Kam piev\u0113rst uzman\u012bbu, lai pied\u0101v\u0101jums iepirkum\u0101 atbilstu pras\u012bb\u0101m?<\/p>\n\n\n\n<p>Saska\u0146\u0101 ar&nbsp;Sen\u0101ta 2012.gada 17.augusta l\u0113mumu liet\u0101 SKA-850\/2012&nbsp;\u201cnolikums ir ties\u012bbu akts, uz kuru tiek balst\u012bta turpm\u0101k\u0101 iepirkuma proced\u016bra un kur\u0161 l\u012bdztekus normat\u012bvajam regul\u0113jumam (un vienlaikus tam atbilsto\u0161i) reglament\u0113 iepirkuma proced\u016bras norisi; taj\u0101 ietvertie noteikumi, tostarp krit\u0113riji, kurus pas\u016bt\u012bt\u0101js v\u0113rt\u0113, pie\u0161\u0137irot l\u012bguma sl\u0113g\u0161anas ties\u012bbas, ir saisto\u0161i l\u012bdz pat br\u012bdim, kad tiek izpild\u012bts vai ir k\u013cuvis neapstr\u012bdams l\u0113mums par l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu\u201d.&nbsp;Tas noz\u012bm\u0113, ka iepirkuma dokument\u0101cij\u0101 noteiktie krit\u0113riji ir saisto\u0161i un no tiem nevar atk\u0101pties ne pretendenti, ne pas\u016bt\u012bt\u0101js.&nbsp;V\u0113rt\u0113jot pied\u0101v\u0101jumus, pas\u016bt\u012bt\u0101jam ir j\u0101p\u0101rbauda visi pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas aspekti, p\u0101rliecinoties,&nbsp;ka pied\u0101v\u0101jums piln\u012bb\u0101 atbilst iepirkuma dokument\u0101cijas pras\u012bb\u0101m.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Atbilst\u012bba kvalifik\u0101cijas\/atlases pras\u012bb\u0101m<\/strong><\/h4>\n\n\n\n<p>Nereti Centr\u0101l\u0101 finan\u0161u un l\u012bgumu a\u0123ent\u016bra&nbsp;(CFLA) konstat\u0113, ka finans\u0113juma sa\u0146\u0113m\u0113js, p\u0101rbaudot pretendenta kvalifik\u0101ciju, nepietiekami r\u016bp\u012bgi izv\u0113rt\u0113 pieteikum\u0101 nor\u0101d\u012bto inform\u0101ciju. Rezult\u0101t\u0101 par iepirkuma uzvar\u0113t\u0101ju tiek pasludin\u0101ts pretendents, kura kvalifik\u0101cija faktiski neatbilst atlases pras\u012bb\u0101m. \u0160\u0101da neatbilst\u012bba saska\u0146\u0101 ar Finan\u0161u ministrijas izstr\u0101d\u0101taj\u0101m vadl\u012bnij\u0101m Nr.2.7. \u201cVadl\u012bnijas par finan\u0161u korekciju piem\u0113ro\u0161anu, zi\u0146o\u0161anu par Eiropas Savien\u012bbas fondu ievie\u0161an\u0101 konstat\u0113taj\u0101m neatbilst\u012bb\u0101m, neatbilsto\u0161i veikto izdevumu atg\u016b\u0161anu 2014.\u20132020. gada pl\u0101no\u0161anas period\u0101\u201d ir v\u0113rt\u0113jama k\u0101 atlases pras\u012bbu groz\u012b\u0161ana, par kuru paredz\u0113ta finan\u0161u korekcija 25% apm\u0113r\u0101.<\/p>\n\n\n\n<p>V\u0113rt\u0113jot pretendenta atbilst\u012bbu, b\u016btiski ne tikai r\u016bp\u012bgi izanaliz\u0113t pa\u0161a pretendenta kvalifik\u0101ciju, bet ar\u012b to personu kvalifik\u0101ciju, uz kuras sp\u0113j\u0101m pretendents balst\u0101s, k\u0101 ar\u012b piesaist\u012bto speci\u0101listu kvalifik\u0101ciju. Svar\u012bgi atcer\u0113ties, ka, izvirzot pieredzes pras\u012bbu pretendentam, pas\u016bt\u012bt\u0101ja m\u0113r\u0137is ir p\u0101rliecin\u0101ties par pretendenta sp\u0113ju nodro\u0161in\u0101t l\u012bguma izpildi. T\u0101d\u0113\u013c iepirkumu veic\u0113jam j\u0101no\u0161\u0137ir pras\u012bbas, kas izvirz\u012btas pretendentam, no t\u0101m, kas izvirz\u012btas piesaist\u012btajiem speci\u0101listiem, p\u0101rliecinoties, ka pied\u0101v\u0101jums atbilst katram iepirkuma dokument\u0101cij\u0101 noteiktajam krit\u0113rijam.