Lai ar\u012b iepirkums veikts un l\u012bgums sl\u0113gts par lo\u0123istikas pakalpojumu visaptvero\u0161ai p\u0101rtikas pieg\u0101dei NBS vajadz\u012bb\u0101m miera un kr\u012bzes laik\u0101, k\u0101 ar\u012b atsevi\u0161\u0137u p\u0101rtikas produktu grupu rezervju uzglab\u0101\u0161anu, iepirkum\u0101 un l\u012bgum\u0101 nav noteiktas pras\u012bbas par p\u0101rtikas pieg\u0101di un rezervju glab\u0101\u0161anu kr\u012bzes laik\u0101.<\/p>\n\n\n\n<p>VK min, ka pl\u0101not\u0101 l\u012bguma summa l\u012bdz 220 miljoniem eiro ar ties\u012bb\u0101m to palielin\u0101t par 50% l\u012bdz 110 miljoniem eiro, kop\u0113jo maksim\u0101lo l\u012bguma summu paredzot l\u012bdz 330 miljoniem eiro piecos l\u012bguma darb\u012bbas gados, pirmo reizi nor\u0101d\u012bta, iepirkuma komisijai lemjot par l\u012bguma sl\u0113g\u0161anu ar iepirkuma proced\u016bras uzvar\u0113t\u0101ju SIA &#8220;Z\u012btari LZ&#8221;.<\/p>\n\n\n\n<p>L\u012bguma summa noteikta, balstoties iepirkuma komisijas amatpersonas pie\u0146\u0113mumos un ner\u0113\u0137inoties ar centraliz\u0113taj\u0101 iepirkumu pl\u0101n\u0101 paredz\u0113to finans\u0113jumu p\u0101rtikas ieg\u0101d\u0113m 8,02 miljonu eiro apm\u0113r\u0101. Saska\u0146\u0101 ar gr\u0101matved\u012bbas uzskaites datiem no \u0161\u0101 gada 1.janv\u0101ra l\u012bdz 30.apr\u012blim NBS no &#8220;Z\u012btari LZ&#8221; ir sa\u0146\u0113mu\u0161i p\u0101rtikas preces par 992 000 eiro. Par nor\u0101d\u012bto laika posmu NBS ir sa\u0146\u0113mu\u0161i &#8220;Z\u012btari LZ&#8221; r\u0113\u0137inu par sniegt\u0101 pakalpojuma administr\u0113\u0161anu 30 000 eiro apm\u0113r\u0101.<\/p>\n\n\n\n<p>Revidenti nor\u0101da, ka pretendentiem izvirz\u012bt\u0101s minim\u0101l\u0101s pras\u012bbas nesniedz p\u0101rliec\u012bbu par l\u012bguma izpildes iesp\u0113j\u0101m atbilsto\u0161i pas\u016bt\u012bt\u0101ja vajadz\u012bb\u0101m. Iepirkuma komisija nebija paredz\u0113jusi pras\u012bbas pretendentiem attiec\u012bb\u0101 uz industri\u0101lo kapacit\u0101ti p\u0101rtikas pieg\u0101des realiz\u0113\u0161anai, kas demonstr\u0113tu sp\u0113ju nodro\u0161in\u0101t iepirkum\u0101 paredz\u0113to apjom\u012bgo lo\u0123istikas pakalpojumu.<\/p>\n\n\n\n<p>K\u0101 nor\u0101da revidenti, pamatojoties uz nosl\u0113gto l\u012bgumu, patlaban p\u0101rtikas preces NBS tiek pieg\u0101d\u0101tas, p\u0101rk\u0101pjot Publisko iepirkumu likumu un Publiskas personas finan\u0161u l\u012bdzek\u013cu un mantas iz\u0161\u0137\u0113rd\u0113\u0161anas nov\u0113r\u0161anas likumu. T\u0101 k\u0101 uz lo\u0123istikas pakalpojumu attiecin\u0101m\u0101s iepirkuma priek\u0161meta izmaksas neveido finansi\u0101li liel\u0101ko l\u012bguma da\u013cu un ir iev\u0113rojami maz\u0101kas nek\u0101 l\u012bgum\u0101 paredz\u0113t\u0101s p\u0101rtikas pieg\u0101des izmaksas, iepirkuma l\u012bguma galvenais priek\u0161mets ir p\u0101rtikas pre\u010du pieg\u0101de, nevis lo\u0123istikas pakalpojums. Ta\u010du p\u0101rtikas saimnieciskais izdev\u012bgums konkr\u0113taj\u0101 iepirkum\u0101 neesot v\u0113rt\u0113ts.