Saska\u0146\u0101 ar ES fondu normat\u012bvo regul\u0113jumu un Finan\u0161u ministrijas izstr\u0101d\u0101taj\u0101m vadl\u012bnij\u0101m Nr.2.7. \u201cVadl\u012bnijas par finan\u0161u korekciju piem\u0113ro\u0161anu, zi\u0146o\u0161anu par Eiropas Savien\u012bbas fondu ievie\u0161an\u0101 konstat\u0113taj\u0101m neatbilst\u012bb\u0101m, neatbilsto\u0161i veikto izdevumu atg\u016b\u0161anu 2014.\u20132020.gada pl\u0101no\u0161anas period\u0101\u201d, tas rezult\u0113jas ar neatbilsto\u0161i veiktiem izdevumiem.&nbsp;CFLA v\u0113r\u0161 uzman\u012bbu, ka \u0161obr\u012bd v\u0113l notiek jaun\u0101 2021.- 2027. gada pl\u0101no\u0161anas perioda vadl\u012bniju finan\u0161u korekciju noteik\u0161anai izstr\u0101de un saska\u0146o\u0161ana.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Iepirkuma dokument\u0101cijas izstr\u0101des posms<\/strong><\/h2>\n\n\n\n<p>Praks\u0113 konstat\u0113jams, ka nereti jau s\u0101kotn\u0113ji netiek veikta atbilsto\u0161a projekta aktivit\u0101\u0161u pl\u0101no\u0161ana vai kav\u0113jas iepirkuma l\u012bguma nosl\u0113g\u0161ana, kas ietekm\u0113 projekta ievie\u0161anu. Proti, nav iesp\u0113jams projekta \u012bsteno\u0161anas termi\u0146\u0101 pabeigt taj\u0101 pl\u0101not\u0101s darb\u012bbas un past\u0101v iesp\u0113ja piln\u012bb\u0101 vai da\u013c\u0113ji zaud\u0113t projekta finans\u0113jumu. Saist\u012bb\u0101 ar to uzsverams, ka b\u016btisk\u0101kais iepirkuma posms ir t\u0101 sagatavo\u0161anas process \u2013 pl\u0101no\u0161ana, vajadz\u012bbu apzin\u0101\u0161ana, pras\u012bbu izvirz\u012b\u0161ana u.tml. \u0160\u012bs darb\u012bbas ir pamats iepirkuma norisei. Iepirkuma proced\u016brai turpinoties, labot pl\u0101no\u0161anas posm\u0101 pie\u013caut\u0101s k\u013c\u016bdas k\u013c\u016bs arvien sare\u017e\u0123\u012bt\u0101k.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Iepirkuma pl\u0101no\u0161ana<\/strong><\/h3>\n\n\n\n<p>Viens no b\u016btisk\u0101kajiem iepirkumu p\u0101rk\u0101pumiem ir neatbilsto\u0161as iepirkuma proced\u016bras piem\u0113ro\u0161ana vai publisko iepirkumu regul\u0113juma nepiem\u0113ro\u0161ana visp\u0101r. \u0160\u0101das k\u013c\u016bdas pie\u013cau\u0161ana rezult\u0113jas ar finan\u0161u korekciju 25% apm\u0113r\u0101. Min\u0113t\u0101s sekas rada neatbilsto\u0161a iepirkuma pl\u0101no\u0161ana, tostarp nepareizas paredzam\u0101s l\u012bgumcenas noteik\u0161ana un nepamatota iepirkuma priek\u0161meta sadal\u012b\u0161ana. L\u012bdz ar to finans\u0113juma sa\u0146\u0113m\u0113jiem j\u0101\u0146em v\u0113r\u0101, ka viens no b\u016btisk\u0101kajiem aspektiem, kas j\u0101iev\u0113ro, pl\u0101nojot iepirkumu un nosakot paredzamo l\u012bgumcenu, ir Publisko iepirkumu likuma (PIL) 11.panta nosac\u012bjumi.