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Tehnisk\u0101 pied\u0101v\u0101juma v\u0113rt\u0113\u0161ana<\/strong><\/h4>\n\n\n\n<p>Sen\u0101ts 2014.gada 6.novembra spriedum\u0101 liet\u0101 SKA-681\/2014&nbsp;secin\u0101jis, ka \u201cnolikumam neatbilsto\u0161a pied\u0101v\u0101juma atz\u012b\u0161ana par atbilsto\u0161u tam ir pret\u0113ja Publisko iepirkumu likuma (PIL) m\u0113r\u0137im nodro\u0161in\u0101t taisn\u012bgu un vienl\u012bdz\u012bgu attieksmi pret pieg\u0101d\u0101t\u0101jiem\u201d. T\u0101p\u0113c, p\u0101rbaudot tehnisko pied\u0101v\u0101jumu, iepirkuma komisijai r\u016bp\u012bgi j\u0101izv\u0113rt\u0113 pied\u0101v\u0101juma atbilst\u012bba katrai iepirkuma dokument\u0101cij\u0101 izvirz\u012btajai pras\u012bbai. \u0160aj\u0101 posm\u0101 nav pie\u013caujama pat neliela atk\u0101p\u0161an\u0101s no tehnisk\u0101s specifik\u0101cijas pras\u012bb\u0101m. Min\u0113to apstiprina Sen\u0101ta 2013.gada 18.septembra spriedum\u0101 liet\u0101 SKA-772\/2013 paust\u0101 atzi\u0146a: \u201cVis\u0101m pras\u012bb\u0101m, kur\u0101m j\u0101atbilst pied\u0101v\u0101jumam, un pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas k\u0101rt\u012bbai ir j\u0101b\u016bt paredz\u0113tai iepirkuma proced\u016bras dokument\u0101cij\u0101, ja pretendents vai potenci\u0101lais pretendents iebilst pret pas\u016bt\u012bt\u0101ja izvirz\u012btaj\u0101m pras\u012bb\u0101m, tas \u0161\u012bs pras\u012bbas var apstr\u012bd\u0113t Iepirkumu uzraudz\u012bbas biroj\u0101, ja tas netiek dar\u012bts, pretendentam j\u0101g\u0101d\u0101, lai vi\u0146a pied\u0101v\u0101jums piln\u012bb\u0101 atbilstu \u0161\u012bm pras\u012bb\u0101m. [..] Pied\u0101v\u0101juma neatbilst\u012bba ir pamats pied\u0101v\u0101juma t\u0101l\u0101kai nev\u0113rt\u0113\u0161anai.\u201d<\/p>\n\n\n\n<p>Izstr\u0101d\u0101jot tehnisko specifik\u0101ciju, taj\u0101 iek\u013cauj v\u0113lamo pre\u010du vai pakalpojumu parametrus un to pie\u013caujam\u0101s sv\u0101rst\u012bbu robe\u017eas.&nbsp;Konkr\u0113tu pras\u012bbu izvirz\u012b\u0161ana noz\u012bm\u0113, ka pas\u016bt\u012bt\u0101jam ir b\u016btiski sa\u0146emt preci vai pakalpojumu ar noteiktiem parametriem un atk\u0101p\u0161an\u0101s no \u0161\u012bm pras\u012bb\u0101m nav pie\u013caujama.&nbsp;CFLA bie\u017ei konstat\u0113 gad\u012bjumus, kad finans\u0113juma sa\u0146\u0113m\u0113js ir noteicis konkr\u0113tas v\u0113lamo parametru amplit\u016bdas, bet iepirkuma komisija, v\u0113rt\u0113jot tehnisko pied\u0101v\u0101jumu atbilst\u012bbu, par uzvar\u0113t\u0101ju atz\u012bst pied\u0101v\u0101jumu, kas neiek\u013caujas tehniskaj\u0101 specifik\u0101cij\u0101 noteiktaj\u0101s robe\u017e\u0101s.