S\u0101kotn\u0113jo inform\u0101ciju par potenci\u0101lu karte\u013ca vieno\u0161anos iest\u0101de ieguva no sadarb\u012bbas partnera Korupcijas nov\u0113r\u0161anas un apkaro\u0161anas biroja (KNAB). Ieg\u016bt\u0101 inform\u0101cija liecin\u0101ja par lietas dal\u012bbnieku tik\u0161an\u0101s reiz\u0113m, kuru ietvaros notika vieno\u0161an\u0101s par iepirkumu sadali, kas attiecas uz VSIA \u201cLatvijas Valsts ce\u013ci\u201d (LVC) iepirkumiem par ce\u013cu b\u016bvdarbiem Latvijas teritorij\u0101.<\/p>\n\n\n\n<p>Vari\u0101cijas skr\u012bnings ir viens no testiem, kas pla\u0161i pielietots starptautiskaj\u0101 praks\u0113, lai analiz\u0113tu pretendentu iesniegtos cenu pied\u0101v\u0101jumus iepirkumos. Zema cenas vari\u0101cija ir viena no paz\u012bm\u0113m, kas var liecin\u0101t par aizliegtas vieno\u0161an\u0101s esam\u012bbu.<\/p>\n\n\n\n<p>T\u0101d\u0113j\u0101di, KP secin\u0101ja, ka zem\u0101 cenu pied\u0101v\u0101jumu vari\u0101cija analiz\u0113taj\u0101s LVC iepirkuma proced\u016br\u0101s laika period\u0101 no 2016. l\u012bdz 2018.\u00a0gadam ir paz\u012bme, kas kopsakar\u0101 ar l\u0113mum\u0101 ieg\u016btajiem faktiem un to nov\u0113rt\u0113jumu apstiprin\u0101ja KP konstat\u0113to, ka ir past\u0101v\u0113jusi aizliegta vieno\u0161an\u0101s starp lietas dal\u012bbniekiem.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Pieg\u0101d\u0101t\u0101ju apvien\u012bba k\u0101 aizsegs karte\u013ca realiz\u0101cijai<\/strong><\/h3>\n\n\n\n<p>B\u016btisks aspekts, kas pirmo reizi tika detaliz\u0113ti analiz\u0113ts 2023. gada karte\u013cu izp\u0113tes liet\u0101s ir <strong>pretendentu kop\u012bga pied\u0101v\u0101jumu iesnieg\u0161ana jeb dal\u012bba apvien\u012bb\u0101.<\/strong><\/p>\n\n\n\n<p>V\u0113rt\u0113jot, vai kop\u012bga pied\u0101v\u0101juma iesnieg\u0161ana b\u016btu uzskat\u0101ma par at\u013cautu un kop\u012bga pied\u0101v\u0101juma iesnieg\u0161ana iepirkumos nep\u0101rk\u0101pj Konkurences likum\u0101 (KL) noteikto vieno\u0161an\u0101s aizliegumu, ir j\u0101vad\u0101s no apsv\u0113rumiem, vai:<\/p>\n\n\n\n<p>1) <strong>apvien\u012bb\u0101 iesaist\u012btie tirgus dal\u012bbnieki nav sp\u0113j\u012bgi izpild\u012bt iepirkumu pras\u012bbas individu\u0101li<\/strong>, tostarp papla\u0161in\u0101t savu kapacit\u0101ti l\u012bdz nepiecie\u0161amajam l\u012bmenim. \u0160\u0101d\u0101 gad\u012bjum\u0101 tirgus dal\u012bbnieki nav uzskat\u0101mi par faktiskiem vai potenci\u0101liem konkurentiem un to vieno\u0161an\u0101s nav uzskat\u0101ma par konkurences ierobe\u017eojumu.