Iepirkuma dokument\u0101cijai un normat\u012bvajam regul\u0113jumam atbilsto\u0161a iepirkuma l\u012bguma izpilde ir b\u016btisks priek\u0161noteikums publisko iepirkumu pamatprincipu nodro\u0161in\u0101\u0161anai, ko finans\u0113juma sa\u0146\u0113m\u0113ji ap\u0146emas iev\u0113rot, sl\u0113dzot l\u012bgumus\/vieno\u0161an\u0101s ar CFLA par projektu \u012bsteno\u0161anu.<\/p>\n\n\n\n<p>PIL nosac\u012bjumi paredz, ka iepirkuma l\u012bguma izpildes laik\u0101 ir iesp\u0113jama speci\u0101listu un apak\u0161uz\u0146\u0113m\u0113ju nomai\u0146a vai jaunu apak\u0161uz\u0146\u0113m\u0113ju piesaiste, k\u0101 ar\u012b iepirkuma l\u012bguma groz\u012b\u0161ana, izv\u0113rt\u0113jot groz\u012bjumu b\u016btiskumu un pie\u013caujam\u012bbu. Ja iepirkuma l\u012bguma izpild\u0113 tiek pie\u013cauti groz\u012bjumi, kuru veik\u0161ana neatbilst publisko iepirkumu regul\u0113jumam, CFLA ir pamats konstat\u0113t neatbilst\u012bbu, kas saska\u0146\u0101 ar ES fondu normat\u012bvo regul\u0113jumu un Finan\u0161u ministrijas izstr\u0101d\u0101taj\u0101m vadl\u012bnij\u0101m Nr.2.7. \u201cVadl\u012bnijas par finan\u0161u korekciju piem\u0113ro\u0161anu, zi\u0146o\u0161anu par Eiropas Savien\u012bbas fondu ievie\u0161an\u0101 konstat\u0113taj\u0101m neatbilst\u012bb\u0101m, neatbilsto\u0161i veikto izdevumu atg\u016b\u0161anu 2014.\u20132020.gada pl\u0101no\u0161anas period\u0101\u201d rezult\u0113jas ar neatbilsto\u0161i veiktajiem izdevumiem, t.i., projekta publisk\u0101 finans\u0113juma samazin\u0101jumu. Lai no min\u0113t\u0101 izvair\u012btos, finans\u0113juma sa\u0146\u0113m\u0113jiem un citiem pas\u016bt\u012bt\u0101jiem j\u0101\u0146em v\u0113r\u0101 vair\u0101ki b\u016btiski aspekti saist\u012bb\u0101 ar iepirkuma l\u012bguma izpildi un groz\u012bjumu veik\u0161anu taj\u0101.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>B\u016btiskie aspekti iepirkuma l\u012bguma groz\u012b\u0161an\u0101<\/strong><\/h3>\n\n\n\n<p>PIL 61.panta 3.da\u013ca paredz gad\u012bjumus, kad b\u016btisku groz\u012bjumu veik\u0161ana iepirkuma l\u012bgum\u0101 ir pie\u013caujama. Tom\u0113r j\u0101atz\u012bst, ka \u0161is regul\u0113jums galvenok\u0101rt aptver situ\u0101cijas, kad iepirkuma l\u012bguma izpildes laik\u0101 rodas iepriek\u0161 neparedzama nepiecie\u0161am\u012bba pas\u016bt\u012bt papildu darbus vai palielin\u0101t iepirkuma l\u012bguma apjomu, kas var kalpot par pamatu ar\u012b l\u012bguma izpildes termi\u0146a pagarin\u0101jumam. Tas noz\u012bm\u0113, ka, konstat\u0113jot, ka veikti b\u016btiski l\u012bguma groz\u012bjumi, pamatojoties uz k\u0101du no PIL 61.panta 3.da\u013cas punktiem, CFLA l\u016bgs finans\u0113juma sa\u0146\u0113m\u0113jus pier\u0101d\u012bt konkr\u0113t\u0101s situ\u0101cijas atbilst\u012bbu attiec\u012bg\u0101 punkta tv\u0113rumam, k\u0101 ar\u012b v\u0113rt\u0113s, vai puses nepiecie\u0161amos groz\u012bjumus objekt\u012bvi nevar\u0113ja paredz\u0113t. CFLA, v\u0113rt\u0113jot, vai iepirkuma l\u012bguma izpilde ir notikusi atbilsto\u0161i iepirkuma dokumentos noteiktaj\u0101m pras\u012bb\u0101m un iepirkuma l\u012bgum\u0101 iek\u013cautajiem noteikumiem, nereti konstat\u0113 gad\u012bjumus, kad pas\u016bt\u012bt\u0101js r\u016bp\u012bbas tr\u016bkuma vai