&nbsp;CFLA nor\u0101da, ka ar\u012b gad\u012bjumos, kad&nbsp;pas\u016bt\u012bt\u0101js iep\u0113rk da\u017e\u0101da izm\u0113ra un funkcionalit\u0101tes preces, kur tikai viena no poz\u012bcij\u0101m neatbilst izvirz\u012btaj\u0101m pras\u012bb\u0101m, \u0161\u0101ds pied\u0101v\u0101jums nav uzskat\u0101ms par atbilsto\u0161u tehnisk\u0101s specifik\u0101cijas pras\u012bb\u0101m. CFLA atg\u0101dina, ka, lai gan p\u0101rbaud\u0101mo poz\u012bciju apjoms var b\u016bt iev\u0113rojams, nosakot konkr\u0113tus krit\u0113rijus, ir svar\u012bgi p\u0101rliecin\u0101ties par katras poz\u012bcijas atbilst\u012bbu izvirz\u012btaj\u0101m pras\u012bb\u0101m.&nbsp;Tehnisk\u0101 pied\u0101v\u0101juma v\u0113rt\u0113\u0161anas laik\u0101 konstat\u0113jot pat nelielu atk\u0101pi&nbsp;(piem\u0113ram, da\u017eu milimetru atk\u0101pi no tehniskaj\u0101 specifik\u0101cij\u0101 nor\u0101d\u012bt\u0101 izm\u0113ra),&nbsp;iepirkuma komisijai j\u0101p\u0101rtrauc pied\u0101v\u0101juma v\u0113rt\u0113\u0161ana un pied\u0101v\u0101jums j\u0101noraida.<\/p>\n\n\n\n<p>L\u012bdz\u012bgas iepirkumu komisijas k\u013c\u016bdas, akcept\u0113jot neatbilsto\u0161u tehnisko pied\u0101v\u0101jumu, konstat\u0113jamas ar\u012b tad, kad vair\u0101ku pretendentu pied\u0101v\u0101jumos ir iek\u013cautas identiskas poz\u012bcijas, kas neatbilst tehnisk\u0101s specifik\u0101cijas pras\u012bb\u0101m, kurus iepirkuma komisija neizsl\u0113dz no iepirkuma laika taup\u012b\u0161anas nol\u016bk\u0101 vai pied\u0101v\u0101juma izdev\u012bguma d\u0113\u013c. CFLA v\u0113r\u0161 uzman\u012bbu, ka \u0161\u0101da pas\u016bt\u012bt\u0101ja r\u012bc\u012bba ir pretrun\u0101 ar Sen\u0101ta spriedum\u0101 liet\u0101 SKA-772\/2013&nbsp;pausto atzi\u0146u: \u201cLai ar\u012b neatbilst\u012bba starp pas\u016bt\u012bt\u0101ja pras\u012bb\u0101m un pieteic\u0113jas pied\u0101v\u0101jumu \u0161\u0137ietami ir neliela, tam nevar pie\u0161\u0137irt k\u0101du noz\u012bmi, apsverot, vai pretendents ir vai nav izsl\u0113dzams no turpm\u0101kas dal\u012bbas iepirkum\u0101, pret\u0113j\u0101 gad\u012bjum\u0101 tiktu p\u0101rk\u0101pts vienl\u012bdz\u012bbas un taisn\u012bgas attieksmes princips, ja ar\u012b citi pretendenti b\u016btu zin\u0101ju\u0161i, ka var tikt pied\u0101v\u0101tas no tehnisk\u0101s specifik\u0101cijas nedaudz at\u0161\u0137ir\u012bgas preces (proti, ja \u0161\u0101da iesp\u0113ja b\u016btu paredz\u0113to iepirkuma proced\u016bras dokument\u0101cij\u0101), to pied\u0101v\u0101jums, iesp\u0113jams, b\u016btu cit\u0101d\u0101ks, un tas savuk\u0101rt var\u0113tu ietekm\u0113t iepirkuma proced\u016bras rezult\u0101tus.\u201d No min\u0113t\u0101s tiesas atzi\u0146as nep\u0101rprotami izriet, ka neatkar\u012bgi no t\u0101, cik neliela ir neatbilst\u012bba, tehniskajai specifik\u0101cijai neatbilsto\u0161s pied\u0101v\u0101jums&nbsp;ir j\u0101noraida. \u0160\u0101da pied\u0101v\u0101juma atz\u012b\u0161ana par atbilsto\u0161u v\u0113rt\u0113jama k\u0101 atlases pras\u012bbu groz\u012b\u0161ana un rezult\u0113jas ar finan\u0161u korekciju.<\/p>\n\n\n\n<p>Praks\u0113 konstat\u0113tas ar\u012b situ\u0101cijas, kad pas\u016bt\u012bt\u0101js \u013cauj pretendentam papildin\u0101t tehnisko pied\u0101v\u0101jumu.