Par svar\u012bg\u0101kaj\u0101m publisko iepirkumu sist\u0113mas izmai\u0146\u0101m intervij\u0101 st\u0101sta Iepirkumu uzraudz\u012bbas biroja vad\u012bt\u0101js ARTIS LAPI\u0145\u0160.\u00a0<\/p>\n\n\n\n<p><strong>Cik svar\u012bgi tautsaimniec\u012bbai ir publiskie iepirkumi?&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Publisk\u0101 iepirkuma loma ir \u013coti b\u016btiska. Eiropas Savien\u012bb\u0101 (ES) \u0161iem m\u0113r\u0137iem kopum\u0101 tiek izlietoti divi triljoni eiro gad\u0101, kas ir apm\u0113ram 14% no iek\u0161zemes kopprodukta (IKP). Latvij\u0101 katru gadu tiek nosl\u0113gti l\u012bgumi par vair\u0101k nek\u0101 5,5 miljardiem eiro, kas ir 13\u201314% no IKP. P\u0113rn nosl\u0113gto publisko iepirkuma l\u012bgumu v\u0113rt\u012bba bija p\u0101ri par devi\u0146iem miljardiem eiro, ja pieskaita SIA \u201cEiropas dzelzce\u013ca l\u012bnijas\u201d sl\u0113gto l\u012bgumu par \u201cRail Baltica pamattrases b\u016bvdarbiem Latvij\u0101\u201d 3,7 miljardu eiro apm\u0113r\u0101.&nbsp;<\/p>\n\n\n\n<p>Tas noz\u012bm\u0113, ka publiskais sektors nodro\u0161ina gan preces un pakalpojumus sav\u0101m vajadz\u012bb\u0101m, gan ar\u012b publiskos pakalpojumus un infrastrukt\u016bru sabiedr\u012bbai. Publiskais iepirkums skar pla\u0161u nozaru loku, s\u0101kot no soci\u0101l\u0101s apr\u016bpes un \u0113din\u0101\u0161anas l\u012bdz ce\u013cu un \u0113ku b\u016bvniec\u012bbai. T\u0101pat&nbsp;bie\u017ei vien iepirkuma l\u012bgumu izpild\u0113 pastarpin\u0101ti tiek iesaist\u012btas daudzas citas saist\u012bt\u0101s nozares.&nbsp;<\/p>\n\n\n\n<p>\u0160ogad mart\u0101 tika izveidota darba grupa, kuras uzdevums bija izv\u0113rt\u0113t Latvijas publisko iepirkumu sist\u0113mu. Vai uz \u0161\u0101du soli pamudin\u0101ja\u00a0Valsts kontroles (VK) pag\u0101ju\u0161\u0101 gada nogales\u00a0<a href=\"https:\/\/lrvk.gov.lv\/lv\/revizijas\/revizijas\/noslegtas-revizijas\/problemas-un-iespejas-publisko-iepirkumu-attistibai\" target=\"_blank\" rel=\"noreferrer noopener\">rev\u012bzija<\/a>\u00a0\u201cProbl\u0113mas un iesp\u0113jas publisko iepirkumu att\u012bst\u012bbai\u201d, kur\u0101 tika secin\u0101ts, ka Latvijas publisko iepirkumu sist\u0113ma un normat\u012bvais regul\u0113jums ir j\u0101uzlabo, vienk\u0101r\u0161ojot un pa\u0101trinot iepirkumu procesu, k\u0101 ar\u012b ar ieg\u016bto rezult\u0101tu sam\u0113rojot iepirkumu speci\u0101listu ieguld\u012bto darbu?\u00a0<\/p>\n\n\n\n<p>ES Rev\u012bzijas pal\u0101ta (ESRP) auditu par publiskajiem iepirkumiem ES l\u012bmen\u012b veica jau 2023. gad\u0101. Viens no audita secin\u0101jumiem bija t\u0101ds, ka ES konkurence publiskajos iepirkumos desmit gadu laik\u0101 ir samazin\u0101jusies uz pusi. Otrs lielais jaut\u0101jums ir par priorit\u0101\u0161u un m\u0113r\u0137u neskaidr\u012bbu. Skaidrs, ka visu uzreiz nevar sasniegt, bet nav defin\u0113ta m\u0113r\u0137u priorit\u0101te. Rezult\u0101t\u0101 ir labi un vajadz\u012bgi m\u0113r\u0137i, bet tie n\u0101k kop\u0101 ar administrat\u012bvo slogu un citiem uzsl\u0101\u0146ojumiem, kas aiz\u0113no prim\u0101ros m\u0113r\u0137us.