Sarunu proced\u016bra saska\u0146\u0101 ar Direkt\u012bvas 2004\/18 un Eiropas tiesas judikat\u016bru ir atz\u012bstama par iepirkumu proced\u016bru, kas piem\u0113rojama tikai iz\u0146\u0113muma gad\u012bjumos. \u0160\u012b atzi\u0146a ir nostiprin\u0101ta vair\u0101kos Eiropas Savien\u012bbas tiesu spriedumus un ir uzskat\u0101ma par visp\u0101rpie\u0146emtu principu<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup>.<br \/>\nProti, lai publisk\u0101 iepirkuma direkt\u012bva nezaud\u0113tu savu lietder\u012bgo iedarb\u012bbu, dal\u012bbvalst\u012bm nevajadz\u0113tu paredz\u0113t, ka sarunu proced\u016bru ir iesp\u0113jams izmantot gad\u012bjumos, kas nav paredz\u0113ti direkt\u012bv\u0101, vai ar\u012b izvirz\u012bt attiec\u012bgaj\u0101 direkt\u012bv\u0101 tie\u0161i paredz\u0113tajiem gad\u012bjumiem jaunus nosac\u012bjumus, kuru rezult\u0101t\u0101 \u0161o proced\u016bru b\u016btu daudz viegl\u0101k izmantot<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup>. <\/p>\n<p>Turkl\u0101t atk\u0101pes no norm\u0101m, kas paredz\u0113tas, lai garant\u0113tu L\u012bgum\u0101 (L\u012bgums par Eiropas Savien\u012bbu) atz\u012bto ties\u012bbu efektivit\u0101ti publisk\u0101 iepirkuma l\u012bgumu jom\u0101, ir interpret\u0113jamas \u0161auri un personai, kas atsaucas uz \u0101rk\u0101rt\u0113jiem apst\u0101k\u013ciem, kuri attaisno \u0161o atk\u0101pi, ir j\u0101pier\u0101da, ka tie patie\u0161\u0101m past\u0101v<sup><a href=\"#fn3\" id=\"ref3\">3<\/a><\/sup>.<br \/>\n<!--more--><br \/>\nNo iepriek\u0161 min\u0113t\u0101 ir secin\u0101ms, ka sarunu proced\u016bra, nepublic\u0113jot pazi\u0146ojumu par l\u012bgumu, ir pie\u013caujama tikai iz\u0146\u0113muma gad\u012bjumos, kas ir skaidri uzskait\u012bti un ir \u013coti \u0161auri skaidroti<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>. L\u012bdz ar to turpm\u0101kaj\u0101 raksta da\u013c\u0101 tiks sniegts ieskats par <em>\u0101rk\u0101rtas<\/em> un <em>neparedzamu<\/em> apst\u0101k\u013cu j\u0113dzienu Publisko iepirkumu likum\u0101, nepieskaroties citiem tiesiskajiem pamatiem sarunu proced\u016bras piem\u0113ro\u0161anai. <\/p>\n<p><strong>PIL 63. panta pirm\u0101s da\u013cas 3. punkts<\/strong><\/p>\n<p>Tiesiskais pamats sarunu proced\u016bras piem\u0113ro\u0161anai saska\u0146\u0101 ar Publisko iepirkumu likuma 63. panta pirmo da\u013cu ir neparedzamu \u0101rk\u0101rtas apst\u0101k\u013cu rezult\u0101t\u0101 objekt\u012bvi radusies situ\u0101cija, kur\u0101 steidzam\u012bbas d\u0113\u013c nav iesp\u0113jams piem\u0113rot atkl\u0101tu konkursu, sl\u0113gtu konkursu vai sarunu proced\u016bru, iepriek\u0161 public\u0113jot pazi\u0146ojumu par l\u012bgumu. Min\u0113tie apst\u0101k\u013ci, kas pamato \u0101rk\u0101rtas situ\u0101ciju, nedr\u012bkst b\u016bt atkar\u012bgi no pas\u016bt\u012bt\u0101ja darb\u012bbas.