Elektroniskie iepirkumi Malt\u0101 noz\u012bm\u0113, ka interneta vid\u0113 ir izveidota publisko iepirkumu platforma inform\u0101cijas apmai\u0146ai elektronisk\u0101 vid\u0113<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup>, kur tiek dota iesp\u0113ja ievietot inform\u0101ciju un lejupiel\u0101d\u0113t dokumentus. <\/p>\n<p>Iepirkumu sludin\u0101jumi tiek public\u0113ti div\u0101s vietn\u0113s \u2013 Finan\u0161u ministrijas L\u012bgumu departamenta (FMLD) m\u0101jaslap\u0101<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup> vai Elektronisko publisko iepirkumu sist\u0113mas (e-PPS) m\u0101jaslap\u0101. Turpat ar\u012b iepirkuma proced\u016bras dokument\u0101cija un cita inform\u0101cija. FMLD m\u0101jaslap\u0101 public\u0113tajiem pazi\u0146ojumiem iesp\u0113ja atv\u0113rt katru interes\u0113jo\u0161o sada\u013cu atsevi\u0161\u0137i (ar\u012b atbildes uz uzdotajiem jaut\u0101jumiem) tiek dota tikai re\u0123istr\u0113tiem lietot\u0101jiem. Re\u0123istr\u0113t savu uz\u0146\u0113mumu ir iesp\u0113jams, nos\u016btot attiec\u012bgu iesniegumu pa faksu vai elektroniski.<\/p>\n<p>Kas attiecas uz iepirkumu centraliz\u0101ciju, Malt\u0101 valsts iest\u0101d\u0113m lielo iepirkuma proced\u016bru veik\u0161ana ir dele\u0123\u0113ta FMLD. Sarakst\u0101 ir devi\u0146as ministrijas un to padot\u012bb\u0101 eso\u0161\u0101s iest\u0101des. T\u0101s visas ir nor\u0101d\u012btas Maltas Publisko iepirkumu likuma (PIL) 2. tabul\u0101. Centraliz\u0113t\u0101s iepirkuma proced\u016bras tiek organiz\u0113tas katras iest\u0101des vajadz\u012bb\u0101m, \u0146emot v\u0113r\u0101 to priek\u0161likumus, kas tiek iesniegti par iepirkuma proced\u016bras norisi atbild\u012bgaj\u0101 Visp\u0101r\u0113j\u0101 l\u012bgumu komisij\u0101. Gal\u012bgos l\u0113mumus par l\u012bgumu sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu pie\u0146em \u0122ener\u0101l\u0101 l\u012bgumu komisija<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>.<\/p>\n<p>Proced\u016bras, kuru l\u012bgumcena nep\u0101rsniedz ES noteikt\u0101s l\u012bgumcenu robe\u017eas, min\u0113t\u0101s valsts iest\u0101des, k\u0101 ar\u012b visi p\u0101r\u0113jie pas\u016bt\u012bt\u0101ji, kuri nav min\u0113ti Maltas PIL 2. tabul\u0101, var organiz\u0113t pa\u0161i. \u0160\u0101dos gad\u012bjumos 2. tabul\u0101 eso\u0161o valsts iest\u0101\u017eu pie\u0146emtos l\u0113mumus par rezult\u0101tiem apstiprina FMLD. <\/p>\n<p>Malt\u0101 e-PPS darb\u012bbu nodro\u0161ina Maltas inform\u0101cijas tehnolo\u0123iju a\u0123ent\u016bra (MITA)<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup> . Tika pl\u0101nots, ka 2013. gad\u0101 FMLD organiz\u0113to iepirkuma proced\u016bru norise piln\u012bb\u0101 tiks nodro\u0161in\u0101ta elektroniski. Apskatot e-PPS vietn\u0113 izsludin\u0101t\u0101s iepirkuma proced\u016bras, redzams, ka aktivit\u0101te ir liela, ik dienas tiek ievietota inform\u0101cija par vair\u0101k\u0101m iepirkuma proced\u016br\u0101m. L\u012bdz\u0101s