<\/p>\n\n\n\n<p>Lai visobjekt\u012bv\u0101k noteiktu iepirkuma paredzamo l\u012bgumcenu, CFLA iesaka pirms katras iepirkuma proced\u016bras veikt tirgus izp\u0113ti, \u0146emot v\u0113r\u0101 aktu\u0101l\u0101s cenas un tirgus situ\u0101ciju, kas b\u016btiski var ietekm\u0113t projekta norisi, k\u0101 ar\u012b atvieglot atbilsto\u0161as iepirkuma proced\u016bras izv\u0113li. Savuk\u0101rt, lai izvair\u012btos no nepamatotas iepirkuma priek\u0161meta sadal\u012b\u0161anas, CFLA aicina v\u0113rst uzman\u012bbu, ka pl\u0101no\u0161ana j\u0101\u012bsteno nevis atsevi\u0161\u0137u strukt\u016brvien\u012bbu, bet gan pas\u016bt\u012bt\u0101ja l\u012bmen\u012b un par pas\u016bt\u012bt\u0101ja vajadz\u012bb\u0101m kopum\u0101, neizdalot finans\u0113juma avotu. B\u016btiski iev\u0113rot, ka \u0161aubu gad\u012bjum\u0101 par izv\u0113l\u0113t\u0101s paredzam\u0101s l\u012bgumcenas noteik\u0161anas metodes pareiz\u012bbu piem\u0113rojama iepirkuma proced\u016bra, kas atbilst augst\u0101kajai paredzamajai l\u012bgumcenai. \u012apa\u0161a uzman\u012bba b\u016bvdarbu iepirkumos j\u0101piev\u0113r\u0161 b\u016bvju vienotajai tehniskajai un\/vai ekonomiskajai funkcijai, savuk\u0101rt pre\u010du, pakalpojumu iepirkumos \u2013 pretendentu lokam un tam, vai iepirkuma priek\u0161meti uzskat\u0101mi par l\u012bdz\u012bgiem. CFLA iesaka izmantot Iepirkumu uzraudz\u012bbas biroja (IUB) izstr\u0101d\u0101t\u0101s pa\u0161p\u0101rbaudes lapas un \u0146emt v\u0113r\u0101 IUB 2022.gada 14.oktobr\u012b public\u0113to skaidrojumu \u201cParedzam\u0101s l\u012bgumcenas noteik\u0161anas pamatprincipi, lai izv\u0113l\u0113tos atbilsto\u0161u iepirkuma proced\u016bru\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kvalitat\u012bva iepirkuma dokument\u0101cijas izstr\u0101de<\/strong><\/h3>\n\n\n\n<p>Iepirkuma veic\u0113ji nereti pie\u013cauj atk\u0101pes no normat\u012bv\u0101 regul\u0113juma, kas pirms\u0161\u0137ietami var\u0113tu nelikties b\u016btiskas, tom\u0113r faktiski var rad\u012bt apst\u0101k\u013cus neatbilst\u012bbas konstat\u0113\u0161anai. Sare\u017e\u0123\u012bjumus iepirkumu l\u012bgumu izpild\u0113 var rad\u012bt tehniskas neprecizit\u0101tes, iek\u013caujot iepirkuma dokument\u0101cij\u0101 savstarp\u0113ji nesaska\u0146otu inform\u0101ciju, piem\u0113ram, paredzot at\u0161\u0137ir\u012bgus saist\u012bbu izpildes nodro\u0161in\u0101juma nosac\u012bjumus (apm\u0113ru, termi\u0146us) iepirkuma nolikum\u0101 un iepirkuma l\u012bguma projekt\u0101 vai paredzot at\u0161\u0137ir\u012bgus l\u012bguma izpildes termi\u0146us (nolikum\u0101 pakalpojuma izpildes termi\u0146\u0161 paredz\u0113ts m\u0113ne\u0161os, savuk\u0101rt l\u012bguma projekt\u0101 nor\u0101d\u012bts konkr\u0113ts l\u012bguma izpildes datums).