<\/p>\n<p>K\u0101 redzams, \u0161\u012b ties\u012bbu norma paredz vair\u0101kus apst\u0101k\u013cus un ir sare\u017e\u0123\u012bt\u0101ka p\u0113c konstrukcijas nek\u0101 citi 63. panta pirmaj\u0101 da\u013c\u0101 min\u0113tie pamati sarunu proced\u016bras piem\u0113ro\u0161anai. Proti, apst\u0101k\u013ciem, kuru d\u0113\u013c ir j\u0101piem\u0113ro sarunu proced\u016bra, ir j\u0101b\u016bt <em>\u0101rk\u0101rtas<\/em> un <strong>neparedzamiem.<\/strong> <\/p>\n<p>Lai sarunu proced\u016bras izv\u0113le b\u016btu pamatota, nepietiek konstat\u0113t faktu, ka laika tr\u016bkuma d\u0113\u013c nav iesp\u0113jams piem\u0113rot Likum\u0101 noteikt\u0101s iepirkuma proced\u016bras (atkl\u0101tu vai sl\u0113gtu konkursu vai sarunu proced\u016bru, iepriek\u0161 public\u0113jot pazi\u0146ojumu par l\u012bgumu), pas\u016bt\u012bt\u0101jam j\u0101sp\u0113j pier\u0101d\u012bt, ka attiec\u012bg\u0101 situ\u0101cija izveidojusies no pas\u016bt\u012bt\u0101ja neatkar\u012bgu un objekt\u012bvi neparedzamu apst\u0101k\u013cu d\u0113\u013c<sup><a href=\"#fn5\" id=\"ref5\">5<\/a><\/sup>. <\/p>\n<p>Nedz Direkt\u012bv\u0101 2004\/18, nedz Publisko iepirkumu likum\u0101 nav izskaidrots j\u0113dziens <em>\u0101rk\u0101rtas apst\u0101k\u013ci<\/em>. Likumdev\u0113js ties\u012bbu tekst\u0101 iek\u013cauj ar\u012b bie\u017ei lietotu, saturiski ietilp\u012bgu, bet \u012bsi, da\u017eos v\u0101rdos formul\u0113tu j\u0113dzienu, kas ietver p\u0113c iesp\u0113jas vair\u0101ku darb\u012bbu raksturojumus \u2013 \u0123ener\u0101lklauzulas, ar ko saprot normat\u012bvu ties\u012bbu j\u0113dzienu, kas piepild\u0101ms ar noteiktu saturu<sup><a href=\"#fn6\" id=\"ref6\">6<\/a><\/sup>. K\u0101 redzams, PIL min\u0113tais j\u0113dziens \u0101rk\u0101rtas apst\u0101k\u013ci ir uzskat\u0101ms par \u0123ener\u0101lklauzulu, kas piepild\u0101ms ar saturu, \u0146emot v\u0113r\u0101 judikat\u016bras un ties\u012bbu zin\u0101tnes atzi\u0146as. <\/p>\n<p>Atsaucoties uz Eiropas Savien\u012bbas tiesas spriedumiem, Iepirkumu uzraudz\u012bbas birojs atz\u012bst, ka \u201epar neparedzamiem \u0101rk\u0101rtas apst\u0101k\u013ciem uzskat\u0101mi apst\u0101k\u013ci, kuri iziet \u0101rpus norm\u0101las ekonomisk\u0101s un soci\u0101l\u0101s situ\u0101cijas robe\u017e\u0101m (piem\u0113ram, av\u0101rijas vai dabas katastrofas) un kuru d\u0113\u013c radusies neatliekama nepiecie\u0161am\u012bba veikt iepirkumus neparedzamo \u0101rk\u0101rtas apst\u0101k\u013cu izrais\u012bto seku nov\u0113r\u0161anai.