Klientiem (atkritumu rad\u012bt\u0101jiem) ir oblig\u0101ts pien\u0101kums sl\u0113gt l\u012bgumu ar vienu konkr\u0113tu apsaimniekot\u0101ju, nepast\u0101vot izv\u0113les iesp\u0113jai sl\u0113gt l\u012bgumu ar citu pakalpojumu sniedz\u0113ju.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Atkritumu apsaimnieko\u0161anas normat\u012bv\u0101 regul\u0113juma skaidrojums<\/strong><\/h3>\n\n\n\n<p>Atkritumu apsaimnieko\u0161ana ir valsts vides aizsardz\u012bbas politikas sast\u0101vda\u013ca. Latvijas vides un atkritumu apsaimnieko\u0161anas politiskie m\u0113r\u0137i ir skat\u0101mi vienot\u0101 sist\u0113m\u0101 ar Eiropas Savien\u012bbas apsaimnieko\u0161anas politikas m\u0113r\u0137iem, k\u0101 ar\u012b ar Eiropas direkt\u012bvu pras\u012bb\u0101m, kas ir atspogu\u013cotas Latvijas normat\u012bvaj\u0101 regul\u0113jum\u0101.<\/p>\n\n\n\n<p>Atkritumu apsaimnieko\u0161anas likuma (AAL) 18.&nbsp;panta pirm\u0101 da\u013ca nosaka, ka pa\u0161vald\u012bba iepirkuma procesa rezult\u0101t\u0101 izv\u0113las atkritumu apsaimniekot\u0101ju, kur\u0161 veiks sadz\u012bves atkritumu apsaimnieko\u0161anu pa\u0161vald\u012bbas teritorij\u0101, par pied\u0101v\u0101juma izv\u0113les krit\u0113riju nosakot saimnieciski visizdev\u012bg\u0101ko pied\u0101v\u0101jumu. Savuk\u0101rt Pa\u0161vald\u012bbu likuma 4.&nbsp;panta pirm\u0101s da\u013cas 1.&nbsp;punkts nosaka vienu no pa\u0161vald\u012bbas autonomaj\u0101m funkcij\u0101m \u2013 organiz\u0113t iedz\u012bvot\u0101jiem sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumus, neatkar\u012bgi no t\u0101, k\u0101 \u012bpa\u0161um\u0101 atrodas dz\u012bvojamais fonds. L\u012bdz ar to pa\u0161vald\u012bbai patst\u0101v\u012bgi ir j\u0101nodro\u0161ina tai ties\u012bbu aktos noteikto funkciju un uzdevumu izpilde savas administrat\u012bv\u0101s teritorijas iedz\u012bvot\u0101ju interes\u0113s.<a href=\"https:\/\/www.kp.gov.lv\/sites\/kp\/files\/gallery_images\/9_7.png\"><\/a><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"184\" src=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2023\/11\/16.11.2023_1.Istenojot_psvald_likumu.png\" alt=\"\" class=\"wp-image-22331\"\/><\/figure>\n\n\n\n<p>Min\u0113t\u0101s autonom\u0101s funkcijas \u012bsteno\u0161anas ietvaros, k\u0101 ar\u012b atbilsto\u0161i AAL 8.&nbsp;panta pirm\u0101s da\u013cas 3.&nbsp;punkt\u0101 noteiktajam pa\u0161vald\u012bbas kompetenc\u0113 ir izdot saisto\u0161os noteikumus par sadz\u012bves atkritumu apsaimnieko\u0161anu sav\u0101 administrat\u012bvaj\u0101 teritorij\u0101. \u0160ajos noteikumos &nbsp;nor\u0101d\u012btas ar sadz\u012bves atkritumu apsaimnieko\u0161anas organiz\u0113\u0161anu nepiecie\u0161am\u0101s pras\u012bbas, nosakot:<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"424\" src=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2023\/11\/16.11.2023_2.bilde_.png\" alt=\"\" class=\"wp-image-22330\"\/><\/figure>\n\n\n\n<p>J\u0101\u0146em