Diem\u017e\u0113l 2005. gada 26. j\u016blija Ministru kabineta ieteikumi nr. 1 \u201cIeteikumi pa\u0161vald\u012bb\u0101m par saisto\u0161ajiem noteikumiem, kuri reglament\u0113 sadz\u012bves atkritumu apsaimnieko\u0161anu\u201d ir jau zaud\u0113ju\u0161i sp\u0113ku, un atkal pa\u0161vald\u012bbu iepirkumu komisij\u0101m ir j\u0101\u0137eras pa\u0161\u0101m pie darba, m\u0113\u0123inot, pamatojoties uz normat\u012bvo aktu pras\u012bb\u0101m un novada saisto\u0161ajiem noteikumiem, izveidot optim\u0101lus nosac\u012bjumus konkursa noteikumiem un pretendentu izv\u0113lei. Pa\u0161vald\u012bbas iepirkuma konkurs\u0101 uzvar\u0113t\u0101ju var noteikt gan p\u0113c l\u0113t\u0101k\u0101 pied\u0101v\u0101juma, gan p\u0113c saimnieciski izdev\u012bg\u0101kajiem nosac\u012bjumiem. L\u012bdz\u0161in\u0113j\u0101 prakse ir par\u0101d\u012bjusi, ka l\u0113t\u0101kais pied\u0101v\u0101jums ne vienm\u0113r ir ar\u012b izdev\u012bg\u0101kais ab\u0101m l\u012bguma sl\u0113dz\u0113ja pus\u0113m. J\u016brmalas piem\u0113rs par\u0101d\u012bja, ka atkritumus apsaimniekojo\u0161ais uz\u0146\u0113mums nebija sp\u0113j\u012bgs turpin\u0101t nosl\u0113gto l\u012bgumu par t\u0101 noteikto tarifu, savuk\u0101rt M\u0101rupes gad\u012bjum\u0101 diskusija non\u0101ca vai l\u012bdz Satversmes tiesai, kad iedz\u012bvot\u0101ji, sl\u0113dzot l\u012bgumu ar uz\u0146\u0113mumu, sa\u0146\u0113ma virkni papildu nosac\u012bjumu, kuru neizpildes gad\u012bjum\u0101 b\u016btu spiesti maks\u0101t lielus papildu izdevumus. T\u0101tad pirmais jaut\u0101jums: cik un k\u0101d\u0101s zon\u0101s iedal\u012bt pa\u0161vald\u012bbas administrat\u012bvo teritoriju? Te risin\u0101jums nav nemaz tik vienk\u0101r\u0161s. Likuma pras\u012bba, ka atkritumu apsaimniekot\u0101js, kuru atbilsto\u0161i \u0161im likumam izv\u0113l\u0113jusies pa\u0161vald\u012bba, nodro\u0161ina sadz\u012bves atkritumu sav\u0101k\u0161anu, p\u0101rvad\u0101\u0161anu, p\u0101rkrau\u0161anu, uzglab\u0101\u0161anu, dal\u012bt\u0101s atkritumu sav\u0101k\u0161anas, \u0161\u0137iro\u0161anas un p\u0101rkrau\u0161anas infrastrukt\u016bras objektu <b>uztur\u0113\u0161anu par vien\u0101du maksu visiem sadz\u012bves atkritumu rad\u012bt\u0101jiem attiec\u012bgaj\u0101 \u0161o atkritumu apsaimnieko\u0161anas zon\u0101 atbilsto\u0161i \u0161aj\u0101 likum\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101 nosl\u0113gtajam l\u012bgumam ar pa\u0161vald\u012bbu<\/b>, praktiski liek pa\u0161vald\u012bbai izv\u0113rt\u0113t \u2013 cik tad p\u0113c b\u016bt\u012bbas maks\u0101s atkritumu apsaimnieko\u0161ana bl\u012bvi apdz\u012bvot\u0101 pils\u0113t\u0101, t\u0101s priv\u0101tm\u0101ju rajonos un cik re\u0101li maks\u0101s sadz\u012bves atkritumu apsaimnieko\u0161ana lauku teritorij\u0101s ar atsevi\u0161\u0137\u0101m viens\u0113t\u0101m. Atsevi\u0161\u0137as zonas noteik\u0161ana ir lo\u0123iska, ja apsaimniekojam\u0101 teritorija b\u016btiski at\u0161\u0137iras no p\u0101r\u0113j\u0101m vai ar\u012b tie\u0161i