Tas attiecin\u0101ms ar\u012b uz nupat uzjund\u012bju\u0161o diskusiju par valsts amatpersonu atalgojuma public\u0113\u0161anas nosac\u012bjumiem. Ko tad Saeima un pilsonisk\u0101 sabiedr\u012bba var m\u0101c\u012bties no \u0161\u012b sprieduma?<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Regula j\u0101iev\u0113ro no pie\u0146em\u0161anas br\u012b\u017ea<\/span><\/strong><\/p>\n<p>Atalgojuma liet\u0101 Saeima apstr\u012bd\u0113t\u0101s normas pie\u0146\u0113ma pirms Datu regulas st\u0101\u0161an\u0101s sp\u0113k\u0101 2018. gada 25. maij\u0101, t\u0101d\u0113\u013c Satversmes tiesai bija j\u0101noskaidro, vai past\u0101v apstr\u012bd\u0113to normu un Datu regulas pras\u012bbu konflikts. Sprieduma 18.4.1. punkt\u0101 Satversmes tiesa apstiprin\u0101ja, ka konflikts nevar past\u0101v\u0113t, jo Latvijas Republikai no L\u012bguma par Eiropas Savien\u012bbu 4. panta tre\u0161\u0101s da\u013cas tre\u0161\u0101 paragr\u0101fa izriet pien\u0101kums sekm\u0113t Eiropas Savien\u012bbas uzdevumu izpildi un attur\u0113ties no jebk\u0101du darb\u012bbu veik\u0161anas, kas var kait\u0113t Eiropas Savien\u012bbas interes\u0113m. Proti, Satversmes tiesa spriedum\u0101 pirmo reizi nostiprina Eiropas Savien\u012bbas dal\u012bbvalstu lojalit\u0101tes principa darb\u012bbu Latvij\u0101.<\/p>\n<p>Satversmes tiesas v\u0113rt\u0113jums par Datu regulas iev\u0113ro\u0161anu apstr\u012bd\u0113t\u0101s normas pie\u0146em\u0161anas proces\u0101 un t\u0101s b\u016bt\u012bb\u0101 aiz\u0146em p\u0101ris lapas un ir visp\u0101r\u012bgs. Tas saist\u012bts ar neskaidr\u012bbu par apstr\u012bd\u0113to normu le\u0123it\u012bmo m\u0113r\u0137i gan public\u0113\u0161anas pien\u0101kumam, gan public\u0113t\u0101 atalgojuma glab\u0101\u0161anas termi\u0146am.<\/p>\n<p>Spriedums liecina, ka Saeima nev\u0113rt\u0113ja apstr\u012bd\u0113t\u0101s normas no Eiropas Savien\u012bbas dal\u012bbvalstu lojalit\u0101tes prin\u00adcipa viedok\u013ca. Tom\u0113r Saeima cent\u0101s argument\u0113t, ka apstr\u012bd\u0113t\u0101s normas nav pretrun\u0101 EST judikat\u016brai. \u00d6sterreichischer Rundfunk liet\u0101 EST konstat\u0113ja, ka Austrijas un N\u012bderlandes likumos noteiktie pien\u0101kumi public\u0113t ier\u0113d\u0146u atalgojumu ir noteikti pien\u0101c\u012bg\u0101 k\u0101rt\u012bb\u0101 pie\u0146emt\u0101 likum\u0101 un tas atbilst p\u0101rredzam\u012bbas principam.<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup> Austrij\u0101 algu public\u0113\u0161anas le\u0123it\u012bmais m\u0113r\u0137is bija nodro\u0161in\u0101t l\u012bdz\u012bgu atalgojuma l\u012bmeni publiskaj\u0101s instit\u016bcij\u0101s, t\u0101tad valsts ekonomisk\u0101s labkl\u0101j\u012bbas intereses saska\u0146\u0101 ar Eiropas Cilv\u0113ka ties\u012bbu un pamatv\u0113rt\u012bbu aizsardz\u012bbas konvencijas 8. panta 2. apak\u0161punktu.<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup> Savuk\u0101rt ierobe\u017eojuma nepiecie\u0161am\u012bbas v\u0113rt\u0113jumu min\u0113taj\u0101 liet\u0101 EST, k\u0101 ierasts, atst\u0101ja nacion\u0101lo tiesu kompetenc\u0113.