v\u0113r\u0101, ka pa\u0161vald\u012bbai ir pien\u0101kums izstr\u0101d\u0101tos saisto\u0161os noteikumus nos\u016bt\u012bt Vides aizsardz\u012bbas un re\u0123ion\u0101l\u0101s att\u012bst\u012bbas ministrijai (VARAM), kas izv\u0113rt\u0113 \u0161o noteikumu atbilst\u012bbu normat\u012bvajiem aktiem par atkritumu apsaimnieko\u0161anu, atkritumu apsaimnieko\u0161anas valsts pl\u0101nam un re\u0123ion\u0101lajiem pl\u0101niem.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"331\" src=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2023\/11\/16.11.2023_3.pasvaldiba_var.png\" alt=\"\" class=\"wp-image-22329\"\/><\/figure>\n\n\n\n<p>KP v\u0113r\u0161 uzman\u012bbu uz gad\u012bjumiem, kad pa\u0161vald\u012bba izv\u0113las nodro\u0161in\u0101t atkritumu apsaimnieko\u0161anu pa\u0161vald\u012bbas teritorij\u0101 patst\u0101v\u012bgi vai uzdot pa\u0161vald\u012bbas to komersantam (<em>in-house<\/em>). Pa\u0161vald\u012bba uz&nbsp;<em>in-house<\/em>&nbsp;principa pamata k\u0101 sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumu sniedz\u0113ju sav\u0101 teritorij\u0101 izv\u0113las \u201csavu\u201d (t.&nbsp;i., komersantu, kur\u0101 attiec\u012bg\u0101 pa\u0161vald\u012bba ir kapit\u0101lda\u013cu tur\u0113t\u0101ja) atkritumu apsaimniekot\u0101ju, \u0146emot v\u0113r\u0101 iepirkuma procesa normat\u012bvaj\u0101 regul\u0113jum\u0101 past\u0101vo\u0161o iz\u0146\u0113mumu. Tom\u0113r min\u0113to izv\u0113li pa\u0161vald\u012bba var realiz\u0113t, tikai&nbsp;iev\u0113rojot Valsts p\u0101rvaldes iek\u0101rtas likuma 88.&nbsp;pant\u0101 noteiktos priek\u0161noteikumus, t.&nbsp;sk. lai nov\u0113rstu tirgus nepiln\u012bbas. KP skaidro, ka&nbsp;<em>in-house<\/em>&nbsp;proced\u016bra, \u0146emot v\u0113r\u0101 t\u0101s ilgtermi\u0146a negat\u012bvo ietekmi uz priv\u0101to tirgus dal\u012bbnieku konkur\u0113tsp\u0113ju un konkurenci kopum\u0101, ir piem\u0113rojama tikai gad\u012bjumos, ja pa\u0161vald\u012bba var pamatot tirgus nepiln\u012bbas past\u0101v\u0113\u0161anu un to, ka konkr\u0113t\u0101 pakalpojuma sniedz\u0113ja izv\u0113le efekt\u012bv\u0101k nav \u012bstenojama tirgus dal\u012bbnieku savstarp\u0113j\u0101s s\u0101ncens\u012bbas ce\u013c\u0101. Turkl\u0101t ar sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojuma snieg\u0161anu saist\u012btos riskus iesp\u0113jams nov\u0113rst ar skaidru pras\u012bbu izvirz\u012b\u0161anu iepirkuma konkursa nolikum\u0101.