otr\u0101di \u2013 zonu izveido t\u0101, lai t\u0101 ietvertu gan \u201cizdev\u012bgos\u201d atkritumu rad\u012bt\u0101jus, gan p\u0101r\u0113jos, l\u012bdz ar to vien\u0101dojot izmaksas gan lauku, gan pils\u0113tas iedz\u012bvot\u0101jiem. \u0160is otrais variants pal\u012bdz centraliz\u0113taj\u0101 atkritumu apsaimnieko\u0161an\u0101 iesaist\u012bt visus pa\u0161vald\u012bbas iedz\u012bvot\u0101jus neatkar\u012bgi no to dz\u012bvesvietas, nodro\u0161in\u0101t t\u012brus me\u017eus, p\u013cavas, upju un ezeru krastus. Katr\u0101 zi\u0146\u0101, samazinot zonu skaitu, pa\u0161vald\u012bbai ir viegl\u0101k sagatavot atkritumu apsaimnieko\u0161anas noteikumus katrai zonai, k\u0101 ar\u012b organiz\u0113t konkursu un izv\u0113l\u0113ties pretendentu.<\/p>\n<p>Ja pa\u0161vald\u012bba nolemj izv\u0113l\u0113ties saimnieciski izdev\u012bg\u0101ko pied\u0101v\u0101jumu, t\u0101l\u0101kais uzdevums ir pareizi izvirz\u012bt apsaimnieko\u0161anas pras\u012bbas un nov\u0113rt\u0113t konkursa rezult\u0101tus. Likums nosaka, ka pa\u0161vald\u012bba iek\u013cauj darba uzdevum\u0101 pras\u012bbas pretendenta darbinieku kvalifik\u0101cijai, sp\u0113jai veikt sadz\u012bves atkritumu apsaimnieko\u0161anu un tehniskajam vai finansi\u0101lajam nodro\u0161in\u0101jumam sadz\u012bves atkritumu apsaimnieko\u0161anas darb\u012bbu veik\u0161anai konkr\u0113taj\u0101 zon\u0101, k\u0101 ar\u012b nor\u0101da atkritumu poligonu, kur\u0101 atbilsto\u0161i atkritumu apsaimnieko\u0161anas re\u0123ion\u0101lajam pl\u0101nam apglab\u0101 \u0161\u012bs pa\u0161vald\u012bbas administrat\u012bvaj\u0101 teritorij\u0101 rad\u012btos sadz\u012bves atkritumus.<\/p>\n<p>Lai noteiktu pras\u012bbas, pa\u0161vald\u012bbai ir vispirms j\u0101apzina sava l\u012bdz\u0161in\u0113j\u0101 atkritumu saimniec\u012bba \u2013 tas ir iedz\u012bvot\u0101ju skaits un to izvietojums, rad\u012btais atkritumu daudzums uz vienu apsaimniekoto iedz\u012bvot\u0101ju, \u0161\u0137iroto atkritumu veidi un daudzums, eso\u0161o sav\u0101k\u0161anas punktu un laukumu novietojums. Praktiski, lai izpild\u012btu pamatpras\u012bbu \u2013 organiz\u0113t atkritumu dal\u012btu v\u0101k\u0161anu sav\u0101 administrat\u012bvaj\u0101 teritorij\u0101 atbilsto\u0161i atkritumu apsaimnieko\u0161anas valsts pl\u0101nam un re\u0123ion\u0101lajiem pl\u0101niem, pa\u0161vald\u012bbai ir skaidri j\u0101apzin\u0101s pl\u0101nu nosac\u012bjumi, to pras\u012bbas t\u0101s konkr\u0113tam iedz\u012bvot\u0101ju skaitam un jau j\u0101iepl\u0101no, cik daudz un k\u0101di \u0161\u0137irotu atkritumu veidi b\u016bs j\u0101sav\u0101c. Tas nosaka, kur un k\u0101 \u0161ie atkritumi b\u016bs j\u0101apsaimnieko \u2013 \u0161\u0137iroto konteineru punktu izvietojums ar apr\u0113\u0137inu viens punkts uz 300 \u2013 500 iedz\u012bvot\u0101jiem un \u0161\u0137iroto atkritumu laukuma b\u016bvniec\u012bba ar apr\u0113\u0137inu viens laukums uz ~ 3000 iedz\u012bvot\u0101ju. \u0160\u0137iroto atkritumu punktos ir j\u0101novieto konteineri