Pretendents, kuram vieno\u0161an\u0101s rezult\u0101t\u0101 bija paredz\u0113ts uzvar\u0113t, citiem pretendentiem nos\u016bt\u012bja vai nu jau sagatavotas t\u0101mes, vai nor\u0101des par to, k\u0101das cenas tiem b\u016btu j\u0101pied\u0101v\u0101, vai ar\u012b nos\u016bt\u012bja pats savu t\u0101mi, nor\u0101dot, lai p\u0101r\u0113jie pretendenti savu cenu veido liel\u0101ku. Izmekl\u0113\u0161anas rezult\u0101t\u0101 KP konstat\u0113ja: \u201eV\u0113rt\u0113jot aizvietojam\u012bbu no pied\u0101v\u0101juma puses, konstat\u0113jams, ka attiec\u012bgos b\u016bvdarbus vai pakalpojumus var sniegt pretendenti, ja tie atbilst pas\u016bt\u012bt\u0101ja izvirz\u012btaj\u0101m kvalifik\u0101cijas pras\u012bb\u0101m. T\u0101d\u0113j\u0101di no pied\u0101v\u0101juma puses katr\u0101 no konkursiem var b\u016bt at\u0161\u0137ir\u012bgas aizvietojam\u012bbas iesp\u0113jas (pretendentu loks). E02-31 protokola).<\/p>\n<p><em>Latvenergo<\/em> Iepirkumu un lo\u0123istikas direktors <strong>M\u0101ris Zvirbulis<\/strong> skaidro:<br \/>\n\u201eKP l\u0113mum\u0101 ir secin\u0101jusi, ka atsevi\u0161\u0137u AS <em>Latvenergo<\/em>\/AS <em>Sadales t\u012bkls<\/em> darbinieku p\u0101r\u0101k cie\u0161\u0101s attiec\u012bbas ar sod\u012btajiem uz\u0146\u0113mumiem ir veicin\u0101jusi b\u016bvnieku saska\u0146otas darb\u012bbas. Konkurenti savstarp\u0113ju p\u0101rrunu ce\u013c\u0101 izv\u0113l\u0113j\u0101s uzvar\u0113t\u0101jus konkr\u0113tos iepirkumos, nevis \u013c\u0101va to dar\u012bt pas\u016bt\u012bt\u0101jam konkursa k\u0101rt\u012bb\u0101. P\u0113c b\u016bt\u012bbas t\u0101 bija tirgus p\u0101rdale, nevis iepirkumu konkurss. <\/p>\n<p>J\u0101atz\u012bst, ka KP ir veikusi \u013coti apjom\u012bgu lietas izmekl\u0113\u0161anu, ir ieg\u016bti tik p\u0101rliecino\u0161i pier\u0101d\u012bjumi, ka tos b\u016bs gr\u016bti apstr\u012bd\u0113t tiesas ce\u013c\u0101. Iepaz\u012bstoties ar KP izmekl\u0113\u0161anas materi\u0101liem, nedaudz izbr\u012bna fakts, cik viegli uz\u0146\u0113mumi sav\u0101 starp\u0101 dal\u012bj\u0101s ar komerci\u0101li j\u016bt\u012bgu inform\u0101ciju. Vis\u0101 pasaul\u0113 uz\u0146\u0113mumi c\u012bn\u0101s pret r\u016bpniecisko spiego\u0161anu, bet pie mums viss notiek <em>draudz\u012bgi,<\/em> un nekas netiek sl\u0113pts. Tikai saska\u0146\u0101 ar Konkurences likumu komerci\u0101laj\u0101 darb\u012bb\u0101 nav pie\u013caujama konkurentu apmai\u0146a ar komerci\u0101l\u0101s darb\u012bbas pl\u0101niem un citu komerci\u0101li j\u016bt\u012bgu inform\u0101ciju. Ja konkurenti saska\u0146o savus pl\u0101nus vai dara tos zin\u0101mus cits citam, ekonomisk\u0101 s\u0101ncens\u012bba nenotiek, t\u0101d\u0113j\u0101di pretendentu vieno\u0161an\u0101s pirms iepirkumu proced\u016br\u0101m uzskat\u0101ma par konkurences imit\u0113\u0161anu jeb deform\u0113\u0161anu.<\/p>\n<p><strong>Izmai\u0146as tarifos<\/strong><\/p>\n<p>Gala pat\u0113r\u0113t\u0101jus \u0161\u012b lieta var\u0113tu ieinteres\u0113t ar\u012b saist\u012bb\u0101 ar izmai\u0146\u0101m elektr\u012bbas tarifos, kas \u0161obr\u012bd balst\u0101s uz tr\u012bs <em>va\u013ciem<\/em> \u2013 elektr\u012bbas cenas br\u012bvaj\u0101 tirg\u016b, oblig\u0101t\u0101 iepirkuma komponentes un invest\u012bcijas sadales t\u012bklos. T\u0101tad, ja \u0161\u012b karte\u013ca darb\u012bbas rezult\u0101t\u0101 invest\u012bcijas sadales t\u012bklos konkr\u0113tajos iepirkumos ir sad\u0101rdzin\u0101tas l\u012bdz pat 30 %, k\u0101 apgalvo KP, tad tas teor\u0113tiski var\u0113tu atsaukties uz gala tarifiem.<\/p>\n<p>\u0160oreiz gan pas\u016bt\u012bt\u0101js, gan sod\u012bto uz\u0146\u0113mumu p\u0101rst\u0101vji pau\u017e vienotu viedokli, ka sad\u0101rdzin\u0101juma praktiski nav bijis, vai vismaz ne tik lielos apm\u0113ros, lai tiktu iek\u013cauts gala tarif\u0101. B\u016bvniec\u012bbas tirgus no 2006. gada l\u012bdz 2011. gadam piedz\u012bvoja gan nekustamo \u012bpa\u0161umu burbuli, gan kr\u012bzes apst\u0101k\u013cus, t\u0101p\u0113c gr\u016bti b\u016btu apgalvot, ka \u0161ie p\u0101rk\u0101pumi tika veikti tikai pe\u013c\u0146as nol\u016bkos.
