Konkurences padome (turpm\u0101k &#8211; KP) prevent\u012bvos nol\u016bkos skaidro, pie k\u0101diem faktiskajiem apst\u0101k\u013ciem var rasties situ\u0101cijas, attiec\u012bb\u0101 uz konkur\u0113jo\u0161u uz\u0146\u0113mumu saska\u0146oti izvirz\u012btiem ierobe\u017eojumiem saviem darbiniekiem, kas var rad\u012bt aizliegtu vieno\u0161anos p\u0101rk\u0101pumu risku, saska\u0146\u0101 ar Latvijas un Eiropas Savien\u012bbas konkurences ties\u012bbu norm\u0101m.<\/p>\n\n\n\n<p>Saska\u0146\u0101 ar Konkurences likuma (turpm\u0101k \u2013 KL) 11.pantu, kas izriet no L\u012bguma par Eiropas Savien\u012bbas darb\u012bbu 101.pantu, ir aizliegtas un kop\u0161 nosl\u0113g\u0161anas br\u012b\u017ea sp\u0113k\u0101 neeso\u0161as tirgus dal\u012bbnieku vieno\u0161an\u0101s, kuru m\u0113r\u0137is vai sekas ir konkurences kav\u0113\u0161ana, ierobe\u017eo\u0161ana vai deform\u0113\u0161ana Latvijas teritorij\u0101. KL 11.pant\u0101 ir min\u0113ti aizliegtu vieno\u0161anos piem\u0113ri, tostarp ir aizliegtas vieno\u0161an\u0101s par tie\u0161u vai netie\u0161u cenu (tai skait\u0101 vieno\u0161an\u0101s par darba algu) vai tarifu noteik\u0161anu jebk\u0101d\u0101 veid\u0101 vai to veido\u0161anas noteikumiem, k\u0101 ar\u012b par t\u0101das inform\u0101cijas apmai\u0146u, kura attiecas uz cen\u0101m vai realiz\u0101cijas noteikumiem un tirgus sadali (tai skait\u0101 darba tirgus sadale), \u0146emot v\u0113r\u0101 teritoriju, pirc\u0113jus, pieg\u0101d\u0101t\u0101jus vai citus nosac\u012bjumus. KL izpratn\u0113 vieno\u0161an\u0101s ir divu vai vair\u0101ku tirgus dal\u012bbnieku l\u012bgums vai saska\u0146ota darb\u012bba, kur\u0101 tirgus dal\u012bbnieki piedal\u0101s, k\u0101 ar\u012b l\u0113mums, ko pie\u0146\u0113musi re\u0123istr\u0113ta vai nere\u0123istr\u0113ta tirgus dal\u012bbnieku apvien\u012bba vai t\u0101s amatpersona. Vieno\u0161an\u0101s var b\u016bt gan rakst\u012btas (ietvertas l\u012bgumos un cita veida savstarp\u0113j\u0101 sazi\u0146\u0101), gan nerakst\u012btas (tostarp mutv\u0101rdos, k\u0101 ar\u012b k\u0101 neform\u0101la vienota izpratne par vieno\u0161anos, saska\u0146otas darb\u012bbas).<\/p>\n\n\n\n<p>Vieno\u0161an\u0101s, kas ir pan\u0101ktas starp neatkar\u012bgiem tirgus dal\u012bbniekiem, kas ir savstarp\u0113ji konkurenti, attiec\u012bb\u0101 uz to darbinieku darb\u0101 pie\u0146em\u0161anas noteikumiem, tiek sauktas ar\u012b par nep\u0101rvilin\u0101\u0161anas&nbsp;<em>(ang. \u201cno-poach\u201d)<\/em>&nbsp;vieno\u0161an\u0101m. Konkr\u0113t\u0101k \u0161\u012bs vieno\u0161an\u0101s nosaka, ka \u0161ie tirgus dal\u012bbnieki nepie\u0146em darb\u0101 viens otra darbiniekus vai saska\u0146o darbiniekiem pied\u0101v\u0101t\u0101 atalgojuma l\u012bmeni. \u0160\u0101das vieno\u0161an\u0101s ierobe\u017eo darbinieku mobilit\u0101ti, k\u0101 ar\u012b liedz tiem sa\u0146emt taisn\u012bgu atalgojumu konkur\u0113tsp\u0113j\u012bg\u0101 