stikla, plastmasas, pap\u012bra un met\u0101la iepakojuma sav\u0101k\u0161anai. Daudz\u0101s lauku pa\u0161vald\u012bb\u0101s, lai samazin\u0101tu apsaimnieko\u0161anas izmaksas, plastmasas, pap\u012bra un met\u0101la iepakojumam izmanto vienu konteineru, ko atkritumu apsaimnieko\u0161anas uz\u0146\u0113mums p\u0101r\u0161\u0137iro v\u0113lreiz uz l\u012bnijas. Stikla iepakojumu nedr\u012bkst likt kop\u0101 ar citiem iepakojuma veidiem, jo stikls ir trausls, veido \u0161\u0137embas, kas pies\u0101r\u0146o citus materi\u0101lus un ir b\u012bstams, to manu\u0101li at\u0161\u0137irojot. Lai samazin\u0101tu priv\u0101tm\u0101ju apsaimnieko\u0161anas izmaksas, vair\u0101k\u0101s pa\u0161vald\u012bb\u0101s \u0161\u0137irotu atkritumu sav\u0101k\u0161anai lieto ekosomas, ko m\u0101ju \u012bpa\u0161nieki p\u0113c iztuk\u0161o\u0161anas izmanto vair\u0101kk\u0101rt.<\/p>\n<p>K\u0101 b\u016btisks atkritumu apsaimnieko\u0161anas elements ir j\u0101min \u0161\u0137irotu atkritumu laukums. Laukum\u0101 ir j\u0101paredz vieta ar\u012b lielgabar\u012bta atkritumu novieto\u0161anai. Piem\u0113ram, m\u0113bel\u0113m, elektrisko un elektronisko iek\u0101rtu atkritumiem, logu stikliem, b\u016bvgru\u017eiem, k\u0101 ar\u012b za\u013cajiem d\u0101rza atkritumiem. Par p\u0113d\u0113jiem pa\u0161vald\u012bbai ir j\u0101r\u016bp\u0113jas, ne tikai sav\u0101cot no iedz\u012bvot\u0101jiem, bet ar\u012b apsaimniekojot savu saimniec\u012bbu \u2013 k\u0101 kaps\u0113tas, parkus un skv\u0113rus. Za\u013cie atkritumi ir viegli kompost\u0113jami, tos var izmantot ar\u012b d\u016b\u0146u komposta izveidei. Ruden\u012b saus\u0101s lapas nav dedzin\u0101mas, bet ir p\u0101rstr\u0101d\u0101jamas kompost\u0101.<\/p>\n<p>Konkursa nolikum\u0101 pa\u0161vald\u012bbai ir j\u0101paredz ar\u012b lielgabar\u012bta atkritumu sav\u0101k\u0161ana no iedz\u012bvot\u0101jiem, ko sezon\u0101li var veikt atkritumus apsaimniekojo\u0161ais uz\u0146\u0113mums.<\/p>\n<p>Visas paredz\u0113t\u0101s darb\u012bbas un to izmaksas ir j\u0101iek\u013cauj tarif\u0101. Saska\u0146\u0101 ar likumu sadz\u012bves atkritumu apsaimnieko\u0161anas (iz\u0146emot sadz\u012bves atkritumu re\u0123ener\u0101ciju) maksas noteik\u0161anas k\u0101rt\u012bbu atkritumu rad\u012bt\u0101jam vai vald\u012bt\u0101jam apstiprina pa\u0161vald\u012bba ar saisto\u0161ajiem noteikumiem. Pamatojoties uz saisto\u0161ajos noteikumos paredz\u0113to k\u0101rt\u012bbu, pa\u0161vald\u012bba ar savu l\u0113mumu nosaka maksu par sadz\u012bves atkritumu apsaimnieko\u0161anu (iz\u0146emot sadz\u012bves atkritumu re\u0123ener\u0101ciju), un to veido:<br \/>\n1) maksa par sadz\u012bves atkritumu sav\u0101k\u0161anu, p\u0101rvad\u0101\u0161anu, p\u0101rkrau\u0161anu, uzglab\u0101\u0161anu, dal\u012bt\u0101s atkritumu sav\u0101k\u0161anas, \u0161\u0137iro\u0161anas un p\u0101rkrau\u0161anas infrastrukt\u016bras objektu uztur\u0113\u0161anu atbilsto\u0161i l\u012bgumam, ko nosl\u0113gusi pa\u0161vald\u012bba un atkritumu apsaimniekot\u0101js;<br \/>\n2) sabiedrisko pakalpojumu regulatora apstiprin\u0101tais tarifs par sadz\u012bves atkritumu apglab\u0101\u0161anu atkritumu poligon\u0101, uz kuru pa\u0161vald\u012bbai ir j\u0101aizved noglab\u0101jamie atkritumi;<br \/>\n3) dabas resursu nodoklis (DRN) par atkritumu apglab\u0101\u0161anu normat\u012bvajos aktos noteiktaj\u0101 apm\u0113r\u0101.