Vienlaikus piln\u012bg\u0101kai izpratnei j\u0101paskaidro, ka saska\u0146\u0101 ar&nbsp;Eiropas Savien\u012bbas Tiesas (EST) 2016.gada 26.maija spriedumu liet\u0101 C-260\/14&nbsp;neatbilst\u012bbas&nbsp;j\u0113dziens interpret\u0113jams t\u0101d\u0113j\u0101di, ka tas attiecas ne tikai uz ES ties\u012bbu p\u0101rk\u0101pumu, bet ar\u012b uz to nacion\u0101lo ties\u012bbu normu p\u0101rk\u0101pumu, kuras pal\u012bdz nodro\u0161in\u0101t ES ties\u012bbu (attiec\u012bb\u0101 uz ES l\u012bdzek\u013ciem finans\u0113to projektu p\u0101rvald\u012bbu) labu piem\u0113ro\u0161anu un kuras ir piem\u0113rojamas strukt\u016brfondiem atbalst\u0101maj\u0101m darb\u012bb\u0101m. T\u0101tad ar neatbilst\u012bbu saprotamas jebkuras atk\u0101pes no pras\u012bb\u0101m, kas attiecas uz tiesisku ES fondu projektu \u012bsteno\u0161anu.<\/p>\n\n\n\n<p>Viena no b\u016btisk\u0101kaj\u0101m atk\u0101p\u0113m tiesisk\u0101 ES fondu projektu \u012bsteno\u0161anas proces\u0101 ir publisk\u0101 iepirkuma ietvaros pie\u013cauta intere\u0161u konflikta situ\u0101cija. Intere\u0161u konfliktam, \u012bstenojot ES fondu projektu, ir piev\u0113r\u0161ama \u012bpa\u0161a uzman\u012bba ne tikai t\u0101 iemesla d\u0113\u013c, ka tas apdraud Publisko iepirkumu likuma (PIL) 2.pant\u0101 noteikt\u0101 m\u0113r\u0137a sasnieg\u0161anu, bet ar\u012b t\u0101d\u0113\u013c, ka, konstat\u0113jot \u0161o p\u0101rk\u0101pumu, finans\u0113juma sa\u0146\u0113m\u0113jam 100% apm\u0113r\u0101 var tikt samazin\u0101tas konkr\u0113t\u0101 iepirkuma l\u012bguma izdevumu seg\u0161anai paredz\u0113t\u0101s attiecin\u0101m\u0101s izmaksas.<\/p>\n\n\n\n<p>Lai nodro\u0161in\u0101tu caurskat\u0101mu, god\u012bgu un atbild\u012bgu, k\u0101 ar\u012b uz sabiedr\u012bbas uztic\u0113\u0161anos balst\u012btu ES fondu l\u012bdzfinans\u0113juma apguvi, \u0161\u0101du p\u0101rk\u0101pumu izv\u0113rt\u0113\u0161an\u0101 Centr\u0101l\u0101 finan\u0161u un l\u012bgumu a\u0123ent\u016bra (CFLA) iev\u0113ro nulles tolerances principu. Iepriek\u0161 min\u0113tais princips un iest\u0101des risku vad\u012bbas kult\u016bra paredz, ka intere\u0161u konflikti nav pie\u0146emami.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Intere\u0161u konflikta veidi un pas\u016bt\u012bt\u0101ja loma<\/strong><\/h3>\n\n\n\n<p>Iepirkuma komisijas darb\u012bbas pamatprincipi, tostarp intere\u0161u konflikta tiesiskie aspekti ir defin\u0113ti PIL 25.pant\u0101. No min\u0113tas normas izriet divi at\u0161\u0137ir\u012bgi intere\u0161u konflikta veidi, kas var iest\u0101ties iepirkuma proced\u016bras dokumentu sagatavot\u0101jam (pas\u016bt\u012bt\u0101ja amatpersonai vai darbiniekam), iepirkuma komisijas loceklim, iepirkuma komisijas sekret\u0101ram vai ekspertam, proti, kandid\u0101ta vai pretendenta intere\u0161u p\u0101rst\u0101v\u012bba (PIL 25.panta 1.da\u013ca) vai tie\u0161i defin\u0113ta saist\u012bba (PIL 25.panta 1.da\u013cas 1.\u20135.punkts).<\/p>\n\n\n\n<p>J\u0101nor\u0101da, ka arvien ret\u0101k ir sastopamas situ\u0101cijas, kad, veicot iepirkuma p\u0101rbaudi, CFLA konstat\u0113tu tie\u0161i defin\u0113tu saist\u012bbu PIL 25.panta 1.da\u013cas 1.