T\u0101tad publiskas un atkl\u0101tas proced\u016bras ietvaros pas\u016bt\u012bt\u0101jam ir j\u0101nodro\u0161ina ierobe\u017eotas pieejam\u012bbas statuss un atbilsto\u0161a aizsardz\u012bba noteiktai inform\u0101cijai, ko pieg\u0101d\u0101t\u0101js ir nodevis pas\u016bt\u012bt\u0101jam l\u012bdz ar savu pied\u0101v\u0101jumu vai iepirkuma l\u012bguma izpildes ietvaros. Turkl\u0101t \u0161\u0101das proced\u016bras ietvaros pas\u016bt\u012bt\u0101jam ir j\u0101nodro\u0161ina ar\u012b pa\u0161am savas klasific\u0113tas inform\u0101cijas pien\u0101c\u012bga aizsardz\u012bba.<br \/>\n<!--more--><br \/>\nLai ar\u012b saska\u0146\u0101 ar Augst\u0101k\u0101s tiesas Sen\u0101ta Administrat\u012bvo lietu departamenta nolemto, Iepirkumu uzraudz\u012bbas biroja (IUB) un Administrat\u012bv\u0101s rajona tiesas nol\u0113mumiem cit\u0101s, iesp\u0113jams, l\u012bdz\u012bg\u0101s liet\u0101s nav prejudici\u0101las noz\u012bmes<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup>, informat\u012bviem nol\u016bkiem t\u0101l\u0101k tiek sniegta ar\u012b inform\u0101cija par IUB Iesniegumu izskat\u012b\u0161anas komisijas (Komisija) nolemto.<\/p>\n<p><strong>1. Iepirkuma proced\u016bras dokument\u0101cijas pieejam\u012bba un aizsardz\u012bba<\/strong><br \/>\nAtbilsto\u0161i iepirkumu izsludin\u0101\u0161anas un atkl\u0101t\u012bbas iev\u0113ro\u0161anas noteikumiem pas\u016bt\u012bt\u0101js nodro\u0161ina br\u012bvu un tie\u0161u elektronisku pieeju iepirkuma proced\u016bras dokumentiem un visiem papildus nepiecie\u0161amajiem dokumentiem, k\u0101 ar\u012b iesp\u0113ju ieinteres\u0113tajiem pieg\u0101d\u0101t\u0101jiem iepaz\u012bties uz vietas ar iepirkuma proced\u016bras dokumentiem<sup><a href=\"#fn6\" id=\"ref6\">6<\/a><\/sup>. T\u0101pat Likum\u0101 ir noteikts gan pas\u016bt\u012bt\u0101ja pien\u0101kums sniegt ieinteres\u0113tajiem pieg\u0101d\u0101t\u0101jiem papildu inform\u0101ciju, piem\u0113ram, par kandid\u0101tu atlases vai pied\u0101v\u0101juma pras\u012bb\u0101m<sup><a href=\"#fn7\" id=\"ref7\">7<\/a><\/sup>, gan pras\u012bbas attiec\u012bb\u0101 uz inform\u0101cijas apmai\u0146u<sup><a href=\"#fn8\" id=\"ref8\">8<\/a><\/sup> un elektronisku dokumentu sa\u0146em\u0161anu<sup><a href=\"#fn9\" id=\"ref9\">9<\/a><\/sup>.<\/p>\n<p>Min\u0113tie noteikumi nodro\u0161ina ties\u012bbas un iesp\u0113jas pieg\u0101d\u0101t\u0101jam sa\u0146emt visu ar iepirkumu saist\u012bto dokument\u0101ciju un inform\u0101ciju, lai tas var\u0113tu atbilsto\u0161i nov\u0113rt\u0113t savas sp\u0113jas un iesp\u0113jas, k\u0101 ar\u012b sagatavot un iesniegt pied\u0101v\u0101jumu. Pieg\u0101d\u0101t\u0101jam, to darot, ir j\u0101\u0146em v\u0113r\u0101, ka konfidencialit\u0101tes pras\u012bbas ir attiecin\u0101mas ne tikai uz inform\u0101ciju, kas pas\u016bt\u012bt\u0101jam tiek nodota no pieg\u0101d\u0101t\u0101ja puses, bet ar\u012b inform\u0101ciju, ko pas\u016bt\u012bt\u0101js no savas puses nodod pieg\u0101d\u0101t\u0101jam. Proti, pas\u016bt\u012bt\u0101js