Lai gan kop\u012bga dal\u012bba iepirkumos pati par sevi nav aizliegta un liel\u0101koties veicina konkurenci, at\u013caujot iepirkumos piedal\u012bties tirgus dal\u012bbniekiem, kuri tiem nesp\u0113tu kvalific\u0113ties individu\u0101li, tom\u0113r \u013caunpr\u0101t\u012bga kop\u012bgas dal\u012bbas izmanto\u0161ana, lai sl\u0113ptu tirgus dal\u012bbnieku starp\u0101 nosl\u0113gtu karte\u013ca vieno\u0161anos, ir Konkurences likuma (turpm\u0101k \u2013 KL) 11. panta pirm\u0101s da\u013cas p\u0101rk\u0101pums, par kuru var tikt piem\u0113rots sods l\u012bdz pat 10 % no tirgus dal\u012bbnieka iepriek\u0161\u0113j\u0101 gada neto finan\u0161u apgroz\u012bjuma.<sup><a href=\"#fn1\" id=\"ref1\">[2]<\/a><\/sup><\/p>\n\n\n\n<p>Piem\u0113ram, 2023. gad\u0101 KP uzlika tr\u012bs sabiedrisk\u0101 transporta pakalpojumu sniedz\u0113jiem teju divu miljonu eiro sodu par VSIA \u201cAutotransporta direkcija\u201d 2019. gad\u0101 izsludin\u0101ta iepirkuma par sabiedrisk\u0101 transporta pakalpojumu nodro\u0161in\u0101\u0161anu re\u0123ion\u0101las noz\u012bmes mar\u0161rutos uz desmit gadiem sadali sav\u0101 starp\u0101.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/iepirkumos-kopa-objektiva-nepieciesamiba-vai-kartelis#_ftn3\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[3]<\/a><\/sup>&nbsp;\u0160aj\u0101 iepirkum\u0101 pas\u016bt\u012bt\u0101js tirgus dal\u012bbniekiem bija noteicis apjoma ierobe\u017eojumus, ko viens pretendents var\u0113ja ieg\u016bt konkurs\u0101, t.i., ne vair\u0101k k\u0101 15 miljoni kilometru gad\u0101. KP konstat\u0113ja, ka katrs karte\u013ca dal\u012bbnieks v\u0113l\u0113j\u0101s ieg\u016bt pakalpojuma snieg\u0161anas ties\u012bbas p\u0113c iesp\u0113jas pietuvin\u0101ti \u0161im maksim\u0101lajam \u2013 15 miljoni kilometru gad\u0101 \u2013 apjomam, t\u0101d\u0113\u013c tie savstarp\u0113ji vienoj\u0101s gan par piedal\u012b\u0161anos vai nepiedal\u012b\u0161anos konkr\u0113t\u0101 iepirkuma lot\u0113, gan par piedal\u012b\u0161an\u0101s formu \u2013 individu\u0101li vai veidojot apvien\u012bbas, t\u0101d\u0113j\u0101di savstarp\u0113ji sadalot vienas lotes kilometrus sav\u0101 starp\u0101. Vieno\u0161an\u0101s rezult\u0101t\u0101 tika deform\u0113ts sabiedrisk\u0101 transporta pakalpojumu tirgus, \u0146emot v\u0113r\u0101, ka pas\u016bt\u012bt\u0101js sa\u0146\u0113ma nevis re\u0101li konkur\u0113jo\u0161us pretendentu pied\u0101v\u0101jumus, bet gan savstarp\u0113ji saska\u0146otus, konkurenci imit\u0113jo\u0161us pied\u0101v\u0101jumus. P\u0101rk\u0101puma liet\u0101 KP detaliz\u0113ti skaidroja, k\u0101 tirgus dal\u012bbnieku kop\u012bga dal\u012bba iepirkumos v\u0113rt\u0113jama no konkurences ties\u012bbu aspekta, un l\u0113mum\u0101 skaidrotie principi izmantoti ar\u012b KP v\u0113l\u0101k public\u0113taj\u0101m vadl\u012bnij\u0101m par tirgus dal\u012bbnieku kop\u012bgu dal\u012bbu iepirkumos. Vienlaikus j\u0101nor\u0101da, ka ar\u012b pirms \u0161\u012bs 2023. gada p\u0101rk\u0101puma lietas, KP sav\u0101 praks\u0113 vair\u0101kk\u0101rt ir konstat\u0113jusi konkurentu sadarb\u012bbu bez objekt\u012bva pamata, ar m\u0113r\u0137i savstarp\u0113ji sadal\u012bt iepirkumus, tai skait\u0101, izmantojot kop\u012bgu dal\u012bbas formu iepirkumos.