<\/p>\n\n\n\n<p>Ar\u012b iepirkuma priek\u0161metam neatbilsto\u0161u vai neprec\u012bzu CPV&nbsp;<em>(Common Procurement Vocabulary)&nbsp;<\/em>kodu nor\u0101d\u012b\u0161ana, ja \u0161\u0101ds CPV kods ir vien\u012bgais, kas min\u0113ts pazi\u0146ojum\u0101 par iepirkumu, var rad\u012bt konkurences ierobe\u017eo\u0161anas un inform\u0101cijas par izsludin\u0101to iepirkumu nepieejam\u012bbas risku, kas var izrais\u012bt situ\u0101ciju, ka potenci\u0101lie pretendenti nemaz neuzzina par izsludin\u0101to iepirkumu.<\/p>\n\n\n\n<p>CFLA praks\u0113 ir konstat\u0113ti gad\u012bjumi, kad iepirkumu veic\u0113js ir pie\u013c\u0101vis tehnisku neprecizit\u0101ti Elektronisko iepirkumu sist\u0113mas e\u2013konkursu apak\u0161sist\u0113mas pazi\u0146ojum\u0101 par iepirkumu, public\u0113jot k\u013c\u016bdainu paredzamo l\u012bgumcenu, kas ir bijusi pieejama tirgus dal\u012bbniekiem un maldin\u0101jusi ieinteres\u0113to pieg\u0101d\u0101t\u0101ju loku. CFLA atg\u0101dina, ka, public\u0113jot paredzamo l\u012bgumcenu pazi\u0146ojum\u0101 par l\u012bgumu vai pazi\u0146ojum\u0101 Elektronisko iepirkumu sist\u0113m\u0101, pas\u016bt\u012bt\u0101jam ir saisto\u0161s PIL 41.panta 11.da\u013cas 2.punkts. Proti, pas\u016bt\u012bt\u0101jam ir pien\u0101kums p\u0101rliecin\u0101ties, vai pretendenta pied\u0101v\u0101t\u0101 l\u012bgumcena nep\u0101rsniedz 150% no paredzam\u0101s l\u012bgumcenas. Ja t\u0101 p\u0101rsniedz norm\u0101 min\u0113to procentu\u0101lo apm\u0113ru, pretendents no dal\u012bbas iepirkum\u0101 ir j\u0101noraida.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Izvirz\u012bto kvalifik\u0101cijas pras\u012bbas un l\u012bguma nosac\u012bjumu sam\u0113r\u012bgums<\/strong><\/h3>\n\n\n\n<p>Viens no bie\u017e\u0101kajiem neatbilst\u012bbu c\u0113lo\u0146iem iepirkuma dokument\u0101cijas sagatavo\u0161an\u0101 ir iepirkuma priek\u0161metam nesam\u0113r\u012bgu vai pretendentu loku ierobe\u017eojo\u0161u pras\u012bbu izvirz\u012b\u0161ana. PIL 41.panta 2.da\u013ca paredz, ka&nbsp;<em>pas\u016bt\u012bt\u0101js var noteikt minim\u0101lo atbilst\u012bbas l\u012bmeni \u0161\u0101 likuma 45. un 46.pant\u0101 min\u0113taj\u0101m pras\u012bb\u0101m. Pras\u012bbu apjomu, k\u0101 ar\u012b piepras\u012bto minim\u0101lo sp\u0113ju l\u012bmeni konkr\u0113t\u0101 iepirkuma l\u012bguma izpildei nosaka sam\u0113r\u012bgi iepirkuma l\u012bguma priek\u0161metam. \u0160\u0101das minim\u0101l\u0101 atbilst\u012bbas l\u012bme\u0146a pras\u012bbas iek\u013cauj pazi\u0146ojum\u0101 par l\u012bgumu, k\u0101 ar\u012b iepirkuma proced\u016bras dokumentos.