vien\u012bg\u0101s centraliz\u0113t\u0101s iest\u0101des<sup><a href=\"#fn6\" id=\"ref6\">6<\/a><\/sup> ievietotajiem sludin\u0101jumiem redzamas ar\u012b citu iest\u0101\u017eu izsludin\u0101t\u0101s proced\u016bras. Lielo iepirkuma proced\u016bru nelielajai Maltai ir sal\u012bdzino\u0161i maz. <\/p>\n<p>Br\u012bvpr\u0101t\u012bgi centraliz\u0113ta pieeja ir medikamentu un medic\u012bnas pre\u010du iepirkumiem. Izsludin\u0101tas vair\u0101kas iepirkumu proced\u016bras, kuru rezult\u0101t\u0101 ir paredz\u0113ts sl\u0113gt visp\u0101r\u012bg\u0101s vieno\u0161an\u0101s. K\u0101 l\u012bgumsl\u0113dz\u0113ja iest\u0101de min\u0113ta <em>Central Procurement and Supplies Unit<\/em> (MHF), kas veic iepirkumus ar vesel\u012bbas apr\u016bpi saist\u012btu iest\u0101\u017eu vajadz\u012bb\u0101m. Elektronisko iepirkumu priek\u0161roc\u012bbas akt\u012bvi izmanto ar\u012b MITA un v\u0113l da\u017eas iest\u0101des, savuk\u0101rt citi pas\u016bt\u012bt\u0101ji joproj\u0101m dod priek\u0161roku FMLD m\u0101jaslapai.<\/p>\n<p>S\u016bdz\u012bbu par publiskajiem iepirkumiem Malt\u0101 vispirms iesniedz pas\u016bt\u012bt\u0101jam \u2013 piecu darba dienu laik\u0101 p\u0113c rezult\u0101tu pazi\u0146o\u0161anas. To iesniedz kop\u0101 ar depoz\u012btu, kura summa atkar\u012bga no paredzam\u0101s l\u012bgumcenas (0,5 %), un nav maz\u0101ka par 400 eiro. P\u0113c noteikt\u0101 piecu darba dienu termi\u0146a s\u016bdz\u012bbu var iesniegt L\u012bgumu p\u0101rskat\u012b\u0161anas padom\u0113<sup><a href=\"#fn7\" id=\"ref7\">7<\/a><\/sup> desmit darba dienu laik\u0101. Padome pie\u0146em l\u0113mumu un sniedz rekomend\u0101cijas, t\u0101s l\u0113mumu var apstr\u012bd\u0113t, iesniedzot pras\u012bbu ties\u0101 (noteiktais termi\u0146\u0161 atkar\u012bb\u0101 no l\u012bgumcenas \u2013 20 vai 60 dienas)<sup><a href=\"#fn8\" id=\"ref8\">8<\/a><\/sup> . P\u0113c s\u016bdz\u012bbas iesnieg\u0161anas autom\u0101tiski iest\u0101jas aizliegums sl\u0113gt iepirkuma l\u012bgumu. Pazi\u0146ojumi par iepirkuma proced\u016bras rezult\u0101tiem ES <em>Ofici\u0101laj\u0101 V\u0113stnes\u012b<\/em> (OV) tiek public\u0113ti, piln\u0101 m\u0113r\u0101 izmantojot iesp\u0113jas, kas noteiktas Direkt\u012bv\u0101 2004\/18\/EK, tas ir, ne v\u0113l\u0101k k\u0101 48 dienu laik\u0101 p\u0113c l\u0113muma pie\u0146em\u0161anas.<\/p>\n<p><strong><u>Uzzi\u0146ai<\/u><\/strong><br \/>\n<strong>Malta<\/strong><\/p>\n<li>Viena no vismaz\u0101kaj\u0101m Eiropas valst\u012bm (316 km<sup>2<\/sup>)<\/li>\n<li>Taj\u0101 ir ap pusmiljons iedz\u012bvot\u0101ju <\/li>\n<li>Neatkar\u012bbu no Apvienot\u0101s Karalistes t\u0101 ieguvusi tikai 1964. gada 21. septembr\u012b<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup><\/li>\n<li>ES dal\u012bbvalsts kop\u0161 2004. gada<\/li>\n<p><brake><\/brake><br \/>\n<strong>M\u016bsu kaimi\u0146valst\u012b Igaunij\u0101 <\/strong><\/p>\n<p>L\u012bdz 2010. gadam publisko iepirkumu sist\u0113ma ne ar ko daudz neat\u0161\u0137\u012br\u0101s no