<\/p>\n\n\n\n<p>Ja pa\u0161vald\u012bba sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumu snieg\u0161anai izv\u0113las nol\u012bgt priv\u0101tpersonu nodibin\u0101to apsaimniekot\u0101ju, pa\u0161vald\u012bba to var dar\u012bt iepirkuma proced\u016bras vai publisk\u0101s un priv\u0101t\u0101s partner\u012bbas proced\u016bras veid\u0101. KP aicina pa\u0161vald\u012bbas izv\u0113rt\u0113t iesp\u0113ju sadz\u012bves atkritumu apsaimnieko\u0161anas (sav\u0101k\u0161anas un p\u0101rvad\u0101\u0161anas) pakalpojumu sniedz\u0113ju izv\u0113l\u0113ties publisk\u0101 iepirkuma ce\u013c\u0101, kas t\u0101d\u0113j\u0101di savstarp\u0113j\u0101s s\u0101ncens\u012bbas apst\u0101k\u013cos \u013cautu nodro\u0161in\u0101t iedz\u012bvot\u0101jiem un komersantiem izdev\u012bg\u0101k\u0101s cenas, k\u0101 ar\u012b augst\u0101kas kvalit\u0101tes atkritumu sav\u0101k\u0161anas un p\u0101rvad\u0101\u0161anas pakalpojumu.<\/p>\n\n\n\n<p>J\u0101\u0146em v\u0113r\u0101, ka minim\u0101l\u0101s pras\u012bbas, kas pa\u0161vald\u012bbai j\u0101iek\u013cauj darba uzdevum\u0101, izv\u0113loties sadz\u012bves atkritumu apsaimniekot\u0101ju, ir nor\u0101d\u012btas Ministru kabineta 16.08.2016. noteikumos Nr.&nbsp;546 \u201cNoteikumi par minim\u0101laj\u0101m pras\u012bb\u0101m, kas iek\u013caujamas darba uzdevum\u0101, pa\u0161vald\u012bbai izraugoties sadz\u012bves atkritumu apsaimniekot\u0101ju, un atkritumu apsaimnieko\u0161anas l\u012bgumu b\u016btiskie nosac\u012bjumi\u201d (turpm\u0101k \u2013 Noteikumi Nr.&nbsp;546).<\/p>\n\n\n\n<p>Iepirkuma konkurs\u0101 atbilsto\u0161i AAL 18.&nbsp;panta pirmaj\u0101 da\u013c\u0101 noteiktajam par pied\u0101v\u0101juma izv\u0113les krit\u0113riju nosak\u0101ms saimnieciski visizdev\u012bg\u0101kais pied\u0101v\u0101jums. Konkursam nosl\u0113dzoties, pa\u0161vald\u012bba nosl\u0113dz l\u012bgumu ar konkursa uzvar\u0113t\u0101ju par sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumu snieg\u0161anu pa\u0161vald\u012bbas teritorij\u0101.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>L\u012bguma sl\u0113g\u0161ana ar iepirkuma konkursa uzvar\u0113t\u0101ju<\/strong><\/h3>\n\n\n\n<p>KP nor\u0101da<sup><a href=\"#fn1\" id=\"ref1\">[1]<\/a><\/sup>,&nbsp;ka tie\u0161i iepirkuma konkurss ir efekt\u012bv\u0101kais veids, k\u0101 pa\u0161vald\u012bbai izv\u0113l\u0113ties pakalpojuma sniedz\u0113ju, kas vislab\u0101k atbilst pras\u012bb\u0101m un teritorijas iedz\u012bvot\u0101ju vajadz\u012bb\u0101m, jo&nbsp;publisk\u0101 iepirkuma r\u012bko\u0161ana \u013cauj publiskai personai sa\u0146emt finansi\u0101li izdev\u012bg\u0101ko pied\u0101v\u0101jumu. T\u0101d\u0113j\u0101di nav pamata uzskat\u012bt, ka priv\u0101tie atkritumu apsaimniekot\u0101ji nevar\u0113tu nodro\u0161in\u0101t vienl\u012bdz efekt\u012bvu sadz\u012bves atkritumu apsaimnieko\u0161anas (sav\u0101k\u0161anas un p\u0101rvad\u0101\u0161anas) pakalpojumu snieg\u0161anu, t.&nbsp;i., priv\u0101tie atkritumu apsaimniekot\u0101ji jau ilgsto\u0161i sniedz min\u0113tos pakalpojumus atbilsto\u0161i pa\u0161vald\u012bbu r\u012bkotajos iepirkuma konkursos izvirz\u012btajiem noteikumiem.&nbsp;B\u016btiski uzsv\u0113rt, ka iepirkuma konkursa, t.