Tom\u0113r ne maz\u0101k svar\u012bgs projekta izdo\u0161an\u0101s nosac\u012bjums ir atbilsto\u0161i sagatavots iepirkuma l\u012bgums, kas tiek sl\u0113gts ar iepirkuma proced\u016bras uzvar\u0113t\u0101ju (vai uzvar\u0113t\u0101jiem).<\/p>\n<p>Ilg\u0101 darba pieredze publisk\u0101 iepirkuma jom\u0101 man ir \u013c\u0101vusi veikt vair\u0101kus nov\u0113rojumus, kuri, cerams, var\u0113tu b\u016bt aktu\u0101li ar\u012b citiem \u0161aj\u0101 jom\u0101 str\u0101d\u0101jo\u0161iem speci\u0101listiem.<\/p>\n<p>1. Iepirkuma l\u012bgumi ne vienm\u0113r tiek pievienoti iepirkuma proced\u016bras dokument\u0101cijai jau iepirkuma procesa laik\u0101 (\u0161\u0101da situ\u0101cija notiek liel\u0101koties t\u0101d\u0113\u013c, ka publisko iepirkumu regul\u0113jo\u0161ie normat\u012bvie akti paredz oblig\u0101tu l\u012bguma pievieno\u0161anu iepirkuma proced\u016bras dokumentiem tikai atsevi\u0161\u0137u proced\u016bru gad\u012bjumos).<\/p>\n<p>2. Gad\u012bjumos, kad iepirkuma l\u012bguma projekts tom\u0113r ir pievienots iepirkuma dokument\u0101cijai, tirgus dal\u012bbnieki pat tad, ja k\u0101da l\u012bguma projekt\u0101 paredz\u0113t\u0101 norma tos neapmierina, neveic vai nov\u0113loti veic komunik\u0101ciju ar iepirkuma veic\u0113ju, l\u016bdzot kori\u0123\u0113t vai izsl\u0113gt no iepirkuma l\u012bguma projekta tiem net\u012bkamos vai neizpild\u0101mos nosac\u012bjumus.<\/p>\n<p>3. Iepirkumu uzraudz\u012bbas biroja Iesniegumu izskat\u012b\u0161anas komisijas prakse nav p\u0101r\u0101k labv\u0113l\u012bga tiem uz\u0146\u0113m\u0113jiem, kuri v\u0113las apstr\u012bd\u0113t iepirkuma dokument\u0101cijai pievienot\u0101 iepirkuma l\u012bguma projekta nosac\u012bjumus \u2013 Iepirkumu uzraudz\u012bbas birojs, v\u0113rt\u0113jot \u0161\u0101dus str\u012bdus, parasti p\u0101rbauda vien to, vai apstr\u012bd\u0113t\u0101 norma potenci\u0101li nerada nevienl\u012bdz\u012bgu attieksmi, t. i., vai t\u0101 k\u0101dam pieg\u0101d\u0101t\u0101jam nerada nepamatotas priek\u0161roc\u012bbas. Tom\u0113r bie\u017ei vien praks\u0113 netiek v\u0113rt\u0113ts, piem\u0113ram, tas, cik sam\u0113r\u012bgs ir noteiktais l\u012bgumsods.<!--more--><\/p>\n<p>4. Iepirkuma veic\u0113ji iepirkuma l\u012bguma projektos nereti paredz \u0101rk\u0101rt\u012bgi stingras sankcijas par l\u012bguma neizpildi vai pla\u0161u l\u012bguma izbeig\u0161anas gad\u012bjumu uzskait\u012bjumu, neizv\u0113rt\u0113jot to, ka pretendenti \u0161\u0101dus nosac\u012bjumus uzsver k\u0101 riskus, attiec\u012bgi iecenojot tos iepirkuma dokument\u0101cij\u0101 un t\u0101d\u0113j\u0101di palielinot savu pied\u0101v\u0101to cenu.<\/p>\n<p>Rezum\u0113jot ir j\u0101secina, ka atbilsto\u0161i eksist\u0113jo\u0161ajai praksei gad\u012bjumos, kad iepirkuma veic\u0113js iepirkuma l\u012bguma projekt\u0101 paredz, piem\u0113ram, bargas sankcijas par iepirkuma l\u012bguma neatbilsto\u0161u izpildi, tirgus dal\u012bbniekam var\u0113tu b\u016bt gr\u016bti \u0161\u0101das normas apstr\u012bd\u0113t Iepirkumu uzraudz\u012bbas biroj\u0101 un pan\u0101kt to atcel\u0161anu vai m\u012bkstin\u0101\u0161anu. Tom\u0113r tas nenoz\u012bm\u0113, ka iepirkuma veic\u0113jam vajadz\u0113tu izmantot \u0161o situ\u0101ciju un \u201cpiegriezt skr\u016bves\u201d, jo tas ietekm\u0113s konkurenci iepirkum\u0101 un pied\u0101v\u0101juma cenu.