Tie ir cilv\u0113ki, kuri visakt\u012bv\u0101k apmekl\u0113 semin\u0101rus par publisko iepirkumu tematiem, lasa visas Iepirkumu uzraudz\u012bbas biroja (IUB) sagatavot\u0101s vadl\u012bnijas, ieteikumus, skaidrojumus, patst\u0101v\u012bgi stud\u0113 ties\u012bbu aktus, precedentus un j\u0101atz\u012bst, ka liela da\u013ca no vi\u0146iem publisko iepirkumu jom\u0101 ir dom\u0101jo\u0161i cilv\u0113ki, kas sasniegu\u0161i \u013coti augstu profesionalit\u0101tes l\u012bmeni. <\/strong><\/p>\n<p>Tom\u0113r ar zin\u0101\u0161an\u0101m, pieredzi, sp\u0113j\u0101m un prasm\u0113m ir par maz, lai iepirkuma process, par kuru iepirkuma komisija ir piln\u012bb\u0101 atbild\u012bga, nosl\u0113gtos sekm\u012bgi, neradot liekas probl\u0113mas nevienai no paredzam\u0101 l\u012bguma sl\u0113dz\u0113ju pus\u0113m. L\u012bdz\u0101s iek\u0161\u0113jiem probl\u0113mas ietekm\u0113jo\u0161iem faktoriem (k\u013c\u016bdas, cilv\u0113kresursi, intere\u0161u sadursmes u. c.) past\u0101v ar\u012b virkne \u0101r\u0113jo faktoru, kurus ne pas\u016bt\u012bt\u0101js, ne iepirkuma komisijas locek\u013ci nav sp\u0113j\u012bgi ietekm\u0113t. <\/p>\n<p>Protams, ka pas\u016bt\u012bt\u0101ja izveidot\u0101s iepirkuma komisijas galven\u0101 probl\u0113ma ir s\u016bdz\u012bbas \u2013 gan t\u0101s, kuras ir pamatotas, gan t\u0101s, kuras nav objekt\u012bvi pamatotas. Cilv\u0113kiem no malas parasti \u0161\u0137iet, ka galvenie s\u016bdz\u012bbu c\u0113lo\u0146i ir pas\u016bt\u012bt\u0101ja administr\u0101cijas negod\u012bga r\u012bc\u012bba vai ar\u012b iepirkumu komisijas nekompetence un k\u013c\u016bdas. T\u0101 to parasti m\u0113dz pasniegt publisko iepirkumu trib\u012bnes akt\u012bv\u0101kie person\u0101\u017ei, bet \u012bsten\u012bb\u0101 s\u016bdz\u012bbu c\u0113lo\u0146i mekl\u0113jami vair\u0101k nek\u0101 desmit gadu laik\u0101 veidotaj\u0101 publisko iepirkumu sist\u0113m\u0101.<\/p>\n<p>Sen bija laiks nov\u0113rst t\u0101du s\u016bdz\u012bbu iesnieg\u0161anu, kuras tiek gatavotas ar m\u0113r\u0137i at\u0146emt l\u012bguma sl\u0113g\u0161anas ties\u012bbas, vai ar\u012b t\u0101das, kuras iesniegtas ar m\u0113r\u0137i piev\u0113rst sev uzman\u012bbu. Pieredz\u0113ju\u0161ie iesniedz\u0113ji veikli manipul\u0113 ar IUB sagatavotaj\u0101m Publisko iepirkumu likuma interpret\u0101cij\u0101m, apzin\u012bgajiem censo\u0146iem sag\u0101d\u0101jot arvien jaunus nepat\u012bkamus p\u0101rsteigumus. Lai IUB iesniegumu komisijas locek\u013ci sp\u0113tu identific\u0113t \u0161\u0101dus gad\u012bjumus, nepiecie\u0161ama ne tikai pieredze iesniegumu izskat\u012b\u0161an\u0101, bet ar\u012b laba izpratne par iesaist\u012bto personu r\u012bc\u012bbas mot\u012bviem. To nek\u0101d\u0101 veid\u0101 nesekm\u0113 pa\u0101trin\u0101t\u0101 kadru main\u012bba, kas, neraugoties uz sal\u012bdzino\u0161i piekl\u0101j\u012bgo atalgojumu, desmit gadu laik\u0101 jau p\u0101rsniegusi 200 procentus.