<\/p>\n\n\n\n<p>Ja uz\u0146\u0113mums nesp\u0113j faktiski kvalific\u0113ties iepirkumiem (vai to da\u013c\u0101m) individu\u0101li, tam ir j\u0101piesaista, piem\u0113ram, apak\u0161uz\u0146\u0113m\u0113ji, kuri ar\u012b nav sp\u0113j\u012bgi kvalific\u0113ties iepirkumam individu\u0101li. Turpret\u012b apvien\u012bbas veido\u0161ana ar tirgus dal\u012bbnieku, kur\u0161 ir sp\u0113j\u012bgs kvalific\u0113ties iepirkumam individu\u0101li, nav at\u013cauta. J\u0101min, ka vieno\u0161an\u0101s dal\u012bbniekiem j\u0101sp\u0113j pier\u0101d\u012bt, ka sadarb\u012bba ir tie\u0161i tik pla\u0161a, cik nepiecie\u0161ams konkr\u0113t\u0101s efektivit\u0101tes realiz\u0113\u0161anai, un ka tie neb\u016btu sp\u0113ju\u0161i pan\u0101kt \u0161os uzlabojumus cit\u0101 veid\u0101. T\u0101pat tiem j\u0101sp\u0113j pier\u0101d\u012bt, ka vieno\u0161an\u0101s rezult\u0101t\u0101 netiks likvid\u0113ta konkurence iev\u0113rojam\u0101 tirgus da\u013c\u0101.<\/p>\n\n\n\n<p>J\u0101nor\u0101da, ka apvien\u012bbas dal\u012bbnieki savstarp\u0113ji dr\u012bkst apmain\u012bties tikai ar inform\u0101ciju, kas ir absol\u016bti nepiecie\u0161ama pied\u0101v\u0101juma iesnieg\u0161anai un l\u012bguma izpildei, maksim\u0101li ierobe\u017eojot \u0161\u012bs inform\u0101cijas sa\u0146\u0113m\u0113ju loku, t\u0101d\u0113j\u0101di izvairoties no komerci\u0101li sensit\u012bvas inform\u0101cijas apmai\u0146as. Kop\u012bga pied\u0101v\u0101juma iesnieg\u0161ana iepirkumos nep\u0101rk\u0101pj KP noteikto vieno\u0161an\u0101s aizliegumu, ja t\u0101 neietilpst karte\u013ca vieno\u0161an\u0101s un ir iev\u0113roti EK Pamatnost\u0101d\u0146u vadl\u012bnij\u0101s noteiktie krit\u0113riji.<\/p>\n\n\n\n<p>2024. gada pirmaj\u0101 pusgad\u0101 KP public\u0113s vadl\u012bnijas, kuras pal\u012bdz\u0113s tirgus dal\u012bbniekiem viegl\u0101k saprast, ko dr\u012bkst un nedr\u012bkst pie\u013caut, kad runa ir par kop\u012bgu dal\u012bbu iepirkumos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>KP jaun\u0101 funkcija PIL groz\u012bjumu ietvaros<\/strong><\/h3>\n\n\n\n<p>No 2023. gada 1. janv\u0101ra, kad st\u0101j\u0101s sp\u0113k\u0101 Publisko iepirkuma likuma (PIL) groz\u012bjumi, pas\u016bt\u012bt\u0101ji, ja saskata <strong>\u201cpietieko\u0161i p\u0101rliecino\u0161as nor\u0101des<\/strong>\u201d, ka iepirkuma pretendenti iesp\u0113jams ir saska\u0146oju\u0161i savas darb\u012bbas, var izsl\u0113gt pretendentus no turpm\u0101kas dal\u012bbas iepirkum\u0101. Tiesa, regul\u0113jums attiecas uz iepirkumiem, kas izsludin\u0101ti s\u0101kot no 2023. gada. Un, ja p\u0101rliecino\u0161as nor\u0101des tiek atkl\u0101tas, tad pas\u016bt\u012bt\u0101jam ir iesp\u0113ja v\u0113rsties pie KP, lai 10 darba dienu laik\u0101 sa\u0146emtu iest\u0101des atzinumu.