Konkurences padome (KP)&nbsp;nereti sa\u0146em iesniegumus, kuros v\u0113rsta uzman\u012bba uz iesp\u0113jamiem konkurences ierobe\u017eojumiem \u0161ajos iepirkumos, k\u0101 piem\u0113ram, iesp\u0113jamu intere\u0161u konfliktu,&nbsp;v\u0113rt\u0113\u0161anas krit\u0113rijiem, kas pie\u0161\u0137ir priek\u0161roc\u012bbas noteiktiem uz\u0146\u0113mumiem, nepamatoti l\u0113ta pied\u0101v\u0101juma proced\u016bras ierosin\u0101\u0161anu un iepirkumu p\u0101rtrauk\u0161anas praksi.<\/p>\n\n\n\n<p>KP paskaidro, ka Konkurences likuma (KL) 14.<sup>1<\/sup>&nbsp;pant\u0101 ir noteikts aizliegums publisk\u0101m person\u0101m ar savu darb\u012bbu kav\u0113t, ierobe\u017eot vai deform\u0113t konkurenci \u2013 t.s. konkurences neitralit\u0101tes iev\u0113ro\u0161anas pien\u0101kums. Tostarp publiskai personai, r\u012bkojot publiskos iepirkumuspre\u010du vai pakalpojumu ieg\u0101dei, ir j\u0101nodro\u0161ina p\u0101rdom\u0101ta, god\u012bga, atkl\u0101ta un caurskat\u0101ma iepirkuma proced\u016bra un, izstr\u0101d\u0101jot iepirkuma dokument\u0101ciju, j\u0101p\u0101rliecin\u0101s, lai taj\u0101 ietvert\u0101s pras\u012bbas veicin\u0101tu iesp\u0113jami daudzu pretendentu dal\u012bbu. Konkurence iepirkumos nodro\u0161ina, ka pas\u016bt\u012bt\u0101jam iesp\u0113jams iepirkt kvalitat\u012bv\u0101ko pakalpojumu par saimnieciski izdev\u012bg\u0101ko cenu.&nbsp;T\u0101pat iepirkumu r\u012bkot\u0101jiem ir b\u016btiska loma aizliegtu vieno\u0161anos jeb karte\u013cu atkl\u0101\u0161an\u0101, jo pretendentu iesniegtie pied\u0101v\u0101jumi var satur\u0113t aizliegtas vieno\u0161an\u0101s paz\u012bmes.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/kp-aspekti-kurus-nepieciesams-nemt-vera-rikojot-skanas-gaismas-un-skatuves-aprikojuma-iepirkumus#_ftn1\"><\/a><a href=\"#fn1\" id=\"ref1\">[1]<\/a><\/sup><\/p>\n\n\n\n<p>Lai pal\u012bdz\u0113tu iepirkumu veic\u0113jiem izvair\u012bties no konkurences ierobe\u017eojumiem un konkurences ties\u012bbu p\u0101rk\u0101pumiem skatuves&nbsp;iek\u0101rtu nodro\u0161in\u0101\u0161anas&nbsp;iepirkumos, KP ir apkopojusi prakses gad\u012bjumus, kuros t\u0101 ir skat\u012bjusi ar \u0161iem iepirkumiem saist\u012btus jaut\u0101jumus un problem\u0101tiku, un ir izstr\u0101d\u0101jusi ieteikumus pas\u016bt\u012bt\u0101jiem, kas organiz\u0113 skatuves iek\u0101rtu nodro\u0161in\u0101\u0161anas iepirkumus:<\/p>\n\n\n\n<ol>\n<li><strong>Tirgus izp\u0113te.<\/strong>&nbsp;Konkurences padome aicina pas\u016bt\u012bt\u0101jus pirms skatuves nodro\u0161in\u0101\u0161anas iepirkuma izsludin\u0101\u0161anas veikt r\u016bp\u012bgu tirgus izp\u0113ti \u2013 identific\u0113t potenci\u0101los pretendentus, iepaz\u012bties ar to pied\u0101v\u0101taj\u0101m prec\u0113m, pakalpojumiem, cen\u0101m un izmaks\u0101m. Tas \u013caus ne tikai izv\u0113rt\u0113t iesp\u0113jas ieg\u0101d\u0101ties izklaides un kult\u016bras pas\u0101kumu r\u012bko\u0161anai nepiecie\u0161amos pakalpojumus atbilsto\u0161i finansi\u0101laj\u0101m iesp\u0113j\u0101m, bet ar\u012b ieg\u016bt visaptvero\u0161u priek\u0161statu par tirgus situ\u0101ciju un savlaic\u012bgi rea\u0123\u0113t, ja pret\u0113ji tirgus izp\u0113t\u0113 ieg\u016btajai inform\u0101cijai iepirkum\u0101 pied\u0101v\u0101jumu iesniedzis maz\u0101ks pretendentu skaits vai tiek pied\u0101v\u0101ta nepamatoti augsta (vai ret\u0101k \u2013 zema) cena.<\/li>\n\n\n\n<li><strong>Intere\u0161u konflikta nepie\u013cau\u0161ana<\/strong>. KP aicina pas\u016bt\u012bt\u0101jus iepirkumu dokument\u0101ciju, jo \u012bpa\u0161i iepirkumu tehnisk\u0101s specifik\u0101cijas, sagatavot patst\u0101v\u012bgi. Gad\u012bjumos, kad tehnisk\u0101s specifik\u0101cijas patst\u0101v\u012bga izstr\u0101d\u0101\u0161ana nav iesp\u0113jama, lai izvair\u012btos no iesp\u0113jama intere\u0161u konflikta un konkurences ties\u012bbu p\u0101rk\u0101pumiem, iesp\u0113ju robe\u017e\u0101s ieteicams izv\u0113l\u0113ties nozares asoci\u0101ciju vai sabiedrisko organiz\u0101ciju ekspertu konsult\u0101cijas, nevis konkr\u0113tu pretendentu p\u0101rst\u0101vju iesaisti.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/kp-aspekti-kurus-nepieciesams-nemt-vera-rikojot-skanas-gaismas-un-skatuves-aprikojuma-iepirkumus#_ftn2\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[2]<\/a><\/sup>&nbsp;KP atbalsta ar\u012b savstarp\u0113ju komunik\u0101ciju ar citiem pas\u016bt\u012bt\u0101jiem, kuri ieg\u0101d\u0101ju\u0161ies l\u012bdz\u012bgas preces un pakalpojumus, lai pilnveidotu izpratni par tirgu un t\u0101 dal\u012bbniekiem, k\u0101 ar\u012b iepirkuma priek\u0161metu, tam izvirz\u0101maj\u0101m pras\u012bb\u0101m.