neuzman\u012bbas d\u0113\u013c ir pie\u013c\u0101vis b\u016btiskus groz\u012bjumus iepirkuma l\u012bgum\u0101, kas nebija pie\u013caujami. Piem\u0113ram, bez objekt\u012bva pamatojuma nesam\u0113r\u012bgi pagarina iepirkuma l\u012bgum\u0101 noteikto darbu izpildes termi\u0146u. \u0160aj\u0101 gad\u012bjum\u0101 j\u0101nor\u0101da, ka pas\u016bt\u012bt\u0101jam ir r\u016bp\u012bgi j\u0101iev\u0113ro iepirkuma l\u012bgum\u0101 min\u0113tie nosac\u012bjumi attiec\u012bb\u0101 uz gad\u012bjumiem, kad termi\u0146\u0161 var tikt pagarin\u0101ts. Saska\u0146ot dr\u012bkst tikai t\u0101du iepirkuma l\u012bguma izpildes termi\u0146a pagarin\u0101jumu, kas ir sam\u0113r\u012bgs papildus veicamo darbu apjomam vai atbilst periodam, kur\u0101 iepirkuma l\u012bguma izpilde nav bijusi iesp\u0113jama no izpild\u012bt\u0101ja neatkar\u012bgu iemeslu d\u0113\u013c.<\/p>\n\n\n\n<p>CFLA prakse liecina, ka visas situ\u0101cijas, kas var rasties l\u012bguma izpildes laik\u0101, iepriek\u0161 nav paredzamas, l\u012bdz ar to b\u016btu ieteicams iepirkuma l\u012bgum\u0101 noteikt nevis konkr\u0113tu l\u012bguma izpildes termi\u0146a pagarin\u0101juma maksim\u0101lo apjomu, bet gan izv\u0113l\u0113ties t\u0101du formul\u0113jumu k\u0101, piem\u0113ram, \u2013 \u201ciepirkuma l\u012bguma izpildes termi\u0146u var pagarin\u0101t par laiku, kas atbilst papildus veicamo darbu apjomam&#8221; vai &#8220;iepirkuma l\u012bguma izpildes termi\u0146u var pagarin\u0101t par laiku, kas atbilst termi\u0146am, k\u0101d\u0101 l\u012bguma izpilde nebija iesp\u0113jama no izpild\u012bt\u0101ja neatkar\u012bgu iemeslu d\u0113\u013c\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Nepie\u013caujami b\u016btiski l\u012bguma groz\u012bjumi<\/strong><\/h3>\n\n\n\n<p>PIL 61.panta 2.da\u013cas 1.punkt\u0101 teikts, ka iepirkuma l\u012bguma vai visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s groz\u012bjumi ir b\u016btiski, ja groz\u012btie iepirkuma l\u012bguma vai visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s noteikumi, ja tie b\u016btu biju\u0161i paredz\u0113ti iepirkuma proced\u016bras dokumentos, pie\u013cautu at\u0161\u0137ir\u012bgu pied\u0101v\u0101jumu iesnieg\u0161anu vai citu kandid\u0101tu vai pretendentu dal\u012bbu vai izv\u0113li iepirkuma proced\u016br\u0101.<\/p>\n\n\n\n<p>CFLA praks\u0113 pas\u016bt\u012bt\u0101ji, veicot iepirkuma l\u012bguma groz\u012bjumus, nereti nav pietiekami izv\u0113rt\u0113ju\u0161i, vai attiec\u012bgie groz\u012bjumi nerada labv\u0113l\u012bg\u0101kus apst\u0101k\u013cus izpild\u012bt\u0101jam, atvieglojot iepirkuma dokument\u0101cij\u0101 izvirz\u012bt\u0101s pras\u012bbas. Turkl\u0101t CFLA pieredze liecina, ka nereti \u0161\u0101das k\u013c\u016bdas tiek pie\u013cautas net\u012b\u0161i, nepietiekami kontrol\u0113jot l\u012bguma izpildi. Bie\u017e\u0101kie piem\u0113ri min\u0113tajam ir \u0161\u0101di:<\/p>\n\n\n\n<ul>\n<li>pas\u016bt\u012bt\u0101js, pietiekam\u0101 apjom\u0101 neveicot l\u012bguma izpildes kontroli, pie\u013cauj, ka pieg\u0101d\u0101t\u0101js aizvieto pied\u0101v\u0101jum\u0101 nor\u0101d\u012btos speci\u0101listus ar iepirkuma nolikum\u0101 noteiktaj\u0101m pras\u012bb\u0101m atbilsto\u0161u kvalifik\u0101ciju ar maz\u0101k