var izvirz\u012bt nosac\u012bjumus t\u0101s inform\u0101cijas aizsardz\u012bbai, kuru kop\u0101 ar tehniskaj\u0101m specifik\u0101cij\u0101m vai iepirkuma proced\u016bras laik\u0101 tas ir nodevis pieg\u0101d\u0101t\u0101jiem<sup><a href=\"#fn10\" id=\"ref10\">10<\/a><\/sup>. \u0160is publisko iepirkumu aspekts pieg\u0101d\u0101t\u0101jiem ir j\u0101\u0146em v\u0113r\u0101, jo pas\u016bt\u012bt\u0101js var b\u016bt ne tikai, piem\u0113ram, valsts vai pa\u0161vald\u012bbas iest\u0101de, bet ar\u012b Likum\u0101 noteiktajiem krit\u0113rijiem atbilsto\u0161a priv\u0101to ties\u012bbu juridisk\u0101 persona<sup><a href=\"#fn11\" id=\"ref11\">11<\/a><\/sup>. T\u0101tad iepirkuma proced\u016bras ietvaros komercnosl\u0113pumu saturo\u0161u inform\u0101ciju var ietvert ne tikai pieg\u0101d\u0101t\u0101ja pied\u0101v\u0101jums, bet ar\u012b pas\u016bt\u012bt\u0101ja sniegt\u0101 inform\u0101cija.<\/p>\n<p>Saist\u012bb\u0101 ar \u0161o ir j\u0101nor\u0101da, ka IUB Komisija sav\u0101 praks\u0113 ir skat\u012bjusi jaut\u0101jumu, vai pas\u016bt\u012bt\u0101js pamatoti ir atzinis, ka tehnisk\u0101 specifik\u0101cija piln\u0101 apm\u0113r\u0101 ir uzskat\u0101ma par komercnosl\u0113pumu<sup><a href=\"#fn12\" id=\"ref12\">12<\/a><\/sup>. \u0160aj\u0101 liet\u0101 IUB Komisija nor\u0101d\u012bja, ka atbilsto\u0161i Likuma noteikumiem<sup><a href=\"#fn13\" id=\"ref13\">13<\/a><\/sup> tehniskajai specifik\u0101cijai k\u0101 dokumentu kopumam ir j\u0101b\u016bt visp\u0101rpieejamai, t\u0101p\u0113c pas\u016bt\u012bt\u0101js nav ties\u012bgs visai tehniskajai specifik\u0101cijai kopum\u0101 noteikt komercnosl\u0113puma statusu, k\u0101 ar\u012b pas\u016bt\u012bt\u0101jam k\u0101 publiskai personai ir j\u0101veic nepiecie\u0161am\u0101s darb\u012bbas, lai nov\u0113rstu situ\u0101ciju, ka priv\u0101tpersonai nepamatoti tiek liegta piek\u013cuve inform\u0101cijai, kas ir atz\u012bstama par visp\u0101rpieejamu<sup><a href=\"#fn14\" id=\"ref14\">14<\/a><\/sup>. Turkl\u0101t IUB Komisija ar\u012b konstat\u0113ja, ka pas\u016bt\u012bt\u0101ja un tehnisk\u0101s specifik\u0101cijas izstr\u0101d\u0101t\u0101ja nosl\u0113gt\u0101s vieno\u0161an\u0101s noteikumi attiec\u012bb\u0101 uz izstr\u0101d\u0101to dokumentu, kas tiek izmantots citas iepirkumu proced\u016bras ietvaros, nedr\u012bkst b\u016bt pretrun\u0101 ar Likuma nosac\u012bjumiem<sup><a href=\"#fn15\" id=\"ref15\">15<\/a><\/sup>. T\u0101tad saska\u0146\u0101 ar IUB Komisijas secin\u0101jumiem ir pie\u013caujama konfidencialit\u0101tes noteik\u0161ana attiec\u012bb\u0101 uz atsevi\u0161\u0137iem tehnisk\u0101s specifik\u0101cijas tehniskajiem risin\u0101jumiem, bet nav pie\u013caujama komercnosl\u0113puma statusa pie\u0161\u0137ir\u0161ana visai tehniskajai specifik\u0101cijai kopum\u0101.