T\u0101d\u0113j\u0101di pa\u0161vald\u012bbu iepirkumu centraliz\u0101cijas regul\u0113jums pasteidzin\u0101ja regul\u0113juma groz\u012bjumus ar\u012b citos aspektos.<\/p>\n<p>Ar iepirkumu centraliz\u0113\u0161anu l\u012bdz \u0161im Latvij\u0101 \u012bpa\u0161i nav veicies, vismaz par to neliecina pieejam\u0101 statistika, saska\u0146\u0101 ar kuru liel\u0101k\u0101 da\u013ca iepirkumu tiek veikti decentraliz\u0113ti. Centraliz\u0113ti tiek veikts maz\u0101k par pieciem procentiem no visu iepirkumu kop\u0113j\u0101 skaita. Protams, Latvij\u0101 ir biju\u0161i m\u0113\u0123in\u0101jumi atsevi\u0161\u0137\u0101s nozar\u0113s ieviest centraliz\u0113tu pieeju iepirkumu veik\u0161an\u0101, t\u0101pat ar\u012b virkne pa\u0161vald\u012bbu ir m\u0113\u0123in\u0101ju\u0161as iepirkumus veikt centraliz\u0113ti savu iest\u0101\u017eu vajadz\u012bb\u0101m, tom\u0113r p\u0101rsvar\u0101 iepirkumi tiek veikti decentraliz\u0113ti, neizmantojot to potenci\u0101lu, ko var\u0113tu sniegt speci\u0101listu kompetences un iepirkumu apjomu koncentr\u0113\u0161ana. K\u0101 viens no retajiem pozit\u012bvajiem piem\u0113riem ir Valsts re\u0123ion\u0101l\u0101s att\u012bst\u012bbas a\u0123ent\u016bras uztur\u0113t\u0101 Elektronisko iepirkumu sist\u0113ma (turpm\u0101k \u2013 EIS), kura daudziem asoci\u0113jas ar iepirkumu centraliz\u0101ciju. Tom\u0113r ar\u012b EIS v\u0113l joproj\u0101m tiek izmantota sal\u012bdzino\u0161i ierobe\u017eota pre\u010du un pakalpojumu kl\u0101sta ieg\u0101dei, turkl\u0101t \u0161\u0101da veida sist\u0113mas p\u0101rsvar\u0101 ir izmantojamas tikai standartiz\u0113tu pre\u010du iepirkumiem. <\/p>\n<p>L\u012bdz jauno groz\u012bjumu sp\u0113k\u0101 st\u0101\u0161an\u0101s br\u012bdim pien\u0101kums ieg\u0101d\u0101ties preces un pakalpojumus ar centraliz\u0113to iepirkumu instit\u016bcijas starpniec\u012bbu ir bijis attiecin\u0101ts tikai uz tie\u0161\u0101s p\u0101rvaldes iest\u0101d\u0113m. Atbilsto\u0161i Ministru kabineta 2010. gada 28. decembra noteikumiem nr. 1241 <em>Centraliz\u0113to elektronisko iepirkumu noteikumi<\/em> tie\u0161\u0101s p\u0101rvaldes iest\u0101d\u0113m EIS \u0161obr\u012bd oblig\u0101ti j\u0101ieg\u0101d\u0101jas biroja tehnika, datortehnika, drukas iek\u0101rtu piederumi, programmat\u016bra, biroja pap\u012brs un noteikta veida z\u0101les. Visdr\u012bz\u0101k tie\u0161i min\u0113t\u0101s preces oblig\u0101ti centraliz\u0113ti b\u016bs j\u0101ieg\u0101d\u0101jas ar\u012b pa\u0161vald\u012bb\u0101m un pa\u0161vald\u012bbu iest\u0101d\u0113m, bet to l\u012bdz 2013. gada 31. decembrim noteiks Ministru kabinets t\u0101 izdotajos noteikumos. Tom\u0113r j\u0101\u0146em v\u0113r\u0101, ka attiec\u012bb\u0101 uz pa\u0161vald\u012bb\u0101m ir divas b\u016btiskas at\u0161\u0137ir\u012bbas centraliz\u0113to iepirkumu organiz\u0113\u0161an\u0101.