T\u0101pat citas kompetent\u0101s ties\u012bbu aizsardz\u012bbas iest\u0101des, piem\u0113ram, Korupcijas nov\u0113r\u0161anas un apkaro\u0161anas birojs (KNAB), atkl\u0101jot korupcijas izpausmes publiskajos iepirkumos, nereti saskata aizliegtas vieno\u0161an\u0101s p\u0101rk\u0101puma paz\u012bmes, par kur\u0101m attiec\u012bgi zi\u0146o Konkurences padomei (KP). L\u012bdz \u0161im praks\u0113 ir biju\u0161i vair\u0101ki gad\u012bjumi, kad KNAB ir sniedzis inform\u0101ciju KP par iesp\u0113jam\u0101m aizliegtas vieno\u0161an\u0101s nor\u0101d\u0113m.<\/p>\n\n\n\n<p><strong>\u201c<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/kp-soda-26-energobuvniecibas-uznemumus-par-dalibu-karteli-0\" target=\"_blank\">Energob\u016bvnieku karte\u013ca<\/a>\u201d<\/strong> lieta,<strong>&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/kp-soda-vas-latvijas-dzelzcels-kapitalsabiedribu-sia-ldz-cargo-par-dominejosa-stavokla-launpratigu-izmantosanu\" target=\"_blank\">VAS&nbsp;\u201cLatvijas dzelzce\u013c\u0161\u201d cenu aptaujas<\/a>&nbsp;<\/strong>kartelis,&nbsp;<strong>\u201c<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/konkurences-padome-soda-10-buvniecibas-uznemumus-par-dalibu-karteli\" target=\"_blank\">B\u016bvnieku karte\u013ca<\/a>\u201d<\/strong> lieta, ka ar\u012b <strong>\u201c<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/konkurences-padome-atklaj-celu-buves-karteli\" target=\"_blank\">Ce\u013cu b\u016bves kartelis<\/a>\u201d<\/strong> &#8211; tie ir tikai da\u017ei no piem\u0113riem, kad KNAB ir sniedzis KP s\u0101kotn\u0113jo inform\u0101ciju par iesp\u0113jam\u0101m aizliegtas vieno\u0161an\u0101s p\u0101rk\u0101pumu paz\u012bm\u0113m. Publiskajos iepirkumos aizliegtas vieno\u0161an\u0101s var izpausties da\u017e\u0101di &#8211; konkurentiem vienojoties par dal\u012bbu iepirkumos vai par darb\u012bbas noteikumiem, iesniedzot&nbsp;<em>\u201caizsega\u201d<\/em>&nbsp;pied\u0101v\u0101jumus vai ar\u012b neiesniedzot pied\u0101v\u0101jumus noteiktos iepirkumos, k\u0101 ar\u012b vienojoties par tirgus sadali, objektiem vai par pas\u016bt\u012bt\u0101jiem, tos savstarp\u0113ji sadalot.<\/p>\n\n\n\n<p>Vienlaikus KP, v\u0113rt\u0113jot aizliegtu vieno\u0161anos iepirkum\u0101, vienm\u0113r v\u0113rt\u0113 ar\u012b pas\u016bt\u012bt\u0101ja lomu. L\u012bdz \u0161im KP praks\u0113 ir biju\u0161i vair\u0101ki gad\u012bjumi, kad saskatot pas\u016bt\u012bt\u0101ja pretlikum\u012bg\u0101s darb\u012bbas, KP ir zi\u0146ojusi par tiem gan KNAB, gan Eiropas prokurat\u016brai (EPPO). Piem\u0113ram,<strong>&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/konkurences-padome-soda-tris-buvniecibas-uznemumus-par-aizliegtu-vienosanos-privata-pasutitaja-organizetaja-iepirkuma\" target=\"_blank\">priv\u0101t\u0101 pas\u016bt\u012bt\u0101ja karte\u013ca<\/a><\/strong>&nbsp;liet\u0101, aizliegta vieno\u0161an\u0101s