Iev\u0113rojot min\u0113to, prokurat\u016bra jau 2023. gada 10. maij\u0101 ar v\u0113stuli v\u0113rs\u0101s pie Ministru prezidenta Artura Kri\u0161j\u0101\u0146a Kari\u0146a ar priek\u0161likumu papildin\u0101t Krimin\u0101llikumu ar jaunu 211.1\u202fpantu, kur\u0101 b\u016btu noteikta krimin\u0101latbild\u012bba par aizliegtu vieno\u0161anos publisk\u0101 iepirkum\u0101.&nbsp;<\/p>\n\n\n\n<p>Krimin\u0101latbild\u012bbu paredz\u0113ts noteikt par tr\u012bs viskait\u012bg\u0101kajiem aizliegt\u0101s vieno\u0161an\u0101s veidiem publisk\u0101 iepirkuma proced\u016br\u0101, kas apdraud ne tikai god\u012bgu konkurenci, bet ar\u012b valsts un pa\u0161vald\u012bbu bud\u017eetus, t.\u202fi., nodok\u013cu maks\u0101t\u0101ju naudu, kas tiek nelietder\u012bgi izlietota iepriek\u0161 sarun\u0101tos iepirkumos, proti: (1)\u202faizliegta vieno\u0161an\u0101s par b\u016btiskiem publisk\u0101 iepirkuma pieteikuma vai pied\u0101v\u0101juma nosac\u012bjumiem; (2)\u202faizliegta vieno\u0161an\u0101s par dal\u012bbas noteikumiem; (3)\u202fvai aizliegta vieno\u0161an\u0101s par pieteikuma vai pied\u0101v\u0101juma neiesnieg\u0161anu publiskaj\u0101 iepirkum\u0101.\u00a0\u00a0<\/p>\n\n\n\n<p>Aizliegta vieno\u0161an\u0101s saska\u0146\u0101 ar Konkurences likumu ir konkurenci ierobe\u017eojo\u0161a darb\u012bba. T\u0101s&nbsp;m\u0113r\u0137is vai sekas ir konkurences kav\u0113\u0161ana, ierobe\u017eo\u0161ana vai deform\u0113\u0161ana Latvijas teritorij\u0101, kas, savuk\u0101rt, nereti noved pie m\u0101ksl\u012bgi sad\u0101rdzin\u0101tiem publiskiem iepirkumiem, kas publisku personu gad\u012bjum\u0101 noz\u012bm\u0113 valsts bud\u017eeta l\u012bdzek\u013cu prettiesisku, neefekt\u012bvu izlietojumu.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>2024.\u202fgada 3.\u202fmaija Konkurences padomes s\u0113d\u0113 saist\u012bb\u0101 ar min\u0113tajiem priek\u0161likumiem tika nolemts \u2013 konceptu\u0101li atbalst\u012bt nepiecie\u0161am\u012bbu noteikt krimin\u0101latbild\u012bbu smag\u0101ko konkurences noteikumu p\u0101rk\u0101pumu gad\u012bjum\u0101, konstat\u0113jot aizliegtas vieno\u0161an\u0101s publiskajos iepirkumos.&nbsp;<\/p>\n\n\n\n<p>Eso\u0161ais Krimin\u0101llikuma 211.\u202fpants \u201cNegod\u012bga konkurence, maldino\u0161a rekl\u0101ma un negod\u012bga komercprakse\u201d aptver tikai negod\u012bgu konkurenci, kas ir paredz\u0113ta Konkurences likuma 18.\u202fpant\u0101 \u201cNegod\u012bgas konkurences aizliegums\u201d, bet neaptver aizliegtu vieno\u0161anos, kas paredz\u0113ta Konkurences likuma 11.\u202fpant\u0101 \u201cAizliegtas vieno\u0161an\u0101s un par sp\u0113k\u0101 eso\u0161\u0101m atz\u012btas vieno\u0161an\u0101s\u201d. T\u0101d\u0113j\u0101di pa\u0161reiz fizisk\u0101m person\u0101m nav paredz\u0113ta krimin\u0101latbild\u012bba par aizliegtu vieno\u0161anos, tikai juridisk\u0101s personas tiek sauktas pie administrat\u012bv\u0101s atbild\u012bbas Konkurences likum\u0101 paredz\u0113taj\u0101 k\u0101rt\u012bb\u0101.