<\/p>\n<p>Pirmk\u0101rt, tie\u0161\u0101s p\u0101rvaldes iest\u0101d\u0113m l\u012bgumcenu robe\u017ev\u0113rt\u012bba gada ietvaros, no kuras attiec\u012bg\u0101s grupas preces j\u0101ieg\u0101d\u0101jas centraliz\u0113ti, ir Ls 100, bet pa\u0161vald\u012bb\u0101m t\u0101 ir Ls 3000. \u0160\u0101da at\u0161\u0137ir\u012bba ir pan\u0101kta k\u0101 kompromiss, lai dotu iesp\u0113ju pa\u0161vald\u012bb\u0101m un to iest\u0101d\u0113m gad\u012bjum\u0101, ja kop\u0113jais attiec\u012bg\u0101s grupas pre\u010du vai pakalpojumu iepirkuma apjoms gada laik\u0101 ir sal\u012bdzino\u0161i neliels, \u0161\u012bs preces ieg\u0101d\u0101ties \u0101tri, ar minim\u0101lu administrat\u012bvo resursu pat\u0113ri\u0146u, k\u0101 ar\u012b atbalst\u012bt viet\u0113jos pieg\u0101d\u0101t\u0101jus.<\/p>\n<p>Otrk\u0101rt, tie\u0161\u0101s p\u0101rvaldes iest\u0101d\u0113m oblig\u0101ti centraliz\u0113ti iep\u0113rkam\u0101s preces un pakalpojumi j\u0101ieg\u0101d\u0101jas EIS, bet pa\u0161vald\u012bb\u0101m un to iest\u0101d\u0113m EIS izmanto\u0161ana ir tikai viena no iesp\u0113j\u0101m, k\u0101 izpild\u012bt pien\u0101kumu Ministru kabineta noteikt\u0101s pre\u010du grupas ieg\u0101d\u0101ties centraliz\u0113ti. Respekt\u0113jot pa\u0161vald\u012bbu autonomiju, likumdev\u0113js k\u0101 alternat\u012bvu EIS izmanto\u0161anai ir paredz\u0113jis pa\u0161vald\u012bbai vai vair\u0101k\u0101m pa\u0161vald\u012bb\u0101m kop\u0101 izveidot vai noteikt centraliz\u0113to iepirkumu instit\u016bciju, kas nodro\u0161ina attiec\u012bgo pre\u010du un pakalpojumu iepirkumus pa\u0161vald\u012bbai un vis\u0101m t\u0101s iest\u0101d\u0113m. Otr\u0101 alternat\u012bva var\u0113tu tikt bie\u017e\u0101k izmantota lielo pa\u0161vald\u012bbu gad\u012bjum\u0101, \u0146emot v\u0113r\u0101, ka t\u0101 sniedz pla\u0161\u0101kas iesp\u0113jas veidot savu iepirkumu politiku, piem\u0113ram, pa\u0161vald\u012bbas l\u012bmen\u012b defin\u0113jot nepiecie\u0161amo pre\u010du kvalit\u0101ti, savietojam\u012bbu u. tml. <\/p>\n<p>T\u0101pat \u0161\u012b alternat\u012bva nodro\u0161ina elast\u012bg\u0101ku iesp\u0113ju piel\u0101goties specifisk\u0101m pa\u0161vald\u012bbu iest\u0101\u017eu vajadz\u012bb\u0101m, ko sal\u012bdzino\u0161i gr\u016bt\u0101k ir nodro\u0161in\u0101t EIS ietvaros, \u0146emot v\u0113r\u0101 t\u0101s dal\u012bbnieku skaitu. Savuk\u0101rt EIS vienm\u0113r b\u016bs risin\u0101jums t\u0101m situ\u0101cij\u0101m, kad \u0161\u0101da pa\u0161vald\u012bbas l\u012bme\u0146a centraliz\u0113to iepirkumu instit\u016bcija neb\u016bs izveidota vai konkr\u0113taj\u0101 situ\u0101cij\u0101 