&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u0113rn VK rev\u012bzij\u0101 secin\u0101tais sasaucas ar ESRP zi\u0146ojumu par administrat\u012bvo slogu, resursu pat\u0113ri\u0146u, m\u0113r\u0137u sasnieg\u0161anu. VK nor\u0101d\u012bja ar\u012b uz to, ka publisko iepirkumu proced\u016bras Latvij\u0101 ir sare\u017e\u0123\u012btas, p\u0101r\u0101k l\u0113nu att\u012bst\u0101s iepirkumu centraliz\u0101cija, k\u0101 ar\u012b tr\u016bkst profesion\u0101lu iepirkumu speci\u0101listu.&nbsp;<\/p>\n\n\n\n<p>Eiropas Komisija pl\u0101no priek\u0161likumu par publisko iepirkumu jomas reformu prezent\u0113t n\u0101kam\u0101 gada beig\u0101s. Kam\u0113r notiks diskusijas un tiks lemts&nbsp;par gala versiju, paies vair\u0101ki gadi. Latvij\u0101 nebija v\u0113lmes gaid\u012bt tr\u012bs, \u010detrus gadus, turkl\u0101t vair\u0101ki aspekti ir un ar\u012b turpm\u0101k b\u016bs tikai m\u016bsu valsts kompetenc\u0113. T\u0101p\u0113c \u0161ogad mart\u0101, lai p\u0101rskat\u012btu publisk\u0101 iepirkuma regul\u0113jumu, finan\u0161u ministrs izveidoja \u0161\u0101du darba grupu.&nbsp;<\/p>\n\n\n\n<p><strong>K\u0101ds ir galvenais darba grupas secin\u0101jums? Kas var\u0113tu main\u012bties Latvijas publisko iepirkumu sist\u0113m\u0101?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Tika konstat\u0113ts, ka publiskajos iepirkumos \u013coti b\u016btisks ir konkurences tr\u016bkums. Tas saskan ar\u012b ar iepriek\u0161 veiktajiem auditiem. Otra probl\u0113ma ir regul\u0113juma sare\u017e\u0123\u012bt\u012bba. Ar publiskajiem iepirkumiem var risin\u0101t daudzas priorit\u0101tes, bet kop\u0113j\u0101 sare\u017e\u0123\u012bt\u012bba pieaug \u0101tr\u0101k, nek\u0101 tiek sagaid\u012bti rezult\u0101ti. Tre\u0161ais aspekts ir nepietiekama digitaliz\u0101cija, kas rada papildu administrat\u012bvo slogu.&nbsp;<\/p>\n\n\n\n<p>No t\u0101 izriet\u0113ja ar\u012b secin\u0101jumi. Priek\u0161likumi, kas veido reformu, ir iek\u013cauti Finan\u0161u ministrijas&nbsp;<a href=\"https:\/\/tapportals.mk.gov.lv\/legal_acts\/ed8dec57-a49f-4f33-ad00-f2d8a0bac6f9\" target=\"_blank\" rel=\"noreferrer noopener\">informat\u012bvaj\u0101<\/a>&nbsp;zi\u0146ojum\u0101 \u201cPar darba grupas publisk\u0101 iepirkuma efektivit\u0101tes palielin\u0101\u0161anai rezult\u0101tu un priek\u0161likumiem t\u0101l\u0101kai publisko iepirkumu sist\u0113mas att\u012bst\u012bbai\u201d.&nbsp;<\/p>\n\n\n\n<p>Viens no pied\u0101v\u0101jumiem ir atcelt nacion\u0101l\u0101s iepirkuma proced\u016bru l\u012bgumcenu robe\u017ev\u0113rt\u012bbas, paliekot tikai pie ES l\u012bgumcenu robe\u017ev\u0113rt\u012bb\u0101m.