\u201d<sup><a href=\"#fn7\" id=\"ref7\">7<\/a><\/sup>. P\u0113c b\u016bt\u012bbas \u0161ie apst\u0101k\u013ci ir piel\u012bdzin\u0101mi <em>force majeure<\/em> situ\u0101cij\u0101m, ko pas\u016bt\u012bt\u0101js nav sp\u0113jis nedz paredz\u0113t, nedz jebk\u0101d\u0101 veid\u0101 tos ietekm\u0113t vai nov\u0113rst. <\/p>\n<p>Pas\u016bt\u012bja nesp\u0113ju ietekm\u0113t \u0101rk\u0101rtas apst\u0101k\u013cus uzsver ar\u012b Direkt\u012bvas 2004\/18 31. panta pirm\u0101s da\u013cas <em>c<\/em> apak\u0161punkt\u0101 nor\u0101d\u012btais. \u201eLietas apst\u0101k\u013ci, uz kuriem atsaucas, pamatojot \u0101rk\u0101rt\u0113ju steidzam\u012bbu, nek\u0101d\u0101 zi\u0146\u0101 nedr\u012bkst b\u016bt radu\u0161ies l\u012bgumsl\u0113dz\u0113jas iest\u0101des d\u0113\u013c.\u201d<\/p>\n<p>Rezum\u0113jot var secin\u0101t, ka PIL izpratn\u0113 \u0101rk\u0101rtas apst\u0101k\u013cu paz\u012bmes ir \u0161\u0101das: <\/p>\n<ul>\n1. gad\u012bjums, kas ir \u0101rpus norm\u0101las ekonomisk\u0101s un soci\u0101l\u0101s situ\u0101cijas robe\u017e\u0101m;<br \/>\n2. apst\u0101k\u013cu iest\u0101\u0161anos nebija iesp\u0113jams un personai nebija pien\u0101kums paredz\u0113t;<br \/>\n3. persona nevar\u0113ja paredz\u0113t \u0101rk\u0101rtas apst\u0101k\u013cu iest\u0101\u0161anos un nov\u0113rst sekas, kas rodas \u0161o apst\u0101k\u013cu d\u0113\u013c.<\/ul>\n<p>Attiec\u012bgi gad\u012bjum\u0101, ja pas\u016bt\u012bt\u0101js v\u0113las piem\u0113rot sarunu proced\u016bru, ir j\u0101p\u0101rliecin\u0101s, vai pas\u016bt\u012bt\u0101ja mot\u012bvi, piem\u0113rojot sarunu proced\u016bru, ir uzskat\u0101mi par atbilsto\u0161iem ties\u012bbu aktos un judikat\u016br\u0101 min\u0113taj\u0101m defin\u012bcij\u0101m, proti, \u0101rk\u0101rtas apst\u0101k\u013cu j\u0113dzienam. <\/p>\n<p>Da\u017ereiz rodas situ\u0101cijas, kad pas\u016bt\u012bt\u0101js par \u0101rk\u0101rtas apst\u0101k\u013ciem uzskata gad\u012bjumus, kad vair\u0101kk\u0101rt\u012bgi notiek konkursa rezult\u0101tu apstr\u012bd\u0113\u0161ana, kuras sekas ir nenov\u0113r\u0161ama noteiktu projektu \u012bsteno\u0161anas termi\u0146a tuvo\u0161an\u0101s, kas apdraud noteiktu projektu realiz\u0101ciju vai Eiropas Savien\u012bbas l\u012bdzfinans\u0113juma sa\u0146em\u0161anu. <\/p>\n<p>Iepriek\u0161 min\u0113tais arguments, ka pas\u016bt\u012bt\u0101js nevar\u0113ja paredz\u0113t iepirkuma proced\u016bras