Kas ir publiskais iepirkums un kas regul\u0113 iepirkuma veik\u0161anu?<\/p>\n<p>Iepirkums un t\u0101 m\u0113r\u0137is<\/p>\n<p>Iepirkums ir process<\/strong>, kuru ierosina pirc\u0113js, defin\u0113jot savu vajadz\u012bbu apjomu p\u0113c noteiktas kvalit\u0101tes prec\u0113m, pakalpojumiem vai b\u016bvdarbiem, vienlaikus izvirzot pieg\u0101d\u0101t\u0101jiem noteikumus, lai konkurences apst\u0101k\u013cos noskaidrotu lab\u0101ko pieg\u0101d\u0101t\u0101ju, kam tiek pie\u0161\u0137irtas ties\u012bbas sl\u0113gt publisk\u0101 iepirkuma l\u012bgumu.<br \/>\nPublisk\u0101 iepirkum\u0101 pirc\u0113js ir valsts vai pa\u0161vald\u012bbas iest\u0101de, sabiedrisk\u0101 pakalpojuma sniedz\u0113js vai komersants, kas konkr\u0113tu vajadz\u012bbu apmierin\u0101\u0161anai veic iepirkumu, par kuru nor\u0113\u0137in\u0101s ar pieg\u0101d\u0101t\u0101ju par valsts pie\u0161\u0137irtajiem finan\u0161u l\u012bdzek\u013ciem. Veicot PIL 2.pielikuma B da\u013cas pakalpojumu iepirkumus, j\u0101\u0146em v\u0113r\u0101 tikai PIL 8.panta sept\u012bt\u0101s da\u013cas noteikumi, ja min\u0113t\u0101 iepirkuma paredzam\u0101 l\u012bgumcena ir vien\u0101da ar 20 000 latu vai liel\u0101ka.<\/p>\n<p><strong>Sabiedrisko pakalpojumu sniedz\u0113jiem SPSIL<\/strong><\/p>\n<p>Sabiedrisko pakalpojumu sniedz\u0113ju iepirkumu likumu (SPSIL) piem\u0113ro publisk\u0101 instit\u016bcija vai publisk\u0101s instit\u016bcijas uz\u0146\u0113mums, kas darbojas k\u0101d\u0101 no \u0161\u012bm jom\u0101m:<\/p>\n<p>a) g\u0101zes vai SPSIL subjekti ir ne tikai lieli monopoluz\u0146\u0113mumi, R\u012bg\u0101 k\u0101 PSIA <em>R\u012bgas \u016bdens<\/em>, a\/s R\u012bgas siltums vai PSIA R\u012bgas satiksme, bet ar\u012b uz\u0146\u0113mumi, kas darbojas SPSIL II noda\u013c\u0101 min\u0113taj\u0101s jom\u0101s konkr\u0113t\u0101 re\u0123ion\u0101, novad\u0101, pils\u0113t\u0101 vai pagasta p\u0101rvald\u0113. \u0160\u0101di uz\u0146\u0113mumi ir PSIA <em>Ug\u0101les nami<\/em>, SIA <em>VTU VALMIERA<\/em>, PSIA <em>Valgums-S<\/em>, PSIA <em>Ventspils siltums<\/em>, PAS <em>&#8220;Daugavpils siltumt\u012bkli&#8221;<\/em> u.c.<\/p>\n<p>Da\u017e\u0101s pa\u0161vald\u012bb\u0101s ir komersanti, kam ir du\u0101la daba, proti, tie vienlaikus darbojas jom\u0101s, kas min\u0113tas SPSIL II noda\u013c\u0101 (piem\u0113ram, \u016bdens vai siltumapg\u0101des jom\u0101), t\u0101d\u0113j\u0101di k\u013c\u016bstot par SPSIL subjektu, un vienlaikus pilda ar\u012b pa\u0161vald\u012bbu dele\u0123\u0113tas funkcijas (piem\u0113ram, veic pa\u0161vald\u012bbas \u012bpa\u0161um\u0101 eso\u0161\u0101 nekustam\u0101 \u012bpa\u0161uma apsaimnieko\u0161anu), k\u013c\u016bstot par PIL subjektu. <span class=\"post_underline\">T\u0101dos gad\u012bjumos, kad objekt\u012bvi nav iesp\u0113jams noteikt, uz kuru jomu attiecas pl\u0101not\u0101 iepirkuma l\u012bguma b\u016btisk\u0101k\u0101 da\u013ca, iepirkuma proced\u016bra veicama saska\u0146\u0101 ar Publisko iepirkumu likumu, k\u0101 to nosaka SPSIL 8.panta tre\u0161\u0101 da\u013ca.<\/span><\/p>\n<p>SPSIL piem\u0113ro tikai gad\u012bjumos, kad pl\u0101not\u0101 pre\u010du pieg\u0101des un pakalpojumu l\u012bguma paredzam\u0101 l\u012bgumcena ir vien\u0101da ar 283240 latu vai liel\u0101ka un b\u016bvdarbu \u2013 vien\u0101da ar 3540500 latu vai liel\u0101ka.<\/p>\n<p><strong>Komersantiem MK noteikumi Nr.65<\/strong><\/p>\n<p>Iepriek\u0161 tika min\u0113ti likumi, kuri nosaka iepirkuma procesa norisi valsts vai pa\u0161vald\u012bbu iest\u0101d\u0113m un sabiedrisko pakalpojumu sniedz\u0113jiem, ta\u010du ir ar\u012b normat\u012bvais akts, kas nosaka iepirkuma norisi komersantiem, proti, MK noteikumi Nr.65 \u201eNoteikumi par iepirkuma proced\u016bru un t\u0101s piem\u0113ro\u0161anas k\u0101rt\u012bbu pas\u016bt\u012bt\u0101ja finans\u0113tiem projektiem\u201d. \u0160ie noteikumi attiecas uz komersantiem (neatkar\u012bgi no to uz\u0146\u0113m\u0113jdarb\u012bbas formas), kas v\u0113las piesaist\u012bt Eiropas Savien\u012bbas strukt\u016brfondu l\u012bdzek\u013cus vai sa\u0146em finans\u0113jumu no valsts vai pa\u0161vald\u012bbas, tas ir:<\/p>\n<p>a) persona, kura saska\u0146\u0101 ar atbild\u012bg\u0101s instit\u016bcijas (Latvijas Invest\u012bciju un att\u012bst\u012bbas a\u0123ent\u016bra, Lauku atbalsta dienests u.c..) l\u0113mumu sa\u0146em Eiropas Savien\u012bbas finans\u0113jumu (piem\u0113ram, zemnieku saimniec\u012bbas, individu\u0101lie komersanti, sabiedr\u012bbas ar ierobe\u017eotu atbild\u012bbu, akciju sabiedr\u012bbas, utt.);<br \/>\nb) sa\u0146em valsts vai pa\u0161vald\u012bbu bud\u017eeta finans\u0113jumu projekta