tika konstat\u0113ta priv\u0101t\u0101 pas\u016bt\u012bt\u0101ja iepirkuma ietvaros, kur tika vienlaikus ieg\u016bta inform\u0101cija ar\u012b par pas\u016bt\u012bt\u0101ja pretlikum\u012bg\u0101m darb\u012bb\u0101m, prettiesiski apg\u016bstot ES l\u012bdzfinans\u0113jumu. Rezult\u0101t\u0101 EPPO ierosin\u0101ja krimin\u0101lprocesu un atbild\u012bg\u0101s personas tika sauktas pie krimin\u0101latbild\u012bbas&nbsp;par kr\u0101p\u0161anu liel\u0101 apm\u0113r\u0101, kas ir izdar\u012bta organiz\u0113t\u0101 grup\u0101.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Sadarb\u012bba ar Korupcijas nov\u0113r\u0161anas un apkaro\u0161anas biroju<\/strong><\/h3>\n\n\n\n<p>Sadarb\u012bb\u0101 ar KNAB, KP ir sa\u0146\u0113musi da\u017e\u0101da veida inform\u0101ciju, kas ir pal\u012bdz\u0113jusi atkl\u0101t aizliegtas vieno\u0161an\u0101s. Piem\u0113ram, \u201cCe\u013cu b\u016bves karte\u013ca\u201d liet\u0101 KP no KNAB sa\u0146\u0113ma neofici\u0101lu sarunu un telefonsarunu at\u0161ifr\u0113jumus, kas satur\u0113ja inform\u0101ciju par tik\u0161an\u0101m, kur\u0101s piedal\u012bj\u0101s Latvijas liel\u0101ko autoce\u013cu, ma\u0123istr\u0101\u013cu, tiltu b\u016bvniec\u012bbas, uztur\u0113\u0161anas un b\u016bvniec\u012bbas komercsabiedr\u012bbu p\u0101rst\u0101vji, sprie\u017eot par VAS&nbsp;\u201cLatvijas&nbsp;Valsts ce\u013ci\u201d organiz\u0113tajiem iepirkumiem. Izp\u0113tes laik\u0101 KP konstat\u0113ja, ka tik\u0161an\u0101s dal\u012bbnieki apspriedu\u0161i iepirkumu sadali, saska\u0146oju\u0161i savstarp\u0113jo r\u012bc\u012bbu, vienojoties par dal\u012bbas nosac\u012bjumiem iepirkumos, k\u0101 ar\u012b apmain\u012bju\u0161ies ar sensit\u012bvu inform\u0101ciju.<\/p>\n\n\n\n<p>Savuk\u0101rt, \u201cB\u016bvnieku karte\u013ca\u201d liet\u0101 KP no KNAB sa\u0146\u0113ma jau pla\u0161\u0101ku inform\u0101ciju &#8211; vair\u0101ku sarunu ierakstu at\u0161ifr\u0113jumus un procesu\u0101lo darb\u012bbu laik\u0101 iz\u0146emtas piez\u012bmes, kas satur\u0113ja inform\u0101ciju par Latvijas liel\u0101ko b\u016bvniec\u012bbas komercsabiedr\u012bbu p\u0101rst\u0101vju tik\u0161an\u0101s reiz\u0113m, kur\u0101s apspriesta publisko un priv\u0101to iepirkumu objektu konceptu\u0101la iedal\u012b\u0161ana. Atkl\u0101jot aizliegtu vieno\u0161anos, KP secin\u0101ja, ka tirgus dal\u012bbnieki darb\u012bbas saska\u0146oju\u0161i ilgsto\u0161i. Detaliz\u0113ti v\u0113rt\u0113jot pas\u016bt\u012bt\u0101ju r\u012bc\u012bbu un analiz\u0113jot sarunu ierakstus, KP atkl\u0101ja vair\u0101kas paz\u012bmes, kas, iesp\u0113jams, liecin\u0101ja par pas\u016bt\u012bt\u0101ja lomu kartel\u012b \u2013 pas\u016bt\u012bt\u0101ja cie\u0161ie kontakti pretendentiem un to ietekmi uz iepirkumu nolikuma pras\u012bbu izstr\u0101di, k\u0101 ar\u012b pas\u016bt\u012bt\u0101ja iesp\u0113jamo prettiesisko r\u012bc\u012bbu, neinform\u0113jot KP par