<\/p>\n\n\n\n<p>Iepirkuma komisija k\u0101 da\u013cu no lo\u0123istikas pakalpojuma par p\u0101rtikas ieg\u0101di NBS vajadz\u012bb\u0101m iepirkuma paredz\u0113ja e-platformas izstr\u0101di. \u0160\u0101da digit\u0101la r\u012bka izstr\u0101de p\u0101rtikas ieg\u0101dei NBS vajadz\u012bb\u0101m nav bijusi paredz\u0113ta nevien\u0101 aizsardz\u012bbas resora un NBS att\u012bst\u012bbas pl\u0101no\u0161anas dokument\u0101 un nav v\u0113rt\u0113ta ar\u012b NBS nodro\u0161in\u0101juma un apg\u0101des sist\u0113mas kontekst\u0101, konstat\u0113jusi VK.<\/p>\n\n\n\n<p>Neesot ar\u012b v\u0113rt\u0113tas alternat\u012bvas \u0161\u0101du digit\u0101lu r\u012bku veidot un uztur\u0113t aizsardz\u012bbas resora ietvaros, k\u0101 ar\u012b nav v\u0113rt\u0113ti riski un ieguvumi saist\u012bb\u0101 ar \u0161\u0101da digit\u0101la r\u012bka izveidi un uztur\u0113\u0161anu komersanta p\u0101rzi\u0146\u0101. Lai ar\u012b iepirkuma un l\u012bguma izpratn\u0113 sekm\u012bga e-platformas darb\u012bba ir b\u016btisks priek\u0161noteikums lo\u0123istikas pakalpojuma par p\u0101rtikas pieg\u0101di snieg\u0161anai, &#8220;Z\u012btari LZ&#8221; piesaist\u012btais komersants e-platformas izstr\u0101dei iepirkum\u0101 nav v\u0113rt\u0113ts k\u0101 apak\u0161uz\u0146\u0113m\u0113js un nav izmantotas publisko iepirkumu likum\u0101 paredz\u0113t\u0101s ties\u012bbas iepirkuma l\u012bgum\u0101 noteikt tiesisk\u0101s attiec\u012bbas ar e-platformas izstr\u0101d\u0101t\u0101ju, t\u0101 nodro\u0161inoties, ka bez NBS saska\u0146ojuma nav iesp\u0113jama apak\u0161uz\u0146\u0113m\u0113ja nomai\u0146a.<\/p>\n\n\n\n<p>Uzvar\u0113ju\u0161ajam pakalpojuma sniedz\u0113jam ar l\u012bgumu p\u0113c b\u016bt\u012bbas dele\u0123\u0113ti valsts amatperson\u0101m rakstur\u012bgi uzdevumi. Proti, p\u0101rtikas pieg\u0101des lo\u0123istikas pakalpojuma sniedz\u0113jam pie\u0161\u0137irtas ties\u012bbas veikt cenu aptaujas, lai noteiktu tos p\u0101rtikas ra\u017eot\u0101jus un pieg\u0101d\u0101t\u0101jus, kas nodro\u0161ina NBS p\u0101rtikas vajadz\u012bbas. T\u0101d\u0113j\u0101di pakalpojuma sniedz\u0113jam ar l\u012bgumu p\u0113c b\u016bt\u012bbas dele\u0123\u0113ti valsts amatperson\u0101m rakstur\u012bgi un ar iepirkumu veik\u0161anu saist\u012bti valsts p\u0101rvaldes uzdevumi, p\u0101rk\u0101pjot likum\u0101 noteikto, ka priv\u0101tpersonai administrat\u012bvo aktu izdo\u0161anu var dele\u0123\u0113t tikai tad, ja tas paredz\u0113ts \u0101r\u0113j\u0101 normat\u012bvaj\u0101 akt\u0101, un ne\u0146emot v\u0113r\u0101, ka komersants neatbilst pas\u016bt\u012bt\u0101ja defin\u012bcijai publisko iepirkumu likuma izpratn\u0113.<\/p>\n\n\n\n<p>Lai ar\u012b l\u012bgum\u0101 paredz\u0113ts, ka pakalpojuma sniedz\u0113js mekl\u0113 p\u0113c iesp\u0113jas vair\u0101k pieg\u0101d\u0101t\u0101ju, nodro\u0161inot p\u0113c iesp\u0113jas liel\u0101ku konkurenci zem\u0101k\u0101s cenas ieg\u016b\u0161anai, tom\u0113r atl\u012bdz\u012bba par lo\u0123istikas pakalpojuma snieg\u0161anu ir tie\u0161i atkar\u012bga no pieg\u0101d\u0101t\u0101s p\u0101rtikas produktu v\u0113rt\u012bbas.