<\/p>\n<p>Iesp\u0113jams, Satversmes tiesa sniegs \u0161\u0101du v\u0113rt\u0113jumu liet\u0101 Nr. 2018-18-01, kur\u0101 apstr\u012bd\u0113ta autovad\u012bt\u0101ju soda punktu absol\u016bta atkl\u0101t\u012bba. Min\u0113taj\u0101 liet\u0101 norma ar\u012b pie\u0146emta p\u0113c Datu regulas pie\u0146em\u0161anas, bet pirms t\u0101s sp\u0113k\u0101 st\u0101\u0161an\u0101s.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">Personas datu aizsardz\u012bbas jaut\u0101jumos likumdev\u0113jam j\u0101att\u012bsta emp\u0101tija<\/span><\/strong><\/p>\n<p>Ar\u012b \u0161aj\u0101 liet\u0101 b\u016btisk\u0101kais personas datu ekspertu iebildums bija par darbinieku jeb datu subjektu ties\u012bbu uz priv\u0101to dz\u012bvi un valsts bud\u017eeta t\u0113ri\u0146u atkl\u0101t\u012bbas sv\u0113ruma rezult\u0101tu jeb ierobe\u017eojuma nepiecie\u0161am\u012bbu un sam\u0113r\u012bgumu. Lietas materi\u0101li, ar\u012b man\u0101 ieskat\u0101,<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup> rad\u012bja iespaidu, ka deput\u0101ti visos ier\u0113d\u0146os redz potenci\u0101lus korumpantus vai vienk\u0101r\u0161i neuzticas valsts p\u0101rvaldei. Ar\u012b koment\u0101ri soci\u0101lajos t\u012bklos p\u0113c sprieduma pasludin\u0101\u0161anas liecin\u0101ja par \u0161\u012b viedok\u013ca esam\u012bbu da\u013c\u0101 sabiedr\u012bbas.<\/p>\n<p>Diem\u017e\u0113l apstr\u012bd\u0113t\u0101s normas pie\u0146em\u0161anas proces\u0101 darbinieku intere\u0161u aizst\u0101v\u012bbai nepiedal\u012bj\u0101s valsts p\u0101rvaldes darbinieku un ier\u0113d\u0146u arodorganiz\u0101cijas. Tikai Datu valsts inspekcija un Latvijas Sertific\u0113to personas datu aizsardz\u012bbas speci\u0101listu asoci\u0101cija cent\u0101s aktualiz\u0113t darbinieku ties\u012bbas Saeimas debat\u0113s.<\/p>\n<p>Satversmes tiesa prec\u012bzi nor\u0101d\u012bja, ka Datu regulas 23. panta 1. punkts at\u013cauj Saeimai ar likumu noteikt personas datu apstr\u0101des veidus. Piem\u0113ram, Darba likuma 40. panta otr\u0101 da\u013ca uzskaita personas datu veidus, kuriem j\u0101b\u016bt nor\u0101d\u012btiem katr\u0101 darba l\u012bgum\u0101. Tom\u0113r jebkuram \u0161\u0101dam likumam j\u0101atbilst ar\u012b Satversmes 96. panta un Datu regulas 23. panta 2. punkta pras\u012bb\u0101m p\u0113c priv\u0101tpersonu ierobe\u017eojuma le\u0123it\u012bm\u0101 m\u0113r\u0137a, sam\u0113r\u012bguma utt. Saeima nenoskaidroja, k\u0101das sekas valsts un pa\u0161vald\u012bbu iest\u0101\u017eu darbiniekiem rad\u012bs situ\u0101cija, kur\u0101 vi\u0146u ikm\u0113ne\u0161a alga b\u016bs public\u0113ta internet\u0101 un \u017eurn\u0101listi s\u0101ks uzdot jaut\u0101jumus, bet, piem\u0113ram, darbinieku kaimi\u0146i gadiem turpina sa\u0146emt aplok\u0161\u0146u algas. Datu regulas 85. pants un Fizisko personu datu apstr\u0101des likuma 32. pants sniedz \u017eurn\u0101listiem garantijas piek\u013cuvei inform\u0101cijai, jo \u017eurn\u0101listika ir past\u0101v\u012bgs personas datu apstr\u0101des m\u0113r\u0137is Datu regulas izpratn\u0113.