<\/em>&nbsp;Judikat\u016bras atzi\u0146as paredz pas\u016bt\u012bt\u0101ja ties\u012bbas noteikt pras\u012bbas, kas nodro\u0161ina kvalitat\u012bv\u0101ka izpild\u012bjuma sa\u0146em\u0161anu. T\u0101, piem\u0113ram, Sen\u0101ta 2015.gada 13.maija l\u0113mum\u0101 liet\u0101 SKA-299\/2015 tiesa nor\u0101da, ka \u201cpas\u016bt\u012bt\u0101jam, nosakot kvalifik\u0101cijas pras\u012bbas, ir r\u012bc\u012bbas br\u012bv\u012bba, kas v\u0113rsta uz to, lai pied\u0101v\u0101jums atbilstu pas\u016bt\u012bt\u0101ja iecer\u0113m un tas sa\u0146emtu iepirkuma priek\u0161metam atbilsto\u0161u un p\u0113c iesp\u0113jas kvalitat\u012bv\u0101ku izpild\u012bjumu.\u201d CFLA v\u0113r\u0161 uzman\u012bbu, ka Sen\u0101ta l\u0113mum\u0101 min\u0113tais viennoz\u012bm\u012bgi nenoz\u012bm\u0113, ka pas\u016bt\u012bt\u0101ja r\u012bc\u012bba pras\u012bbu noteik\u0161an\u0101 var b\u016bt patva\u013c\u012bga \u2013 izvirz\u012btaj\u0101m pras\u012bb\u0101m j\u0101b\u016bt v\u0113rst\u0101m tikai un vien\u012bgi uz iepirkuma priek\u0161metam atbilsto\u0161a un p\u0113c iesp\u0113jas kvalitat\u012bv\u0101ka izpild\u012bjuma sa\u0146em\u0161anu, nevis uz k\u0101du citu intere\u0161u nodro\u0161in\u0101\u0161anu.<\/p>\n\n\n\n<p>No iepriek\u0161 min\u0113t\u0101 var secin\u0101t, ka pas\u016bt\u012bt\u0101ja r\u012bc\u012bbas br\u012bv\u012bbai, izvirzot kvalifik\u0101cijas pras\u012bbas, ir noteiktas robe\u017eas, kas, papildus \u0146emot v\u0113r\u0101 IUB izstr\u0101d\u0101tos metodiskos materi\u0101lus, izriet no iepirkuma priek\u0161meta specifikas un apjoma. Neap\u0161aub\u0101mi \u0161\u0101d\u0101m pras\u012bb\u0101m j\u0101b\u016bt sam\u0113r\u012bg\u0101m un nepiecie\u0161am\u0101m l\u012bguma izpildei. Gad\u012bjumos, kad pras\u012bbas tiek izvirz\u012btas liel\u0101k\u0101 apm\u0113r\u0101 un ir \u201caugst\u0101kas\u201d par iepirkuma l\u012bguma izpild\u0113 paredz\u0113taj\u0101m pretendentu un speci\u0101listu kompetenc\u0113m, iepirkumu veic\u0113jiem j\u0101r\u0113\u0137in\u0101s, ka, nesp\u0113jot pamatot pras\u012bbu izvirz\u012b\u0161anas objekt\u012bvo nepiecie\u0161am\u012bbu, \u0161\u0101da r\u012bc\u012bba var rezult\u0113ties ar finan\u0161u sek\u0101m.<\/p>\n\n\n\n<p>K\u0101 piem\u0113ru iepirkuma priek\u0161metam nesam\u0113r\u012bgu pras\u012bbu izvirz\u012b\u0161an\u0101 var min\u0113t situ\u0101ciju, kad pas\u016bt\u012bt\u0101js ir iepirkuma nolikum\u0101 paredz\u0113jis vair\u0101ku speci\u0101listu piesaisti, kuriem visiem ir ma\u0123istra gr\u0101ds konkr\u0113t\u0101 jom\u0101. Lai ar\u012b pras\u012bba par izgl\u012bt\u012bbu (ma\u0123istra gr\u0101du) p\u0113c b\u016bt\u012bbas nav aizliegta, tom\u0113r \u0161\u0101d\u0101 gad\u012bjum\u0101 svar\u012bgi ir izv\u0113rt\u0113t objekt\u012bvo nepiecie\u0161am\u012bbu