Par karteli konkurences ties\u012bbu izpratn\u0113 var run\u0101t situ\u0101cij\u0101s, kad, piem\u0113ram, divi uz\u0146\u0113m\u0113ji, kas ir savstarp\u0113ji konkurenti, vienoj\u0101s par cenu, sadala tirgu vai vienoj\u0101s par dal\u012bbas nosac\u012bjumiem iepirkumos.<\/p>\n\n\n\n<p><em><strong>Kas ir aizliegta vieno\u0161an\u0101s?<\/strong><\/em><\/p>\n\n\n\n<p>Kas ir aizliegta vieno\u0161an\u0101s un par ko ir aizliegts vienoties ir noteikts Konkurences likuma (turpm\u0101k \u2013 KL) 11.panta pirmaj\u0101 da\u013c\u0101 un attiec\u012bgi L\u012bgum\u0101 par Eiropas Savien\u012bbas darb\u012bbu (turpm\u0101k \u2013 LESD) 101.panta pirmaj\u0101 punkt\u0101. Abas min\u0113t\u0101s ties\u012bbu normas Konkurences padome (turpm\u0101k \u2013 KP) ir ties\u012bga piem\u0113rot izrieto\u0161i no p\u0101rk\u0101puma apm\u0113ra. Ja p\u0101rk\u0101pums ir lok\u0101ls un tas skar nacion\u0101lo tirgu, tad KP piem\u0113ro nacion\u0101lo regul\u0113jumu, kas ietverts KL, ta\u010du, ja p\u0101rk\u0101pums saist\u012bts ar p\u0101rrobe\u017eu tirgu darb\u012bbu vai tas ietekm\u0113jis tirdzniec\u012bbu starp dal\u012bbvalst\u012bm, tad KP var piem\u0113rot attiec\u012bgi ar\u012b starptautisko regul\u0113jumu \u2013 LESD. J\u0101nor\u0101da, ka ar \u201cietekmi uz tirdzniec\u012bbu\u201d tiek saprasts, ka nol\u012bgums, l\u0113mums vai uz\u0146\u0113mumu saska\u0146otas darb\u012bbas var tie\u0161i vai netie\u0161i, faktiski vai potenci\u0101li ietekm\u0113t tirdzniec\u012bbas modeli starp ES dal\u012bbvalst\u012bm<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup>. T\u0101d\u0113j\u0101di \u0161aj\u0101 kontekst\u0101 j\u0113dzienam \u201cietekme uz tirdzniec\u012bbu\u201d ir pla\u0161\u0101ka darb\u012bbas joma, un tas neattiecas tikai uz pre\u010du un pakalpojumu apmai\u0146u p\u0101ri robe\u017e\u0101m<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup>.<\/p>\n\n\n\n<p>Abas augst\u0101k min\u0113t\u0101s ties\u012bbu normas saturiski ir vien\u0101das, proti, t\u0101s nosaka, ka ir aizliegtas un kop\u0161 nosl\u0113g\u0161anas br\u012b\u017ea sp\u0113k\u0101 neeso\u0161as tirgus dal\u012bbnieku vieno\u0161an\u0101s, kuru m\u0113r\u0137is vai sekasir konkurences kav\u0113\u0161ana, ierobe\u017eo\u0161ana vai deform\u0113\u0161ana Latvijas teritorij\u0101. KL 11. panta pirmaj\u0101 da\u013c\u0101 uzskait\u012btie aizliegtu vieno\u0161anos veidi ir tikai piem\u0113ri, ko ir atzinusi ar\u012b Latvijas Republikas Augst\u0101k\u0101 tiesa<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>, t\u0101d\u0113j\u0101di aizliegta vieno\u0161an\u0101s var izpausties ar\u012b cit\u0101d\u0101k, ja vien tiek konstat\u0113ts, ka \u0161\u012bs vieno\u0161an\u0101s m\u0113r\u0137is vai sekas ir pret\u0113jas god\u012bgas konkurences pamatprincipiem. Turkl\u0101t, ja vieno\u0161an\u0101s m\u0113r\u0137is ir v\u0113rsts uz konkurences ierobe\u017eo\u0161anu, tad nav b\u016btiski, vai un k\u0101das bija \u0161\u0101 p\u0101rk\u0101puma sekas<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup>.