&nbsp;Saska\u0146\u0101 ar PIL 41.panta 8.da\u013cu, pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas gait\u0101 pas\u016bt\u012bt\u0101js ir ties\u012bgs piepras\u012bt, lai tiek izskaidrota tehniskaj\u0101 pied\u0101v\u0101jum\u0101 jau iek\u013caut\u0101 inform\u0101cija. K\u0101 nor\u0101d\u012bts Sen\u0101ta 2016.gada 10.novembra spriedum\u0101 liet\u0101 SKA-714\/2016, \u201cattiec\u012bb\u0101 uz tehnisk\u0101 pied\u0101v\u0101jum\u0101 ietverto inform\u0101ciju, nav j\u0101atsak\u0101s izv\u0113rt\u0113t pretendenta papildus sniegto inform\u0101ciju, ja t\u0101 vien\u012bgi izskaidro pied\u0101v\u0101jumu, nevis papildina vai groza to; lai secin\u0101tu, ka v\u0113l\u0101k iesniegt\u0101 inform\u0101cija ir pied\u0101v\u0101juma papildin\u0101jumi vai groz\u012bjumi, t\u0101 b\u016btu j\u0101sal\u012bdzina ar s\u0101kotn\u0113jo pied\u0101v\u0101jumu, p\u0101rbaudot, vai v\u0113l\u0101k iesniegtie dokumenti izmaina pied\u0101v\u0101jumu p\u0113c b\u016bt\u012bbas\u201d. No min\u0113t\u0101s tiesas atzi\u0146as izriet, ka tehnisko pied\u0101v\u0101jumu papildin\u0101\u0161ana un groz\u012b\u0161ana nav pie\u013caujama, tom\u0113r pas\u016bt\u012bt\u0101jam ir ties\u012bbas l\u016bgt skaidrot pied\u0101v\u0101jum\u0101 ietverto inform\u0101ciju. V\u0113rt\u0113jot pretendenta sniegto skaidrojumu, pas\u016bt\u012bt\u0101jam j\u0101p\u0101rliecin\u0101s, ka skaidrojum\u0101 nav iek\u013cauta t\u0101da jauna inform\u0101cija, kas faktiski noved pie pied\u0101v\u0101juma groz\u012b\u0161anas p\u0113c b\u016bt\u012bbas, sal\u012bdzinot to ar s\u0101kotn\u0113jo pied\u0101v\u0101jumu.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Finan\u0161u pied\u0101v\u0101juma v\u0113rt\u0113\u0161ana<\/strong><\/h4>\n\n\n\n<p>V\u0113rt\u0113jot finan\u0161u pied\u0101v\u0101jumu, pas\u016bt\u012bt\u0101jam j\u0101p\u0101rbauda, vai pied\u0101v\u0101jums sagatavots atbilsto\u0161i iepirkuma dokument\u0101cijas pras\u012bb\u0101m: vai visas izmaksas ir korekti sadal\u012btas un atspogu\u013cotas pied\u0101v\u0101jum\u0101 un vai pied\u0101v\u0101jum\u0101 ir iek\u013cauti visi izdevumi.&nbsp;Sen\u0101ta 2017.gada 23.oktobra sprieduma liet\u0101 SKA-776\/2017 nor\u0101d\u012bts: \u201cja nolikum\u0101 paredz\u0113ts, ka k\u0101da pakalpojuma komponente ir j\u0101izceno atsevi\u0161\u0137i, un \u0161ai cenai ir noz\u012bme saimnieciski izdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma izv\u0113l\u0113, tad pas\u016bt\u012bt\u0101ja r\u012bc\u012bba, akcept\u0113jot pied\u0101v\u0101jumu, kur\u0101 attiec\u012bg\u0101 cena faktiski iek\u013cauta cit\u0101 poz\u012bcij\u0101, var rad\u012bt vienl\u012bdz\u012bgas attieksmes principa p\u0101rk\u0101pumu\u201d. Vienlaikus, v\u0113rt\u0113jot finan\u0161u pied\u0101v\u0101jumu, pas\u016bt\u012bt\u0101jam j\u0101p\u0101rbauda vai pied\u0101v\u0101jum\u0101 nav aritm\u0113tisk\u0101s k\u013c\u016bdas (p\u0113c nepiecie\u0161am\u012bbas labojot t\u0101s), k\u0101 ar\u012b j\u0101izv\u0113rt\u0113, vai pied\u0101v\u0101jums nav atz\u012bstams par nepamatoti l\u0113tu, \u0161aubu gad\u012bjum\u0101 pretendentam l\u016bdzot sniegt skaidrojumu.