S.c. arl\/De Vellis Servizi Globali Sr <\/em>(\u201cSpriedums\u201d), <strong>ne vienm\u0113r pas\u016bt\u012bt\u0101js b\u016bs publisko ties\u012bbu subjekts<\/strong> un var rasties situ\u0101cijas, kur\u0101s priv\u0101to ties\u012bbu subjektam ir pien\u0101kums piem\u0113rot <strong>publisko iepirkumu regul\u0113jo\u0161us normat\u012bvus aktus<\/strong>, pie\u0161\u0137irot l\u012bguma sl\u0113g\u0161anas ties\u012bbas.<\/p>\n\n\n\n<p>Saska\u0146\u0101 ar PIL 1.panta 19.punktu, <strong>pas\u016bt\u012bt\u0101js ir publiska persona vai t\u0101s instit\u016bcija, biedr\u012bba,<\/strong> kuras visi biedri ir pas\u016bt\u012bt\u0101ji, <strong>nodibin\u0101jums<\/strong>, kura visi dibin\u0101t\u0101ji ir pas\u016bt\u012bt\u0101ji, k\u0101 ar\u012b t\u0101da <strong>priv\u0101to ties\u012bbu juridisk\u0101 persona<\/strong>, kas atbilst visiem \u0161\u0101diem krit\u0113rijiem:<\/p>\n\n\n\n<p>a) ir nodibin\u0101ta vai\ndarbojas, lai apmierin\u0101tu sabiedr\u012bbas vajadz\u012bbas, kam nav\nkomerci\u0101la vai r\u016bpnieciska rakstura;<\/p>\n\n\n\n<p>b) atrodas publiskas\npersonas vai t\u0101s instit\u016bcijas padot\u012bb\u0101 vai iz\u0161\u0137iro\u0161\u0101 ietekm\u0113\nvai \u0161iem krit\u0113rijiem atbilsto\u0161as priv\u0101to ties\u012bbu juridisk\u0101s\npersonas iz\u0161\u0137iro\u0161\u0101 ietekm\u0113 (\u0161\u012b ietekme izpau\u017eas k\u0101\nbalssties\u012bbu vair\u0101kums p\u0101rraudz\u012bbas instit\u016bcijas vai\nizpildinstit\u016bcijas locek\u013cu iev\u0113l\u0113\u0161an\u0101 vai vad\u012bbas iecel\u0161an\u0101),\nvai ar\u012b \u0161\u012bs priv\u0101to ties\u012bbu juridisk\u0101s personas darb\u012bbu vair\u0101k\npar 50 procentiem finans\u0113 publiska persona, t\u0101s instit\u016bcija vai\ncita \u0161iem krit\u0113rijiem atbilsto\u0161a priv\u0101to ties\u012bbu juridisk\u0101\npersona. \n<\/p>\n\n\n\n<p>Lai ar\u012b krit\u0113riji \u0161\u0137iet\nskaidri defin\u0113ti, tie nedaudz at\u0161\u0137iras no Eiropas parlamenta un\npadomes 2014.gada 28. febru\u0101ra Direkt\u012bvas 2014\/24\/ES par publisko\niepirkumu un ar ko atce\u013c Direkt\u012bvu 2004\/18\/EK (\u201cDirekt\u012bva\u201d)\ndefin\u012bcijas.