<\/p>\n<p>Aplams ir sabiedr\u012bb\u0101 valdo\u0161ais uzskats, ka at\u0161\u0137iroto atkritumu apsaimnieko\u0161anas izdevumi iedz\u012bvot\u0101jam nav j\u0101nosedz. Ra\u017eot\u0101ja atbild\u012bbas likums nosaka, ka tikai iepakojuma un atsevi\u0161\u0137u videi b\u012bstamo pre\u010du apsaimnieko\u0161anas izdevumus sedz to rad\u012bt\u0101js vai pre\u010du ieved\u0113js, bet p\u0101r\u0113jo atkritumu apsaimnieko\u0161ana ir j\u0101ietver kop\u0113j\u0101 tarif\u0101. P\u0113d\u0113j\u0101s ned\u0113\u013c\u0101s Valsts kontroles izvirz\u012btais jaut\u0101jums par atkritumu bl\u012bvuma atbilst\u012bbu un DRN nomaksu pa\u0161vald\u012bbas ietvaros b\u016btu j\u0101risina, regul\u0101ri p\u0101rsverot noteikta tilpuma sadz\u012bves atkritumu konteinerus un p\u0113c veikto praktisko m\u0113r\u012bjumu datiem nosakot gan konkursam iesniedzamo tarifu nov\u0113rt\u0113jumu par viena kubikmetra un vienas tonnas atkritumu apsaimnieko\u0161anu, gan noglab\u0101\u0161anai paredzamo atkritumu daudzumu. Ja iedz\u012bvot\u0101js ir ievietojis atkritumus ne\u0161\u0137irotu atkritumu konteiner\u0101, tas maks\u0101 dabas resursu nodokli \u2013 12 eiro par tonnu atkritumu. Ne\u0161\u0137irotu atkritumu p\u0101r\u0161\u0137iro\u0161ana un noglab\u0101jamo atkritumu samazin\u0101\u0161ana ir jau uz\u0146\u0113muma vai poligona zi\u0146\u0101.<\/p>\n<p>Sast\u0101dot tarifu, j\u0101paredz, ka tas praktiski veidojas no vair\u0101k\u0101m da\u013c\u0101m. Tarif\u0101 iek\u013cauj atkritumu transport\u0113\u0161anas izmaksas, darbasp\u0113ka izmaksas, administr\u0101cijas izmaksu da\u013cu un atkritumu noglab\u0101\u0161anas maksu, k\u0101 ar\u012b DRN. Ja konteiners nav piepild\u012bts vai ar\u012b t\u0101 izve\u0161ana ir trauc\u0113ta atkritumu rad\u012bt\u0101ja vainas d\u0113\u013c, uz\u0146\u0113mumam ir j\u0101sa\u0146em da\u013ca no tarifa, kas sedz t\u0101 izmaksas konteinera izve\u0161anai. Protams, vien\u0101 rakst\u0101 nav iesp\u0113jams ietvert visas noteikumu deta\u013cas, te noteikti b\u016btu v\u0113l j\u0101piemin nepiecie\u0161am\u012bba inform\u0113t iedz\u012bvot\u0101jus, katrai m\u0101jsaimniec\u012bbai sniedzot visu nepiecie\u0161amo inform\u0101ciju gan par tarifu un t\u0101 samaksas k\u0101rt\u012bbu, gan l\u012bgumu sl\u0113g\u0161anas nosac\u012bjumiem un iesp\u0113j\u0101m nodot \u0161\u0137iroti sav\u0101ktos atkritumus. Latvijas Atkritumu saimniec\u012bbas asoci\u0101cija ir pal\u012bdz\u0113jusi vair\u0101k\u0101m pa\u0161vald\u012bb\u0101m izveidot gan konkursa noteikumus, gan konkursa gait\u0101 izv\u0113l\u0113ties atkritumu apsaimniekot\u0101ju.