\u20135.punkta izpratn\u0113, t\u0101d\u0113\u013c secin\u0101ms, ka pas\u016bt\u012bt\u0101ji \u0161aj\u0101 jom\u0101 k\u013c\u016bst arvien zino\u0161\u0101ki. Min\u0113to var pamatot ar apst\u0101kli, ka tie\u0161i pas\u016bt\u012bt\u0101js (jebkura persona, kas jebk\u0101d\u0101 veid\u0101 iesaist\u012bta l\u0113muma pie\u0146em\u0161an\u0101 vai var ietekm\u0113t l\u0113mumu) ir atbild\u012bgs par risku apzin\u0101\u0161anu un izv\u0113rt\u0113\u0161anu, k\u0101 ar\u012b visu \u0161aubu par iesp\u0113jam\u0101s intere\u0161u konflikta situ\u0101cijas es\u012bbu klied\u0113\u0161anu. Min\u0113tais princips ir nostiprin\u0101ts ar\u012b EST 2015.gada 12.marta spriedum\u0101 liet\u0101 C-538\/13, kas nosaka, ka pas\u016bt\u012bt\u0101jam ir akt\u012bva loma intere\u0161u konflikta situ\u0101ciju izv\u0113rt\u0113\u0161an\u0101 un l\u012bgumsl\u0113dz\u0113ja iest\u0101dei katr\u0101 zi\u0146\u0101 ir j\u0101p\u0101rbauda, vai nepast\u0101v iesp\u0113jami intere\u0161u konflikti, un j\u0101veic pas\u0101kumi, lai nepie\u013cautu un atkl\u0101tu intere\u0161u konfliktus, k\u0101 ar\u012b nov\u0113rstu to sekas. Atbilsto\u0161a kontrole ir j\u0101nodro\u0161ina, ne tikai uzs\u0101kot iepirkuma procesu, bet vis\u0101 t\u0101 norises laik\u0101. L\u012bgumsl\u0113dz\u0113ja iest\u0101dei iepirkuma proces\u0101 iesaist\u012btaj\u0101m person\u0101m j\u0101sniedz pietiekams skaidrojums par prec\u012bzu intere\u0161u konflikta defin\u012bciju un t\u0101s \u012bpa\u0161i pla\u0161o tv\u0113rumu (tai skait\u0101, ka nav nek\u0101du faktu vai apst\u0101k\u013cu pag\u0101tn\u0113, tagadn\u0113 vai, iesp\u0113jams, tuv\u0101kaj\u0101 n\u0101kotn\u0113, kas \u013cautu ap\u0161aub\u012bt \u0161\u012bs personas objektivit\u0101ti).<\/p>\n\n\n\n<p>Ja intere\u0161u konflikta situ\u0101cij\u0101 ir nok\u013cuvis iepirkuma komisijas loceklis vai eksperts (ja vien iepirkuma komisijas loceklis vai eksperts nav vienlaikus ar\u012b gatavojis iepirkuma dokument\u0101ciju), ir iesp\u0113jama iepirkuma komisijas locek\u013ca vai eksperta nomai\u0146a, \u0146emot v\u0113r\u0101, ka p\u0113c iesp\u0113jas j\u0101izv\u0113las kandid\u0101tus vai pretendentus maz\u0101k ierobe\u017eojo\u0161s risin\u0101jums. Svar\u012bgi atcer\u0113ties, ka, \u0146emot v\u0113r\u0101 PIL 25.panta 4.da\u013cas pien\u0101kumu, saskaroties ar intere\u0161u konflikta situ\u0101ciju un nosakot piem\u0113rojamos intere\u0161u konflikta mazin\u0101\u0161anas pas\u0101kumus, iepirkumu komisijai \u0161\u0101di fakti b\u016btu j\u0101dokument\u0113, tostarp atspogu\u013cojot iepirkumu komisijas l\u0113mumu par konkr\u0113tiem intere\u0161u konflikta mazino\u0161iem pas\u0101kumiem.