<\/p>\n\n\n\n<p>Revidenti ar\u012b secin\u0101ju\u0161i, ka &#8220;Z\u012btari LZ&#8221; bija izsl\u0113dzama no turpm\u0101kas dal\u012bbas iepirkum\u0101 jau konkursa dialoga pirmaj\u0101 k\u0101rt\u0101, jo t\u0101 neatbilda konkursa nolikum\u0101 noteiktaj\u0101m pras\u012bb\u0101m par pieredzi lo\u0123istikas pakalpojumu snieg\u0161an\u0101. Konkursa dialoga nosl\u0113dzo\u0161aj\u0101 k\u0101rt\u0101 iepirkuma komisija nav ar\u012b v\u0113rt\u0113jusi, vai &#8220;Z\u012btari LZ&#8221; iesniegtais pied\u0101v\u0101jums nav nepamatoti l\u0113ts un l\u012bdz ar to noraid\u0101ms, jo &#8220;Z\u012btari LZ&#8221; pied\u0101v\u0101t\u0101s administr\u0113\u0161anas un rezervju uzglab\u0101\u0161anas maksas bija aptuveni 40 reizes zem\u0101kas nek\u0101 otra pretendenta pied\u0101v\u0101t\u0101s. Neskatoties uz min\u0113to, iepirkuma komisija komersantu atzina par konkursa uzvar\u0113t\u0101ju un tam ir pie\u0161\u0137irtas l\u012bguma sl\u0113g\u0161anas ties\u012bbas.<\/p>\n\n\n\n<p>VK nor\u0101da, ka iepirkuma gait\u0101 nebija nodefin\u0113tas pras\u012bbas p\u0101rtikas apg\u0101dei kr\u012bzes laik\u0101 un p\u0101rtikas rezervju veido\u0161anai &#8211; \u0161\u0101dus risin\u0101jumus paredz\u0113ts mekl\u0113t sadarb\u012bb\u0101 ar komersantu l\u012bguma izpildes gait\u0101, sl\u0113dzot papildu vieno\u0161anos. \u0145emot v\u0113r\u0101 to, ka p\u0101rtikas pieg\u0101des dro\u0161\u012bbas pras\u012bbas ir tie\u0161i saist\u012btas ar nacion\u0101l\u0101s dro\u0161\u012bbas interes\u0113m, \u0161\u0101du iepirkumu un l\u012bgumu sl\u0113g\u0161anai bija j\u0101nosaka \u012bpa\u0161i nosac\u012bjumi, ta\u010du pretendentu atbilst\u012bba nacion\u0101l\u0101s dro\u0161\u012bbas interes\u0113m netika izv\u0113rt\u0113ta.<\/p>\n\n\n\n<p>Rev\u012bzij\u0101 nav rasts pamatojums, k\u0101p\u0113c lo\u0123istikas pakalpojums par p\u0101rtikas pieg\u0101di NBS vajadz\u012bb\u0101m tika iepirkts, piem\u0113rojot konkursa dialoga proced\u016bru. Konkursa dialoga ietvaros netika ieg\u016bti inovat\u012bvi risin\u0101jumi un specifiskas konkursa dialoga dal\u012bbnieku zin\u0101\u0161anas, kas pal\u012bdz\u0113tu izstr\u0101d\u0101t pas\u016bt\u012bt\u0101ja vajadz\u012bb\u0101m atbilsto\u0161u risin\u0101jumu. Netika ar\u012b risin\u0101ti sare\u017e\u0123\u012bti, ar iepirkuma juridisko vai finansi\u0101lo strukt\u016bru saist\u012bti jaut\u0101jumi, kas ir priek\u0161noteikums konkursa dialoga proced\u016bras piem\u0113ro\u0161anai.<\/p>\n\n\n\n<p>&#8220;Iepirkuma dokument\u0101cija liecina, ka iepirkuma pras\u012bbas bija nodefin\u0113tas pirms konkursa dialoga un konkursa dialogs galvenok\u0101rt noz\u012bm\u0113ja iepirkuma pras\u012bbu skaidro\u0161anu t\u0101 dal\u012bbniekiem, k\u0101 ar\u012b atteik\u0161anos no pras\u012bb\u0101m, kas demonstr\u0113tu pretendentu sp\u0113ju nodro\u0161in\u0101t iepirkum\u0101 paredz\u0113to apjom\u012bgo lo\u0123istikas pakalpojumu,&#8221; skaidro Jaunzeme.