<br \/>\n<!--more--><br \/>\nInform\u0101cija par katru iesniegto s\u016bdz\u012bbu tiek public\u0113ta, un katrs \u0161\u0101ds gad\u012bjums attiec\u012bg\u0101s iest\u0101des vad\u012bbai ce\u013c publisku neslavu, jo t\u0101 tiek uzl\u016bkota k\u0101 aizdom\u0101s turam\u0101 par Publisko iepirkumu likuma p\u0101rk\u0101pumu. <\/p>\n<p>Atverot un ar izpratni izlasot IUB pie\u0146emtos l\u0113mumus, kuri ir br\u012bvi pieejami min\u0113t\u0101s iest\u0101des m\u0101jaslap\u0101, redzams, ka teju ikvien\u0101 gad\u012bjum\u0101 da\u013c\u0113ja taisn\u012bba ir katrai no iesaist\u012btaj\u0101m pus\u0113m, un svaru kausu par labu vienai no t\u0101m nosver IUB izveidot\u0101 iesniegumu izskat\u012b\u0161anas komisija. Ik reizi, kad pas\u016bt\u012bt\u0101ja l\u0113mums par noteikto uzvar\u0113t\u0101ju tiek atz\u012bts par nepamatotu, b\u016btu konstat\u0113jams konkr\u0113ts p\u0101rk\u0101pums, kura nov\u0113r\u0161anai turpm\u0101kaj\u0101 iepirkuma komisijas darb\u012bb\u0101 b\u016btu j\u0101sniedz izsme\u013co\u0161as un nep\u0101rprotamas rekomend\u0101cijas. \u0160\u0101du rekomend\u0101ciju nav, un tam ir b\u016btiski iemesli. Pirmk\u0101rt, to neparedz Publisko iepirkumu likums un, otrk\u0101rt, IUB nav no t\u0101m iest\u0101d\u0113m, kura pati labpr\u0101t\u012bgi var\u0113tu sev nosl\u0113gt atk\u0101p\u0161an\u0101s ce\u013cus l\u0113mumu pie\u0146em\u0161an\u0101.<\/p>\n<p>Nevi\u013cus rodas jaut\u0101jums: vai tie\u0161\u0101m IUB darbinieku subjekt\u012bvi pie\u0146emtie l\u0113mumi var b\u016bt taisn\u012bg\u0101ki par iepirkuma komisijas pie\u0146emtajiem l\u0113mumiem?! Ar ko \u0161ie ier\u0113d\u0146i, kuri pa\u0161i nekad nav organiz\u0113ju\u0161i nevienu iepirkuma proced\u016bru, ir pier\u0101d\u012bju\u0161i liel\u0101ku kompetenci? Ar to, ka k\u0101du laiku ir nostr\u0101d\u0101ju\u0161i IUB? Manupr\u0101t, tas nav nedz god\u012bgi, nedz taisn\u012bgi, nedz ar\u012b k\u0101 cit\u0101di objekt\u012bvi pamatoti.<\/p>\n<p>Papildus jau eso\u0161aj\u0101m probl\u0113m\u0101m saist\u012bb\u0101 ar s\u016bdz\u012bb\u0101m IUB, 1. septembr\u012b st\u0101ju\u0161ies sp\u0113k\u0101 groz\u012bjumi Latvijas Administrat\u012bvo p\u0101rk\u0101pumu kodeks\u0101, ar ko tiek noteikts, ka par administrat\u012bvajiem p\u0101rk\u0101pumiem publisko iepirkumu liet\u0101s Iepirkumu uzraudz\u012bbas birojs uzliek sodu. Atkar\u012bb\u0101 no p\u0101rk\u0101puma veida \u2013 tas ir br\u012bdin\u0101jums