Eiropas publisk\u0101 iepirkuma noteikumos ir sniegti visi nepiecie\u0161amie r\u012bki \u0161o vajadz\u012bbu apmierin\u0101\u0161anai saska\u0146\u0101 ar sp\u0113k\u0101 eso\u0161ajiem Direkt\u012bvas 2004\/18\/EK<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup> (turpm\u0101k\u00a0\u2013 Direkt\u012bva) noteikumiem, k\u0101 ar\u012b saska\u0146\u0101 ar jaun\u0101ko publisk\u0101 iepirkuma Direkt\u012bvu 2014\/24\/ES<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup>. \u0160\u012b direkt\u012bva ir j\u0101transpon\u0113 l\u012bdz 2016. gada 18. apr\u012blim, un t\u0101 ir piem\u0113rojama tikai dal\u012bbvalst\u012bs, kur\u0101s transpon\u0113\u0161anas pas\u0101kumi jau ir st\u0101ju\u0161ies sp\u0113k\u0101. \u0160\u0101 pazi\u0146ojuma pamat\u0101 ir Direkt\u012bva 2004\/18\/EK, bet ir nor\u0101d\u012btas ar\u012b Direkt\u012bvas 2014\/24\/ES \u012bpatn\u012bbas, ja t\u0101s pa\u0161reiz\u0113jos apst\u0101k\u013cos ir svar\u012bgas<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>. Ar \u0161o pazi\u0146ojumu netiek rad\u012bti jauni ties\u012bbu aktu noteikumi. Pazi\u0146ojum\u0101 ir atspogu\u013cota komisijas izpratne par l\u012bgumiem, publisk\u0101 iepirkuma direkt\u012bv\u0101m un Eiropas Savien\u012bbas Tiesas (Tiesas) judikat\u016bru. Jebkur\u0101 gad\u012bjum\u0101 j\u0101\u0146em v\u0113r\u0101, ka sniegt savien\u012bbas ties\u012bbu aktu gal\u012bgo saisto\u0161o interpret\u0101ciju ir Tiesas pien\u0101kums. <\/p>\n<p><strong><font size=\"5\" color=\"#2d5986\">1. SAVIEN\u012aBAS PUBLISK\u0100 IEPIRKUMA NOTEIKUMU DARB\u012aBAS JOMA<\/font><\/strong><\/p>\n<p><strong><font size=\"4\" color=\"#2d5986\">1.1. Infrastrukt\u016bra\u00a0\u2013 b\u016bvdarbi <\/font><\/strong><\/p>\n<p>Infrastrukt\u016bru (t.\u00a0i., m\u0101jok\u013cus) var nodro\u0161in\u0101t, vai nu \u012br\u0113jot eso\u0161as \u0113kas, kur\u0101s nav j\u0101veic apjom\u012bgi piel\u0101gojumi (t.\u00a0i., b\u016bvdarbi), vai b\u016bv\u0113jot jaunas \u0113kas, vai izremont\u0113jot eso\u0161as \u0113kas. Publisk\u0101 iepirkuma noteikumi neattiecas uz eso\u0161u \u0113ku \u012br\u0113\u0161anu (sk. Direkt\u012bvas 16. panta a) punktu<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup>). Pie\u0146emot, ka m\u0101jok\u013ci ir pieejami, tos var nodro\u0161in\u0101t bez nepiecie\u0161am\u012bbas veikt publisk\u0101 iepirkuma proced\u016bras, ja eso\u0161\u0101s \u0113kas tiek \u012br\u0113tas tirg\u016b vai ja \u0161\u0101d\u0101m vajadz\u012bb\u0101m tiek pie\u0161\u0137irta eso\u0161\u0101 publisk\u0101 infrastrukt\u016bra (piem., kazarmas, skolas, sporta \u0113kas). Ja ir vajadz\u012bba b\u016bv\u0113t jaunas \u0113kas, remont\u0113t vai cit\u0101di piel\u0101got eso\u0161\u0101s \u0113kas, iesp\u0113jams, ka ir j\u0101piem\u0113ro savien\u012bbas publisk\u0101 iepirkuma noteikumi<sup><a href=\"#fn6\" id=\"ref6\">6<\/a><\/sup>. Lai Direkt\u012bva b\u016btu j\u0101piem\u0113ro, attiec\u012bg\u0101 