<\/p>\n\n\n\n<p>Atbilsto\u0161i KL 2.&nbsp;pant\u0101 ietvertajam likuma m\u0113r\u0137im katram tirgus dal\u012bbniekam, konkur\u0113jot ar citiem, sava saimniecisk\u0101 darb\u012bba j\u0101veido, izmantojot br\u012bvas, god\u012bgas un vienl\u012bdz\u012bgas konkurences l\u012bdzek\u013cus. Tas attiecas ar\u012b uz tirgus dal\u012bbnieku r\u012bc\u012bbu, kas katram tirgus dal\u012bbniekam tirg\u016b ir j\u0101nosaka patst\u0101v\u012bgi<sup><a href=\"#fn6\" id=\"ref6\">6<\/a><\/sup>. \u0160is princips izriet ne tikai no Eiropas Savien\u012bbas Tiesas (l\u012bdz 01.10.2009. Eiropas Kopienas tiesas) judikat\u016bras<sup><a href=\"#fn7\" id=\"ref7\">7<\/a><\/sup>, bet ar\u012b no KL 11.&nbsp;panta pirm\u0101s da\u013cas.<\/p>\n\n\n\n<p><strong>Svar\u012bgi atcer\u0113ties<\/strong>!<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>KL 11.panta pirmaj\u0101 da\u013c\u0101 ir uzskait\u012bti aizliegtu vieno\u0161anos veidi, ta\u010du ir b\u016btiski atcer\u0113ties, ka min\u0113tie veidi ir tikai piem\u0113ri un pant\u0101 min\u0113tie septi\u0146i punkti nesniedz izsme\u013co\u0161u sarakstu. Galvenais princips, kas j\u0101iev\u0113ro \u2013 jebkuram tirgus dal\u012bbniekam sava komercdarb\u012bba, pl\u0101ni un r\u012bc\u012bba tirg\u016b ir j\u0101veido patst\u0101v\u012bgi un neatkar\u012bgi.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><em><strong>K\u0101di ir vieno\u0161an\u0101s izpausmes veidi un vieno\u0161an\u0101s aizliegumi?<\/strong><\/em><\/p>\n\n\n\n<p>KL 11.&nbsp;panta pirmaj\u0101 da\u013c\u0101 lietot\u0101 termina \u201cvieno\u0161an\u0101s\u201d piem\u0113ro\u0161ana netiek ierobe\u017eota tikai ar divpus\u0113ji vai daudzpus\u0113ji nosl\u0113gtu l\u012bgumu. KL ir piem\u0113rojams ar\u012b tirgus dal\u012bbnieku sadarb\u012bbai, kura tiek sasniegta ar daudz neform\u0101l\u0101kas sapratnes pal\u012bdz\u012bbu, ko sauc par saska\u0146otu darb\u012bbu. T\u0101d\u0113j\u0101di vieno\u0161an\u0101s ir ar\u012b jebkur\u0101 cit\u0101d\u0101 form\u0101 pan\u0101kta un \u012bstenota sadarb\u012bba starp konkurentiem, jo \u0161\u0101da darb\u012bba p\u0113c sava m\u0113r\u0137a ir v\u0113rsta uz konkurences mazin\u0101\u0161anu starp tiem, t.i., kav\u0113\u0161anu, ierobe\u017eo\u0161anu vai deform\u0113\u0161anu starp konkurentiem.