aizliegtu vieno\u0161anos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Pas\u016bt\u012bt\u0101ja iesaiste aizliegtas vieno\u0161an\u0101s atkl\u0101\u0161an\u0101<\/strong><\/h3>\n\n\n\n<p>Pas\u016bt\u012bt\u0101ja iesp\u0113jamais \u201catbalsts\u201d vai \u201cpal\u012bdz\u012bba\u201d var rezult\u0113ties k\u0101 karte\u013ca veicin\u0101\u0161ana un atbalst\u012b\u0161ana. T\u0101 var izpausties, piem\u0113ram, k\u0101 iepirkuma proced\u016bras sensit\u012bvas inform\u0101cijas nodo\u0161ana karteliz\u0113tiem uz\u0146\u0113mumiem, da\u017e\u0101du specifisku kvalifik\u0101cijas pras\u012bbu iestr\u0101de iepirkumu dokument\u0101cij\u0101, kuras piem\u012bt noteiktam un \u0161auram pretendentu lokam, da\u013c\u0113ja pretendentu pied\u0101v\u0101jumu sagatavo\u0161ana vai karte\u013ca dal\u012bbnieku lomu noteik\u0161ana aizliegt\u0101 vieno\u0161an\u0101. Par papildu risku ir uzskat\u0101ma ar\u012b cie\u0161a pas\u016bt\u012bt\u0101ja komunik\u0101cija, tostarp, neform\u0101la, ar iesp\u0113jamiem pretendentiem \u0101rpus iepirkuma proced\u016bras noris\u0113m. Tikpat r\u016bp\u012bgi analiz\u0113jama ir ar\u012b pas\u016bt\u012bt\u0101ja r\u012bc\u012bba, pien\u0101c\u012bgi nerea\u0123\u0113jot uz konkurences ties\u012bbu p\u0101rk\u0101puma paz\u012bm\u0113m vai cit\u0101m sakrit\u012bb\u0101m pied\u0101v\u0101jumos. KP nor\u0101da, ka \u0161\u0101da r\u012bc\u012bba ir klaja pas\u016bt\u012bt\u0101ja bezdarb\u012bba vai nolaid\u012bga amata pien\u0101kumu pild\u012b\u0161ana.<\/p>\n\n\n\n<p>J\u0101nor\u0101da, ka min\u0113to iesp\u0113jamo p\u0101rk\u0101pumu izpausmju uzskait\u012bjums nav izsmelo\u0161s, jo prakse r\u0101da, ka negodpr\u0101t\u012bga r\u012bc\u012bba ir sp\u0113j\u012bga rad\u012bt jaunas p\u0101rk\u0101puma izpausmes formas un veidus. Aizdomu gad\u012bjum\u0101 par pas\u016bt\u012bt\u0101ju l\u012bdziesaisti p\u0101rk\u0101pum\u0101, KP izp\u0113tes liet\u0101s v\u0113rt\u0113 iesaistes apm\u0113ru un lomu kartel\u012b. Ja pas\u016bt\u012bt\u0101js ir organiz\u0113jis vai veicin\u0101jis karteli, tas ar\u012b ir atbild\u012bgs par konkurences ties\u012bbu p\u0101rk\u0101pumu un tam piem\u0113ro sodu. Pirmo reizi \u0161\u0101ds precedents, atkl\u0101jot pas\u016bt\u012bt\u0101ja akt\u012bvu iesaisti karte\u013ca veicin\u0101\u0161an\u0101, tika konstat\u0113ts 2019. gad\u0101&nbsp;<a href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/par-dalibu-karteli-kp-piemero-24-milj-eiro-sodu-ts-nanoudens-lieta-iesaistitajiem-uznemumiem-0\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cNano \u016bdens\u201d<\/a>&nbsp;liet\u0101, atkl\u0101jot se\u0161u pretendentu \u012bstenotu un pas\u016bt\u012bt\u0101ja atbalst\u012btu aizliegtu vieno\u0161anos div\u0101s uz\u0146\u0113muma SIA&nbsp;\u201cR\u012bgas satiksme\u201d cenu aptauj\u0101s par&nbsp;<em>nano<\/em>&nbsp;tehnolo\u0123isk\u0101s \u0137\u012bmijas pieg\u0101di. Atbild\u012bba tika piem\u0113rota vis\u0101m iesaist\u012btaj\u0101m pus\u0113m, tostarp pas\u016bt\u012bt\u0101jam piem\u0113rots vair\u0101k nek\u0101 2 milj.