<\/p>\n\n\n\n<p>Tom\u0113r, neskatoties uz iepriek\u0161 min\u0113to, joproj\u0101m ir konstat\u0113jami gad\u012bjumi, kad intere\u0161u konflikta tv\u0113rums tiek saprasts \u0161aur\u0101k, nek\u0101 likumdev\u0113js to ir paredz\u0113jis, nepien\u0101c\u012bgu uzman\u012bbu v\u0113r\u0161ot pla\u0161\u0101k neat\u0161ifr\u0113tai paz\u012bmei&nbsp;\u2013 intere\u0161u p\u0101rst\u0101v\u012bbai. \u0145emot v\u0113r\u0101 faktu, ka tie\u0161i prec\u012bza intere\u0161u p\u0101rst\u0101v\u012bbas identific\u0113\u0161ana m\u0113dz b\u016bt pas\u016bt\u012bt\u0101ja \u201cklup\u0161anas akmens\u201d, apskat\u012bsim \u0161\u012b intere\u0161u konflikta veida piem\u0113ro\u0161anas aspektus.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Intere\u0161u p\u0101rst\u0101v\u012bba<\/strong><\/h3>\n\n\n\n<p>Saist\u012bb\u0101 ar PIL regul\u0113jumu j\u0101nor\u0101da, ka noteikumi par l\u012bgumsl\u0113dz\u0113ju iest\u0101\u017eu r\u012bkotaj\u0101m iepirkumu proced\u016br\u0101m publisko l\u012bgumu jom\u0101 ir paredz\u0113ti direkt\u012bv\u0101 2014\/24\/ES par publisko iepirkumu un ar ko atce\u013c direkt\u012bvu 2004\/18\/EK, kas atbilsto\u0161i direkt\u012bvas 90.pantam ir transpon\u0113ti PIL. Ar PIL 25.panta regul\u0113jumu ir piln\u012bb\u0101 p\u0101r\u0146emts direkt\u012bvas 24.pant\u0101 noteiktais, kas noz\u012bm\u0113, ka intere\u0161u konflikta j\u0113dziens ietver vismaz visas t\u0101s situ\u0101cijas, kad l\u012bgumsl\u0113dz\u0113jas iest\u0101des person\u0101la locek\u013ciem vai t\u0101da iepirkumu pakalpojumu sniedz\u0113ja person\u0101la locek\u013ciem, kas r\u012bkojas l\u012bgumsl\u0113dz\u0113jas iest\u0101des v\u0101rd\u0101, kuri ir iesaist\u012bti iepirkuma proced\u016bras r\u012bko\u0161an\u0101 vai var ietekm\u0113t \u0161\u012bs proced\u016bras izn\u0101kumu, ir tie\u0161a vai netie\u0161a finansi\u0101la, ekonomiska vai cita veida personiska ieinteres\u0113t\u012bba, ko var uzskat\u012bt par t\u0101du, kas kompromit\u0113 vi\u0146u objektivit\u0101ti un neatkar\u012bbu iepirkuma proced\u016bras kontekst\u0101. L\u012bdz ar to intere\u0161u konflikta j\u0113dziens atbilsto\u0161i pretendenta intere\u0161u p\u0101rst\u0101v\u012bbas paz\u012bmei ir interpret\u0113jams maksim\u0101li pla\u0161i,&nbsp;\u0146emot v\u0113r\u0101 situ\u0101cijas, kas jebk\u0101d\u0101 veid\u0101 var trauc\u0113t neatkar\u012bgai un objekt\u012bvai personas funkciju izpildei.<\/p>\n\n\n\n<p>ES fondu p\u0101rvald\u012bb\u0101, v\u0113rt\u0113jot intere\u0161u konflikta situ\u0101ciju, iz\u0161\u0137iro\u0161a noz\u012bme ir faktam, vai past\u0101v pamatotas \u0161aubas par personas neatkar\u012bbu un objektivit\u0101ti iepirkuma ietvaros un l\u012bdz ar to rad\u012bto vai potenci\u0101li rad\u012bto kait\u0113jumu ES bud\u017eetam, no t\u0101 prasot segt nepamatotu izdevumu da\u013cu. Nav iz\u0161\u0137iro\u0161as noz\u012bmes pier\u0101d\u012b\u0161anas apst\u0101klim, ka intere\u0161u konflikta rezult\u0101t\u0101 ir radusies faktiska ietekme uz l\u0113muma pie\u0146em\u0161anas procesu un t\u0101d\u0113j\u0101di ar\u012b uz iepirkuma rezult\u0101tu. J\u0101nor\u0101da, ka v\u0113rt\u0113jum\u0101 par pretendenta intere\u0161u p\u0101rst\u0101v\u012bbu, taj\u0101 skait\u0101 skaidrojot PIL 25.panta 1.da\u013c\u0101 iek\u013cauto pretendenta intere\u0161u p\u0101rst\u0101v\u012bbas paz\u012bmi un izdarot secin\u0101jumu par iepirkum\u0101 pie\u013cautu PIL 25.panta 1.da\u013cas p\u0101rk\u0101pumu, nav nepiecie\u0161ams vienlaikus konstat\u0113t ar\u012b k\u0101du no PIL 25.panta 1.da\u013cas 1.