nevar\u0113s vai tai neb\u016bs lietder\u012bgi veikt iepirkumu konkr\u0113t\u0101s vajadz\u012bbas nodro\u0161in\u0101\u0161anai. Min\u0113to at\u0161\u0137ir\u012bbu d\u0113\u013c pa\u0161vald\u012bb\u0101m un to iest\u0101d\u0113m nav paredz\u0113tas ties\u012bbas neizmantot centraliz\u0113to iepirkumu instit\u016bcijas pakalpojumus specifisk\u0101s situ\u0101cij\u0101s, kad attiec\u012bgu preci vai pakalpojumu nevar ieg\u0101d\u0101ties ar centraliz\u0113to iepirkumu instit\u016bcijas starpniec\u012bbu vai ar\u012b decentraliz\u0113ti l\u012bgumu var nosl\u0113gt par zem\u0101ku cenu,. Kopum\u0101 j\u0101cer, ka \u0161\u012bs pa\u0161vald\u012bbu centraliz\u0113to iepirkumu instit\u016bcijas laika gait\u0101 izveidosies k\u0101 kompetences centri attiec\u012bgo jomu iepirkumu nodro\u0161in\u0101\u0161an\u0101, t\u0101d\u0113j\u0101di uzlabojot iepirkumu norises kvalit\u0101ti un sekm\u0113jot atkl\u0101t\u012bbu un konkurenci. T\u0101pat j\u0101izsaka cer\u012bba, ka pak\u0101peniski centraliz\u0113ta pieeja iepirkumu veik\u0161an\u0101 tiks padar\u012bta saisto\u0161a attiec\u012bb\u0101 uz cit\u0101m pre\u010du un pakalpojumu grup\u0101m, kuru centraliz\u0113ta ieg\u0101de nodro\u0161in\u0101tu liel\u0101kas apjoma atlaides, k\u0101 ar\u012b samazin\u0101tu izdevumus \u0161o pre\u010du un pakalpojumu dz\u012bves cikla laik\u0101.<\/p>\n<p>Nosl\u0113dzot jaut\u0101jumu par iepirkumu centraliz\u0101ciju, v\u0113l j\u0101atz\u012bm\u0113, ka likuma 16. pants ar\u012b ir ticis preciz\u0113ts, pie\u013caujot iesp\u0113ju pas\u016bt\u012bt\u0101jiem Latvij\u0101 k\u0101 centraliz\u0113to iepirkumu instit\u016bcij\u0101m veikt iepirkumus gan viet\u0113jo pas\u016bt\u012bt\u0101ju un sabiedrisko pakalpojumu sniedz\u0113ju vajadz\u012bb\u0101m, gan ar\u012b citu valstu, turkl\u0101t ne tikai Eiropas Savien\u012bbas dal\u012bbvalstu, pas\u016bt\u012bt\u0101ju un sabiedrisko pakalpojumu sniedz\u0113ju vajadz\u012bb\u0101m. \u0160ie preciz\u0113jumi nov\u0113r\u0161 juridiskos \u0161\u0137\u0113r\u0161\u013cus, kas liedza pas\u016bt\u012bt\u0101jiem Latvij\u0101 centraliz\u0113ti veikt iepirkumus citu valstu, kas nav Eiropas Savien\u012bbas dal\u012bbvalstis, vajadz\u012bb\u0101m, piem\u0113ram, kaimi\u0146valstu sadarb\u012bbas programmu ietvaros.<br \/>\nUn b\u016btiski ir atz\u012bm\u0113t, ka groz\u012bjumi PIL 8. panta 2.<sup>1<\/sup> da\u013c\u0101 un 16. pant\u0101 st\u0101sies sp\u0113k\u0101 tikai 2014. gada 1. janv\u0101r\u012b.