&nbsp;<em>eiro<\/em>&nbsp;naudas sods. T\u0101pat KP konstat\u0113jot paz\u012bmes par pas\u016bt\u012bt\u0101ja&nbsp;bezdarb\u012bbu vai nolaid\u012bgu amata pien\u0101kumu pild\u012b\u0161anu publisk\u0101 iepirkuma organiz\u0113\u0161an\u0101, nodod t\u0101s izv\u0113rt\u0113\u0161anai kompetent\u0101m iest\u0101d\u0113m.&nbsp;T\u0101d\u0113j\u0101di, konstat\u0113jot pas\u016bt\u012bt\u0101ju \u201catbalstu\u201d karte\u013ca \u012bsteno\u0161an\u0101, tas var tikt v\u0113rt\u0113ts:<\/p>\n\n\n\n<ul>\n<li><strong>K\u0101 iesp\u0113jama korupcija.<\/strong>&nbsp;Piem\u0113ram, kuku\u013c\u0146em\u0161ana, dienesta st\u0101vok\u013ca \u013caunpr\u0101t\u012bga izmanto\u0161ana, valsts amatpersonas bezdarb\u012bba vai intere\u0161u konflikts. Proti, kompetent\u0101 ties\u012bbu aizsardz\u012bbas iest\u0101de v\u0113rt\u0113 valsts amatpersonu r\u012bc\u012bbas atbilst\u012bbu Krimin\u0101llikum\u0101 noteiktajiem ties\u012bbu p\u0101rk\u0101pumiem, piem\u0113ram, past\u0101vot t\u0101d\u0101m paz\u012bm\u0113m, k\u0101 pas\u016bt\u012bt\u0101ja un pretendenta regul\u0101r\u0101 komunik\u0101cija, to cie\u0161as attiec\u012bbas, pas\u016bt\u012bt\u0101ja \u012bpa\u0161as labv\u0113l\u012bbas un pretimn\u0101k\u0161anas izr\u0101d\u012b\u0161ana konkr\u0113tajiem pretendentiem, pas\u016bt\u012bt\u0101jam iepirkuma dokument\u0101ciju izstr\u0101d\u0101jot konkr\u0113tam pretendentam, lai nodro\u0161in\u0101tu t\u0101 uzvaru publiskaj\u0101 iepirkum\u0101 utt.;<\/li>\n\n\n\n<li><strong>K\u0101 Konkurences likuma p\u0101rk\u0101pums.<\/strong>&nbsp;T\u0101d\u0113j\u0101di, gan viens, gan otrs p\u0101rk\u0101pums vienlaikus var tikt pak\u013cauts da\u017e\u0101du ties\u012bbp\u0101rk\u0101pumu nov\u0113rt\u0113jumam. Viens p\u0101rk\u0101pums, divas da\u013cas &#8211; vienu da\u013cu v\u0113rt\u0113 ties\u012bbu aizsardz\u012bbas iest\u0101de, otru KP. Abos gad\u012bjumos p\u0101rk\u0101puma pier\u0101d\u012b\u0161an\u0101 var tikt izmantota inform\u0101cija par vieniem un tiem pa\u0161iem faktiem konkr\u0113taj\u0101 liet\u0101. Judikat\u016br\u0101 vair\u0101kk\u0101rt tiek atz\u012bts<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup>, ka iest\u0101de administrat\u012bvaj\u0101 liet\u0101 var ieg\u016bt inform\u0101ciju ar\u012b no krimin\u0101lprocesa, un Krimin\u0101lprocesa likums neierobe\u017eo krimin\u0101lproces\u0101 ieg\u016bt\u0101s inform\u0101cijas izmanto\u0161anu administrat\u012bvaj\u0101 liet\u0101. Situ\u0101cij\u0101s, kad KP izp\u0113tes laik\u0101 konstat\u0113 nep\u0101rprotamu pas\u016bt\u012bt\u0101ja iesaisti uz\u0146\u0113mumu aizliegt\u0101 vieno\u0161an\u0101, pas\u016bt\u012bt\u0101js tiek uzskat\u012bts par karte\u013ca atbalst\u012bt\u0101ju, akt\u012bvi iesaistoties t\u0101 darb\u012bb\u0101s un veicinot t\u0101 m\u0113r\u0137u sasnieg\u0161anu.