vai naudas sods, atsevi\u0161\u0137os gad\u012bjumos at\u0146emot ar\u012b ties\u012bbas ie\u0146emt valsts amatpersonas amatus. <\/p>\n<p>Saprotams, ka par likuma p\u0101rk\u0101pumiem vain\u012bg\u0101s personas jeb apzin\u0101ti \u013caunpr\u0101t\u012bgas darb\u012bbas veic\u0113ji b\u016btu j\u0101soda, bet min\u0113to darb\u012bbu nov\u0113rt\u0113jumam un sodu piem\u0113ro\u0161anai ir j\u0101b\u016bt objekt\u012bvi pamatotai. Ja gad\u012bjums par savlaic\u012bgi nepublic\u0113tu pazi\u0146ojumu ir viegli identific\u0113jams, tad intere\u0161u konfliktu gad\u012bjumi p\u0113c b\u016bt\u012bbas t\u0101di nav. Nav ar\u012b saprotams, k\u0101 tiks noteikts p\u0101rk\u0101pums attiec\u012bb\u0101 uz sam\u0113r\u0101 visp\u0101r\u012bgu atlases pras\u012bbu neiev\u0113ro\u0161anu vai pied\u0101v\u0101jumu v\u0113rt\u0113\u0161anu divdom\u012bgu tehnisko specifik\u0101ciju gad\u012bjum\u0101. Tad v\u0113l da\u017e\u0101d\u0101s situ\u0101cijas t\u0101 saukt\u0101s <em>nepamatoti zem\u0101s cenas (abnormally low prices)<\/em> identific\u0113\u0161anas gad\u012bjum\u0101. K\u0101da iepirkuma komisijas r\u012bc\u012bba tiks nov\u0113rt\u0113ta k\u0101 pareiza, ja nevienam no komisijas locek\u013ciem nav radu\u0161\u0101s ne maz\u0101k\u0101s \u0161aubas par pied\u0101v\u0101t\u0101s cenas pamatot\u012bbu? Vai tie\u0161\u0101m ir j\u0101ap\u0161auba ikviena cena, kura nav nesam\u0113r\u012bgi augsta?<\/p>\n<p>Publisko iepirkumu process Latvij\u0101 t\u0101pat k\u0101 vis\u0101 Eiropas Savien\u012bb\u0101 (ES) p\u0113d\u0113jo desmit gadu laik\u0101 ir publiski pieejams, un ikviens pietiekami motiv\u0113ts interesents var sekot iepirkuma procesa notikumu gaitai un izdar\u012bt attiec\u012bgus secin\u0101jumus, protams, ar nosac\u012bjumu, ka vi\u0146am ir pietiekami laba izpratne par procesiem, kas tur notiek.<br \/>\nTie, kuriem \u0161\u0101da izpratne jau ir izveidojusies, saprot, ka Latvijas publisko iepirkumu sist\u0113ma \u0161\u0101d\u0101 form\u0101, k\u0101da t\u0101 ir \u0161obr\u012bd, ilgi vairs nevar past\u0101v\u0113t. To ir nepiecie\u0161ams reorganiz\u0113t un, manupr\u0101t, nekas jauns nav j\u0101izgudro, bet j\u0101m\u0101c\u0101s no citu valstu pieredzes, kuras nep\u0101rsp\u012bl\u0113 ar publisko iepirkumu direkt\u012bv\u0101s noteikto ties\u012bbu normu ievie\u0161anu viet\u0113j\u0101 l\u012bme\u0146a likumos.<\/p>\n<p><strong>Liel\u0101ku patst\u0101v\u012bbu re\u0123ioniem!