Eiropas Komisija ir apr\u0113\u0137in\u0101jusi, ka ES dal\u012bbvalstis, taj\u0101 skait\u0101\u00a0\u2013 Latvija, publisk\u0101 iepirkuma m\u0113r\u0137iem t\u0113r\u0113 ap 20% no IKP. \u0145emot v\u0113r\u0101 publisko iepirkumu apjoma ekonomisko \u012bpatsvaru, valsts ekonomikas turpm\u0101kai pozit\u012bvai izaugsmei ir svar\u012bga publisk\u0101 iepirkuma veik\u0161ana atbilsto\u0161i ES noteiktajiem publisk\u0101 iepirkuma pamatprincipiem, nodro\u0161inot p\u0113c iesp\u0113jas pla\u0161\u0101ku iepirkuma proced\u016bru atkl\u0101t\u012bbu un caurskat\u0101m\u012bbu, k\u0101 ar\u012b pieg\u0101d\u0101t\u0101ju br\u012bvu konkurenci un vienl\u012bdz\u012bgu attieksmi pret tiem.<\/b><\/p>\n<p>Publiskie iepirkumi un ar to saist\u012btais normat\u012bvais regul\u0113jums alla\u017e ir bijis \u0100rvalstu investoru padomes Latvij\u0101 (\u0100IPL) uzman\u012bbas lok\u0101. \u0100IPL pasp\u0101rn\u0113 ir izveidota un darbojas publisko iepirkumu darba grupa, kur\u0101 tiek skat\u012bti un apspriesti \u0101rvalstu investoriem aktu\u0101li jaut\u0101jumi attiec\u012bb\u0101 uz Publisko iepirkumu likum\u0101 un Sabiedrisko pakalpojumu sniedz\u0113ju iepirkumu likum\u0101 ietverto regul\u0113jumu un t\u0101 piem\u0113ro\u0161anas praksi Latvij\u0101. \u0160\u012bs darba grupas darba rezult\u0101t\u0101 \u0100IPL 2011. un 2013.gad\u0101 n\u0101ca klaj\u0101 ar diviem poz\u012bcijas zi\u0146ojumiem par priek\u0161likumiem publisko iepirkumu regul\u0113juma izmai\u0146\u0101m, kas tika prezent\u0113ti Ministru kabinetam un iez\u012bm\u0113ja tobr\u012bd aktu\u0101l\u0101s probl\u0113mas \u0161aj\u0101 jom\u0101, k\u0101 ar\u012b to iesp\u0113jamos risin\u0101jumus. Atskatoties uz paveikto, j\u0101secina, ka apm\u0113ram divas tre\u0161da\u013cas no \u0100IPL ierosin\u0101taj\u0101m izmai\u0146\u0101m jau \u0161obr\u012bd ir iestr\u0101d\u0101tas likumos, kas visdr\u012bz\u0101k liecina par to, ka \u0100IPL biedru pied\u0101v\u0101tie priek\u0161likumi, kas parasti ir balst\u012bti uz cit\u0101s Eiropas Savien\u012bbas dal\u012bbvalst\u012bs g\u016bto pieredzi un lab\u0101s prakses piem\u0113riem, ir konstrukt\u012bvi un sekm\u0113 komercdarb\u012bbas vides un iepirkumu jomas sak\u0101rto\u0161anu Latvij\u0101.