<\/p>\n\n\n\n<p>Vair\u0101k\u0101s Eiropas Savien\u012bbas valst\u012bs \u2013 V\u0101cij\u0101, Ung\u0101rij\u0101, Igaunij\u0101, Austrij\u0101, Francij\u0101, Norv\u0113\u0123ij\u0101 un \u012arij\u0101 \u2013 fiziskai personai par aizliegtu vieno\u0161anos ir paredz\u0113ta krimin\u0101latbild\u012bba \u2013 cietumsods (visbie\u017e\u0101k l\u012bdz 5\u202fgadiem) un naudas sods \u2013, savuk\u0101rt Polij\u0101, Sp\u0101nij\u0101 un Slov\u0113nij\u0101 ir paredz\u0113ta gan krimin\u0101latbild\u012bba (cietumsods), gan administrat\u012bv\u0101 atbild\u012bba (naudas sods).&nbsp;<\/p>\n\n\n\n<p>Ekonomisk\u0101s sadarb\u012bbas un att\u012bst\u012bbas organiz\u0101cija (OECD) saist\u012bb\u0101 ar efekt\u012bvu r\u012bc\u012bbu pret karte\u013ciem k\u0101 visnopietn\u0101kajiem un smag\u0101kajiem konkurences ties\u012bbu p\u0101rk\u0101pumiem uzsver nepiecie\u0161am\u012bbu uzlabot apkaro\u0161anas politiku, tostarp sankciju ievie\u0161anu pret tirgus dal\u012bbnieku amatperson\u0101m. Aizliegta vieno\u0161an\u0101s iepirkuma pretendentiem pal\u012bdz izvair\u012bties no savstarp\u0113jas konkurences un t\u0101d\u0113j\u0101di nepamatoti paaugstin\u0101t cenas, pazemin\u0101t pied\u0101v\u0101juma kvalit\u0101tes krit\u0113rijus vai samazin\u0101t iepirkuma r\u012bkot\u0101ja izv\u0113li, vienojoties par dal\u012bbu konkurs\u0101. T\u0101d\u0113\u013c pirc\u0113jiem var n\u0101kties maks\u0101t augst\u0101ku cenu par slikt\u0101ku preci vai pakalpojumu.&nbsp;<\/p>\n\n\n\n<p>\u201cEnergob\u016bvnieku karte\u013ca\u201d lieta, VAS \u201cLatvijas dzelzce\u013c\u0161\u201d cenu aptaujas kartelis, \u201cB\u016bvnieku karte\u013ca\u201d lieta, ka ar\u012b \u201cCe\u013cu b\u016bves kartelis\u201d \u2013 tie ir tikai da\u017ei no piem\u0113riem, kad Korupcijas nov\u0113r\u0161anas un apkaro\u0161anas birojs ir sniedzis Konkurences padomes s\u0101kotn\u0113jo inform\u0101ciju par iesp\u0113jam\u0101m aizliegtas vieno\u0161an\u0101s p\u0101rk\u0101pumu paz\u012bm\u0113m. Publiskajos iepirkumos aizliegtas vieno\u0161an\u0101s var izpausties da\u017e\u0101di \u2013 konkurentiem vienojoties par dal\u012bbu iepirkumos vai par darb\u012bbas noteikumiem, iesniedzot \u201caizsega\u201d pied\u0101v\u0101jumus vai ar\u012b neiesniedzot pied\u0101v\u0101jumus noteiktos iepirkumos, k\u0101 ar\u012b vienojoties par tirgus sadali, objektiem vai par pas\u016bt\u012bt\u0101jiem, tos savstarp\u0113ji sadalot.\u00a0\u00a0<\/p>\n\n\n\n<p>\u201cTies\u012bbaizsardz\u012bbas iest\u0101d\u0113m ir j\u0101b\u016bt efekt\u012bviem l\u012bdzek\u013ciem, lai pretdarbotos negod\u012bgai r\u012bc\u012bbai. Publiski iepirkumi ir ar augstu korupcijas risku.
