PIL noteikts: ja pied\u0101v\u0101jums ir nepamatoti l\u0113ts, pas\u016bt\u012bt\u0101js pirms noraid\u012b\u0161anas rakstveid\u0101 pieprasa detaliz\u0113tu paskaidrojumu. Oga ar\u012b uzsver, ka <b>publisko iepirkumu regul\u0113jo\u0161ajos normat\u012bvajos aktos nepamatoti l\u0113ta pied\u0101v\u0101juma j\u0113dziens nav ietverts<\/b>. T\u0101pat \u0161ajos aktos nav ietverti krit\u0113riji, p\u0113c kuriem var\u0113tu konstat\u0113t, ka pied\u0101v\u0101jums ir nepamatoti l\u0113ts. Nepamatoti l\u0113ta pied\u0101v\u0101juma paz\u012bmes jeb apst\u0101k\u013ci, kas liecina par to, ka pied\u0101v\u0101jums ir nepamatoti l\u0113ts, izriet no IIK un tiesu prakses. Kas var liecin\u0101t, ka pied\u0101v\u0101jums ir nepamatoti l\u0113ts vai kad ir pamats iedarbin\u0101t \u201cnepamatoti l\u0113ta pied\u0101v\u0101juma p\u0101rbaudes meh\u0101nismu\u201d? Eksperte nor\u0101da, ka pas\u016bt\u012bt\u0101jam pamatotu aizdomu gad\u012bjum\u0101 ir j\u0101izv\u0113rt\u0113 pretendentu pied\u0101v\u0101to l\u012bgumcenu pamatot\u012bba un j\u0101izsl\u0113dz no dal\u012bbas proced\u016br\u0101 tie pretendenti, kuru iesniegtie pied\u0101v\u0101jumi ir nepamatoti l\u0113ti. Princip\u0101 nepamatoti l\u0113ta pied\u0101v\u0101juma identific\u0113\u0161anai var tikt izmantoti matem\u0101tiski krit\u0113riji, piem\u0113ram, pied\u0101v\u0101t\u0101s cenas at\u0161\u0137ir\u012bba sal\u012bdzin\u0101jum\u0101 ar visu iesniegto pied\u0101v\u0101jumu vid\u0113jo cenu, ta\u010du tas nevar b\u016bt pietiekams pamats pretendenta autom\u0101tiskai izsl\u0113g\u0161anai no proced\u016bras.