&nbsp;Eiropas Savien\u012bbas Tiesas judikat\u016br\u0101<sup><a href=\"#fn1\" id=\"ref1\">2<\/a><\/sup>&nbsp;ir nostiprin\u0101ti krit\u0113riji, kuriem izpildoties, pas\u016bt\u012bt\u0101js b\u016btu uzskat\u0101ms par aizliegtas vieno\u0161an\u0101s dal\u012bbnieku, ja:<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>tas piln\u012bb\u0101 ir p\u0101rzin\u0101jis visus lietas apst\u0101k\u013cus, sniedzot un apmainoties ar inform\u0101ciju (tostarp sensit\u012bvu) par tirgu un klientu sadali ar aizliegt\u0101s vieno\u0161anas dal\u012bbniekiem, \u012bstenojot pret konkurenci v\u0113rstos m\u0113r\u0137us;<\/li>\n\n\n\n<li>tas paredz\u0113ja dot ieguld\u012bjumu visu aizliegt\u0101s vieno\u0161anas dal\u012bbnieku kop\u0113jo m\u0113r\u0137u sasnieg\u0161an\u0101 un ir zin\u0101jis par citu uz\u0146\u0113mumu paredz\u0113to vai \u012bstenoto prettiesisko r\u012bc\u012bbu, lai sasniegtu \u0161os m\u0113r\u0137us, vai ka tas var\u0113ja to lo\u0123iski paredz\u0113t.<\/li>\n<\/ul>\n\n\n\n<p>KP nov\u0113ro, ka p\u0113d\u0113jos gados atbild\u012bg\u0101kie pas\u016bt\u012bt\u0101ji ir \u012bstenojo\u0161i un turpina \u012bstenot pas\u0101kumus, kas veicina karte\u013cu paz\u012bmju atpaz\u012b\u0161anu publiskajos iepirkumos, vienlaikus par aizdom\u012bgiem gad\u012bjumiem inform\u0113jot ar\u012b KP. Turkl\u0101t saska\u0146\u0101 ar 2023. gada groz\u012bjumiem Publisko iepirkumu likum\u0101, \u0161obr\u012bd pas\u016bt\u012bt\u0101jam ir pien\u0101kumus v\u0113rsties KP, lai sa\u0146emtu t\u0101s viedokli, ja iepirkuma noris\u0113 tiek konstat\u0113tas aizliegtas vieno\u0161an\u0101s paz\u012bmes.<\/p>\n\n\n\n<p>Lai veicin\u0101tu inform\u0101cijas apmai\u0146u par iesp\u0113jamiem konkurences ties\u012bbu p\u0101rk\u0101pumiem, KP turpina izgl\u012btot un sadarboties ar cit\u0101m valsts p\u0101rvaldes iest\u0101d\u0113m, k\u0101 ar\u012b prevent\u012bvi izgl\u012btot tirgus dal\u012bbniekus par konkurences ties\u012bbu principiem un korupcijas nepie\u013caujam\u012bbu, Ieciet\u012bbas programmas noz\u012bmi un iesp\u0113j\u0101m izmantot pa\u0161nov\u0113rt\u0113juma r\u012bkus.<\/p>\n\n\n\n<p>Nor\u0101d\u0101ms, ka publisko iepirkumu vajadz\u012bb\u0101m turpm\u0101kajos gados tiks t\u0113r\u0113ti b\u016btiski finan\u0161u resursi un sabiedr\u012bbas interes\u0113s ir \u0161os finan\u0161u l\u012bdzek\u013cus t\u0113r\u0113t god\u012bgas un br\u012bvas konkurences apst\u0101k\u013cos, caurskat\u0101m\u0101s publisko iepirkumu proced\u016br\u0101s. T\u0101p\u0113c svar\u012bgi, lai min\u0113tie finan\u0161u l\u012bdzek\u013ci tiek apg\u016bti bez korupcijas riskiem un god\u012bgos konkurences apst\u0101k\u013cos.&nbsp; &nbsp;<\/p>\n\n\n\n<sup id=\"fn1\">1.