t\u0101s, kas bija izveidota Latvij\u0101. Citu ce\u013cu Igaunija izv\u0113l\u0113j\u0101s 2010. gad\u0101, kad tika veikta reorganiz\u0101cija un iepirkumu uzraudz\u012bbas instit\u016bcijas funkcijas tika nodotas Finan\u0161u ministrijas (FM) p\u0101rzi\u0146\u0101. Respekt\u012bvi, uzraudz\u012bbas funkcija tika no\u0161\u0137irta no starpniec\u012bbas funkcij\u0101m. <\/p>\n<p>Tagad Igaunijas publisko iepirkumu port\u0101ls ir univers\u0101ls bezmaksas lieto\u0161anai nodots publisko iepirkumu port\u0101ls, kur re\u0123istr\u0113tiem lietot\u0101jiem tiek pied\u0101v\u0101ta iesp\u0113ja gan pa\u0161iem ievietot, gan ar\u012b mekl\u0113t citu ievietotos sludin\u0101jumus, k\u0101 ar\u012b citu ar iepirkumiem saist\u012btu inform\u0101ciju. Lietot\u0101ji no Igaunijas var izmantot identifik\u0101cijas (ID) karti vai mobilo ID. Port\u0101ls nav p\u0101rslogots ar lieku inform\u0101ciju, apskatot sada\u013cas, viegli var atrast gan ierastos iepirkumu sludin\u0101jumus, gan elektronisk\u0101s izsoles, normat\u012bvos aktus, rokasgr\u0101matas, apm\u0101c\u012bbu iesp\u0113jas un citu svar\u012bgu inform\u0101ciju.<\/p>\n<p>Igaunijas Publisko iepirkumu likums (PIL)<sup><a href=\"#fn10\" id=\"ref10\">10<\/a><\/sup> ietver ar\u012b uz sabiedrisko pakalpojumu sniedz\u0113jiem attiecin\u0101m\u0101s pras\u012bbas iepirkumu jom\u0101. T\u0101 m\u0113r\u0137is ir formul\u0113ts sam\u0113r\u0101 \u012bsi un kodol\u012bgi: nodro\u0161in\u0101t l\u012bdzek\u013cu p\u0101rredzamu, racion\u0101lu un ilgtsp\u0113j\u012bgu izmanto\u0161anu, vienl\u012bdz\u012bgas attieksmes un efekt\u012bvas past\u0101vo\u0161\u0101s konkurences izmanto\u0161anu publiskaj\u0101 iepirkum\u0101. Likums nosaka ar\u012b FM funkcijas, ties\u012bbas un pien\u0101kumus iepirkumu jom\u0101, k\u0101 ar\u012b publisko iepirkumu re\u0123istra (PIR) m\u0113r\u0137us. <\/p>\n<p><strong>FM:<\/strong> \u012bsteno valsts uzraudz\u012bbu p\u0101r publisko iepirkumu un p\u0101rk\u0101pumiem; konsult\u0113 un apm\u0101ca jaut\u0101jumos par PIL; sav\u0101 m\u0101jaslap\u0101 public\u0113 atjaunotu inform\u0101ciju par publiskajiem iepirkumiem.<\/p>\n<p><strong>PIR m\u0113r\u0137i:<\/strong> nodro\u0161in\u0101t publisko iepirkumu pazi\u0146ojumu public\u0113\u0161anu un nos\u016bt\u012b\u0161anu OV; atspogu\u013cot p\u0101rs\u016bdz\u012bbu rezult\u0101tus; nodro\u0161in\u0101t elektronisku iepirkuma proced\u016bru; nodro\u0161in\u0101t statistikas inform\u0101ciju; sniegt inform\u0101ciju.<\/p>\n<p>Igaunijas PIL ir interesants ar to, ka taj\u0101 ir atsevi\u0161\u0137a noda\u013ca par atbild\u012bbu. Piem\u0113ram, tas nosaka naudas soda piem\u0113ro\u0161anu par to, ka pieg\u0101d\u0101t\u0101js ir iesniedzis pied\u0101v\u0101jumu bez ap\u0146em\u0161an\u0101s nosl\u0113gt iepirkuma l\u012bgumu (priv\u0101tperson\u0101m 200 eiro, juridisk\u0101m \u2013 2000 eiro). L\u012bdzv\u0113rt\u012bgs sods paredz\u0113ts par nepatiesas inform\u0101cijas iesnieg\u0161anu, dokumentu vilto\u0161anu, pieskaitot v\u0113l ar\u012b zaud\u0113jumu atl\u012bdzin\u0101\u0161anu, kas radu\u0161ies nepatiesi sniegt\u0101s inform\u0101cijas d\u0113\u013c. Igaunij\u0101 FM var atcelt iepirkuma komisijas l\u0113mumu ar\u012b tad, ja nav v\u0113l iesniegta neviena s\u016bdz\u012bba, piem\u0113ram, ja ir pamatotas \u0161aubas par pas\u016bt\u012bt\u0101ja objektivit\u0101ti.