pras\u012bbu attiecin\u0101t uz visiem speci\u0101listiem, r\u016bp\u012bgi p\u0101rdom\u0101jot, vai speci\u0101listi ar bakalaura l\u012bme\u0146a izgl\u012bt\u012bbu nesp\u0113tu l\u012bguma izpildi veikt tikpat kvalitat\u012bvi. T\u0101pat par nesam\u0113r\u012bg\u0101m pras\u012bb\u0101m var uzskat\u012bt t\u0101das pras\u012bbas, kur\u0101s v\u0113lam\u0101 pieredze nor\u0101d\u012bta liel\u0101k\u0101 apjom\u0101, nek\u0101 to paredz tehnisk\u0101s specifik\u0101cijas nosac\u012bjumi, piem\u0113ram, faktiskaj\u0101 l\u012bguma izpild\u0113 paredz\u0113ts sniegt apm\u0101c\u012bbu pakalpojumus 50 cilv\u0113kiem, savuk\u0101rt pieredz\u0113 pras\u012bta apm\u0101c\u012bbu veik\u0161ana divas reizes liel\u0101kam dal\u012bbnieku skaitam.<\/p>\n\n\n\n<p>K\u0101 v\u0113l vienu no bie\u017e\u0101k konstat\u0113taj\u0101m neatbilst\u012bb\u0101m var min\u0113t ar\u012b pretendentu ierobe\u017eojo\u0161u pras\u012bbu iek\u013cau\u0161anu iepirkuma nolikum\u0101. Finan\u0161u korekciju risku var rad\u012bt situ\u0101cijas, kad iepirkuma nolikum\u0101 ir noteiktas atlases pras\u012bbas pretendentu vai speci\u0101listu pieredzei atbilsto\u0161i konkr\u0113tiem nacion\u0101lajiem standartiem, neparedzot nodro\u0161in\u0101t atbilst\u012bbu ekvivalentiem standartiem. T\u0101pat risku potenci\u0101li var rad\u012bt ar\u012b gad\u012bjumi, kad pieredz\u0113 pras\u012bta saska\u0146o\u0161ana ar konkr\u0113t\u0101m valsts iest\u0101d\u0113m, vai ar\u012b iepirkuma veic\u0113ja izvirz\u012bta pras\u012bba uz pied\u0101v\u0101juma iesnieg\u0161anas br\u012bdi pretendentam vai speci\u0101listam b\u016bt re\u0123istr\u0113tam konkr\u0113t\u0101 nacion\u0101l\u0101 re\u0123istr\u0101 (piem\u0113ram, \u0100rstniec\u012bbas personu un \u0101rstniec\u012bbas atbalsta personu re\u0123istr\u0101, Soci\u0101lo pakalpojumu sniedz\u0113ju re\u0123istr\u0101 u.tml.).<\/p>\n\n\n\n<p>CFLA atg\u0101dina, ka ar\u012b pras\u012bbas izvirz\u012b\u0161ana pretendenta vai speci\u0101listu pieredzei pied\u0101v\u0101t\u0101s (nevis paredzam\u0101s) l\u012bgumcenas apm\u0113r\u0101 nav at\u013cauta un var liecin\u0101t par nevienl\u012bdz\u012bgu attieksmi pras\u012bbu noteik\u0161an\u0101, jo \u0161\u0101da pras\u012bba rada at\u0161\u0137ir\u012bgas pied\u0101v\u0101jumu sagatavo\u0161anas iesp\u0113jas. Proti, pretendenti var piel\u0101got pieredzes objektus pied\u0101v\u0101tajai l\u012bgumcenai vai, tie\u0161i pret\u0113ji, pied\u0101v\u0101t t\u0101du l\u012bgumcenu, kas tiek noteikta, \u0146emot v\u0113r\u0101 pieredzes objektos realiz\u0113to b\u016bvdarbu vai pakalpojumu cenu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Saimnieciski visizdev\u012bg\u0101k\u0101 