Iepirkuma proced\u016bras p\u0101rskat\u012b\u0161anas meh\u0101nismi ir vieni no galvenajiem instrumentiem iepirkuma atkl\u0101tuma, pieg\u0101d\u0101t\u0101ju br\u012bvas konkurences, vienl\u012bdz\u012bgas un taisn\u012bgas attieksmes \u012bsteno\u0161an\u0101, k\u0101 ar\u012b sabiedrisko pakalpojumu sniedz\u0113ju un publisko personu l\u012bdzek\u013cu efekt\u012bv\u0101 izmanto\u0161an\u0101.<\/p>\n<p><a href=\"http:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2014\/08\/apstridesana.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2014\/08\/apstridesana.png\" alt=\"apstridesana\" width=\"531\" height=\"428\" class=\"aligncenter size-full wp-image-4140\" srcset=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2014\/08\/apstridesana.png 531w, https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2014\/08\/apstridesana-336x270.png 336w\" sizes=\"(max-width: 531px) 100vw, 531px\" \/><\/a><\/p>\n<p><strong>Kad rodas zin\u0101ms ties\u012bbu aizsardz\u012bbas vakuums<\/strong><\/p>\n<p>\u012apa\u0161i aktu\u0101li tas ir sabiedrisko pakalpojumu sniedz\u0113ju iepirkumos, kur l\u012bgumcenu robe\u017ev\u0113rt\u012bbas ir krietni augst\u0101kas nek\u0101 Publisko iepirkumu likumu gad\u012bjum\u0101. Saska\u0146\u0101 ar 2010. gada 7. septembra Ministru kabineta noteikumiem Nr. 840 <em>Noteikumi par sabiedrisko pakalpojumu sniedz\u0113ju iepirkumu l\u012bgumcenu robe\u017e\u0101m<\/em> robe\u017ev\u0113rt\u012bba b\u016bvdarbu l\u012bgumiem ir EUR 5 186\u00a0000, savuk\u0101rt pieg\u0101des un pakalpojumu l\u012bgumiem robe\u017ev\u0113rt\u012bba ir EUR 414\u00a0000.  <\/p>\n<p>Tas noz\u012bm\u0113, ka gad\u012bjumos, kad sabiedrisko pakalpojumu sniedz\u0113js r\u012bko pieg\u0101des vai pakalpojumu iepirkumu un t\u0101 v\u0113rt\u012bba ir EUR 300\u00a0000, turkl\u0101t pas\u016bt\u012bt\u0101js neizmanto SPSIL nor\u0101d\u012bt\u0101s ties\u012bbas piem\u0113rot \u0161\u012b likuma normas, ieinteres\u0113taj\u0101m person\u0101m SPSIL \u0161aj\u0101 gad\u012bjum\u0101 neparedz ties\u012bbas apstr\u012bd\u0113t \u0161o proced\u016bru. Turkl\u0101t t\u0101d\u0101 gad\u012bjum\u0101 ir apdraud\u0113ta ne tikai ieinteres\u0113to personu ties\u012bbu aizsardz\u012bba, bet ar\u012b p\u0101rraudz\u012bba p\u0101r efekt\u012bvu publisko l\u012bdzek\u013cu izmanto\u0161anu. Var pat teikt, ka gad\u012bjumos, kad l\u012bgumcena nesasniedz noteikt\u0101s robe\u017ev\u0113rt\u012bbas, rodas zin\u0101ms ties\u012bbu aizsardz\u012bbas vakuums. <\/p>\n<p>K\u0101 piem\u0113ru var min\u0113t vienu 2013. gada sabiedrisk\u0101 pakalpojumu sniedz\u0113ja iepirkumu par datorsist\u0113mu uztur\u0113\u0161anu, kura paredzam\u0101 l\u012bgumcena bija LVL 15\u00a0000 \u2013 16\u00a0000 (EUR 21\u00a0343 \u2013 EUR 22 765). Min\u0113taj\u0101 iepirkuma proced\u016br\u0101 pretendents tika izsl\u0113gts no turpm\u0101k\u0101s dal\u012bbas t\u0101p\u0113c, ka pretendenta iesniegtais pied\u0101v\u0101jums nebija atbilsto\u0161s iepirkuma dokument\u0101cijas pras\u012bb\u0101m. <\/p>\n<p>Min\u0113to pas\u016bt\u012bt\u0101ja l\u0113mumu pretendents apstr\u012bd\u0113ja Administrat\u012bvaj\u0101 rajona ties\u0101, kura atteica lietas izskat\u012b\u0161anu, nor\u0101dot, ka