<\/p>\n<p>K\u0101 v\u0113l vienu piem\u0113ru saist\u012bb\u0101 ar pas\u016bt\u012bt\u0101ju sniegt\u0101s inform\u0101cijas aizsardz\u012bbu var nor\u0101d\u012bt IUB Komisijas skat\u012bto jaut\u0101jumu par iesp\u0113ju pieg\u0101d\u0101t\u0101jiem iepaz\u012bties ar pied\u0101v\u0101juma sagatavo\u0161anai nepiecie\u0161amo inform\u0101ciju maz\u0101k ierobe\u017eojo\u0161\u0101 veid\u0101<sup><a href=\"#fn16\" id=\"ref16\">16<\/a><\/sup>. Skatot \u0161o iesniegumu, IUB Komisija secin\u0101ja, ka pas\u016bt\u012bt\u0101ja kompetenc\u0113 ir noteikt, vai attiec\u012bg\u0101s sist\u0113mas tehnisk\u0101 dokument\u0101cija ir uzskat\u0101ma par ierobe\u017eotas pieejam\u012bbas inform\u0101ciju, noteikt t\u0101s aizsardz\u012bbu un veidu, k\u0101d\u0101 pretendenti var iepaz\u012bties ar \u0161o inform\u0101ciju, ja tas nepiecie\u0161ams pied\u0101v\u0101juma sagatavo\u0161anai un iesnieg\u0161anai<sup><a href=\"#fn17\" id=\"ref17\">17<\/a><\/sup>. T\u0101pat IUB Komisija secin\u0101ja, ka pas\u016bt\u012bt\u0101js, izv\u0113rt\u0113jot iesp\u0113jamos riskus, k\u0101 ar\u012b \u0146emot v\u0113r\u0101 ieinteres\u0113to pieg\u0101d\u0101t\u0101ju intereses, ir noteicis \u012bpa\u0161u k\u0101rt\u012bbu, k\u0101 pretendenti var iepaz\u012bties ar sist\u0113mas tehnisko dokument\u0101ciju, ja tie uzskata, ka min\u0113t\u0101 inform\u0101cija ir nepiecie\u0161ama pied\u0101v\u0101juma sagatavo\u0161an\u0101. \u0160aj\u0101 gad\u012bjum\u0101 IUB Komisija uzskat\u012bja, ka iepirkuma nolikum\u0101 pas\u016bt\u012bt\u0101js ir iek\u013c\u0101vis visu nepiecie\u0161amo inform\u0101ciju, lai pretendenti var\u0113tu sagatavot un iesniegt pied\u0101v\u0101jumus, k\u0101 ar\u012b nodro\u0161in\u0101jis pretendentiem piesp\u0113ju iepaz\u012bties ar papildu inform\u0101ciju, ja pretendenti to uzskata par nepiecie\u0161amu.<\/p>\n<p>T\u0101tad pieg\u0101d\u0101t\u0101jam ir nodro\u0161in\u0101tas ties\u012bbas un iesp\u0113jas sa\u0146emt ar iepirkumu saist\u012bto dokument\u0101ciju un inform\u0101ciju, lai tas var\u0113tu atbilsto\u0161i nov\u0113rt\u0113t savas sp\u0113jas un iesp\u0113jas un sagatavot un iesniegt savu pied\u0101v\u0101jumu, tom\u0113r ir j\u0101\u0146em v\u0113r\u0101, ka konfidencialit\u0101tes pras\u012bbas ir attiecin\u0101mas ar\u012b uz inform\u0101ciju, ko pas\u016bt\u012bt\u0101js no savas puses nodod pieg\u0101d\u0101t\u0101jam.<\/p>\n<p><strong>2. Pied\u0101v\u0101jum\u0101 ietvert\u0101 komercnosl\u0113puma aizsardz\u012bba:<\/strong><\/p>\n<ul>\n<em>a. Komercnosl\u0113puma identific\u0113\u0161ana pied\u0101v\u0101jum\u0101<\/em><\/ul>\n<p>Likum\u0101 ietvertie konfidencialit\u0101tes noteikumi paredz, ka pas\u016bt\u012bt\u0101js, pazi\u0146ojot par l\u012bguma sl\u0113g\u0161anu un inform\u0113jot kandid\u0101tus un pretendentus, nav ties\u012bgs atkl\u0101t inform\u0101ciju, kuru tam k\u0101 komercnosl\u0113pumu vai konfidenci\u0101lu inform\u0101ciju nodevu\u0161i citi pieg\u0101d\u0101t\u0101ji<sup><a href=\"#fn18\" id=\"ref18\">18<\/a><\/sup>. Pie\u013caujot iesp\u0113ju, ka var\u0113tu m\u0113\u0123in\u0101t interpret\u0113t, ka \u0161ie noteikumi