<\/p>\n\n\n\n<p>Saska\u0146otas darb\u012bbas j\u0113dziens ietver sev\u012b divpus\u0113ju kontaktu eksistenci. \u0160is apst\u0101klis izpild\u0101s tad, kad viens konkurents atkl\u0101j t\u0101 n\u0101kotnes nodomus vai r\u012bc\u012bbu citam, savuk\u0101rt otrs nav rea\u0123\u0113jis noraido\u0161i attiec\u012bb\u0101 uz \u0161\u0101das inform\u0101cijas sa\u0146em\u0161anu.<sup><a href=\"#fn8\" id=\"ref8\">8<\/a><\/sup><\/p>\n\n\n\n<p>Norm\u0101las konkurences apst\u0101k\u013cos katra konkur\u0113jo\u0161a uz\u0146\u0113muma priorit\u0101te ir aizsarg\u0101t un nesamazin\u0101t savu konkur\u0113tsp\u0113ju tirg\u016b, darbojoties neatkar\u012bgi un darot visu iesp\u0113jamo, lai nepie\u013cautu sensit\u012bvas inform\u0101cijas apmai\u0146u starp konkurentiem, t.sk. par komercsabiedr\u012bbas pl\u0101niem piedal\u012bties vai nepiedal\u012bties iepirkumos, kas atkl\u0101j konkurentam darb\u012bbas, kuras tas ir nol\u0113mis vai pl\u0101no veikt n\u0101kotn\u0113.<\/p>\n\n\n\n<p>T\u0101pat b\u016btiski, ka konkurenci regul\u0113jo\u0161ie normat\u012bvie akti nenodala tirgus dal\u012bbnieka jeb uz\u0146\u0113muma atbild\u012bbu no atsevi\u0161\u0137u t\u0101 darbinieku atbild\u012bbas, t.i., nenodala \u201cdarbinieku vainu\u201d no \u201ctirgus dal\u012bbnieka vainas\u201d, jo darbinieki veido tirgus dal\u012bbnieku jeb \u201cpersonific\u0113\u201d to. Turkl\u0101t KL 11.&nbsp;panta pirmaj\u0101 da\u013c\u0101 un ar\u012b LESD 101.&nbsp;pant\u0101 noteiktais vieno\u0161an\u0101s aizliegums nav attiecin\u0101ms tikai uz to amatpersonu r\u012bc\u012bbu, kur\u0101m ir paraksta ties\u012bbas konkr\u0113taj\u0101 komercsabiedr\u012bb\u0101, jo aizliegta vieno\u0161an\u0101s ir attiecin\u0101ma uz jebkura darbinieka darb\u012bb\u0101m, kuram tirgus dal\u012bbnieks ir nodevis t\u0101 inform\u0101ciju, kas attiecas uz cen\u0101m un citiem komerci\u0101li noz\u012bm\u012bgiem tirgus dal\u012bbnieka datiem un kas darbojas darba dev\u0113ja interes\u0113s<sup><a href=\"#fn9\" id=\"ref9\">9<\/a><\/sup>. T\u0101d\u0113j\u0101di tirgus dal\u012bbnieka vad\u012bbai ir j\u0101seko, lai darbinieki, pildot darba pien\u0101kumus, iev\u0113rotu normat\u012bvos aktus, taj\u0101 skait\u0101 KL. L\u012bdz ar to konkurences ties\u012bbu p\u0101rk\u0101puma konstat\u0113\u0161ana nav atkar\u012bga no t\u0101, vai tirgus dal\u012bbnieka vad\u012bba b\u016btu \u012bpa\u0161i pilnvarojusi darbinieku r\u012bkoties noteikt\u0101 veid\u0101 vai b\u016btu inform\u0113ta par darbinieka darb\u012bb\u0101m.