<\/p>\n\n\n\n<p>Viena no praks\u0113 bie\u017e\u0101k sastopamaj\u0101m k\u013c\u016bd\u0101m finan\u0161u pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anas posm\u0101 ir t\u0101da pretendenta atz\u012b\u0161ana par uzvar\u0113t\u0101ju, kura pied\u0101v\u0101jums p\u0101rsniedz 150% no iepirkuma paredzam\u0101s l\u012bgumcenas. \u0160\u0101da neatbilst\u012bba finans\u0113juma sa\u0146\u0113m\u0113jam var rezult\u0113ties ar finan\u0161u korekciju 5\u201325% apm\u0113r\u0101. Nereti tas notiek gad\u012bjumos, kad vair\u0101ki (vai visi) iesniegtie pied\u0101v\u0101jumi p\u0101rsniedz public\u0113to paredzamo l\u012bgumcenu. Resursu taup\u012b\u0161anas nol\u016bk\u0101 iepirkuma komisija pie\u0146em l\u0113mumu nep\u0101rtraukt iepirkuma proced\u016bru, turpinot pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anu, rezult\u0101t\u0101 pie\u0161\u0137irot l\u012bguma sl\u0113g\u0161anas ties\u012bbas pretendentam, kura pied\u0101v\u0101jums iev\u0113rojami p\u0101rsniedz paredzamo l\u012bgumcenu, kas ir pretrun\u0101 ar PIL 41.panta 11.da\u013cas 2.punkt\u0101 nor\u0101d\u012bto.<\/p>\n\n\n\n<p>V\u0113l viena tipiska iepirkumu komisijas k\u013c\u016bda ir uzskat\u012bt, ka, ja iepirkums da\u013c\u0113ji izbeidzas bez rezult\u0101ta, cit\u0101 iepirkuma da\u013c\u0101 dr\u012bkst akcept\u0113t pied\u0101v\u0101jumu, kas p\u0101rsniedz atsevi\u0161\u0137\u0101s da\u013cas paredzamo l\u012bgumcenu, pie nosac\u012bjuma, ka kop\u0113j\u0101 iepirkuma paredzam\u0101 l\u012bgumcena netiek p\u0101rsniegta. \u0160\u0101da r\u012bc\u012bba nav pie\u013caujama, proti, pas\u016bt\u012bt\u0101jam nav tiesiska pamata summ\u0113t atliku\u0161o iepirkuma da\u013cu l\u012bgumcenas un \u0161o summu noteikt k\u0101 kop\u0113jo paredzamo l\u012bgumcenu, jo pas\u016bt\u012bt\u0101jam ir saisto\u0161a katras atsevi\u0161\u0137\u0101s iepirkuma da\u013cas paredzam\u0101 l\u012bgumcena.<\/p>\n\n\n\n<p><strong>Izsl\u0113g\u0161anas nosac\u012bjumu p\u0101rbaude<\/strong><\/p>\n\n\n\n<p>Pirms l\u0113muma pie\u0146em\u0161anas par l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu iepirkumu veic\u0113jam j\u0101p\u0101rliecin\u0101s, ka uz pretendentu nav attiecin\u0101mi PIL 42.pant\u0101 min\u0113tie izsl\u0113g\u0161anas nosac\u012bjumi.<\/p>\n\n\n\n<p>Viens no galvenajiem klup\u0161anas akme\u0146iem izsl\u0113g\u0161anas iemeslu p\u0101rbaudes proces\u0101 ir nepietiekami r\u016bp\u012bga nodok\u013cu saist\u012bbu p\u0101rbaude, tas ir, p\u0101rbaudot pretendenta nodok\u013cu saist\u012bbas, p\u0101rbaude bie\u017ei vien netiek veikta attiec\u012bb\u0101 uz visiem likum\u0101 noteiktajiem subjektiem. Saska\u0146\u0101 ar FM vadl\u012bnij\u0101m l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161ana pretendentam, kur\u0161 ir izsl\u0113dzams no iepirkuma proced\u016bras, finans\u0113juma sa\u0146\u0113m\u0113jam rezult\u0113sies ar finan\u0161u korekciju 25% apm\u0113r\u0101.