&nbsp;<\/p>\n\n\n\n<p>VK rev\u012bzij\u0101 bija secin\u0101jusi, ka iepirkumu proced\u016bras (piem\u0113ram, atkl\u0101ts konkurss, sl\u0113gts konkurss) tiek piem\u0113rotas no b\u016btiski zem\u0101k\u0101m l\u012bgumcenu robe\u017ev\u0113rt\u012bb\u0101m, nek\u0101 to pieprasa ES direkt\u012bva. VK ieskat\u0101 \u0161\u012bs robe\u017ev\u0113rt\u012bbas neatbilst aktu\u0101lajai ekonomiskajai situ\u0101cijai: nacion\u0101li noteikt\u0101 publisko iepirkumu l\u012bgumcenu robe\u017ev\u0113rt\u012bba b\u016bvdarbu l\u012bgumiem ir p\u0101rskat\u012bta 2006. gad\u0101, pakalpojumu un pre\u010du l\u012bgumiem 2013. gad\u0101, bet \u201cmazajiem\u201d iepirkumiem\u00a0\u2013\u00a02017. gad\u0101.\u00a0\u00a0<\/p>\n\n\n\n<p>T\u0101p\u0113c darba grupa pied\u0101v\u0101 p\u0101rskat\u012bt publisko iepirkumu sliek\u0161\u0146us. Attiec\u012bgi pre\u010du un pakalpojumu iepirkumos pa\u0161reiz\u0113jo slieksni 10 000 eiro ieteikts palielin\u0101t l\u012bdz 143 000 eiro, bet b\u016bvdarbu iepirkumos \u2013 no 20 000 eiro l\u012bdz 5 538 000 eiro. Tas noz\u012bm\u0113, ka pas\u016bt\u012bt\u0101jiem b\u016bs liel\u0101ka r\u012bc\u012bbas br\u012bv\u012bba, b\u016btiski mazin\u0101sies birokr\u0101tija, var\u0113s elast\u012bgi izv\u0113l\u0113ties atbilsto\u0161\u0101ko risin\u0101jumu, k\u0101d\u0101 veid\u0101 nosl\u0113gt l\u012bgumus. \u0100trumam ir noz\u012bme \u2013 jo dr\u012bz\u0101k non\u0101kam l\u012bdz l\u012bgumam, jo rait\u0101k nauda non\u0101k ekonomik\u0101 un tiek nodro\u0161in\u0101tas sabiedr\u012bbas vajadz\u012bbas.&nbsp;<\/p>\n\n\n\n<p>T\u0101 k\u0101 izmai\u0146as summ\u0101s ir pietiekami b\u016btiskas, t\u0101m pret\u012b b\u016bs j\u0101liek dro\u0161\u012bbas meh\u0101nismi \u2013 inform\u0101ciju par iepirkuma pl\u0101niem vajadz\u0113s publiskot jau no pirm\u0101 eiro, lai sabiedr\u012bba un pieg\u0101d\u0101t\u0101ji var\u0113tu sekot l\u012bdzi tam, ko, kur\u0161 un k\u0101d\u0101 veid\u0101 pirks. B\u016bs j\u0101publisko ar\u012b atskaites par nosl\u0113gtajiem l\u012bgumiem un to izpildi. T\u0101tad paredz\u0113ta pla\u0161\u0101ka inform\u0101cijas pieejam\u012bba.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Vai iepirkumi, kuru summa bija zem\u0101ka par noteiktaj\u0101m robe\u017ev\u0113rt\u012bb\u0101m, \u0161obr\u012bd nav j\u0101publisko iest\u0101\u017eu t\u012bmek\u013cvietn\u0113s?&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Tas ir j\u0101v\u0113rt\u0113 atkar\u012bb\u0101 no iest\u0101\u017eu prakses un konkr\u0113t\u0101 zemsliek\u0161\u0146a iepirkuma. Piem\u0113ram, patlaban pre\u010du un pakalpojumu iepirkumos zem 10 000 eiro prakses ir \u013coti da\u017e\u0101das. Liel\u0101koties pas\u016bt\u012bt\u0101ji uzaicina vair\u0101kus pieg\u0101d\u0101t\u0101jus iesniegt pied\u0101v\u0101jumus un uzvar\u0113t\u0101js tiek izraudz\u012bts t\u0101 sauktaj\u0101 cenu aptauj\u0101.