<\/strong><\/p>\n<p>\u0160obr\u012bd ir pien\u0101cis \u012bstais br\u012bdis publisko iepirkumu proces\u0101 liel\u0101ku patst\u0101v\u012bbu pie\u0161\u0137irt re\u0123ioniem. Tiem, kuru izpratn\u0113 pa\u0161vald\u012bbas ir Lembergs vien\u0101 person\u0101 un U\u0161akovs kop\u0101 ar Ameriku \u2013 otr\u0101, un liel\u0101ka patst\u0101v\u012bba noz\u012bm\u0113tu min\u0113taj\u0101m person\u0101m pie\u0161\u0137irt pavisam lielu patva\u013cu, paskaidroju, ka tas nav \u0161\u012b ierosin\u0101juma m\u0113r\u0137is. <\/p>\n<p>Publisko iepirkumu likum\u0101 vajadz\u0113tu atjaunot 2004\/18\/EK noteikto normu par to, ka rezult\u0101tu pazi\u0146ojuma formu pas\u016bt\u012bt\u0101js nos\u016bta public\u0113\u0161anai ne v\u0113l\u0101k k\u0101 48 dienu laik\u0101 p\u0113c l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anas (l\u0113muma pie\u0146em\u0161anas vai pat \u2013 l\u012bguma nosl\u0113g\u0161anas). Pirms tam, protams, triju dienu laik\u0101 p\u0113c l\u0113muma pie\u0146em\u0161anas visiem pretendentiem tiek pazi\u0146ots par iepirkuma proced\u016bras rezult\u0101tiem, un pirms l\u012bguma nosl\u0113g\u0161anas tiek ar\u012b iev\u0113rots desmit dienu nogaid\u012b\u0161anas termi\u0146\u0161, bet public\u0113ts tiek tikai piln\u012bgi p\u0101rdom\u0101ts un pabeigts Pazi\u0146ojums par l\u012bguma sl\u0113g\u0161anas ties\u012bbu pie\u0161\u0137ir\u0161anu. <\/p>\n<p>Gad\u012bjum\u0101, ja k\u0101dam no pretendentiem rodas iebildumi, vispirms tam j\u0101v\u0113r\u0161as pie pa\u0161a pas\u016bt\u012bt\u0101ja vai iest\u0101d\u0113, kura ir n\u0101kam\u0101 l\u012bme\u0146a augst\u0101ka iest\u0101de attiec\u012bb\u0101 pret pas\u016bt\u012bt\u0101ju. Ja iepirkuma proces\u0101 radu\u0161\u0101s k\u013c\u016bdas, t\u0101s tiek izlabotas.<\/p>\n<p>Savuk\u0101rt, ja probl\u0113mu nav iesp\u0113jams atrisin\u0101t bez liel\u0101ku kompeten\u010du nes\u0113ju piesaist\u012b\u0161anas, s\u016bdz\u012bba tiek iesniegta pirm\u0101 l\u012bme\u0146a tiesu instanc\u0113 vai attiec\u012bg\u0101 re\u0123iona l\u012bdzv\u0113rt\u012bg\u0101 iest\u0101d\u0113. Publisko iepirkumu s\u016bdz\u012bbas j\u0101izskata pa\u0101trin\u0101t\u0101 k\u0101rt\u012bb\u0101, t. i., 30 dienu laik\u0101. Gad\u012bjum\u0101, ja likuma p\u0101rk\u0101pums ir konstat\u0113ts un tas var b\u016btiski ietekm\u0113t iepirkuma proced\u016bras rezult\u0101tus, ar tiesas spriedumu iesp\u0113jams atcelt ar\u012b jau nosl\u0113gtu l\u012bgumu. L\u012bdz ar to nogaid\u012b\u0161anas termi\u0146a atskaites diena \u2013 pazi\u0146ojumu nos\u016bt\u012b\u0161ana pretendentiem \u2013 ir pa\u0161saprotama un pie\u0146emama. <\/p>\n<p>\u0160obr\u012bd Latvij\u0101 izveidot\u0101 publisko iepirkumu sist\u0113ma sav\u0101 zi\u0146\u0101 ir unik\u0101la. Pirmk\u0101rt, nav saprotams, k\u0101d\u0101 status\u0101 saska\u0146\u0101 ar ES ties\u012bbu aktiem ir vien\u012bg\u0101 