ir attiecin\u0101mi tikai uz citiem pieg\u0101d\u0101t\u0101jiem<sup><a href=\"#fn19\" id=\"ref19\">19<\/a><\/sup>, nevis citiem pretendentiem<sup><a href=\"#fn20\" id=\"ref20\">20<\/a><\/sup>, j\u0101nor\u0101da, ka pretendenta iesp\u0113jas pras\u012bt iesniegt\u0101 pied\u0101v\u0101juma aizsardz\u012bbu ir noteiktas ar\u012b citos Likuma noteikumos, paredzot gan iesp\u0113ju pretendentam nor\u0101d\u012bt iepirkuma priek\u0161metu vai atsevi\u0161\u0137as t\u0101 da\u013cas, attiec\u012bb\u0101 uz kur\u0101m ir nepiecie\u0161ams iev\u0113rot komercnosl\u0113pumu<sup><a href=\"#fn21\" id=\"ref21\">21<\/a><\/sup>, gan piekri\u0161anas nepiecie\u0161am\u012bbu, lai proced\u016bras citiem atkl\u0101tu pied\u0101v\u0101tos risin\u0101jumus un citu inform\u0101ciju, kas ir komercnosl\u0113pums<sup><a href=\"#fn22\" id=\"ref22\">22<\/a><\/sup>.<\/p>\n<p>Likum\u0101 noteiktais pien\u0101kums pied\u0101v\u0101jum\u0101 iek\u013caut ar\u012b komercnosl\u0113pumu saturo\u0161u inform\u0101ciju ir ticis ar\u012b uzsv\u0113rts atsevi\u0161\u0137os IUB Komisijas l\u0113mumos, v\u0113rt\u0113jot pas\u016bt\u012bt\u0101ju ties\u012bbas izvirz\u012bt attiec\u012bgas pras\u012bbas. Piem\u0113ram, skatot str\u012bdu, vai iepriek\u0161\u0113j\u0101s pieredzes apliecin\u0101\u0161anai pied\u0101v\u0101jum\u0101 ir j\u0101nor\u0101da iepriek\u0161 sniegto l\u012bdzv\u0113rt\u012bgu pakalpojumu l\u012bgumcenas, IUB Komisija ir nor\u0101d\u012bjusi, ka tai nav saprotams izvirz\u012btais arguments, ka iepriek\u0161 sniegto pakalpojumu l\u012bgumcenas ir uzskat\u0101mas par komercnosl\u0113pumu un t\u0101d\u0113j\u0101di t\u0101s nebija j\u0101nor\u0101da iepirkum\u0101 iesniegtaj\u0101 pied\u0101v\u0101jum\u0101<sup><a href=\"#fn23\" id=\"ref23\">23<\/a><\/sup>. Citas personas komercnosl\u0113puma ietver\u0161ana pied\u0101v\u0101jum\u0101<\/em><\/ul>\n<p>Sagatavojot un iesniedzot pied\u0101v\u0101jumu iepirkum\u0101, nevar tikt izsl\u0113gta iesp\u0113ja, ka taj\u0101 tiek ietverta ar\u012b citai personai piedero\u0161a komercnosl\u0113pumu saturo\u0161a inform\u0101cija. \u0160\u0101d\u0101 situ\u0101cij\u0101 viens no aspektiem saist\u0101s ar \u0161\u0101das inform\u0101cijas identific\u0113\u0161anu pied\u0101v\u0101jum\u0101 un atbilsto\u0161as aizsardz\u012bbas nodro\u0161in\u0101\u0161anu, ta\u010du noteikti ir j\u0101v\u0113rt\u0113 ar\u012b tas, vai pieg\u0101d\u0101t\u0101js visp\u0101r var tiesiski \u0161\u0101du inform\u0101ciju ieg\u016bt un iek\u013caut sav\u0101 pied\u0101v\u0101jum\u0101.