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/iepirkumos-kopa-objektiva-nepieciesamiba-vai-kartelis#_ftn4\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[4]<\/a><\/sup><\/p>\n\n\n\n<p>\u0160aj\u0101 rakst\u0101 tiks skaidrota robe\u017e\u0161\u0137irtne starp at\u013cautu sadarb\u012bbu un iesp\u0113jamu KL p\u0101rk\u0101pumu, un k\u0101 uz\u0146\u0113mumam r\u012bkoties, ja tas v\u0113las iepirkum\u0101 iesniegt kop\u012bgu pied\u0101v\u0101jumu ar citu tirgus dal\u012bbnieku.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Likum\u0101 noteiktais vieno\u0161an\u0101s aizliegums<\/strong><\/h3>\n\n\n\n<p>Aizliegta vieno\u0161an\u0101s ir viens no smag\u0101kajiem konkurences ties\u012bbu p\u0101rk\u0101pumiem, un to atkl\u0101\u0161anu KP ir izvirz\u012bjusi par vienu no darb\u012bbas priorit\u0101t\u0113m. Vieno\u0161an\u0101s aizliegums ir atrodams Konkurences likuma 11. panta pirmaj\u0101 da\u013c\u0101, kas attiec\u012bb\u0101 uz dal\u012bbu iepirkumos nosaka:&nbsp;<em>\u201cIr aizliegtas un kop\u0161 nosl\u0113g\u0161anas br\u012b\u017ea sp\u0113k\u0101 neeso\u0161as tirgus dal\u012bbnieku vieno\u0161an\u0101s, kuru m\u0113r\u0137is vai sekas ir konkurences kav\u0113\u0161ana, ierobe\u017eo\u0161ana vai deform\u0113\u0161ana Latvijas teritorij\u0101, to skait\u0101 vieno\u0161an\u0101s par piedal\u012b\u0161anos vai nepiedal\u012b\u0161anos konkursos vai izsol\u0113s vai par \u0161\u012bs darb\u012bbas (bezdarb\u012bbas) noteikumiem\u201d<\/em>. Vienlaikus paredz\u0113ts ar\u012b iz\u0146\u0113mums:&nbsp;<em>\u201ciz\u0146emot gad\u012bjumus, kad konkurenti publiski dar\u012bju\u0161i zin\u0101mu kop\u012bgu pied\u0101v\u0101jumu un \u0161\u0101 pied\u0101v\u0101juma m\u0113r\u0137is nav kav\u0113t, ierobe\u017eot vai deform\u0113t konkurenci\u201d<\/em>.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/iepirkumos-kopa-objektiva-nepieciesamiba-vai-kartelis#_ftn5\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[5]<\/a><\/sup><\/p>\n\n\n\n<p>Min\u0113t\u0101 iz\u0146\u0113muma m\u0113r\u0137is ir veicin\u0101t uz\u0146\u0113mumu dal\u012bbu iepirkumos, kuriem tie cit\u0101d\u0101k nesp\u0113tu kvalific\u0113ties, proti, uz\u0146\u0113mums individu\u0101li nesp\u0113tu nodro\u0161in\u0101t iepirkuma nolikum\u0101 izvirz\u012bt\u0101s pras\u012bbas. Atbilsto\u0161i Augst\u0101k\u0101s tiesas Sen\u0101ta nol\u0113mum\u0101 konstat\u0113tajam, pilnsabiedr\u012bbas galvenok\u0101rt ieteicams izmantot mazajiem un vid\u0113jiem uz\u0146\u0113mumiem, lai piedal\u012btos liela apjoma iepirkumos, kuros tie nesp\u0113j piedal\u012bties individu\u0101li.