<\/p>\n<p>\u0160obr\u012bd ir beidzies pirmais darba c\u0113liens pie jaun\u0101s ES direkt\u012bvas 2014\/24\/ES par publisko iepirkumu p\u0101r\u0146em\u0161anu. Lai gan valsts sekret\u0101ru san\u0101ksm\u0113 \u0161\u0101 gada 19. novembr\u012b ir izsludin\u0101ts Finan\u0161u ministrijas sagatavotais Publisko iepirkumu likumprojekts, gan Ministru kabinet\u0101, gan it \u012bpa\u0161i Saeim\u0101 ir sagaid\u0101mas pla\u0161as diskusijas un str\u012bdi par daudz\u0101m jaun\u0101 likumprojekta norm\u0101m. Saj\u016bta t\u0101da, ka priek\u0161\u0101 v\u0113l t\u0101ls ce\u013c\u0161 ejams, jo, k\u0101 saka ang\u013ci, \u201cvelns sl\u0113pjas deta\u013c\u0101s\u201d. <\/p>\n<p>Ta\u010du laika nav atlicis daudz\u00a0\u2013 direkt\u012bvas pras\u012bbas ir j\u0101p\u0101r\u0146em l\u012bdz n\u0101kam\u0101 gada 18. apr\u012blim. \u0160aj\u0101 zi\u0146\u0101 Latvija nav ne lab\u0101ka, ne slikt\u0101ka par cit\u0101m ES dal\u012bbvalst\u012bm. \u0160obr\u012bd jauno regul\u0113jumu ir p\u0101r\u0146\u0113musi tikai Lielbrit\u0101nija. Turkl\u0101t jau tagad ir skaidrs, ka vair\u0101kas b\u016btiskas direkt\u012bvas pras\u012bbas nav ieviestas, t\u0101p\u0113c jau tuv\u0101kaj\u0101 laik\u0101 b\u016bs nepiecie\u0161ami attiec\u012bgi groz\u012bjumi.<!--more--> Ar 2016. gada janv\u0101ri sp\u0113k\u0101 st\u0101sies jauni iepirkumu likumi v\u0113l atsevi\u0161\u0137\u0101s ES dal\u012bbvalst\u012bs (piem\u0113ram, D\u0101nij\u0101), tom\u0113r no vair\u0101kiem \u0101rvalstu kol\u0113\u0123iem neform\u0101l\u0101s sarun\u0101s n\u0101cies dzird\u0113t, ka liel\u0101kaj\u0101 da\u013c\u0101 dal\u012bbvalstu joproj\u0101m norit spraigas debates un l\u012bdz n\u0101kam\u0101 gada apr\u012blim jaun\u0101s ES direkt\u012bvas publisko iepirkumu jom\u0101 neb\u016bs ieviestas.<\/p>\n<p>V\u0113rt\u0113jot Finan\u0161u ministrijas izstr\u0101d\u0101to Publisko iepirkumu likumprojektu, j\u0101atz\u012bst, ka taj\u0101 ir iestr\u0101d\u0101tas jaunas normas, kas vienk\u0101r\u0161os un pa\u0101trin\u0101s iepirkumu norisi, pie\u0161\u0137irs pas\u016bt\u012bt\u0101jiem pla\u0161\u0101kas iesp\u0113jas, ikreiz izv\u0113loties piem\u0113rot\u0101ko proced\u016bru, k\u0101 ar\u012b da\u013c\u0113ji sekm\u0113s administrat\u012bv\u0101 sloga samazin\u0101\u0161anu. B\u016btiski, ka tuv\u0101kaj\u0101 laik\u0101 tiks rad\u012bta normat\u012bv\u0101 b\u0101ze, lai l\u012bdz 2018. gadam iepirkumos p\u0101rietu uz piln\u012bgu elektronisko dokumentu apriti un elektronisku sazi\u0146u ar pretendentiem.<\/p>\n<p>Pozit\u012bvi v\u0113rt\u0113jams tas, ka at\u0161\u0137ir\u012bb\u0101 no l\u012bdz\u0161in\u0113j\u0101s k\u0101rt\u012bbas, da\u013cu no \u0161obr\u012bd likum\u0101 regul\u0113tajiem jaut\u0101jumiem pl\u0101nots dele\u0123\u0113t Ministru kabinetam, t\u0101d\u0113j\u0101di dodot iesp\u0113ju likumdev\u0113jam \u0101tr\u0101k un efekt\u012bv\u0101k rea\u0123\u0113t uz nepiecie\u0161amaj\u0101m izmai\u0146\u0101m normat\u012bvajos aktos, k\u0101 