b\u016bvniec\u012bbas\/remont\u0113\u0161anas\/piel\u0101go\u0161anas projekta apl\u0113stajai v\u0113rt\u012bbai j\u0101b\u016bt vai nu vien\u0101dai ar pa\u0161reiz\u0113jo robe\u017ev\u0113rt\u012bbu, kas ir EUR 5\u00a0186\u00a0000, vai liel\u0101kai par to<sup><a href=\"#fn7\" id=\"ref7\">7<\/a><\/sup>. \u0160is nosac\u012bjums attiecas uz katru funkcion\u0101li neatkar\u012bgu projektu. Pa\u0161vald\u012bba, kura pl\u0101no \u012bstenot da\u017e\u0101das m\u0101jok\u013cu sh\u0113mas, parasti apr\u0113\u0137ina katras sh\u0113mas v\u0113rt\u012bbu atsevi\u0161\u0137i, t\u0101d\u0113j\u0101di p\u0101rbaudot, vai min\u0113t\u0101 robe\u017ev\u0113rt\u012bba ir sasniegta. B\u016bvdarbu projektus nav at\u013cauts sadal\u012bt maz\u0101k\u0101s da\u013c\u0101s, lai t\u0101d\u0101 veid\u0101 apietu Direkt\u012bvas noteikumu piem\u0113ro\u0161anu (Direkt\u012bvas 9. panta 3. punkts). Ja projekta v\u0113rt\u012bba ir maz\u0101ka nek\u0101 robe\u017ev\u0113rt\u012bba, piem\u0113ro valsts ties\u012bbu aktus. Tom\u0113r, ja attiec\u012bgais projekts ir saist\u012bts ar zin\u0101mu p\u0101rrobe\u017eu interesi, ir sp\u0113k\u0101 savien\u012bbas ties\u012bbu pamatprincipi \u0161aj\u0101 jom\u0101, proti, nediskrimin\u0101cija uz valstisk\u0101s pieder\u012bbas pamata, vienl\u012bdz\u012bga attieksme un p\u0101rredzam\u012bba<sup><a href=\"#fn8\" id=\"ref8\">8<\/a><\/sup>.<br \/>\n<!--more--><br \/>\n<strong><font size=\"4\" color=\"#2d5986\">1.2. Preces<\/font><\/strong><\/p>\n<p>P\u0113c daudzu patv\u0113ruma mekl\u0113t\u0101ju iera\u0161an\u0101s steidzami b\u016bs vajadz\u012bgi ar\u012b da\u017e\u0101du pre\u010du kr\u0101jumi (piem., teltis, tvertnes, ap\u0123\u0113rbi, segas, gultas, p\u0101rtika). <\/p>\n<p>Direkt\u012bva attieksies uz visiem pieg\u0101des l\u012bgumiem, kuru sl\u0113g\u0161anas ties\u012bbas pie\u0161\u0137ir l\u012bgumsl\u0113dz\u0113ja iest\u0101de<sup><a href=\"#fn9\" id=\"ref9\">9<\/a><\/sup>, ja to apl\u0113st\u0101 v\u0113rt\u012bba ir vien\u0101da ar piem\u0113rojamo robe\u017ev\u0113rt\u012bbu vai liel\u0101ka par to; \u0161\u012b robe\u017ev\u0113rt\u012bba atkar\u012bb\u0101 no l\u012bgumsl\u0113dz\u0113jas iest\u0101des<sup><a href=\"#fn10\" id=\"ref10\">10<\/a><\/sup> var b\u016bt vai nu EUR 134\u00a0000, vai EUR 207\u00a0000<sup><a href=\"#fn11\" id=\"ref11\">11<\/a><\/sup>. Iepriek\u0161 min\u0113tos savien\u012bbas ties\u012bbu pamatprincipus piem\u0113ro ar t\u0101diem pa\u0161iem nosac\u012bjumiem k\u0101 b\u016bvdarbu l\u012bgumu gad\u012bjum\u0101.<\/p>\n<p><strong><font size=\"4\" color=\"#2d5986\">1.3. Pakalpojumi<\/font><\/strong><\/p>\n<p>Visbeidzot, p\u0113c patv\u0113ruma mekl\u0113t\u0101ju iera\u0161an\u0101s b\u016bs vajadz\u012bga ar\u012b pakalpojumu iepirk\u0161ana (piem., t\u012br\u012b\u0161anas, vesel\u012bbas, \u0113din\u0101\u0161anas un dro\u0161\u012bbas pakalpojumi). Pakalpojumu l\u012bgumu gad\u012bjum\u0101 sp\u0113k\u0101 eso\u0161ie Direkt\u012bvas un Direkt\u012bvas 2014\/24\/ES noteikumi