rezult\u0101tu ilgsto\u0161as apstr\u012bd\u0113\u0161anas situ\u0101ciju, kuras d\u0113\u013c tiek apdraud\u0113ta noteikta projekta \u012bsteno\u0161ana, nav atbilsto\u0161s nedz ties\u012bbu norm\u0101m, nedz judikat\u016brai. <\/p>\n<p>Izskatot iepirkumu proced\u016bru organiz\u0113\u0161anas praksi, it \u012bpa\u0161i liela apjoma iepirkuma proced\u016bras, gad\u012bjumi, kad proced\u016bra norisin\u0101s bez rezult\u0101tu apstr\u012bd\u0113\u0161anas ir tik reti, ka uzskat\u0101mi par iz\u0146\u0113muma situ\u0101cij\u0101m nevis par likumsakar\u012bbu. L\u012bdz ar to pas\u016bt\u012bt\u0101jam ir j\u0101r\u0113\u0137in\u0101s ar to, ka t\u0101 organiz\u0113t\u0101s iepirkuma proced\u016bras var tikt apstr\u012bd\u0113tas, un j\u0101paredz noteikts termi\u0146\u0161 str\u012bdu risin\u0101\u0161anai kop\u0113j\u0101 projekta izpildes laika grafik\u0101. <\/p>\n<p>Turkl\u0101t, k\u0101 iepriek\u0161 tika nor\u0101d\u012bts, par \u0101rk\u0101rtas apst\u0101k\u013cu iest\u0101\u0161anos nedr\u012bkst b\u016bt vainojams pas\u016bt\u012bt\u0101js, kas noz\u012bm\u0113 to, ka \u0161\u012b PIL norma dod pamatu r\u012bkot sarunu proced\u016bru tikai t\u0101d\u0101s situ\u0101cij\u0101s, kas piel\u012bdzin\u0101mas <em>force majeure<\/em> apst\u0101k\u013ciem, piem\u0113ram, dabas katastrofas, ugunsgr\u0113ki utt. Tom\u0113r j\u0101nor\u0101da, ka nav univers\u0101la l\u012bdzek\u013ca, ar kuru pal\u012bdz\u012bbu var noteikt, vai sarunu izv\u0113les pamatojums ir atbilsto\u0161s PIL un katrs gad\u012bjums ir v\u0113rt\u0113jams atsevi\u0161\u0137i. <\/p>\n<p><strong>PIL 63. panta ceturt\u0101s da\u013cas 1. punkts<\/strong><\/p>\n<p>K\u0101 iepriek\u0161 tika nor\u0101d\u012bts, pas\u016bt\u012bt\u0101jam ir ties\u012bbas piem\u0113rot sarunu proced\u016bru saska\u0146\u0101 ar PIL 63. panta ceturt\u0101s da\u013cas 1. punktu, ja tam ir nepiecie\u0161ami papildu b\u016bvdarbi vai pakalpojumi, kuri s\u0101kotn\u0113ji netika iek\u013cauti l\u012bgum\u0101 vai b\u016bvniec\u012bbas projekt\u0101, bet kuri <em>neparedzamu apst\u0101k\u013cu<\/em> d\u0113\u013c k\u013cuvu\u0161i nepiecie\u0161ami iepriek\u0161 nosl\u0113gt\u0101 l\u012bguma izpildei, un tiek iev\u0113roti \u0161\u0101di nosac\u012bjumi:<\/p>\n<ul>\na) kop\u0113j\u0101 l\u012bgumcena papildu iepirkuma l\u012bgumos nep\u0101rsniedz 50 procentus no iepriek\u0161 nosl\u0113gt\u0101 l\u012bguma l\u012bgumcenas;<br \/>\nb) nepiecie\u0161amos papildu b\u016bvdarbus veic vai pakalpojumus sniedz iepriek\u0161 nosl\u0113gt\u0101 l\u012bguma izpild\u012bt\u0101js;<br \/>\nc) papildu b\u016bvdarbus vai pakalpojumus nevar tehniski vai ekonomiski nodal\u012bt no iepriek\u0161 nosl\u0113gtaj\u0101 l\u012bgum\u0101 paredz\u0113tajiem b\u016bvdarbiem vai pakalpojumiem, neradot iev\u0113rojamas gr\u016bt\u012bbas pas\u016bt\u012bt\u0101jam, vai ar\u012b papildu b\u016bvdarbi vai pakalpojumi ir b\u016btiski nepiecie\u0161ami iepriek\u0161 nosl\u0113gt\u0101 l\u012bguma izpildei, kaut ar\u012b tos iesp\u0113jams nodal\u012bt no \u0161aj\u0101 l\u012bgum\u0101 paredz\u0113to b\u016bvdarbu izpildes vai pakalpojumu snieg\u0161anas.<\/ul>\n<p>Turkl\u0101t, ja tr\u016bkst kaut viens no \u0161iem apst\u0101k\u013ciem, sarunu proced\u016bras izv\u0113le nav pamatota<sup><a href=\"#fn8\" id=\"ref8\">8<\/a><\/sup>.<\/p>\n<p>No iepriek\u0161 min\u0113t\u0101 ir secin\u0101ms, ka \u0161\u012b ties\u012bbu norma ir piem\u0113rojama, ja:<\/p>\n<ul>\n1. nepiecie\u0161amie darbi ir papildu b\u016bvdarbi, kas s\u0101kotn\u0113ji nebija iek\u013cauti projekt\u0101 un radu\u0161ies neparedzamu apst\u0101k\u013cu d\u0113\u013c;<br \/>\n2. \u0161ie b\u016bvdarbi papildus iepriek\u0161 min\u0113tajam atbilst PIL 63. panta ceturt\u0101s da\u013cas 1. punkta <em>a, b<\/em> un <em>c<\/em> apak\u0161punktiem.\n<\/ul>\n<p>Min\u0113t\u0101s atzi\u0146as konstat\u0113jamas ar\u012b Iepirkumu uzraudz\u012bbas biroja vadl\u012bnij\u0101s, kur\u0101s nor\u0101d\u012bts, ka, lai sarunu proced\u016bras izv\u0113les pamatojums b\u016btu atbilsto\u0161s PIL, pas\u016bt\u012bt\u0101jam j\u0101pier\u0101da atbilst\u012bba visiem PIL noteiktajiem nosac\u012bjumiem vienlaikus<sup><a href=\"#fn9\" id=\"ref9\">9<\/a><\/sup>.<\/p>\n<p>Tas noz\u012bm\u0113, ka, tikai \u012bstenojoties visiem Publisko iepirkumu likuma 63. panta ceturt\u0101s da\u013cas pirmaj\u0101 punkt\u0101 nor\u0101d\u012btajiem apst\u0101k\u013ciem, pas\u016bt\u012bt\u0101js ir ties\u012bgs piem\u0113rot sarunu proced\u016bru. Turkl\u0101t j\u0101piev\u0113r\u0161 uzman\u012bba tam, ka, lai piem\u0113rotu sarunu proced\u016bru uz \u0161\u012bs ties\u012bbu normas pamata, apst\u0101k\u013ciem nav nepiecie\u0161ams <em>\u0101rk\u0101rtas<\/em> raksturs.<br \/>\nL\u012bdz ar to uzskat\u012bt, ja no radu\u0161\u0101s situ\u0101cijas redzams, ka pas\u016bt\u012bt\u0101jam ir bijis pien\u0101kums un iesp\u0113jas paredz\u0113t situ\u0101ciju, kas tiek izmantota par pamatu sarunu proced\u016bras piem\u0113ro\u0161anai, \u0161\u0101da sarunas proced\u016bras izv\u0113le nav atbilsto\u0161a PIL norm\u0101m. <\/p>\n<p>L\u012bdz\u012bgu viedokli pau\u017e ar\u012b