<\/p>\n\n\n\n<p>No konkurences ties\u012bbu viedok\u013ca ir aizliegts vienoties par:<\/p>\n\n\n\n<ul><li>tie\u0161u vai netie\u0161u cenu vai tarifu noteik\u0161anu jebk\u0101d\u0101 veid\u0101 vai to veido\u0161anas noteikumiem, k\u0101 ar\u012b par t\u0101das inform\u0101cijas apmai\u0146u, kura attiecas uz cen\u0101m vai realiz\u0101cijas noteikumiem,<\/li><li>ra\u017eo\u0161anas vai realiz\u0101cijas apjomu, tirgu, tehnisk\u0101s att\u012bst\u012bbas vai invest\u012bciju ierobe\u017eo\u0161anu vai kontroli,<\/li><li>tirgu sadali, \u0146emot v\u0113r\u0101 teritoriju, pirc\u0113jus, pieg\u0101d\u0101t\u0101jus vai citus nosac\u012bjumus,<\/li><li>noteikumiem, kuri dar\u012bjumu sl\u0113g\u0161anu, groz\u012b\u0161anu vai izbeig\u0161anu ar tre\u0161o personu padara atkar\u012bgu no t\u0101, vai \u0161\u012b tre\u0161\u0101 persona uz\u0146emas saist\u012bbas, kuru komerci\u0101lais lietojums neattiecas uz konkr\u0113to dar\u012bjumu,<\/li><li>piedal\u012b\u0161anos vai nepiedal\u012b\u0161anos konkursos vai izsol\u0113s vai par \u0161\u012bs darb\u012bbas (bezdarb\u012bbas) noteikumiem, iz\u0146emot gad\u012bjumus, kad konkurenti publiski dar\u012bju\u0161i zin\u0101mu kop\u012bgu pied\u0101v\u0101jumu un \u0161\u0101 pied\u0101v\u0101juma m\u0113r\u0137is nav kav\u0113t, ierobe\u017eot vai deform\u0113t konkurenci,<\/li><li>nevien\u0101du noteikumu piem\u0113ro\u0161anu ekvivalentos dar\u012bjumos ar tre\u0161aj\u0101m person\u0101m, radot t\u0101m konkurences zi\u0146\u0101 nelabv\u0113l\u012bg\u0101kus apst\u0101k\u013cus,<\/li><li>darb\u012bb\u0101m (bezdarb\u012bbu), kuru d\u0113\u013c cits tirgus dal\u012bbnieks ir spiests atst\u0101t k\u0101du konkr\u0113to tirgu vai tiek apgr\u016btin\u0101ta potenci\u0101la tirgus dal\u012bbnieka iek\u013c\u016b\u0161ana k\u0101d\u0101 konkr\u0113taj\u0101 tirg\u016b.<\/li><\/ul>\n\n\n\n<p><em>1.att\u0113ls. KL 12. panta pirm\u0101 da\u013ca nosaka \u2013 ja KP konstat\u0113 tirgus dal\u012bbnieku darb\u012bb\u0101s \u0161\u0101 likuma 11. panta pirm\u0101s da\u013cas p\u0101rk\u0101pumu, t\u0101 pie\u0146em l\u0113mumu par p\u0101rk\u0101puma konstat\u0113\u0161anu, tiesisk\u0101 pien\u0101kuma un naudas soda uzlik\u0161anu. Savuk\u0101rt atbilsto\u0161i KL 12. panta tre\u0161ajai da\u013cai KP par horizont\u0101lu aizliegtu vieno\u0161anos starp konkurentiem t\u0101s dal\u012bbniekiem ir ties\u012bga uzlikt naudas sodu l\u012bdz 10 % apm\u0113ram no katra dal\u012bbnieka p\u0113d\u0113j\u0101 finan\u0161u gada neto apgroz\u012bjuma<sup><a href=\"#fn10\" id=\"ref10\">10<\/a><\/sup>, bet ne maz\u0101k k\u0101 700 eiro katram. L\u012bdz ar to ar\u012b publiskajos iepirkumos normat\u012bvais regul\u0113jums stingri v\u0113r\u0161as pret konkurences ties\u012bbu p\u0101rk\u0101pumiem, paredzot kandid\u0101tu un pretendentu izsl\u0113g\u0161anu no iepirkuma konkursa<sup><a href=\"#fn12\" id=\"ref12\">12<\/a><\/sup>, ja tie atbilst noteiktiem krit\u0113rijiem.