<\/p>\n<p>Saist\u012bb\u0101 ar \u0161o var norad\u012bt uz IUB Komisijas sniegto v\u0113rt\u0113jumu par iepirkum\u0101 noteikto pras\u012bbu aprakst\u012bt citai personai piedero\u0161u r\u016bpn\u012bcu un \u0161\u012bs r\u016bpn\u012bcas iek\u0161\u0113jo tehnolo\u0123isko procesu<sup><a href=\"#fn25\" id=\"ref25\">25<\/a><\/sup>. \u0160aj\u0101 liet\u0101 tika izvirz\u012bti argumenti, ka pras\u012bba pied\u0101v\u0101jumos iek\u013caut inform\u0101ciju par r\u016bpn\u012bcas svar\u012bg\u0101kajiem tehniskajiem datiem un t\u0101s pieejam\u012bbu ir nepamatota gad\u012bjum\u0101, ja pretendents iepirkuma l\u012bguma izpildes ietvaros ir paredz\u0113jis ieg\u0101d\u0101ties attiec\u012bg\u0101s preces no cita ra\u017eot\u0101ja, nevis t\u0101s ra\u017eot sev piedero\u0161\u0101 vai vald\u012bjum\u0101 eso\u0161\u0101 r\u016bpn\u012bc\u0101, jo iepirkum\u0101 pras\u012bt\u0101 inform\u0101cija ir pieejama tikai konkr\u0113t\u0101s r\u016bpn\u012bcas \u012bpa\u0161niekam vai vald\u012bt\u0101jam, l\u012bdz ar to ir iesp\u0113jamas situ\u0101cijas, kad attiec\u012bg\u0101s r\u016bpn\u012bcas \u012bpa\u0161nieks vai vald\u012bt\u0101js nevar izsniegt, atsak\u0101s izsniegt vai izsniedz pretendentam nepiln\u012bgu inform\u0101ciju par r\u016bpn\u012bcas tehniskajiem parametriem, savuk\u0101rt pretendentam k\u0101 priv\u0101to ties\u012bbu juridiskai personai nav tiesisku l\u012bdzek\u013cu, lai uzliktu r\u016bpn\u012bcas \u012bpa\u0161niekam vai vald\u012bt\u0101jam pien\u0101kumu izpaust galveno iek\u0101rtu tehniskos parametrus, k\u0101 ar\u012b r\u016bpn\u012bcas iek\u0161\u0113jo tehnolo\u0123isko procesu<sup><a href=\"#fn26\" id=\"ref26\">26<\/a><\/sup>. Konfidencialit\u0101tes saist\u012bbas iepirkuma l\u012bgum\u0101<\/strong><\/p>\n<p>K\u0101 v\u0113l viens no aspektiem, kas saist\u012bts ar komercnosl\u0113pumu saturo\u0161as inform\u0101cijas aizsardz\u012bbu iepirkuma proced\u016br\u0101, ir j\u0101nor\u0101da ar\u012b iepirkuma l\u012bgums un taj\u0101 ietvertie konfidencialit\u0101tes noteikumi. Komercnosl\u0113puma aizsardz\u012bba iepirkuma l\u012bguma izpild\u0113<\/strong><\/p>\n<p>Komercnosl\u0113pumu saturo\u0161a inform\u0101cija var tikt iek\u013cauta gan iepirkuma proced\u016bras ietvaros iesniegtaj\u0101 pied\u0101v\u0101jum\u0101, gan v\u0113l\u0101k izpausta pas\u016bt\u012bt\u0101jam jau iepirkuma l\u012bguma ietvaros. \u0160aj\u0101 sakar\u0101 svar\u012bgi ir atcer\u0113ties publisko un priv\u0101to ties\u012bbu robe\u017eu publisko iepirkumu jom\u0101, proti, l\u012bdz ar iepirkuma l\u012bguma nosl\u0113g\u0161anu pas\u016bt\u012bt\u0101ja r\u012bc\u012bba s\u0101kas priv\u0101to ties\u012bbu jom\u0101<sup><a href=\"#fn50\" id=\"ref50\">50<\/a><\/sup>.<br \/>\nV\u0113rt\u0113jot pas\u016bt\u012bt\u0101ja ties\u012bbas iepirkuma l\u012bguma izpildes ietvaros sa\u0146emt ar l\u012bguma izpildi saist\u012btu komercnosl\u0113pumu saturo\u0161u inform\u0101ciju un saist\u012bb\u0101 ar \u0161o izvirz\u012bto argumentu, ka komercnosl\u0113puma izpau\u0161ana var rad\u012bt kait\u0113jumu izpild\u012bt\u0101jam, IUB Komisija atzina, ka izpild\u012bt\u0101ja pien\u0101kums sniegt pas\u016bt\u012bt\u0101ja l\u016bgto inform\u0101ciju par pakalpojumu nav uzskat\u0101ms par nesam\u0113r\u012bgu vai izpild\u012bt\u0101ja ties\u012bbas p\u0101rlieku ierobe\u017eojo\u0161u<sup><a href=\"#fn51\" id=\"ref51\">51<\/a><\/sup>.