<\/p>\n<p>Viena no \u0161\u0101d\u0101m diskutabl\u0101m situ\u0101cij\u0101m iepirkuma praks\u0113 ir saist\u012bta ar pieg\u0101d\u0101t\u0101ju atbild\u012bbu par nodar\u012btajiem zaud\u0113jumiem un t\u0101s ierobe\u017eo\u0161anu. Proti, atsevi\u0161\u0137\u0101s jom\u0101s (piem\u0113ram, iek\u0101rtu pieg\u0101de laboratorij\u0101m, siltumapg\u0101des vai energoapg\u0101des infrastrukt\u016brai) starptautiskaj\u0101 praks\u0113 ir pie\u0146emts l\u012bgum\u0101 noteikt pieg\u0101d\u0101t\u0101ja kop\u0113j\u0101s atbild\u012bbas vai atbild\u012bbas par netie\u0161ajiem zaud\u0113jumiem apjoma ierobe\u017eojumus, kas nereti izpau\u017eas k\u0101 atbild\u012bbas griestu piel\u012bdzin\u0101\u0161ana konkr\u0113t\u0101 l\u012bguma summai.<\/p>\n<p>\u0160\u0101di nosac\u012bjumi pirmaj\u0101 br\u012bd\u012b var\u0113tu \u0161\u0137ist paradoks\u0101li \u2013 k\u0101d\u0113\u013c gan pieg\u0101d\u0101t\u0101jam par savas r\u012bc\u012bbas sek\u0101m neb\u016btu j\u0101atbild piln\u0101 apjom\u0101, tom\u0113r dzi\u013c\u0101ka anal\u012bze r\u0101da iemeslus, k\u0101d\u0113\u013c par tiem, iesp\u0113jams, b\u016btu v\u0113rts diskut\u0113t.<\/p>\n<p>1. Ja pieg\u0101d\u0101t\u0101js nodara zaud\u0113jumus pas\u016bt\u012bt\u0101jam, tas parasti nevar pak\u013caut sevi t\u0101du zaud\u0113jumu riskam, kuri nav sam\u0113rojami ar pa\u0161a l\u012bguma priek\u0161meta v\u0113rt\u012bbu (l\u012bguma summu). Ja iepirkuma l\u012bgum\u0101 netiek iek\u013cauta klauzula, kas ierobe\u017eo atbild\u012bbas apjomu, izveidojas situ\u0101cija, ka pieg\u0101d\u0101t\u0101js faktiski uz\u0146emas atbild\u012bbu par riskiem, ko tas tikai da\u013c\u0113ji sp\u0113j vad\u012bt vai ietekm\u0113t (piem\u0113ram, iek\u0101rtas defekta d\u0113\u013c tiek trauc\u0113ta ener\u0123ijas padeve, kas savuk\u0101rt nodara zaud\u0113jumus pa\u0161vald\u012bbas teritorij\u0101 str\u0101d\u0101jo\u0161ajiem uz\u0146\u0113mumiem).<\/p>\n<p>2. Pieg\u0101d\u0101t\u0101ji saprotamu iemeslu d\u0113\u013c nev\u0113las uz\u0146emties riskus, kas nav sam\u0113rojami ar ieguvumu no nosl\u0113gt\u0101 l\u012bguma. T\u0101pat pieg\u0101d\u0101t\u0101jiem ir ierobe\u017eotas iesp\u0113jas sagatavot p\u0101rdom\u0101tu finan\u0161u pied\u0101v\u0101jumu, ja tiem ir j\u0101uz\u0146emas riski, kuru apm\u0113rs nav prognoz\u0113jams pied\u0101v\u0101juma sagatavo\u0161anas br\u012bd\u012b.<\/p>\n<p>3. Atbild\u012bbas ierobe\u017eojumu neesam\u012bba l\u012bgum\u0101 b\u016bt\u012bb\u0101 noz\u012bm\u0113, ka iepirkuma veic\u0113js prezum\u0113 \u2013 ikviens pretendents ir sp\u0113j\u012bgs uz\u0146emties atbild\u012bbu un riskus vien\u0101d\u0101 apm\u0113r\u0101.