\u00a0\u00a0<\/p>\n\n\n\n<p>Gan tagad, gan n\u0101kotn\u0113 mums nav m\u0113r\u0137a likt publiski izsludin\u0101t iepirkumus par sam\u0113r\u0101 maz\u0101m summ\u0101m, tas neb\u016btu ne sapr\u0101t\u012bgi, ne lietder\u012bgi.\u00a0\u00a0<\/p>\n\n\n\n<p>Bet iepirkumus par visai liel\u0101m summ\u0101m publiski izsludin\u0101t ir ne tikai v\u0113lami, bet pat vajadz\u012bgi konkurences nodro\u0161in\u0101\u0161anai.&nbsp;<\/p>\n\n\n\n<p>Zemsliek\u0161\u0146a iepirkumus ir vienk\u0101r\u0161\u0101k administr\u0113t, un pas\u016bt\u012bt\u0101jam ir liel\u0101ka elast\u012bba to \u012bsteno\u0161an\u0101. J\u0101piebilst, ka ar\u012b tagad zemsliek\u0161\u0146a iepirkumos ne visiem pas\u016bt\u012bt\u0101jiem ir j\u0101piem\u0113ro nacion\u0101lais regul\u0113jums. Sabiedrisko pakalpojumu sniedz\u0113jiem \u2013 lidost\u0101m, ost\u0101m, dzelzce\u013ca p\u0101rvad\u0101t\u0101jiem, pastam, elektr\u012bbas un siltumapg\u0101des uz\u0146\u0113mumiem \u2013 publisko iepirkumu l\u012bgumcenu robe\u017ev\u0113rt\u012bba jau \u0161obr\u012bd atbilst ES regul\u0113jumam.&nbsp;<\/p>\n\n\n\n<p>Past\u0101v specifiski tirgi, kuros nav konkurences un zemsliek\u0161\u0146a iepirkumu var\u0113s nosl\u0113gt vienk\u0101r\u0161\u0101k, vienlaikus, protams, sekojot l\u012bdzi izmaks\u0101m. Bet ir l\u012bgumi par liel\u0101m summ\u0101m, kur ir j\u0101nodro\u0161ina konkurence, un, paaugstinot zemsliek\u0161\u0146a iepirkuma summas, to var\u0113s izdar\u012bt elast\u012bg\u0101k.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Man bija sarunas ar kapit\u0101lsabiedr\u012bbu vad\u012bt\u0101jiem, sabiedrisko pakalpojumu sniedz\u0113jiem, kuri uzsv\u0113ra: nevajag iedom\u0101ties, ka l\u012bgumu par, piem\u0113ram, \u010detrus miljonus eiro v\u0113rtiem b\u016bvdarbiem vi\u0146i b\u016btu gatavi nosl\u0113gt p\u0113c pirm\u0101 cenu pied\u0101v\u0101juma bez konkursa. T\u0101pat b\u016bs publiski izsludin\u0101ts iepirkums ar pras\u012bb\u0101m un v\u0113rt\u0113\u0161anu.&nbsp;<\/p>\n\n\n\n<p><strong>Vai, paaugstinot zemsliek\u0161\u0146u iepirkumu summas, tiks veicin\u0101ta konkurence?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Elast\u012bba zemsliek\u0161\u0146u iepirkumos ir viens no elementiem. Tom\u0113r tas nav vien\u012bgais, ir j\u0101skata vair\u0101ki aspekti.&nbsp;<\/p>\n\n\n\n<p>Otrs aspekts ir izsl\u0113g\u0161anas noteikumi. \u0160\u012bbr\u012b\u017ea regul\u0113jums paredz: ja pretendentam ir 150 eiro nodok\u013cu par\u0101ds, tad vi\u0146\u0161 no konkursa tiek izsl\u0113gts.&nbsp;&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2014\/24\/oj\/?locale=LV\" target=\"_blank\" rel=\"noreferrer noopener\">Eiropas Parlamenta un Padomes Direkt\u012bva 2014\/24\/ES par publisko iepirkumu un ar ko atce\u013c Direkt\u012bvu 2004\/18\/EK<\/a>&nbsp;paredz, ka publiskajos virssliek\u0161\u0146a iepirkumos oblig\u0101ti j\u0101p\u0101rbauda divi izsl\u0113g\u0161anas iemesli: noteikti noziedz\u012bgi nodar\u012bjumi, par kuriem ir st\u0101jies sp\u0113k\u0101 noties\u0101jo\u0161s tiesas spriedums, un nodok\u013cu nomaksa.