kvalific\u0113tiem speci\u0101listiem, kuri neatbilst nolikum\u0101 noteiktaj\u0101m pras\u012bb\u0101m;<\/li>\n\n\n\n<li>pas\u016bt\u012bt\u0101js pie\u013cauj, ka l\u012bguma izpildi veic izpild\u012bt\u0101js bez atbilsto\u0161as pieredzes un\/vai kvalifik\u0101cijas, piem\u0113ram, l\u012bguma izpild\u0113 darbu veic tas personu apvien\u012bbas biedrs, kuram nav iepirkuma nolikumam atbilsto\u0161as pieredzes, vai gad\u012bjumi, kad persona, uz kuras sp\u0113j\u0101m pretendents balst\u012bj\u0101s, netiek iesaist\u012bta l\u012bguma izpild\u0113;<\/li>\n\n\n\n<li>pas\u016bt\u012bt\u0101js pie\u013cauj iepirkuma dokument\u0101cijai neatbilsto\u0161u pre\u010du pieg\u0101di, uzst\u0101d\u012b\u0161anu vai citus iepirkuma dokument\u0101cijai neatbilsto\u0161us l\u012bguma izpildes risin\u0101jumus;<\/li>\n\n\n\n<li>pas\u016bt\u012bt\u0101js pie\u013cauj nepamatotu iepirkuma l\u012bguma termi\u0146a pagarin\u0101jumu.<\/li>\n<\/ul>\n\n\n\n<p>Min\u0113tajos piem\u0113ros, ja potenci\u0101lie pretendenti b\u016btu inform\u0113ti, ka iepirkuma komisija par atbilsto\u0161iem atz\u012bs ar\u012b to pretendentu pied\u0101v\u0101jumus, kuriem pa\u0161iem vai to pied\u0101v\u0101tajiem speci\u0101listiem nav iepirkuma dokument\u0101cij\u0101 noteiktaj\u0101m pras\u012bb\u0101m atbilsto\u0161as pieredzes un kuri paredz iepirkuma dokument\u0101cijai neatbilsto\u0161us risin\u0101jumus vai termi\u0146us, tie, iesp\u0113jams, iesniegtu savu pied\u0101v\u0101jumu iepirkum\u0101, l\u012bdz ar to pretendentu loks b\u016btu pla\u0161\u0101ks un, iesp\u0113jams, pas\u016bt\u012bt\u0101js l\u012bguma sl\u0113g\u0161anas ties\u012bbas b\u016btu pie\u0161\u0137\u012bris citam pretendentam. T\u0101p\u0113c \u0161\u0101du groz\u012bjumu veik\u0161ana nav pie\u013caujama.<\/p>\n\n\n\n<p>Praks\u0113 CFLA v\u0113rt\u0113 ar\u012b to, vai attiec\u012bgie groz\u012bjumi vai atk\u0101pes no iepirkuma l\u012bguma nosac\u012bjumiem, ko paredz iepirkuma l\u012bgums vai visp\u0101r\u012bg\u0101 vieno\u0161an\u0101s, nemaina ekonomisko l\u012bdzsvaru iepirkuma proced\u016br\u0101 izraudz\u012bt\u0101 pretendenta interes\u0113s, proti, vai nav konstat\u0113jams PIL 61.panta 2.da\u013cas 2.punkta p\u0101rk\u0101pums.&nbsp;Atbilsto\u0161i Iepirkumu uzraudz\u012bbas biroja skaidrojumam \u201cpar&nbsp;ekonomisk\u0101 l\u012bdzsvara mai\u0146u liecina jebk\u0101di apst\u0101k\u013ci, kas padara l\u012bguma izpildi pieg\u0101d\u0101t\u0101jam izdev\u012bg\u0101ku, piem\u0113ram, atviegloti l\u012bguma izpildes noteikumi, maz\u0101kas sankcijas par iesp\u0113jamiem l\u012bguma p\u0101rk\u0101pumiem, izmai\u0146as samaksas noteikumos (piem\u0113ram, paredzot avansa maks\u0101jumu, kas nebija paredz\u0113ts iepirkuma dokument\u0101cij\u0101, vai palielinot t\u0101 apjomu, vai mainot apmaksas k\u0101rt\u012bbu no p\u0113capmaksas uz priek\u0161apmaksu vai izdev\u012bg\u0101ku apmaksas k\u0101rt\u012bbu (maks\u0101jot pa da\u013c\u0101m, lai gan bijis paredz\u0113ts viens maks\u0101jums p\u0113c visa iepirkuma priek\u0161meta izpildes) un citi apst\u0101k\u013ci\u201d. Ar\u012b groz\u012bjumi, kas maina ekonomisko l\u012bdzsvaru par labu izraudz\u012btajam pretendentam, nav pie\u013caujami.