\u0101ka pretendentu loka dal\u012bbu publiskajos iepirkumos un to savstarp\u0113ju konkurenci, kas atbilst gan pas\u016bt\u012bt\u0101ju, gan ar\u012b komersantu interes\u0113m. EST atz\u012bm\u0113ja, ka atbilsto\u0161i Direkt\u012bvas\u00a02004\/18 m\u0113r\u0137iem \u0161\u0101d\u0101 veid\u0101 tiek veicin\u0101ta ar\u012b mazo un vid\u0113jo uz\u0146\u0113mumu piek\u013cuve publiskajiem iepirkumiem.<\/p>\n<p>Atsaucoties uz l\u012bdz\u0161in\u0113jo judikat\u016bru (jo \u012bpa\u0161i\u00a0\u2013 EST spriedumu liet\u0101 C-176\/98, Holst Italia), spriedum\u0101 vienlaikus uzsv\u0113rts, ka gad\u012bjumos, kad pretendents, lai pier\u0101d\u012btu savu finansi\u0101lo un ekonomisko st\u0101vokli vai tehnisk\u0101s un profesion\u0101l\u0101s sp\u0113jas dal\u012bbai iepirkuma proced\u016br\u0101, balst\u0101s uz citu organiz\u0101ciju vai uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m, ar kuriem tas ir tie\u0161i vai netie\u0161i saist\u012bts, neatkar\u012bgi no \u0161\u012bs saist\u012bbas tiesisk\u0101 rakstura, pretendentam ir pien\u0101kums iesniegt pas\u016bt\u012bt\u0101jam attiec\u012bgus pier\u0101d\u012bjumus, ka tam &#8220;faktiski&#8221; b\u016bs pieejami \u0161o organiz\u0101ciju vai uz\u0146\u0113mumu resursi, kuru pretendentam nav, bet kas ir nepiecie\u0161ami iepirkuma l\u012bguma izpildei. Savuk\u0101rt pas\u016bt\u012bt\u0101jam ir pien\u0101kums p\u0101rbaud\u012bt pretendenta sp\u0113ju izpild\u012bt konkr\u0113to iepirkuma l\u012bgumu, un \u0161\u0101das p\u0101rbaudes m\u0113r\u0137is jo \u012bpa\u0161i ir nodro\u0161in\u0101t, ka vis\u0101 l\u012bguma izpildes laik\u0101 pretendentam b\u016bs pieejami un tas faktiski var\u0113s izmantot \u0161os cita uz\u0146\u0113m\u0113ja resursus, uz kuriem tas balst\u012bjies, iesniedzot pied\u0101v\u0101jumu.<\/p>\n<p>EST uzskat\u012bja par nepiecie\u0161amu \u012bpa\u0161i akcent\u0113t ar\u012b to, ka, p\u0101rbaudot pretendenta sp\u0113ju izpild\u012bt konkr\u0113to iepirkuma l\u012bgumu, pas\u016bt\u012bt\u0101js nav ties\u012bgs prezum\u0113t, ka l\u012bguma izpildei nepiecie\u0161amie resursi ir pretendenta r\u012bc\u012bb\u0101, vai ar\u012b <i>a\u00a0priori<\/i> izsl\u0113gt noteiktus pier\u0101d\u012bjumu veidus. No min\u0113t\u0101 izriet, ka pretendents ir ties\u012bgs br\u012bvi izv\u0113l\u0113ties gan ar citiem subjektiem, uz kuru sp\u0113j\u0101m tas balst\u0101s konkr\u0113t\u0101 l\u012bguma izpildei, past\u0101vo\u0161o tiesisko attiec\u012bbu raksturu, gan ar\u012b l\u012bdzek\u013cus, ar kuriem pier\u0101d\u012bt nepiecie\u0161amo resursu pieejam\u012bbu, cikt\u0101l tie nepiecie\u0161ami iepirkuma l\u012bguma izpildes laik\u0101. L\u012bdz ar to Direkt\u012bvas\u00a02004\/18 47.\u00a0panta 2.\u00a0punkts un 48. panta 3.\u00a0punkts ir j\u0101interpret\u0113 t\u0101d\u0113j\u0101di, ka \u0161\u012bs normas nepie\u013cauj to, ka pas\u016bt\u012bt\u0101js iepirkuma proced\u016bras dokument\u0101cij\u0101 b\u016btu ties\u012bgs noteikt pien\u0101kumu pretendentam, kur\u0161 balst\u0101s uz citu subjektu iesp\u0113j\u0101m, pirms iepirkuma l\u012bguma sl\u0113g\u0161anas nosl\u0113gt ar \u0161iem subjektiem sabiedr\u012bbas l\u012bgumu vai izveidot ar tiem pilnsabiedr\u012bbu.<\/p>\n<p><strong><font size=\"5\" color=\"#2d5986\">Secin\u0101jumi<\/font><\/strong><\/p>\n<p>EST spriedums SIA &#8220;Ostas celtnieks&#8221; liet\u0101 ir noz\u012bm\u012bgs vair\u0101ku apst\u0101k\u013cu d\u0113\u013c. Pirmk\u0101rt, tiesa beidzot ir skaidri un nep\u0101rprotami atzinusi, ka pas\u016bt\u012bt\u0101jam nav ties\u012bbu piepras\u012bt no pretendenta konkr\u0113tus dokumentus vai noteikt citus pier\u0101d\u012b\u0161anas l\u012bdzek\u013cus, ar kuriem pretendentam b\u016btu j\u0101pier\u0101da nepiecie\u0161amo resursu pieejam\u012bba gad\u012bjumos, kad tas balst\u0101s uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m. Vispirms jau n\u0101ksies main\u012bt \u0161obr\u012bd past\u0101vo\u0161o tendenci iepirkumu nolikumos paredz\u0113t pien\u0101kumu pretendentiem, kas sava saimniecisk\u0101 un finansi\u0101l\u0101 st\u0101vok\u013ca, k\u0101 ar\u012b tehnisko un profesion\u0101lo sp\u0113ju apliecin\u0101\u0161anai balst\u0101s uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m, iesniegt \u0161o uz\u0146\u0113m\u0113ju apliecin\u0101jumu vai konkr\u0113tu vieno\u0161anos par nepiecie\u0161amo resursu nodo\u0161anu pieg\u0101d\u0101t\u0101ja r\u012bc\u012bb\u0101. Proti, min\u0113t\u0101s Publisko iepirkumu likuma normas paredz, ka, gad\u012bjumos, kad pieg\u0101d\u0101t\u0101js balst\u0101s uz citu uz\u0146\u0113m\u0113ju iesp\u0113j\u0101m, tas pier\u0101da pas\u016bt\u012bt\u0101jam, ka vi\u0146a r\u012bc\u012bb\u0101 b\u016bs nepiecie\u0161amie resursi, iesniedzot \u0161o uz\u0146\u0113m\u0113ju apliecin\u0101jumu vai vieno\u0161anos par nepiecie\u0161amo resursu nodo\u0161anu pieg\u0101d\u0101t\u0101ja r\u012bc\u012bb\u0101.