&nbsp;i., konkurences rezult\u0101t\u0101, pa\u0161vald\u012bbas teritorij\u0101 ir iesp\u0113jama augst\u0101ka pakalpojuma kvalit\u0101te un zem\u0101ka cena.<\/p>\n\n\n\n\n\n<p>Pa\u0161vald\u012bbas r\u012bkot\u0101s iepirkuma proced\u016bras rezult\u0101t\u0101 pa\u0161vald\u012bba sl\u0113dz l\u012bgumu ar iepirkuma uzvar\u0113t\u0101ju uz termi\u0146u, kas nep\u0101rsniedz 7 gadus. Gad\u012bjum\u0101, ja pa\u0161vald\u012bba sadz\u012bves atkritumu apsaimniekot\u0101ju izv\u0113las normat\u012bvajos aktos par publisko un priv\u0101to partner\u012bbu noteiktaj\u0101 k\u0101rt\u012bb\u0101, l\u012bgumu var sl\u0113gt uz laiku, kas nav ilg\u0101ks par 20 gadiem. Laiks, uz k\u0101du sl\u0113dzami iepriek\u0161 min\u0113tie l\u012bgumi, noteikts AAL 18.&nbsp;panta sept\u012btaj\u0101 da\u013c\u0101.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Pa\u0161vald\u012bbu kompetence<\/strong><\/h3>\n\n\n\n<p>Atbilsto\u0161i Noteikumiem Nr.&nbsp;546 atkritumu apsaimnieko\u0161anas l\u012bgumos pa\u0161vald\u012bbas nosaka &nbsp;atkritumu apsaimnieko\u0161an\u0101 iesaist\u012bto pu\u0161u ties\u012bbas un pien\u0101kumus, t.&nbsp;sk. pakalpojumus, kurus pa\u0161vald\u012bbas organiz\u0113t\u0101 iepirkuma konkursa rezult\u0101t\u0101 izv\u0113l\u0113tais atkritumu apsaimniekot\u0101js sniedz, pieprasot papildu samaksu. Iepirkuma konkursa rezult\u0101t\u0101 nosl\u0113gt\u0101 l\u012bguma darb\u012bbas laik\u0101 konkurence sadz\u012bves atkritumu apsaimnieko\u0161anas tirg\u016b&nbsp;nepast\u0101v, un pa\u0161vald\u012bbas teritorij\u0101 \u0161aj\u0101 laik\u0101 sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumus sniedz viens sadz\u012bves atkritumu apsaimniekot\u0101js \u2013 iepirkuma konkursa uzvar\u0113t\u0101js, ar kuru pa\u0161vald\u012bba ir nosl\u0113gusi l\u012bgumu.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"306\" src=\"https:\/\/zurnalsiepirkumi.lv\/wp-content\/uploads\/2023\/11\/16.11.2023_4.pasvald_kompetence.png\" alt=\"\" class=\"wp-image-22328\"\/><\/figure>\n\n\n\n<p>Organiz\u0113jot sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumus sav\u0101 teritorij\u0101, pa\u0161vald\u012bba uz\u0146emas r\u016bpes par \u0161\u0101 uzdevuma izpildi, ne tikai izdodot normat\u012bvos aktus, bet ar\u012b faktiski nodro\u0161ina noteiktu publisko pakalpojumu pieejam\u012bbu, piem\u0113rojot risin\u0101jumus viet\u0113j\u0101m iesp\u0113j\u0101m un vajadz\u012bb\u0101m un koordin\u0113jot pakalpojumu faktisku \u012bsteno\u0161anu.&nbsp;L\u012bdz ar to KP nor\u0101da, ka t\u0101s kompetenc\u0113 neietilpst AAL un pa\u0161vald\u012bbu saisto\u0161o noteikumu, kas regul\u0113&nbsp;atkritumu apsaimnieko\u0161anu pa\u0161vald\u012bbu teritorij\u0101s, iev\u0113ro\u0161anas uzraudz\u012bba.