Vienlaikus dar\u012bjums palielin\u0101tu RIMI tirgus varu iepirkumu tirg\u016b Latvij\u0101, no pieg\u0101d\u0101t\u0101jiem ieg\u016bstot v\u0113l izdev\u012bg\u0101kus nosac\u012bjumus nek\u0101 konkurenti. T\u0101pat KP secin\u0101ja, ka dar\u012bjums v\u0113l vair\u0101k samazin\u0101tu konkurentu iesp\u0113jas ilgtermi\u0146\u0101 izdar\u012bt efekt\u012bvu konkurences spiedienu un l\u012bdz ar to ar\u012b pat\u0113r\u0113t\u0101ju izv\u0113les iesp\u0113jas. \u0145emot v\u0113r\u0101 b\u016btisko konkurences samazin\u0101jumu dar\u012bjuma izv\u0113rt\u0113\u0161anas laik\u0101 identific\u0113tajos tirgos, KP l\u0113ma par dar\u012bjuma aizlieg\u0161anu.<\/p>\n\n\n\n<p>K\u0101 dar\u012bjum\u0101 ietekm\u0113tais tirgus tika noteikti ikdienas pat\u0113ri\u0146a pre\u010du mazumtirdzniec\u012bbas veikali, kuru tirdzniec\u012bbas telpas plat\u012bba ir virs 600 m2 un kas sav\u0101s telp\u0101s sp\u0113j nodro\u0161in\u0101t vismaz 6000 sortimenta vien\u012bbu m\u0113nes\u012b. Dar\u012bjuma izv\u0113rt\u0113\u0161anas laik\u0101 KP vad\u012bj\u0101s p\u0113c Eiropas prakses \u0123eogr\u0101fisk\u0101 tirgus noteik\u0161an\u0101, to nosakot 13 min\u016b\u0161u brauciena laika att\u0101lum\u0101 (izohron\u0101) ap \u201cDOMINA Shopping\u201d. Tirgus da\u013cu noteik\u0161anai konkr\u0113taj\u0101 tirg\u016b (13 min\u016b\u0161u brauciena att\u0101lum\u0101) tika iek\u013cauti 62 ikdienas pat\u0113ri\u0146a pre\u010du mazumtirdzniec\u012bbas veikali, taj\u0101 skait\u0101 veikali, kas atrodas multifunkcion\u0101lajos iepirk\u0161an\u0101s centros. 2017. gad\u0101 RIMI atrad\u0101s septi\u0146os no desmit multifunkcion\u0101lajiem iepirk\u0161an\u0101s centriem konkr\u0113taj\u0101 tirg\u016b. Lai ar\u012b SIA \u201cMAXIMA Latvija\u201d ir uzskat\u0101ms par tuv\u0101ko RIMI konkurentu, apvieno\u0161an\u0101s dar\u012bjuma izv\u0113rt\u0113\u0161anas laik\u0101 uz\u0146\u0113mumam konkr\u0113taj\u0101 tirg\u016b bija iev\u0113rojami maz\u0101ka tirgus da\u013ca nek\u0101 RIMI.<\/p>\n\n\n\n<p>SIA \u201cPlesko Real Estate\u201d KP 2017. gada l\u0113mumu p\u0101rs\u016bdz\u0113ja ties\u0101. Administrat\u012bv\u0101 apgabaltiesa \u0161.g. 10. mart\u0101 pie\u0146\u0113ma spriedumu, ar kuru noraid\u012bja uz\u0146\u0113muma pieteikumu par KP l\u0113muma atz\u012b\u0161anu par prettiesisku. Uz\u0146\u0113mums iesniedza kas\u0101cijas s\u016bdz\u012bbu Latvijas Republikas Sen\u0101t\u0101, nor\u0101dot, ka Administrat\u012bv\u0101 apgabaltiesa nav p\u0101rbaud\u012bjusi, vai p\u0101rs\u016bdz\u0113taj\u0101 l\u0113mum\u0101 metodolo\u0123iski pareizi defin\u0113ts konkr\u0113tais tirgus, kas \u013c\u0101vis izdar\u012bt secin\u0101jumus par negat\u012bvi ietekm\u0113to konkurenci tirg\u016b.