<\/p>\n<p><strong>Izsl\u0113g\u0161anas noteikumu groz\u012bjumi<\/strong><\/p>\n<p>Ar 2013. gada 20. j\u016bnija likumu b\u016btiski groz\u012bjumi veikti ar\u012b PIL 39. pant\u0101, kas paredz kandid\u0101tu un pretendentu izsl\u0113g\u0161anas noteikumus iepirkuma proced\u016br\u0101s. Ar groz\u012bjumiem main\u012bti gan izsl\u0113g\u0161anas nosac\u012bjumi, gan k\u0101rt\u012bba, k\u0101 tiek p\u0101rbaud\u012bta atbilst\u012bba izsl\u0113g\u0161anas nosac\u012bjumiem. Izsl\u0113g\u0161anas nosac\u012bjumu piem\u0113ro\u0161anai ir b\u016btiski iev\u0113rot PIL p\u0101rejas noteikumus, kas nosaka at\u0161\u0137ir\u012bgu normu piem\u0113ro\u0161anas k\u0101rt\u012bbu. Papildus j\u0101\u0146em v\u0113r\u0101, ka PIL 39. pants sp\u0113ku zaud\u0113s 2014. gada 1. janv\u0101r\u012b, kad st\u0101sies sp\u0113k\u0101 39.<sup>1<\/sup> un 39.<sup>2<\/sup> pants. Nenoliedzami, ka \u0161o pantu numuru izruna un rakst\u012bba rad\u012bs gr\u016bt\u012bbas to piem\u0113ro\u0161an\u0101, tom\u0113r j\u0101atz\u012bst, ka no min\u0113to pantu pie\u0146em\u0161anas nebija iesp\u0113jams izvair\u012bties, jo PIL 39. pant\u0101 nebija iesp\u0113jams vienlaikus iek\u013caut regul\u0113jumu, kas nepiecie\u0161ams steidzamu jaut\u0101jumu risin\u0101\u0161anai un st\u0101sies sp\u0113k\u0101 2013. gada 1. august\u0101, un regul\u0113jumu, kas saist\u012bts ar p\u0101rbaudes veik\u0161anu elektronisk\u0101 veid\u0101 attiec\u012bb\u0101 uz personu atbilst\u012bbu izsl\u0113g\u0161anas nosac\u012bjumiem un st\u0101sies sp\u0113k\u0101 2014. gada 1. janv\u0101r\u012b.<\/p>\n<p>Groz\u012bjumi PIL 39. panta pirm\u0101s da\u013cas 2. punkt\u0101 paredz, ka turpm\u0101k (saska\u0146\u0101 ar p\u0101rejas noteikumu 46. punktu ar\u012b jau uzs\u0101ktaj\u0101s iepirkuma proced\u016br\u0101s) no dal\u012bbas iepirkum\u0101 b\u016bs izsl\u0113dzams t\u0101ds kandid\u0101ts vai pretendents, kas atz\u012bts par vain\u012bgu p\u0101rk\u0101pum\u0101, kas izpau\u017eas k\u0101 personas nodarbin\u0101\u0161ana bez rakstveid\u0101 nosl\u0113gta darba l\u012bguma, nodok\u013cu normat\u012bvajos aktos noteiktaj\u0101 termi\u0146\u0101 neiesniedzot par \u0161o personu informat\u012bvo deklar\u0101ciju par darba \u0146\u0113m\u0113jiem, kas iesniedzama par person\u0101m, kuras uzs\u0101k darbu. At\u0161\u0137ir\u012bb\u0101 no iepriek\u0161\u0113j\u0101 regul\u0113juma, kad bija v\u0113rt\u0113jams, cik daudz personu un cik ilg\u0101 laika period\u0101 nodarbin\u0101tas bez rakstveid\u0101 nosl\u0113gta darba l\u012bguma, \u0161aj\u0101 gad\u012bjum\u0101 izsl\u0113g\u0161anas pamats b\u016bs jau tad, ja tiks atkl\u0101ts viens \u0161\u0101ds gad\u012bjums, papildus konstat\u0113jot, ka nodok\u013cu normat\u012bvajos aktos noteiktaj\u0101 termi\u0146\u0101 par personu nav bijusi iesniegta informat\u012bv\u0101 deklar\u0101cija par darba \u0146\u0113m\u0113jiem, kas iesniedzama par person\u0101m, kuras uzs\u0101k darbu.