SPSIL neparedz apstr\u012bd\u0113t iepirkumu proced\u016bru, kuru paredzam\u0101 l\u012bgumcena nesasniedz noteikt\u0101s v\u0113rt\u012bbas, rezult\u0101tus. Pretendents p\u0101rs\u016bdz\u0113ja Administrat\u012bv\u0101s rajona tiesas l\u0113mumu apgabalties\u0101 un Augst\u0101k\u0101s tiesas Sen\u0101t\u0101. Savuk\u0101rt Augst\u0101k\u0101s tiesas Sen\u0101ts pie\u0146\u0113ma l\u0113mumu, ar kuru tika atcelts Administrat\u012bv\u0101s rajona tiesas l\u0113mums un tika groz\u012bta judikat\u016bra. \u0160is Augst\u0101k\u0101s tiesas Sen\u0101ta Administrat\u012bvo lietu departamenta l\u0113mums tiks pla\u0161\u0101k apskat\u012bts \u0161\u012b raksta turpin\u0101jum\u0101. <\/p>\n<p><strong>ES Tiesas judikat\u016bras piem\u0113ro\u0161ana<\/strong><\/p>\n<p>Efekt\u012bva ties\u012bbu aizsardz\u012bbas un iepirkumu proced\u016bru p\u0101rskat\u012b\u0161anas meh\u0101nisma neesam\u012bba nav pie\u013caujama, l\u012bdz ar to ar\u012b no SPSIL izrieto\u0161\u0101 nepiln\u012bba attiec\u012bb\u0101 uz iepirkumiem, kas nesasniedz robe\u017ev\u0113rt\u012bbu. <\/p>\n<p>Attiec\u012bb\u0101 uz \u0161\u012bs situ\u0101cijas risin\u0101\u0161anu ir j\u0101\u0146em v\u0113r\u0101 2014. gada 26. febru\u0101ra Eiropas Parlamenta un Padomes Direkt\u012bva 2014\/25\/ES par iepirkumu, ko \u012bsteno subjekti, kuri darbojas \u016bdensapg\u0101des, ener\u0123\u0113tikas, transporta un pasta pakalpojumu nozar\u0113s, un ar ko atce\u013c Direkt\u012bvu 2004\/17\/EK (turpm\u0101k \u2013 Direkt\u012bva).<\/p>\n<p>Min\u0113t\u0101s Direkt\u012bvas preambulas 3. punkts nosaka: \u201cAttiec\u012bb\u0101 uz iepirkumu, kam ir zem\u0101ka v\u0113rt\u012bba par robe\u017ev\u0113rt\u012bbu, no kuras s\u0101k piem\u0113rot Savien\u012bbas l\u012bme\u0146a koordin\u0113\u0161anas noteikumus, ieteicams v\u0113rst uzman\u012bbu uz Eiropas Savien\u012bbas Tiesas judikat\u016bru attiec\u012bb\u0101 uz L\u012bguma noteikumu un principu pareizu piem\u0113ro\u0161anu.\u201d<\/p>\n<p>ES Tiesa vair\u0101kos nol\u0113mumos ir nor\u0101d\u012bjusi, ka tas, ka publisk\u0101 iepirkuma l\u012bguma v\u0113rt\u012bba nesasniedz Kopienu noteikumos noteikto robe\u017ev\u0113rt\u012bbu, tom\u0113r nenoz\u012bm\u0113, ka uz \u0161o publisko iepirkumu l\u012bgumu nemaz neattiecas Kopienu ties\u012bbas. T\u0101da l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas proced\u016br\u0101, kura v\u0113rt\u012bba nesasniedz min\u0113to robe\u017ev\u0113rt\u012bbu, j\u0101iev\u0113ro L\u012bguma pamatnoteikumi un it \u012bpa\u0161i vienl\u012bdz\u012bbas princips (Eiropas Savien\u012bbas Tiesas 2009. gada 29. decembra spriedums liet\u0101 Nr. C-376\/08).<\/p>\n<p><strong>Ar\u012b iepirkumi, kas nesasniedz robe\u017ev\u0113rt\u012bbu, nevar b\u016bt patva\u013c\u012bgi<\/strong><\/p>\n<p>No min\u0113t\u0101s ES tiesas atzi\u0146as izriet \u2013 ja iepirkuma proced\u016bras nesasniedz noteiktu robe\u017ev\u0113rt\u012bbu, tad tas nav pamats person\u0101m, kuras ieinteres\u0113tas ieg\u016bt l\u012bgumsl\u0113g\u0161anas ties\u012bbas, ierobe\u017eot iesp\u0113jas veikt \u0161o apstr\u012bd\u0113\u0161anu, proti, tiesiskuma p\u0101rskat\u012b\u0161anu. <\/p>\n<p>Tas noz\u012bm\u0113 