pied\u0101v\u0101juma izv\u0113rt\u0113\u0161anas krit\u0113riji<\/strong><\/h3>\n\n\n\n<p>Ar groz\u012bjumiem PIL, kas st\u0101j\u0101s sp\u0113k\u0101 2023.gada 1.janv\u0101r\u012b, tika noteiktas t\u0101s jomas, kur\u0101s pas\u016bt\u012bt\u0101jiem papildus cenai j\u0101v\u0113rt\u0113 ar\u012b ar l\u012bguma izpildes kvalit\u0101ti vai ar energoefektivit\u0101ti saist\u012bti pied\u0101v\u0101juma izv\u0113rt\u0113\u0161anas krit\u0113riji. PIL 51.panta 3.\u00b9da\u013c\u0101 noteikt\u0101s iepirkuma priek\u0161meta grupas, par kur\u0101m l\u012bguma sl\u0113g\u0161anas proces\u0101 pas\u016bt\u012bt\u0101js pied\u0101v\u0101jumu sal\u012bdzin\u0101\u0161anai un izv\u0113rt\u0113\u0161anai (tostarp PIL 9.panta k\u0101rt\u012bb\u0101 r\u012bkot\u0101 iepirkum\u0101) nav ties\u012bgs izmantot tikai cenu, ir:<\/p>\n\n\n\n<ul>\n<li>projekt\u0113\u0161ana;<\/li>\n\n\n\n<li>apvienot\u0101 projekt\u0113\u0161ana un b\u016bvdarbi;<\/li>\n\n\n\n<li>elektroener\u0123iju pat\u0113r\u0113jo\u0161as preces vai produkti (publisk\u0101 pieg\u0101des l\u012bgum\u0101);<\/li>\n\n\n\n<li>autotransporta l\u012bdzek\u013ci.<\/li>\n<\/ul>\n\n\n\n<p>CFLA, p\u0101rbaudot iepirkuma dokument\u0101ciju, nereti konstat\u0113, ka finans\u0113juma sa\u0146\u0113m\u0113js vai nu neuzman\u012bbas, vai k\u013c\u016bdas rezult\u0101t\u0101, izstr\u0101d\u0101jot iepirkuma dokument\u0101ciju, nav \u0146\u0113mis v\u0113r\u0101 ar p\u0113d\u0113jiem PIL groz\u012bjumiem veikt\u0101s izmai\u0146as, piem\u0113ram, attiec\u012bb\u0101 uz elektroener\u0123iju pat\u0113r\u0113jo\u0161u pre\u010du iepirkumiem, un k\u0101 vien\u012bgo izv\u0113les krit\u0113riju nor\u0101d\u012bjis cenu. CFLA aicina \u0146emt v\u0113r\u0101 ar\u012b IUB m\u0101jaslap\u0101 nor\u0101d\u012bto inform\u0101ciju un, sagatavojot iepirkuma dokument\u0101ciju, piev\u0113rst pied\u0101v\u0101juma izv\u0113les krit\u0113rijiem pastiprin\u0101tu uzman\u012bbu un izv\u0113rt\u0113t, vai iepirkuma priek\u0161mets neatbilst gad\u012bjumiem, kad k\u0101 vien\u012bgais saimnieciski izdev\u012bg\u0101kais krit\u0113rijs nevar b\u016bt cena.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Secin\u0101jumi<\/strong><\/h2>\n\n\n\n<p>Apkopojot iepriek\u0161 min\u0113to, j\u0101secina, ka pas\u016bt\u012bt\u0101jam jau iepirkuma pl\u0101no\u0161anas posm\u0101, sagatavojot iepirkuma dokument\u0101ciju, ir j\u0101piev\u0113r\u0161 \u012bpa\u0161a uzman\u012bba gan normat\u012bvo aktu pras\u012bb\u0101m un normat\u012bv\u0101 regul\u0113juma groz\u012bjumiem, gan ar\u012b IUB izstr\u0101d\u0101tajiem metodiskajiem materi\u0101liem, jo no t\u0101 ir atkar\u012bga veiksm\u012bga t\u0101l\u0101k\u0101 iepirkuma proced\u016bras norise.
