Ja tehnisk\u0101s specifik\u0101cijas sagatavotas vai aktualiz\u0113tas<em>&nbsp;vair\u0101k nek\u0101 12 m\u0113ne\u0161us pirms iepirkuma izsludin\u0101\u0161anas<\/em>, pas\u016bt\u012bt\u0101jam, to fiks\u0113jot protokol\u0101, pirms iepirkuma izsludin\u0101\u0161anas ir j\u0101p\u0101rskata un, ja nepiecie\u0161ams, j\u0101aktualiz\u0113 tehniskaj\u0101s specifik\u0101cij\u0101s un, ja attiecin\u0101ms, citos iepirkuma proced\u016bras dokumentos ietvertie r\u0101d\u012bt\u0101ji un apr\u0113\u0137ini, kas var ietekm\u0113t paredzam\u0101s l\u012bgumcenas noteik\u0161anu.<\/p>\n\n\n\n<ol start=\"6\">\n<li><strong>B\u016bvdarbu l\u012bgums neatbilst Ministru kabineta 2022. gada 5. j\u016blija noteikumu Nr.419&nbsp;\u201cNoteikumi par publisko b\u016bvdarbu l\u012bgumos oblig\u0101ti ietveramajiem noteikumiem un to saturu\u201d pras\u012bb\u0101m<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Birojs v\u0113r\u0161 uzman\u012bbu, ka saska\u0146\u0101 ar min\u0113tajiem Ministru kabineta noteikumiem pas\u016bt\u012bt\u0101jam publiskaj\u0101 b\u016bvdarbu l\u012bgum\u0101, ko sl\u0113dz saska\u0146\u0101 ar PIL (vai SPSIL) noteiktaj\u0101 k\u0101rt\u012bb\u0101 veiktu iepirkumu vai iepirkuma proced\u016bru, ir j\u0101ietver \u0161ajos noteikumos paredz\u0113tie l\u012bguma nosac\u012bjumi un j\u0101nodro\u0161ina, ka citi l\u012bguma noteikumi nav pretrun\u0101 ar \u0161ajos noteikumos min\u0113tajiem noteikumiem. Attiec\u012bgie l\u012bguma nosac\u012bjumi un to saturs ir j\u0101ietver ar\u012b apvienotaj\u0101 publiskaj\u0101 projekt\u0113\u0161anas un b\u016bvdarbu l\u012bgum\u0101 attiec\u012bb\u0101 uz b\u016bvdarbu l\u012bgumtiesisko regul\u0113jumu.<\/p>\n\n\n\n<p>Ministru kabineta noteikumos citastarp iek\u013cauti nosac\u012bjumi par b\u016bvdarbu pie\u0146em\u0161anas k\u0101rt\u012bbu, nor\u0113\u0137inu veik\u0161anas k\u0101rt\u012bbu, l\u012bgumsoda un l\u012bgumsaist\u012bbu izpildes garantijas noteikumiem, k\u0101 ar\u012b tajos iek\u013cauts nosac\u012bjums oblig\u0101ti paredz\u0113t l\u012bgumcenas indeks\u0101cijas noteikumus l\u012bgumiem, kuru izpildes termi\u0146\u0161 p\u0101rsniedz vienu gadu.<\/p>\n\n\n\n<ol start=\"7\">\n<li><strong>Sankciju regul\u0113juma attiecin\u0101\u0161ana uz visiem apak\u0161uz\u0146\u0113m\u0113jiem<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Gad\u012bjumos, kad iepirkuma dokument\u0101cij\u0101 pas\u016bt\u012bt\u0101js nav paredz\u0113jis veikt tie\u0161us maks\u0101jumus apak\u0161uz\u0146\u0113m\u0113jam, nav pamatoti nolikum\u0101 noteikt p\u0101rbaudi p\u0101r piem\u0113rotaj\u0101m sankcij\u0101m (saska\u0146\u0101 ar Sankciju likumu) attiec\u012bb\u0101 uz apak\u0161uz\u0146\u0113m\u0113jiem.<\/p>\n\n\n\n<p><em>Skat.