ar\u012b to, ka sabiedrisko pakalpojumi sniedz\u0113ji nav piln\u012bb\u0101 br\u012bvi un neierobe\u017eoti sav\u0101 r\u012bc\u012bb\u0101 iepirkuma proced\u016br\u0101s, kur\u0101s l\u012bgumcena nesasniedz noteikt\u0101s v\u0113rt\u012bbas un SPSIL normas attiec\u012bgajai iepirkumu proced\u016brai nav piem\u0113rojamas. Ar\u012b t\u0101dos gad\u012bjumos past\u0101v vair\u0101ki principi, kuri pas\u016bt\u012bt\u0101jiem ir j\u0101iev\u0113ro jebkur\u0101 gad\u012bjum\u0101, neskatoties uz iepirkuma proced\u016bras apjomiem. <\/p>\n<p>Eiropas Komisija, atsaucoties uz ES tiesas judikat\u016bru nor\u0101d\u012bjusi, ka ar\u012b iepirkumi, kas nesasniedz robe\u017ev\u0113rt\u012bbu, nevar b\u016bt patva\u013c\u012bgi un tajos j\u0101iev\u0113ro pre\u010du br\u012bvas aprites, ties\u012bbu veikt uz\u0146\u0113m\u0113jdarb\u012bbu, pakalpojumu snieg\u0161anas br\u012bv\u012bbas, nediskrimin\u0101cijas un vienl\u012bdz\u012bgas attieksmes, p\u0101rskat\u0101m\u012bbas un savstarp\u0113j\u0101s atz\u012b\u0161anas principi. (Skat. Skaidrojo\u0161\u0101 pazi\u0146ojuma par Kopienas ties\u012bbu aktiem, ko piem\u0113ro l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161an\u0101, uz ko neattiecas vai tikai da\u013c\u0113ji attiecas publisk\u0101 iepirkuma direkt\u012bvu noteikumi, Nr.2006\/C 179\/02 1.1.punktu, pieejams: <a href=\"http:\/\/iub.gov.lv\/files\/upload\/ftp\/item_file_2127_lexuriserv_lv.pdf\" target=\"_blank\">http:\/\/iub.gov.lv\/files\/upload\/ftp\/item_file_2127_lexuriserv_lv.pdf<\/a>).<\/p>\n<p>Lai \u0161\u0101du ties\u012bbu izmanto\u0161ana b\u016btu efekt\u012bva, t\u0101m j\u0101bauda tiesas aizsardz\u012bba. Lai izpild\u012btu \u0161o pras\u012bbu par efekt\u012bvu tiesisko aizsardz\u012bbu, ir j\u0101p\u0101rskata vismaz t\u0101di l\u0113mumi, kas nelabv\u0113l\u012bgi ietekm\u0113 personas, kuras izr\u0101da vai ir izr\u0101d\u012bju\u0161as interesi par l\u012bguma sl\u0113g\u0161anas ties\u012bbu ieg\u016b\u0161anu, piem\u0113ram, l\u0113mumi par k\u0101da pieteikuma iesniedz\u0113ja vai pretendenta izsl\u0113g\u0161anu, p\u0101rbaudot, vai nav p\u0101rk\u0101pti pamatstandarti, kas izriet no Kopienas prim\u0101rajiem ties\u012bbu aktiem (skat. turpat 2.3.3. punktu).<\/p>\n<p>T\u0101tad var secin\u0101t, ka l\u012bgumcenas nepietiekams apm\u0113rs nav pamats liegt iesp\u0113ju personai, kura bija ieinteres\u0113ta l\u012bguma sl\u0113g\u0161anas ties\u012bbu ieg\u016b\u0161an\u0101, iesniegt attiec\u012bgu iesniegumu par iepirkumu proced\u016bras rezult\u0101tiem un t\u0101d\u0101 veid\u0101 veikt t\u0101s tiesiskuma kontroli. <\/p>\n<p><strong>LR Augst\u0101k\u0101s tiesas Sen\u0101ta l\u0113mums<\/strong><\/p>\n<p>Tie\u0161a regul\u0113jama neesam\u012bba nav pamats noraid\u012bt priv\u0101tpersonu iesniegumus par attiec\u012bgaj\u0101m sabiedrisko pakalpojumu sniedz\u0113ju iepirkumu proced\u016br\u0101m. To ir atzinis ar\u012b Latvijas Republikas Augst\u0101k\u0101s tiesas Sen\u0101ta Administrat\u012bvo lietu departaments sav\u0101 2013. gada 1. j\u016blija l\u0113mum\u0101, ar kuru tikai main\u012bta judikat\u016bra. <\/p>\n<p>Min\u0113t\u0101j\u0101 l\u0113mum\u0101 Sen\u0101ts nor\u0101d\u012bja, ka