<\/p>\n<p>Par s\u016bdz\u012bbas iesnieg\u0161anu Apel\u0101cijas komisij\u0101 (AK) Igaunij\u0101 ir j\u0101maks\u0101 valsts nodeva, kuras apm\u0113ru nenosaka PIL. To iesniedz septi\u0146u darba dienu laik\u0101 p\u0113c fakta konstat\u0113\u0161anas, un AK s\u016bdz\u012bbu vismaz triju locek\u013cu sast\u0101v\u0101 izskata septi\u0146u darba dienu laik\u0101. Atkl\u0101ta s\u0113de tiek organiz\u0113ta, ja k\u0101da no pus\u0113m to pieprasa. Ja p\u0101rk\u0101pums tiek nov\u0113rsts (tam tiek dots divu dienu termi\u0146\u0161), s\u016bdz\u012bbu neizskata. No iesnieguma sa\u0146em\u0161anas l\u012bdz l\u0113muma pazi\u0146o\u0161anai paiet apm\u0113ram 15 kalend\u0101r\u0101s dienas<sup><a href=\"#fn11\" id=\"ref11\">11<\/a><\/sup>. <\/p>\n<p>Igaunij\u0101 AK  locek\u013cus uz pieciem gadiem p\u0113c vald\u012bbas ierosin\u0101juma iece\u013c ministru prezidents. Likum\u0101 nav noteiktas konkr\u0113tas pras\u012bbas attiec\u012bb\u0101 uz kvalifik\u0101ciju vai pieredzi, bet  ir noteikts, ka komisijas locek\u013cu algai j\u0101b\u016bt l\u012bdzv\u0113rt\u012bgai tai, ko sa\u0146em tiesne\u0161i. <\/p>\n<p>AK loceklis atce\u013c sevi no s\u016bdz\u012bbas izskat\u012b\u0161anas, ja ir radu\u0161\u0101s \u0161aubas par vi\u0146a objektivit\u0101ti, tas ir, ja p\u0101rskat\u012b\u0161anas proced\u016bra ir attiecin\u0101ma uz partijas biedru vai vi\u0146a likum\u012bgo p\u0101rst\u0101vi, p\u0113cn\u0101c\u0113ju vai vienu no vec\u0101kiem, citiem pirm\u0101s pak\u0101pes radiniekiem un vi\u0146u eso\u0161ajiem un biju\u0161ajiem laul\u0101tajiem, pusm\u0101s\u0101m, pusbr\u0101\u013ciem, aud\u017euvec\u0101kiem vai aud\u017eub\u0113rniem, adopt\u0113t\u0101jiem un adopt\u0113tajiem, laul\u0101tajiem, iek\u0161zemes partneriem, k\u0101 ar\u012b vi\u0146u tie\u0161ajiem asinsradiniekiem, tostarp gad\u012bjumos, ja laul\u012bba vai kopdz\u012bve ir beigusies. Sal\u012bdzin\u0101jum\u0101 ar Latvijas PIL noteikto saist\u012bto personu sarakstu, tas ir piln\u012bg\u0101ks.<\/p>\n<p>M\u0101kslas darbu iepirk\u0161anai Igaunij\u0101 ir atsevi\u0161\u0137s likums, bet tas attiecas tikai uz valsts iest\u0101\u017eu sabiedrisko telpu est\u0113tisko bag\u0101tin\u0101\u0161anu, nevis uz pa\u0161vald\u012bb\u0101m. <\/p>\n<p>Ar\u012b Igaunij\u0101 ir iesp\u0113jams organiz\u0113t centraliz\u0113tas iepirkumu proced\u016bras. Tas noz\u012bm\u0113, ka k\u0101da iest\u0101de var organiz\u0113t iepirkuma proced\u016bru ar\u012b citu (parasti padot\u012bb\u0101 eso\u0161u) iest\u0101\u017eu vajadz\u012bb\u0101m, bet tas nav noteikts oblig\u0101ti.