\u20135.punkt\u0101 uzskait\u012btajiem gad\u012bjumiem.<\/p>\n\n\n\n<p>Kaut ar\u012b intere\u0161u konflikta tulkojums ir pla\u0161s, tas nenoz\u012bm\u0113, ka to var attiecin\u0101t uz jebkuru past\u0101vo\u0161o saist\u012bbu. \u0160\u0101diem apst\u0101k\u013ciem ir j\u0101b\u016bt konkr\u0113tai identific\u0113jamai un individu\u0101lai saiknei ar (vai ietekmei uz) konkr\u0113tiem personas r\u012bc\u012bbas, uzved\u012bbas vai attiec\u012bbu aspektiem. Saskat\u012btais intere\u0161u konflikts aptver objekt\u012bvus apst\u0101k\u013cus, kas ietekm\u0113 uztic\u0113\u0161anos personas vai subjekta neatkar\u012bbai un objektivit\u0101tei un pa\u013cau\u0161anos uz t\u0101m, t\u0101d\u0113\u013c ir svar\u012bgi, lai saskat\u012btais intere\u0161u konflikts tiktu pamatots ar objekt\u012bviem un sapr\u0101t\u012bgiem apsv\u0113rumiem. Tas jo \u012bpa\u0161i ietver p\u0101rbaud\u0101mas faktiskas nor\u0101des par to, ka past\u0101v saiknes starp funkcij\u0101m un attiec\u012bgaj\u0101m interes\u0113m. No min\u0113t\u0101 izriet, ka saist\u012bbai j\u0101b\u016bt pietiekami noz\u012bm\u012bgai, lai to var\u0113tu uzskat\u012bt par t\u0101du, kas var trauc\u0113t funkciju neatkar\u012bgu un objekt\u012bvu pild\u012b\u0161anu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Intere\u0161u p\u0101rst\u0101v\u012bbas izpausmes<\/strong><\/h3>\n\n\n\n<p>Praks\u0113 n\u0101kas saskarties ar situ\u0101cij\u0101m, kad intere\u0161u p\u0101rst\u0101v\u012bbas paz\u012bmes identific\u0113\u0161anas pamats ir iepirkuma procesa noris\u0113 iesaist\u012bto personu nosl\u0113gtie uz\u0146\u0113muma (tai skait\u0101 autoratl\u012bdz\u012bbas) l\u012bgumi ar iepirkum\u0101 uzvar\u0113ju\u0161o pretendentu. Secin\u0101ms, ka \u0161\u0101da veida saist\u012bbai bie\u017ei vien netiek v\u0113rsta pietiekama v\u0113r\u012bba, jo pas\u016bt\u012bt\u0101ja ieskat\u0101 nav iest\u0101jies PIL 25.panta 1.da\u013cas 1.punkt\u0101 min\u0113tais gad\u012bjumus (pa\u0161reiz\u0113jais vai biju\u0161ais darbinieks). \u0160im argumentam var piekrist tikt\u0101l, ka uz\u0146\u0113muma l\u012bgums patie\u0161\u0101m nenodibina darba tiesisk\u0101s attiec\u012bbas, tom\u0113r, \u0146emot v\u0113r\u0101 intere\u0161u konflikta pla\u0161o interpret\u0101ciju, j\u0101nor\u0101da, ka faktiski nav iz\u0161\u0137iro\u0161as noz\u012bmes nosl\u0113gt\u0101 l\u012bguma veidam, bet gan faktam, ka starp iepirkuma noris\u0113 iesaist\u012btaj\u0101m person\u0101m un pretendentu past\u0101v mantiska rakstura saist\u012bbas, kas var trauc\u0113t neatkar\u012bgai un objekt\u012bvai funkciju izpildei.