<\/p>\n\n\n\n<p>B\u016btiski nor\u0101d\u012bt, ka ar PIL groz\u012bjumiem tiek risin\u0101tas situ\u0101cijas, kad darb\u012bbas saska\u0146o saist\u012btie uz\u0146\u0113mumi. Pas\u016bt\u012bt\u0101jam nav b\u016btiski konstat\u0113t uz\u0146\u0113mumu savstarp\u0113jo saist\u012bbu un neatkar\u012bbu &#8211; lai izsl\u0113gtu no turpm\u0101kas dal\u012bbas iepirkum\u0101 tam atliek tikai konstat\u0113t p\u0101rliecino\u0161as karte\u013ca nor\u0101des starp pied\u0101v\u0101jumu iesniedz\u0113jiem.<\/p>\n\n\n\n<p>2023. gad\u0101 iest\u0101de sniedza 22 atzinumus publisko iepirkumu pas\u016bt\u012bt\u0101jiem. Tostarp, r\u012bkojoties proakt\u012bvi un rea\u0123\u0113jot uz sniegtajiem l\u016bgumiem, iest\u0101de veica nor\u0101d\u012btajiem tirgus dal\u012bbniekiem prevenciju, kas ir alternat\u012bva form\u0101lai lietas izp\u0113tei. Prevenciju ietvaros tika p\u0101rrun\u0101ta gan pretendentu negodpr\u0101t\u012bg\u0101 r\u012bc\u012bba jeb paz\u012bmes, kas liecin\u0101ja par saska\u0146ot\u0101m darb\u012bb\u0101m, gan sniegts skaidrojums no KL viedok\u013ca, ko tirgus dal\u012bbnieki dr\u012bkst un nedr\u012bkst dar\u012bt, k\u0101 ar\u012b k\u0101das sekas var iest\u0101ties, t\u0101d\u0113j\u0101di nov\u0113r\u0161ot l\u012bdz\u012bgu gad\u012bjumu atk\u0101rto\u0161anos n\u0101kotn\u0113. 15 prevenciju proced\u016br\u0101s kopskait\u0101 tika br\u012bdin\u0101tas 40 juridiskas personas.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"320\" height=\"480\" src=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2024\/02\/IevaSmite3.jpg\" alt=\"\" class=\"wp-image-22891\"\/><\/figure>\n\n\n\n<p>Konkurences padomes Aizliegtu vieno\u0161anos departamenta direktore Ieva \u0160mite: <em>\u201cRedzam, ka jaunajiem PIL groz\u012bjumiem ir pozit\u012bvs efekts, jo pieaug tirgus dal\u012bbnieku interese atjaunot uzticam\u012bbu. T\u0101d\u0113j\u0101di uz\u0146\u0113mumi izv\u0113las jau lietas ietvaros sl\u0113gt izl\u012bgumu ar iest\u0101di, k\u0101 ar\u012b veic prevent\u012bvas darb\u012bbas uz\u0146\u0113mum\u0101 \u2013 izstr\u0101d\u0101 vadl\u012bnijas, un \u012bsteno darbinieku apm\u0101c\u012bbas. Atskatoties uz 2023. gadu, varam secin\u0101t, ka pas\u016bt\u012bt\u0101ju izpratnes un zin\u0101\u0161anu l\u012bmenis par PIL ir krasi at\u0161\u0137ir\u012bgs. Bie\u017ei vien nov\u0113rojam, ka pas\u016bt\u012bt\u0101ji nev\u0113las iesaist\u012bties paz\u012bmju izv\u0113rt\u0113\u0161an\u0101, kas rezult\u0113jas, ka saskaramies ar l\u016bgumiem, kuros ir pavisam lo\u0123iski izskaidrojamas paz\u012bmes par saska\u0146ot\u0101m saist\u012bto pretendentu darb\u012bb\u0101m. PIL groz\u012bjumi nenoliedzami ir sniegu\u0161i mums iesp\u0113ju v\u0113l vair\u0101k tikties ar publisko iepirkumu speci\u0101listiem vaig\u0101, izgl\u012btojot par PIL, konkurences ties\u012bbu regul\u0113jumu un potenci\u0101laj\u0101m sek\u0101m.