rezult\u0101t\u0101, veicot maz\u0101k noz\u012bm\u012bgus vai tehniska rakstura groz\u012bjumus, neb\u016bs j\u0101sastopas ar laikietilp\u012bgo un smagn\u0113jo likumdo\u0161anas procesu Saeim\u0101. <\/p>\n<p>Viens no publiski pla\u0161\u0101k izskan\u0113ju\u0161ajiem jaunin\u0101jumiem ir tas, ka turpm\u0101k k\u0101 vien\u012bgais pied\u0101v\u0101juma izv\u0113les krit\u0113rijs tiek saglab\u0101ts tikai saimnieciski visizdev\u012bg\u0101kais pied\u0101v\u0101jums, ko nosaka, izmantojot izmaksu efektivit\u0101tes metodi (piem\u0113ram, v\u0113rt\u0113jot aprites cikla izmaksas) vai \u0146emot v\u0113r\u0101 cenu vai izmaksu efektivit\u0101ti kop\u0101 ar iepirkuma l\u012bguma priek\u0161metu saist\u012btiem kvalit\u0101tes krit\u0113rijiem. L\u012bdz ar to zem\u0101k\u0101 cena k\u0101 pied\u0101v\u0101juma izv\u0113les krit\u0113rijs likum\u0101 vairs neb\u016bs. Tom\u0113r tas nenoz\u012bm\u0113, ka turpm\u0101k zem\u0101k\u0101 cena visp\u0101r vairs neb\u016bs izmantojama, jo, nosakot saimnieciski visizdev\u012bg\u0101ko pied\u0101v\u0101jumu, pas\u016bt\u012bt\u0101jam joproj\u0101m b\u016bs iesp\u0113ja \u0146emt v\u0113r\u0101 vien\u012bgi cenu, iz\u0146emot, ja likumdev\u0113js noteiks atsevi\u0161\u0137us sektorus, kuros zem\u0101k\u0101s cenas izmanto\u0161ana b\u016btu piln\u012bb\u0101 izsl\u0113gta.<\/p>\n<p>Lai gan \u0161o izmai\u0146u ietekme b\u016bs v\u0113rojama tikai p\u0113c k\u0101da laika, kopum\u0101 p\u0101reja uz vienotu saimnieciski izdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma izv\u0113les krit\u0113riju ir apsveicama, jo \u0161\u0101d\u0101 veid\u0101 netie\u0161i var\u0113tu tikt risin\u0101ta viena no Latvij\u0101 iepirkumu jom\u0101 aktu\u0101l\u0101kaj\u0101m probl\u0113m\u0101m\u00a0\u2013 iepirkumu nepietiekama centraliz\u0101cija. Eirop\u0101 jau labu laiku past\u0101v vienota izpratne, ka iepirkumu centraliz\u0101cija sekm\u0113 pas\u016bt\u012bt\u0101ja iesp\u0113jas sa\u0146emt lab\u0101kas preces, b\u016bvdarbus un pakalpojumus par zem\u0101k\u0101m izmaks\u0101m, uzlabo iepirkumu norisi un efektivit\u0101ti, att\u012bsta iepirkumu speci\u0101listu profesionalit\u0101ti un galarezult\u0101t\u0101 samazina s\u016bdz\u012bbu skaitu. \u0160\u0101du pieeju atbalsta ar\u012b vair\u0101kums \u0100IPL biedru. Turpret\u012b Latvij\u0101 daudzas pa\u0161vald\u012bbas joproj\u0101m uzskata, ka tikai t\u0101s sp\u0113j vislab\u0101k apzin\u0101ties savas vajadz\u012bbas, t\u0101p\u0113c katra pa\u0161vald\u012bba atsevi\u0161\u0137i r\u012bko vienus un tos pa\u0161us iepirkumus un uztur tam neiecie\u0161amo administrat\u012bvo apar\u0101tu.