<\/p>\n\n\n\n<p>Atsevi\u0161\u0137os gad\u012bjumos uz\u0146\u0113muma l\u012bgumi tiek nosl\u0113gti ar\u012b par pedago\u0123isk\u0101 darba snieg\u0161anu, un CFLA praks\u0113 ir konstat\u0113jusi situ\u0101cijas, kad pas\u016bt\u012bt\u0101ja ieskat\u0101 \u0161ajos gad\u012bjumos intere\u0161u konflikta situ\u0101cija nav iest\u0101jusies, jo tas nav uzskat\u0101ms par amatu likuma \u201cPar intere\u0161u konflikta nov\u0113r\u0161anu valsts amatpersonu darb\u012bb\u0101\u201d. J\u0101nor\u0101da, ka intere\u0161u konflikta izpratne par kandid\u0101ta vai pretendenta intere\u0161u p\u0101rst\u0101v\u012bbu tiek skaidrota atbilsto\u0161i PIL noteiktajam regul\u0113jumam un \u0161is apst\u0101klis neizsl\u0113dz intere\u0161u konflikta risku publiskaj\u0101 iepirkum\u0101, kas nav likuma \u201cPar intere\u0161u konflikta nov\u0113r\u0161anu valsts amatpersonu darb\u012bb\u0101\u201d speci\u0101li regul\u0113t\u0101 joma.<\/p>\n\n\n\n<p>Iepirkumu uzraudz\u012bbas birojs ir nor\u0101d\u012bjis, ka, lai izdar\u012btu objekt\u012bvus un pamatotus secin\u0101jumus par intere\u0161u p\u0101rst\u0101v\u012bbas konstat\u0113\u0161anu, j\u0101\u0146em v\u0113r\u0101 izpild\u012bto uz\u0146\u0113muma l\u012bgumu skaits, jo viena neliela l\u012bguma izpilde pati par sevi neliecina par pretendenta p\u0101rst\u0101v\u012bbu, savuk\u0101rt vair\u0101ku \u0161\u0101du l\u012bgumu skaits, kas sl\u0113gts, piem\u0113ram, ilgsto\u0161\u0101k\u0101 period\u0101, var liecin\u0101t par p\u0101rst\u0101v\u012bbu, jo ir piel\u012bdzin\u0101ms nodarbin\u0101t\u012bbas situ\u0101cijai. T\u0101pat \u0161\u0137ietama intere\u0161u konflikta situ\u0101cijas gad\u012bjum\u0101 var\u0113tu tikt v\u0113rt\u0113ts, vai konkr\u0113t\u0101 iepirkuma komisijas locek\u013ca (k\u0101 ar\u012b eksperta, ja t\u0101ds ir piesaist\u012bts) izdar\u012btie secin\u0101jumi un v\u0113rt\u0113jums ir ietekm\u0113jis iepirkuma proced\u016bras izn\u0101kumu, vai nolikuma pras\u012bbas rad\u012bja k\u0101das priek\u0161roc\u012bbas attiec\u012bgajam pretendentam, k\u0101 ar\u012b&nbsp;\u2013&nbsp;vai pretendenta pied\u0101v\u0101jums neliecin\u0101ja par to, ka konkr\u0113tajam pretendentam b\u016btu bijusi zin\u0101ma k\u0101da cita inform\u0101cija, kas rad\u012bja tam priek\u0161roc\u012bbas. Vienlaikus j\u0101nor\u0101da, ka ikviena iesp\u0113jam\u0101 intere\u0161u konflikta situ\u0101cija&nbsp;ir v\u0113rt\u0113jama individu\u0101li, tikai piln\u012bb\u0101 izskatot konkr\u0113t\u0101 gad\u012bjuma faktiskos apst\u0101k\u013cus.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Secin\u0101jumi<\/strong><\/h3>\n\n\n\n<p>Apkopojot iepriek\u0161 min\u0113to, secin\u0101ms, ka&nbsp;joproj\u0101m ir konstat\u0113jami gad\u012bjumi, kad pas\u016bt\u012bt\u0101js intere\u0161u konflikta tv\u0113rumu saprot \u0161aur\u0101k, nek\u0101 likumdev\u0113js to ir paredz\u0113jis, nepien\u0101c\u012bgu uzman\u012bbu v\u0113r\u0161ot pla\u0161\u0101k neat\u0161ifr\u0113tai paz\u012bmei&nbsp;\u2013 intere\u0161u p\u0101rst\u0101v\u012bbai.<\/p>\n\n\n\n<p>Lai ar\u012b intere\u0161u konflikta j\u0113dziens ir pla\u0161i interpret\u0113jams un nav nepiecie\u0161ams pier\u0101d\u012bt t\u0101 faktisko ietekmi, tas nenoz\u012bm\u0113, ka ikviena saskat\u012bt\u0101 saist\u012bba b\u016bs uzskat\u0101ma par p\u0101rk\u0101pumu PIL 25.panta izpratn\u0113.