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Darba grupa pied\u0101v\u0101 turpm\u0101k ar\u012b zemsliek\u0161\u0146u iepirkumos atst\u0101t tikai \u0161os divus krit\u0113rijus. Piebilstams, ka iepriek\u0161 oblig\u0101ti bija j\u0101p\u0101rbauda 12 izsl\u0113g\u0161anas noteikumi.&nbsp;<\/p>\n\n\n\n<p>P\u0101rskatot izsl\u0113g\u0161anas noteikumus, b\u016btiski tiek sa\u012bsin\u0101ts iepirkuma process&nbsp;\u2013 ir maz\u0101k p\u0101rbaud\u0101m\u0101s inform\u0101cijas. T\u0101pat, ja uz\u0146\u0113mumam ir \u201cA\u201d nodok\u013cu nomaksas reitings, tad pas\u016bt\u012bt\u0101js t\u0101l\u0101k p\u0101rbaudi par nodok\u013cu saist\u012bbu izpildi neveic, pat ja konkursa laik\u0101 par\u0101ds ir, piem\u0113ram, 200 eiro vai liel\u0101ks. Uz \u201cpap\u012bra\u201d t\u0101 ir \u0101tr\u0101k\u0101 proced\u016bra. Probl\u0113ma ir tikai viena \u2013 t\u0101 ir ar\u012b visneelast\u012bg\u0101k\u0101 proced\u016bra. Ja pas\u016bt\u012bt\u0101js nosaka pras\u012bbas un sa\u0146em pied\u0101v\u0101jumus, tad vi\u0146am nekas cits neatliek k\u0101 \u0161os pied\u0101v\u0101jumus v\u0113rt\u0113t atbilsto\u0161i pa\u0161a noteiktaj\u0101m pras\u012bb\u0101m.&nbsp;<\/p>\n\n\n\n<p>Ja atkl\u0101t\u0101 konkurs\u0101 k\u0101da neuzman\u012bgi noteikta pras\u012bba rada lielu sad\u0101rdzin\u0101jumu vai ir gr\u016bti izpild\u0101ma, bet pied\u0101v\u0101jums apmierina pas\u016bt\u012bt\u0101ja vajadz\u012bbu, tad vai nu pied\u0101v\u0101jums ir j\u0101noraida, vai ar\u012b j\u0101p\u0101rtrauc iepirkums.&nbsp;<\/p>\n\n\n\n<p>Praks\u0113 redzam, ka ir \u013coti daudz p\u0101rtrauktu iepirkumu, t\u0101tad padar\u012btais darbs ir nelietder\u012bgs.<\/p>\n\n\n\n<p>L\u012bdz ar l\u012bgumcenu robe\u017ev\u0113rt\u012bbu mai\u0146u\u00a0zemsliek\u0161\u0146u iepirkumos b\u016bs liel\u0101ka elast\u012bba \u2013 pretendentu nevajadz\u0113s izsl\u0113gt s\u012bkumu d\u0113\u013c, var\u0113s diskut\u0113t ar tirgus dal\u012bbniekiem p\u0113c b\u016bt\u012bbas, non\u0101kt l\u012bdz dar\u012bjumam, to nosl\u0113gt, izpildot pamatm\u0113r\u0137us.<\/p>\n\n\n\n<p>T\u0101 ir b\u016btiska at\u0161\u0137ir\u012bba, kas ar\u012b var veicin\u0101t konkurenci.&nbsp;<\/p>\n\n\n\n<p>VK rev\u012bzij\u0101 secin\u0101ja, ka veiksm\u012bgu publisko iepirkumu norisi kav\u0113 l\u0113n\u0101 iepirkumu centraliz\u0101cijas att\u012bst\u012bba. Kop\u0113jais centraliz\u0113to iepirkumu skaits valst\u012b no 2021. gada l\u012bdz 2023. gadam vid\u0113ji veidoja 9,4%, bet p\u0113rn tas bija 8,5% no kop\u0113j\u0101 skaita. Ja ne\u0146em v\u0113r\u0101 iepirkumu skaitu, bet l\u012bgumcenas, tad centraliz\u0113ti pie\u0161\u0137irto iepirkumu v\u0113rt\u012bba naudas izteiksm\u0113 veido piekto da\u013cu no visu l\u012bgumu v\u0113rt\u012bbas.