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/iepirkumos-kopa-objektiva-nepieciesamiba-vai-kartelis#_ftn6\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[6]<\/a><\/sup>&nbsp;T\u0101 k\u0101 \u0161ie uz\u0146\u0113mumi nav uzskat\u0101mi par konkurentiem konkr\u0113taj\u0101 iepirkum\u0101, jo alternat\u012bva b\u016btu tiem iepirkum\u0101 nepiedal\u012bties, tad, iesniedzot kop\u012bgu pied\u0101v\u0101jumu, KL noteiktais vieno\u0161an\u0101s aizliegums netiek p\u0101rk\u0101pts. Tirgus dal\u012bbnieki netiks uzskat\u012bti par konkurentiem konkr\u0113t\u0101 iepirkum\u0101 gan tad, ja tie sniedz da\u017e\u0101dus pakalpojumus, kas ir savstarp\u0113ji papildino\u0161i, gan ar\u012b tad, ja tie, lai gan darbojas vienos un tajos pa\u0161os tirgos, tom\u0113r nevar izpild\u012bt l\u012bgumu individu\u0101li, piem\u0113ram, t\u0101 apjoma vai sare\u017e\u0123\u012bt\u012bbas d\u0113\u013c.<\/p>\n\n\n\n<p>Turpret\u012b personu apvien\u012bbas tirgus dal\u012bbnieku, kuri ir ekonomiski, finansi\u0101li un tehniski sp\u0113j\u012bgi pild\u012bt l\u012bgumsaist\u012bbas patst\u0101v\u012bgi, vid\u016b no konkurences ties\u012bbu viedok\u013ca nav at\u013cautas.<sup><a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/iepirkumos-kopa-objektiva-nepieciesamiba-vai-kartelis#_ftn7\"><sup><\/sup><\/a><a href=\"#fn1\" id=\"ref1\">[7]<\/a><\/sup>&nbsp;Tirgus dal\u012bbnieku savstarp\u0113ja konkurence iepirkumos nodro\u0161ina, ka pas\u016bt\u012bt\u0101js un pat\u0113r\u0113t\u0101ji sa\u0146em visizdev\u012bg\u0101ko cenas un kvalit\u0101tes pied\u0101v\u0101jumu. Savuk\u0101rt, ja divi vai vair\u0101ki tirgus dal\u012bbnieki, kuri b\u016btu var\u0113ju\u0161i iepirkum\u0101 piedal\u012bties individu\u0101li, apmain\u0101s ar komerci\u0101li sensit\u012bvu inform\u0101ciju par dal\u012bbas nosac\u012bjumiem un vienojas iesniegt kop\u012bgu pied\u0101v\u0101jumu, nevis iepirkum\u0101 savstarp\u0113ji konkur\u0113t, pieredze r\u0101da, ka sa\u0146emtais pied\u0101v\u0101jums visticam\u0101k b\u016bs d\u0101rg\u0101ks vai zem\u0101kas kvalit\u0101tes nek\u0101 tas b\u016btu bijis norm\u0101las konkurences apst\u0101k\u013cos.<\/p>\n\n\n\n<p>T\u0101d\u0113j\u0101di b\u016btisk\u0101kais jaut\u0101jums, uz kuru j\u0101atbild, lai secin\u0101tu, vai kop\u012bga pied\u0101v\u0101juma iesnieg\u0161ana iepirkum\u0101 ir at\u013cauta vai aizliegta, ir \u2013 vai vieno\u0161an\u0101s dal\u012bbnieki b\u016btu sp\u0113j\u012bgi iepirkum\u0101 piedal\u012bties individu\u0101li?<\/p>\n\n\n\n<p>Lai atbild\u0113tu uz \u0161o jaut\u0101jumu, s\u0101kotn\u0113ji j\u0101v\u0113rt\u0113 iepirkuma nolikuma pras\u012bbas.