<\/p>\n\n\n\n<p>Tom\u0113r, pat ja uz konkr\u0113to situ\u0101ciju attiecas atkritumu apsaimnieko\u0161anas normat\u012bvais regul\u0113jums, kuru piem\u0113ro\u0161anu uzrauga VARAM un\/vai pa\u0161vald\u012bbas, tas neizsl\u0113dz tirgus dal\u012bbnieku un pa\u0161vald\u012bbu pien\u0101kumu iev\u0113rot konkurences ties\u012bbas, ja to r\u012bc\u012bba likvid\u0113 konkurenci. Piem\u0113ram, KP piem\u0113ro Konkurences likuma 13.&nbsp;pantu, gad\u012bjum\u0101, kad tiek konstat\u0113ta pa\u0161vald\u012bbas atra\u0161an\u0101s domin\u0113jo\u0161\u0101 st\u0101vokl\u012b konkr\u0113taj\u0101 tirg\u016b un \u0161\u012b st\u0101vok\u013ca \u013caunpr\u0101t\u012bga izmanto\u0161ana, liedzot atkritumu apsaimnieko\u0161anas pakalpojumu sniedz\u0113jiem konkurences proces\u0101 piek\u013cuvi konkr\u0113tajam tirgum<sup><a href=\"#fn1\" id=\"ref1\">[2]<\/a><\/sup>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ieteikumi atkritumu apsaimnieko\u0161anas tirgus att\u012bst\u012bbai<\/strong><\/h3>\n\n\n\n<p>Vienlaikus KP savas kompetences ietvaros&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.kp.gov.lv\/lv\/jaunums\/kp-atbalsta-briva-tirgus-principa-ieviesanu-atkritumu-apsaimniekosanas-joma-0\" target=\"_blank\"><strong>iesaist\u0101s atkritumu apsaimnieko\u0161anas nozari regul\u0113jo\u0161o normat\u012bvo aktu izstr\u0101d\u0113<\/strong><\/a>, v\u0113r\u0161ot politikas veidot\u0101ju uzman\u012bbu, ka ar\u012b atkritumu apsaimnieko\u0161anas nozar\u0113 j\u0101nodro\u0161ina tirgus atv\u0113r\u0161ana un br\u012bva konkurence sadz\u012bves atkritumu apsaimniekot\u0101ju starp\u0101.<\/p>\n\n\n\n<p>Br\u012bv\u0101 tirgus mode\u013ca ievie\u0161ana atkritumu apsaimnieko\u0161anas nozar\u0113 pa\u0161vald\u012bbu teritorij\u0101s ar lielu iedz\u012bvot\u0101ju skaitu (pa\u0161vald\u012bb\u0101 ar iedz\u012bvot\u0101ju skaitu virs 100&nbsp;000)&nbsp;un bl\u012bvumu veicin\u0101tu konkurenci un sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumu snieg\u0161anas att\u012bst\u012bbu un efektivit\u0101ti pat\u0113r\u0113t\u0101jam. T\u0101d\u0113j\u0101di&nbsp;tiktu dota iesp\u0113ja sadz\u012bves atkritumu apsaimnieko\u0161anu uztic\u0113t savstarp\u0113ji konkur\u0113jo\u0161iem pakalpojumu sniedz\u0113jiem, nodro\u0161inot efekt\u012bvu konkurenci.&nbsp;\u0160\u0101ds atkritumu apsaimnieko\u0161anas pakalpojumu snieg\u0161anas modelis, piem\u0113ram, l\u012bdz 2019. gadam past\u0101v\u0113ja R\u012bg\u0101.&nbsp;<\/p>\n\n\n\n<p>Gad\u012bjum\u0101, ja normat\u012bvaj\u0101 regul\u0113jum\u0101 tiktu noteikta pras\u012bba pa\u0161vald\u012bbai (piem\u0113ram, valstspils\u0113t\u0101s) sadal\u012bt savu teritoriju apsaimnieko\u0161anas zon\u0101s, izpildoties noteiktiem krit\u0113rijiem (iedz\u012bvot\u0101ju skaitam un bl\u012bvumam),&nbsp;vair\u0101kiem atkritumu apsaimniekot\u0101jiem par sadz\u012bves atkritumu apsaimnieko\u0161anas pakalpojumu snieg\u0161anu b\u016btu iesp\u0113ja konkur\u0113t vienas pa\u0161vald\u012bbas ietvaros vair\u0101k\u0101s zon\u0101s.