Iepirkumu uzraudz\u012bbas birojs, proti, par neparedzamiem apst\u0101k\u013ciem nav uzskat\u0101mi apst\u0101k\u013ci, kurus pas\u016bt\u012bt\u0101jam bija j\u0101paredz (piem\u0113ram, nepiecie\u0161am\u012bba labiek\u0101rtot teritoriju, ier\u012bkot piebraucamos ce\u013cus), pas\u016bt\u012bt\u0101ja vajadz\u012bbas mai\u0146a (piem\u0113ram, v\u0113lme main\u012bt telpu pl\u0101nojumu vai \u0113kas pielietojumu), ietaup\u012bti finan\u0161u l\u012bdzek\u013ci (papildu darbu veik\u0161ana), k\u0101 ar\u012b nepiecie\u0161am\u012bba pabeigt b\u016bvdarbus l\u012bdz noteiktam datumam<sup><a href=\"#fn10\" id=\"ref10\">10<\/a><\/sup>. <\/p>\n<p>Turkl\u0101t saska\u0146\u0101 ar iepriek\u0161 min\u0113to attiec\u012bg\u0101s situ\u0101cijas neparedzam\u012bba un steidzam\u012bba ir radusies pas\u016bt\u012bt\u0101ja r\u012bc\u012bbas rezult\u0101t\u0101, un ar\u012b \u0161aj\u0101 gad\u012bjum\u0101 neparedzamie apst\u0101k\u013ci nedr\u012bkst b\u016bt atkar\u012bgi no pas\u016bt\u012bt\u0101ja, piem\u0113ram, no t\u0101 nepietiekami operat\u012bvas r\u012bc\u012bbas<sup><a href=\"#fn11\" id=\"ref11\">11<\/a><\/sup>.<\/p>\n<p>Par atbilsto\u0161u pamatu sarunu proced\u016bras r\u012bko\u0161anai b\u016btu uzskat\u0101ms da\u017e\u0101du \u0123eolo\u0123isku vai tehnisku apst\u0101k\u013cu atkl\u0101\u0161an\u0101s b\u016bvniec\u012bbas proces\u0101, kurus pl\u0101no\u0161anas un projekta izstr\u0101des stadij\u0101 nebija iesp\u0113jams atkl\u0101t, vai tos bija iesp\u0113jams konstat\u0113t, tikai uzs\u0101kot darbu izpildi. Tom\u0113r ar\u012b \u0161aj\u0101 gad\u012bjum\u0101 ir j\u0101nor\u0101da, ka katrs sarunu proced\u016bras gad\u012bjums izv\u0113rt\u0113jams atsevi\u0161\u0137i, un \u0146emot v\u0113r\u0101 sarunu proced\u016bras iz\u0146\u0113muma raksturu, pas\u016bt\u012bt\u0101jam ir r\u016bp\u012bgi j\u0101izv\u0113rt\u0113 pamatojuma atbilst\u012bbu Publisko iepirkumu likuma pras\u012bb\u0101m.<\/p>\n<p>\u0145emot v\u0113r\u0101 visu iepriek\u0161 min\u0113to, j\u0101secina, ka sarunu proced\u016bra, nepublic\u0113jot pazi\u0146ojumu par l\u012bgumu, ir iz\u0146\u0113muma proced\u016bra, kas ir izmantojama tikai \u0101rk\u0101rtas un neparedzamu apst\u0101k\u013cu nov\u0113r\u0161anai. Sarunu proced\u016bras, nepublic\u0113jot pazi\u0146ojumu par l\u012bgumu, iz\u0146\u0113muma statuss saist\u0101ms ar to, ka \u0161aj\u0101 proced\u016br\u0101 ir visliel\u0101kie konkurences un br\u012bv\u0101 tirgus ierobe\u017eojumi, k\u0101 ar\u012b neefekt\u012bvas l\u012bdzek\u013cu izmanto\u0161anas riski.