iev\u0113rojami at\u0161\u0137iras. Saska\u0146\u0101 ar Direkt\u012bvu 2004\/18\/EK pakalpojumiem to piem\u0113ro piln\u012bb\u0101 tikai tad, ja tie ir uzskait\u012bti izsme\u013co\u0161\u0101 sarakst\u0101<sup><a href=\"#fn12\" id=\"ref12\">12<\/a><\/sup>. No min\u0113tajiem pakalpojumiem patv\u0113ruma mekl\u0113t\u0101jiem \u012bpa\u0161i var b\u016bt vajadz\u012bgi autobusu p\u0101rvad\u0101jumi un t\u012br\u012b\u0161anas pakalpojumi. Attiec\u012bb\u0101 uz visiem p\u0101r\u0113jiem pakalpojumiem, kuri nav uzskait\u012bti izsme\u013co\u0161\u0101 sarakst\u0101, Direkt\u012bv\u0101<sup><a href=\"#fn13\" id=\"ref13\">13<\/a><\/sup> ir paredz\u0113ta tikai ex post p\u0101rredzam\u012bba<sup><a href=\"#fn14\" id=\"ref14\">14<\/a><\/sup> un reglament\u0113jo\u0161o tehnisko specifik\u0101ciju piem\u0113ro\u0161ana. Saist\u012bb\u0101 ar pakalpojumu snieg\u0161anu patv\u0113ruma mekl\u0113t\u0101jiem atvieglotais re\u017e\u012bms var\u0113tu b\u016bt noz\u012bm\u012bgs, piem\u0113ram, attiec\u012bb\u0101 uz \u0113din\u0101\u0161anas, vesel\u012bbas un soci\u0101lajiem pakalpojumiem. Da\u017ei pakalpojumi ir piln\u012bb\u0101 izsl\u0113gti no Direkt\u012bvas 2014\/24\/ES piem\u0113ro\u0161anas. To ar da\u017eiem nosac\u012bjumiem nepiem\u0113ro gl\u0101b\u0161anas un neatliekam\u0101s medic\u012bnisk\u0101s pal\u012bdz\u012bbas pakalpojumiem<sup><a href=\"#fn18\" id=\"ref18\">18<\/a><\/sup>. Pakalpojumiem, uz kuriem attiecas atvieglotais re\u017e\u012bms, piem\u0113rojam\u0101 robe\u017ev\u0113rt\u012bba ir EUR 750\u00a0000<sup><a href=\"#fn20\" id=\"ref20\">20<\/a><\/sup>. Atvieglot\u0101 re\u017e\u012bma piem\u0113ro\u0161ana noz\u012bm\u0113, ka l\u012bgumsl\u0113dz\u0113j\u0101m iest\u0101d\u0113m ir pien\u0101kums nodro\u0161in\u0101t inform\u0101cijas public\u0113\u0161anu ES l\u012bmen\u012b gan pirms sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas, gan p\u0113c t\u0101s un ka t\u0101m j\u0101iev\u0113ro da\u017ei procedur\u0101li pamatpien\u0101kumi (jo \u012bpa\u0161i j\u0101nodro\u0161ina nediskrimin\u0101cijas principa piem\u0113ro\u0161ana). PROCED\u016aRU UN TERMI\u0145U IZV\u0112LE SASKA\u0145\u0100 AR ES PUBLISK\u0100 IEPIRKUMA NOTEIKUMIEM <\/font><\/strong><\/p>\n<p><strong><font size=\"4\" color=\"#2d5986\">2.1. Visp\u0101r\u012bgi noteikumi <\/font><\/strong><\/p>\n<p>To l\u012bgumu gad\u012bjum\u0101, kas ir Direkt\u012bvas darb\u012bbas jom\u0101, l\u012bgumsl\u0113dz\u0113ja iest\u0101de var izv\u0113l\u0113ties, vai l\u012bgumsl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu veikt atkl\u0101t\u0101 vai sl\u0113gt\u0101 proced\u016br\u0101 (Direkt\u012bvas 28. pants)<sup><a href=\"#fn22\" id=\"ref22\">22<\/a><\/sup>. Minim\u0101lais termi\u0146\u0161, kuru var noteikt pied\u0101v\u0101juma iesnieg\u0161anai atkl\u0101t\u0101 proced\u016br\u0101, ir 52 dienas, bet to var samazin\u0101t l\u012bdz 40 dien\u0101m, ja tiek izmantoti elektroniskie l\u012bdzek\u013ci (Direkt\u012bvas 38. pants).