publiskos iepirkumus uzraugo\u0161\u0101 iest\u0101de IUB. Lai gan iepirkumu sludin\u0101jumu formas rind\u0101, kur\u0101 j\u0101nor\u0101da par p\u0101rs\u016bdz\u012bb\u0101m atbild\u012bga iest\u0101de, IUB nor\u0101da sevi, \u0161\u0101ds statuss neb\u016bt neizriet no p\u0101rskat\u012b\u0161anas proced\u016bru efektivit\u0101tes uzlabo\u0161anas Direkt\u012bvas 2007\/66\/EK, kur\u0101 noteikt\u0101s normas esot piln\u012bb\u0101 ieviestas Publisko iepirkumu likum\u0101. <\/p>\n<p>Ir ac\u012bmredzami, ka IUB izveidot\u0101s iesniegumu izskat\u012b\u0161anas komisijas locek\u013ciem izvirz\u012bt\u0101s pras\u012bbas nav tik augstas, lai \u0161o personu statusu var\u0113tu piel\u012bdzin\u0101t tiesne\u0161u statusam (sk. Direkt\u012bvas 2007\/66\/EK 2. panta 9. punkta otro rindkopu). <\/p>\n<p>IUB ir kaut kas pa vidu starp pas\u016bt\u012bt\u0101ju un tiesu, turkl\u0101t ar likum\u012bg\u0101m  ties\u012bb\u0101m veikt starpniec\u012bbai l\u012bdzv\u0113rt\u012bgas funkcijas (konsult\u0101cijas, semin\u0101ri vis\u0101m iesaist\u012btaj\u0101m pus\u0113m). \u0160o divdom\u012bgo situ\u0101ciju iesp\u0113jams nov\u0113rst, veicot nelielas korekcijas iest\u0101\u017eu funkciju p\u0101rdal\u0113.<\/p>\n<p>K\u0101ds b\u016btu labums no sist\u0113mas reorganiz\u0101cijas?<br \/>\nPirmk\u0101rt, tiktu nov\u0113rstas aizdomas par IUB ieinteres\u0113t\u012bbu atsevi\u0161\u0137u l\u0113mumu pie\u0146em\u0161an\u0101. Birojs var\u0113tu vair\u0101k piev\u0113rsties Publik\u0101ciju vad\u012bbas sist\u0113mas (PVS) darb\u012bbas uzlabo\u0161anai un sadarb\u012bb\u0101 ar kompeten\u010du centriem re\u0123ionos vair\u0101k resursu velt\u012bt sabiedr\u012bbas izgl\u012bto\u0161anai par publisko iepirkumu tematiem. <\/p>\n<p>Otrk\u0101rt, pa\u0161vald\u012bb\u0101m bez liekas sabiedr\u012bbas uzman\u012bbas rastos lab\u0101kas iesp\u0113jas atbalst\u012bt viet\u0113jos zemniekus, mazinot no cit\u0101m valst\u012bm, piem\u0113ram, no Polijas ievesto l\u0113t\u0101ko aug\u013cu un d\u0101rze\u0146u pieg\u0101des pl\u016bsmas pa\u0161vald\u012bbas iest\u0101d\u0113m. <\/p>\n<p>Tre\u0161k\u0101rt, uzlabotos Latvijas reput\u0101cija. Publisko iepirkumu skand\u0101li pat tad, ja izr\u0101d\u0101s, ka ir biju\u0161i d\u016bmi bez uguns, atskan t\u0101lu aiz Latvijas robe\u017e\u0101m. Tas negat\u012bvi ietekm\u0113 ar\u012b imigr\u0113jo\u0161o tautie\u0161u l\u0113mumu pie\u0146em\u0161anu par atgrie\u0161anos dzimten\u0113. <\/p>\n<p>Ceturtk\u0101rt, mazin\u0101tos centraliz\u0113t\u0101s korupcijas riski, kuri ir gr\u016bt\u0101k nov\u0113r\u0161ami valsts un pa\u0161vald\u012bbu iest\u0101\u017eu hierarhijas d\u0113\u013c.