<\/p>\n\n\n\n<p>Atbilsto\u0161i PIL 61.panta 2.da\u013cas 3.punktam nav pie\u013caujama ar\u012b situ\u0101cija, kad l\u012bgum\u0101 tiek iek\u013cauti papildu darbi, kas iepriek\u0161 bija zin\u0101mi vai paredzami. \u0160aj\u0101 gad\u012bjum\u0101 b\u016btiski uzsv\u0113rt, ka pie\u013caujami var\u0113tu b\u016bt tikai t\u0101di groz\u012bjumi par papildu darbu apjomu, kas ab\u0101m pus\u0113m nebija paredzami. Piem\u0113ram, ja pas\u016bt\u012bt\u0101js jau s\u0101kotn\u0113ji iepirkuma pl\u0101no\u0161anas proces\u0101 bija pl\u0101nojis iepirkuma priek\u0161met\u0101 iek\u013caut k\u0101du konkr\u0113tu darbu apjomu, piem\u0113ram, vienas fas\u0101des energoefektivit\u0101tes uzlabo\u0161anas b\u016bvdarbus, bet pirms iepirkuma sludin\u0101juma public\u0113\u0161anas konstat\u0113jis, ka \u0161o darbu veik\u0161anai var\u0113tu pietr\u016bkt finans\u0113juma, l\u012bdz ar to iepirkuma priek\u0161met\u0101 tos nav iek\u013c\u0101vis, tad iepirkuma l\u012bguma izpildes laik\u0101, ja tiek pie\u0161\u0137irts papildu finans\u0113jums, \u0161\u0101du iepriek\u0161 paredzamu darbu apjomu nevar uzskat\u012bt par papildu darbu apjomu, ko pas\u016bt\u012bt\u0101js nevar\u0113ja paredz\u0113t. Ieteicams pas\u016bt\u012bt\u0101jiem, izstr\u0101d\u0101jot iepirkuma dokument\u0101ciju, tostarp iepirkuma l\u012bguma projektu, skaidri paredz\u0113t iesp\u0113ju veikt groz\u012bjumus, iek\u013caujot l\u012bgum\u0101 min\u0113tos papildu darbus, lai visi potenci\u0101lie pretendenti ir inform\u0113ti par \u0161\u0101d\u0101m iesp\u0113jam\u0101m izmai\u0146\u0101m izpild\u0101mo darbu apm\u0113r\u0101.<\/p>\n\n\n\n<p>Konstat\u0113jot nepie\u013caujamus b\u016btiskus l\u012bguma groz\u012bjumus, ja nav iesp\u0113jams noteikt konkr\u0113ti neatbilsto\u0161i veikto izdevumu apm\u0113ru, CFLA atbilsto\u0161i ES fondu regul\u0113jumam lemj par neatbilst\u012bbu. Vadl\u012bnijas par \u0161\u0101du p\u0101rk\u0101pumu paredz finan\u0161u korekcijas piem\u0113ro\u0161anu 25% apm\u0113r\u0101, t\u0101p\u0113c t\u0101 aicina finans\u0113juma sa\u0146\u0113m\u0113jus un citus pas\u016bt\u012bt\u0101jus b\u016bt atbild\u012bgiem saist\u012bb\u0101 ar iepirkuma l\u012bgumu groz\u012b\u0161anu un nepie\u013caut b\u016btisku l\u012bgumu groz\u012bjumu veik\u0161anu iepirkuma l\u012bguma izpild\u0113.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Citas atk\u0101pes no nosac\u012bjumiem<\/strong><\/h3>\n\n\n\n<p>K\u0101 tika nor\u0101d\u012bts iepriek\u0161, iepirkuma l\u012bguma izpildei j\u0101notiek atbilsto\u0161i t\u0101 nosac\u012bjumiem. T\u0101p\u0113c CFLA atbilsto\u0161i ES fondu regul\u0113jumam un vadl\u012bnij\u0101m attiec\u012bgos ar p\u0101rk\u0101pumu\/atk\u0101pi saist\u012btos izdevumus atz\u012bst par neatbilsto\u0161i veiktiem izdevumiem, piem\u0113ram, ja iepirkuma l\u012bguma izpild\u0113 bez objekt\u012bva pamatojuma nav piem\u0113rots l\u012bgumsods, CFLA samazina publisko finans\u0113jumu nepiem\u0113rot\u0101 l\u012bgumsoda apm\u0113r\u0101.<\/p>\n\n\n\n<p>CFLA nereti konstat\u0113, ka iepirkuma l\u012bgums netiek iev\u0113rots, jo taj\u0101 paredz\u0113ti lieki nosac\u012bjumi, proti, iepirkuma l\u012bguma redakcija nav tikusi piel\u0101gota konkr\u0113tajai situ\u0101cijai.