atbilsto\u0161i visp\u0101r\u0113jiem ties\u012bbu principiem ar\u012b sabiedrisko pakalpojumu sniedz\u0113ju iepirkumi, kas nesasniedz robe\u017ev\u0113rt\u012bbu un uz kuru organiz\u0113\u0161anu likumi neattiecina detaliz\u0113tas pras\u012bbas, nevar b\u016bt patva\u013c\u012bgi. Tas atspogu\u013cojas cit\u0101 normat\u012bvaj\u0101 ties\u012bbu akt\u0101, kas regul\u0113 publisk\u0101 iepirkuma jomu \u2013 Publisko iepirkumu likum\u0101. Publisko iepirkumu likuma 8.1 pants (\u0161obr\u012bd 8.<sup>2<\/sup> pants \u2013 aut. piebilde) paredz noregul\u0113jumu iepirkumiem, kuru l\u012bgumcena nesasniedz noteiktu robe\u017ev\u0113rt\u012bbu. Nepast\u0101vot b\u016btisk\u0101m at\u0161\u0137ir\u012bb\u0101m noregul\u0113juma m\u0113r\u0137os, Publisko iepirkumu likuma 8.<sup>1<\/sup> pant\u0101 (\u0161obr\u012bd 8.<sup>2<\/sup> pants \u2013 aut. piebilde) min\u0113to ties\u012bbu aizsardz\u012bbas meh\u0101nismu var piem\u0113rot p\u0113c analo\u0123ijas sabiedrisko pakalpojumu sniedz\u0113ju r\u012bkotajos iepirkumos.  <\/p>\n<p>K\u0101 redzams, min\u0113tais Augst\u0101k\u0101s tiesas Sen\u0101ta Administrat\u012bvo lietu departamenta l\u0113mums ievie\u0161 ne tikai skaidr\u012bbu par to, ka person\u0101m ir ties\u012bbas apstr\u012bd\u0113t iepirkuma proced\u016bras, kur\u0101s l\u012bgumcena nesasniedz noteikt\u0101s robe\u017ev\u0113rt\u012bbas, bet ar\u012b sniedz nor\u0101di par to, k\u0101ds tiesiskais regul\u0113jums t\u0101dos gad\u012bjumos b\u016btu piem\u0113rojams. <\/p>\n<p>Proti, Augst\u0101k\u0101 tiesa nor\u0101da, ka gad\u012bjumos, kad iepirkuma proced\u016bras l\u012bgumcena nesasniedz noteikt\u0101s robe\u017ev\u0113rt\u012bbas, ir pielietojams l\u012bdz\u012bgs Publisko iepirkumu likuma 8.<sup>2<\/sup> panta regul\u0113jums. Attiec\u012bb\u0101 uz iepirkuma proced\u016bru rezult\u0101tu apstr\u012bd\u0113\u0161anu Publisko iepirkumu likuma 8.<sup>2<\/sup> panta asto\u0146padsmit\u0101 da\u013ca nosaka, ka: \u201cPretendents, kas iesniedzis pied\u0101v\u0101jumu iepirkum\u0101, uz kuru attiecas \u0161\u0101 panta noteikumi, un kas uzskata, ka ir aizskartas t\u0101 ties\u012bbas vai ir iesp\u0113jams \u0161o ties\u012bbu aizsk\u0101rums, ir ties\u012bgs pie\u0146emto l\u0113mumu p\u0101rs\u016bdz\u0113t Administrat\u012bvaj\u0101 rajona ties\u0101 Administrat\u012bv\u0101 procesa likum\u0101 noteiktaj\u0101 k\u0101rt\u012bb\u0101. Administrat\u012bv\u0101s rajona tiesas spriedumu var p\u0101rs\u016bdz\u0113t kas\u0101cijas k\u0101rt\u012bb\u0101 Augst\u0101k\u0101s tiesas Sen\u0101ta Administrat\u012bvo lietu departament\u0101. L\u0113muma p\u0101rs\u016bdz\u0113\u0161ana neaptur t\u0101 darb\u012bbu.\u201d<\/p>\n<p><strong>Iepirkuma rezult\u0101tus var apstr\u012bd\u0113t Administrat\u012bvaj\u0101 rajona ties\u0101<\/strong><\/p>\n<p>Rezum\u0113jums: personas, kuras ir iesniegu\u0161as pied\u0101v\u0101jumus attiec\u012bg\u0101s sabiedrisko pakalpojumu sniedz\u0113ju iepirkuma proced\u016bras ietvaros, ar\u012b ja \u0161\u012b iepirkuma l\u012bgumcenas nesasniedz noteikt\u0101s robe\u017ev\u0113rt\u012bbas, ir ties\u012bgas apstr\u012bd\u0113t \u0161\u012b iepirkuma rezult\u0101tus Administrat\u012bvaj\u0101 rajona ties\u0101.