tirg\u016b, kas var novest ar\u012b pie t\u0101, ka tiek nodar\u012bts kait\u0113jums darbinieka karjeras m\u0113r\u0137iem un att\u012bst\u012bbai. \u201cNo-poach\u201d vieno\u0161an\u0101s ierobe\u017eo konkurenci, ne\u013caujot darbiniekam sa\u0146emt konkur\u0113jo\u0161us pied\u0101v\u0101jumus no potenci\u0101liem darba dev\u0113jiem un uz\u0146\u0113mumiem konkur\u0113t par b\u016btisku resursu to izaugsmei savstarp\u0113j\u0101s konkurences c\u012b\u0146\u0101. \u0160\u0101du pied\u0101v\u0101jumu esam\u012bbu darbinieks norm\u0101los tirgus apst\u0101k\u013cos var izmantot, lai vienotos par lab\u0101ku atalgojumu, gan no tagad\u0113j\u0101, gan n\u0101kotnes darba dev\u0113ja. Eiropas Savien\u012bbas dal\u012bbvalstu prakse r\u0101da, ka \u0161\u0101da aizliegta vieno\u0161an\u0101s tiek uzskat\u012bta k\u0101 ierobe\u017eojums, kura m\u0113r\u0137is jau ir v\u0113rsts uz konkurences ierobe\u017eo\u0161anu, kas ir smag\u0101kais Konkurences ties\u012bbu p\u0101rk\u0101pums.<\/p>\n\n\n\n<p>\u201cNo-poach\u201d vieno\u0161an\u0101s nedr\u012bkst jaukt ar nekonkur\u0113\u0161anas pien\u0101kuma klauzul\u0101m l\u012bgumos, ko darba dev\u0113ji izmanto, lai aizsarg\u0101tu ieguld\u012bjumus un biznesu, darbiniekam ierobe\u017eojot iesp\u0113jas savstarp\u0113ji nol\u012bgt\u0101 laika period\u0101 p\u0101riet darb\u0101 pie konkurenta. \u0160\u0101das vieno\u0161an\u0101s parasti ir at\u013cautas un regul\u0113tas, piev\u0113r\u0161ot uzman\u012bbu, lai t\u0101s nesam\u0113r\u012bgi neierobe\u017eo personu br\u012bv\u012bbu. Tom\u0113r at\u0161\u0137ir\u012bba ir t\u0101da, ka nekonkur\u0113\u0161anas pien\u0101kuma klauzulas parasti ir ietvertas l\u012bgumos starp darba dev\u0113ju un darba \u0146\u0113m\u0113ju, savuk\u0101rt \u201cno-poach\u201d vieno\u0161an\u0101s parasti ir sl\u0113ptas un past\u0101v starp konkur\u0113jo\u0161iem uz\u0146\u0113mumiem par to darbiniekiem &#8211; \u0161\u0101da prakse ir aizliegta. Tom\u0113r \u0161\u0101das situ\u0101cijas var tikt nov\u0113rstas ar konkurenci regul\u0113jo\u0161o normat\u012bvo aktu pal\u012bdz\u012bbu.<\/p>\n\n\n\n<p>Nov\u0113rojams ir apst\u0101klis, ka \u201cno-poach\u201d vieno\u0161an\u0101s past\u0101v sevi\u0161\u0137i sl\u0113gt\u0101s nozar\u0113s, kur darbinieki ir speci\u0101listi k\u0101d\u0101 nozar\u0113 vai ir apvelt\u012bti ar \u012bpa\u0161iem talantiem, un ir \u013coti ierobe\u017eots skaits \u0161\u0101du darbinieku konkr\u0113taj\u0101 tirg\u016b. Piem\u0113ram, tehnolo\u0123iju nozar\u0113, vesel\u012bbas apr\u016bpes nozar\u0113 u.c. profesion\u0101lo pakalpojumu nozar\u0113s. \u201cNo-poach\u201d vieno\u0161an\u0101s nereti tiek pan\u0101ktas nozaru asoci\u0101ciju ietvaros, kur konkurenti visas nozares l\u012bmen\u012b savstarp\u0113ji vienojas nepie\u0146emt darb\u0101 viens otra darbiniekus un noteikt darbinieku algu l\u012bmeni.