<\/p>\n\n\n\n<p>Lai gan iepirkums bija strat\u0113\u0123iski noz\u012bm\u012bgs un AM inici\u0113ts, rev\u012bzij\u0101 nav g\u016bti pier\u0101d\u012bjumi, ka AM atbild\u012bg\u0101s amatpersonas b\u016btu sekoju\u0161as l\u012bdzi iepirkuma \u012bsteno\u0161anas gaitai un savlaic\u012bgi veiku\u0161as kori\u0123\u0113jo\u0161as darb\u012bbas, lai nepie\u013cautu likumam un nacion\u0101l\u0101s dro\u0161\u012bbas interes\u0113m neatbilsto\u0161a l\u012bguma nosl\u0113g\u0161anu. NBS Apvienotajam \u0161t\u0101bam k\u0101 NBS komandiera izpildinstit\u016bcijai ar\u012b nebija \u0161\u0137\u0113r\u0161\u013cu, lai iepirkuma gait\u0101 un l\u012bdz l\u012bguma nosl\u0113g\u0161anai g\u0101d\u0101tu par normat\u012bvajiem aktiem atbilsto\u0161u NBS p\u0101rtikas vajadz\u012bbu nodro\u0161in\u0101\u0161anu, ta\u010du tas netika dar\u012bts.<\/p>\n\n\n\n<p>VK v\u0113rt\u0113jum\u0101, ir maza varb\u016bt\u012bba, ka AM un NBS vado\u0161\u0101m amatperson\u0101m nebija inform\u0101cijas par iepirkum\u0101 un l\u012bgum\u0101 paredz\u0113to lo\u0123istikas risin\u0101jumu p\u0101rtikas pieg\u0101dei NBS vajadz\u012bb\u0101m.<\/p>\n\n\n\n<p>Vienlaikus VK atg\u0101dina, ka jaun\u0101 p\u0101rtikas iepirkuma mode\u013ca pl\u0101no\u0161ana norisin\u0101j\u0101s ar aizsardz\u012bbas ministra pav\u0113l\u0113m izveidot\u0101s aizsardz\u012bbas resora darba grup\u0101s, kuru uzdevums bija ar\u012b sagatavot detaliz\u0113tas jaun\u0101 p\u0101rtikas iepirkuma mode\u013ca gala pras\u012bbas un iesniegt t\u0101s Valsts aizsardz\u012bbas un lo\u0123istikas iepirkumu centram iepirkuma proced\u016bras s\u0101k\u0161anai. Lai ar\u012b tobr\u012bd aizsardz\u012bbas resor\u0101 sp\u0113k\u0101 eso\u0161ais regul\u0113jums paredz\u0113ja aizsardz\u012bbas ministram ties\u012bbas noteikt citu materi\u0101ltehnisko l\u012bdzek\u013cu vai pakalpojumu iepirkumu organiz\u0113\u0161anas k\u0101rt\u012bbu, tom\u0113r, izce\u013cot iepirkumu no visp\u0101r\u0113j\u0101 aizsardz\u012bbas resor\u0101 noteikt\u0101 regul\u0113juma iepirkumu pl\u0101no\u0161anai un organiz\u0113\u0161anai, netika noteiktas pras\u012bbas konkr\u0113t\u0101 iepirkuma \u012bsteno\u0161anai.<\/p>\n\n\n\n<p>Iepirkums veikts no 2021.gada 18.oktobra l\u012bdz 2022.gada 22.novembrim, l\u012bgumu NBS nodro\u0161in\u0101juma pav\u0113lniec\u012bba k\u0101 pas\u016bt\u012bt\u0101js parakst\u012bjusi pag\u0101ju\u0161\u0101 gada 20.decembr\u012b.<\/p>\n\n\n\n<p>Saska\u0146\u0101 ar AM publiski sniegto inform\u0101ciju ar iepirkumu un nosl\u0113gto l\u012bgumu saist\u012btie dokumenti ir iesniegti ties\u012bbaizsardz\u012bbas iest\u0101d\u0113m izv\u0113rt\u0113\u0161anai, Korupcijas nov\u0113r\u0161anas un apkaro\u0161anas birojs ir uzs\u0101cis krimin\u0101lprocesu. Saist\u012bb\u0101 ar NBS p\u0101rtikas iepirkumu AM veiktas dienesta p\u0101rbaudes, kur\u0101s sagatavoti vair\u0101ki zi\u0146ojumi un turpin\u0101s amatpersonu atbild\u012bbas izv\u0113rt\u0113\u0161ana.<\/p>\n\n\n\n<p>Revidenti nor\u0101da &#8211; aizsardz\u012bbas resor\u0101 iepirkumu pl\u0101no\u0161ana ar aizsardz\u012bbas ministra pav\u0113l\u0113m veidot\u0101s darba grup\u0101s nav ierasta prakse. Jaunzeme nor\u0101da, ka iepirkuma rezult\u0101ts ir likumsakar\u012bgs izn\u0101kums tam, ka nav iev\u0113rots aizsardz\u012bbas resor\u0101 noteikt\u0101s daudzpak\u0101pju iepirkuma pl\u0101no\u0161anas un \u012bsteno\u0161anas regul\u0113jums.
