Iepirkumu m\u0113r\u0137is bija steidzami nodro\u0161in\u0101t Latvijas vesel\u012bbas ap\u016bpes un dro\u0161\u012bbas iest\u0101des ar IAL. Neraugoties uz izvirz\u012btaj\u0101m kvalit\u0101tes pras\u012bb\u0101m un pieg\u0101des ierobe\u017eojumiem, gatav\u012bbu nodro\u0161in\u0101t IAL pieteic\u0101s neparasti daudz uz\u0146\u0113mumu. Ir pien\u0101cis laiks izv\u0113rt\u0113t IAL nodro\u0161in\u0101\u0161anas procesu un pilnveidot IAL pieejam\u012bbu n\u0101kotn\u0113.<\/p>\n<p>Lai nodro\u0161in\u0101tu Covid-19 izplat\u012bbas ierobe\u017eo\u0161anai nepiecie\u0161amo individu\u0101lo aizsardz\u012bbas un dezinfekcijas l\u012bdzek\u013cu kr\u0101jumu rezerves vismaz tr\u012bs m\u0113ne\u0161iem, 2020.gada 2.apr\u012b\u013ca Ministru kabineta s\u0113d\u0113 tika pie\u0146emts l\u0113mums aizsardz\u012bbas l\u012bdzek\u013cu centraliz\u0113tos iepirkumus visu valsts instit\u016bciju vajadz\u012bb\u0101m veikt Aizsardz\u012bbas ministrijai. Aizsardz\u012bbas ministrija aicin\u0101ja uz sadarb\u012bbu medic\u012bnisko masku, respiratoru, virsvalku, bahilu, dezinfekcijas l\u012bdzek\u013cu un citu l\u012bdzek\u013cu ra\u017eot\u0101jus un izplat\u012bt\u0101jus. Inform\u0101cija par IAL sarakstu, pre\u010du un pakalpojumu raksturojumu, inform\u0101ciju par iepirkumu gaitu un kontaktinform\u0101ciju atrodama Aizsardz\u012bbas ministrijas t\u012bmek\u013cvietn\u0113.<\/p>\n<p>Tom\u0113r publiski izskan\u0113jusi uz\u0146\u0113m\u0113ju neapmierin\u0101t\u012bba un ap\u0161aub\u012bta publisko iepirc\u0113ju godpr\u0101t\u012bba. \u0160\u0101di tiek rad\u012bts precedents, ka sabiedr\u012bbas vesel\u012bba ar\u012b \u0101rk\u0101rtas situ\u0101cij\u0101s ir atkar\u012bga no pieg\u0101d\u0101t\u0101ju &#8211; uz\u0146\u0113m\u0113ju savstarp\u0113jo attiec\u012bbu k\u0101rto\u0161anas. <b>DAIF Latvija<\/b> valdes priek\u0161s\u0113d\u0113t\u0101ja <b>El\u012bna Egle<\/b> pau\u017e ba\u017eas, ka <i>&#8220;Laik\u0101, kad Latvijas tautsaimniec\u012bb\u0101 svar\u012bgi sa\u0146emt stimulus un \u012bstenot publiskos att\u012bst\u012bbas projektus nodarbin\u0101t\u012bbas veicin\u0101\u0161anai un ekonomikas atjauno\u0161anai, pas\u016bt\u012bt\u0101ji pat\u0113r\u0113 laika resursu, lai rakst\u012btu atbildes uz\u0146\u0113mumiem, kuru kompetence un pieredze IAL ra\u017eo\u0161an\u0101 vai pieg\u0101d\u0113 praktiski nepast\u0101v.&#8221;<\/i><\/p>\n<p><b>DAIF Latvija<\/b> v\u0113r\u0161 uzman\u012bbu, ka p\u0101rmetumiem j\u0101b\u016bt pamatotiem un le\u0123it\u012bmiem, t\u0101d\u0113\u013c sniedz izv\u0113rstu juridisko skaidrojumu par normat\u012bvajos aktos noteiktaj\u0101m iesp\u0113j\u0101m un ierobe\u017eojumiem publiskajos iepirkumos \u0101rk\u0101rtas situ\u0101cij\u0101. <b>DAIF Latvija<\/b> uzskata, ka nepamatoti p\u0101rmetumi publisko pas\u016bt\u012bjumu veic\u0113jiem veido augsni negod\u012bgai konkurencei, tiesiskajam nihilismam un kvalitat\u012bvu speci\u0101listu aizpl\u016b\u0161anai no valsts p\u0101rvaldes.<\/p>\n<p><i>Skaidrojam, ka Publisko iepirkumu likuma (turpm\u0101k &#8211; PIL) 3.panta 8.da\u013c\u0101 ir noteikts, ka \u0161o likumu nepiem\u0113ro, ja t\u0101 piem\u0113ro\u0161ana var\u0113tu rad\u012bt kait\u0113jumu b\u016btisku valsts dro\u0161\u012bbas intere\u0161u aizsardz\u012bbai. Par b\u016btisku valsts dro\u0161\u012bbas intere\u0161u aizsardz\u012bbu katr\u0101 konkr\u0113taj\u0101 gad\u012bjum\u0101 lemj Ministru kabinets. Iz\u0146\u0113muma piem\u0113ro\u0161anas pamats nav ne steidzam\u012bba, nedz ar\u012b aizsarg\u0101jama inform\u0101cija pati par sevi, ja t\u0101s aizsardz\u012bbu var nodro\u0161in\u0101t iepirkuma proced\u016br\u0101s saska\u0146\u0101 ar \u0161o likumu vai aizsardz\u012bbas un dro\u0161\u012bbas jomas iepirkumus regul\u0113jo\u0161iem normat\u012bvajiem aktiem.<\/i><\/p>\n<p>Min\u0113t\u0101 panta piem\u0113ro\u0161anas priek\u0161noteikums ir atsevi\u0161\u0137s MK l\u0113mums, t\u0101d\u0113\u013c konkr\u0113taj\u0101 gad\u012bjum\u0101 attiec\u012bb\u0101 uz COVID 19 izplat\u012bbas ierobe\u017eo\u0161anu 2020.gada 12.mart\u0101 tika izdots MK r\u012bkojums Nr. 103 <b>&#8220;Par \u0101rk\u0101rt\u0113j\u0101s situ\u0101cijas izsludin\u0101\u0161anu&#8221;<\/b>. \u0160o noteikumi 4.14. un 4.14.1 punkt\u0101 tika at\u013cauts konkr\u0113t\u0101m instit\u016bcij\u0101m nepiem\u0113rot PIL ieg\u0101d\u0113m (prec\u0113m un pakalpojumiem), kas nepiecie\u0161amas Covid-19 uzliesmojuma izplat\u012bbas ierobe\u017eo\u0161anai, \u0101rstniec\u012bbai un attiec\u012bgo pas\u0101kumu organiz\u0113\u0161anai, k\u0101 ar\u012b att\u0101lin\u0101t\u0101 m\u0101c\u012bbu procesa nodro\u0161in\u0101\u0161anai.<\/p>\n<p><b>DAIF Latvija<\/b> v\u0113r\u0161 uzman\u012bbu, ka konkr\u0113to iepirkumu veik\u0161ana, nepiem\u0113rojot PIL, ir at\u0161\u0137ir\u012bga no gad\u012bjumiem, kad iepirkums tiek veikts atbilsto\u0161i PIL noteikumiem, kaut vai veicot sarunu proced\u016bru atbilsto\u0161i PIL 8.panta 7.da\u013cas 3.punktam. <b>DAIF Latvija<\/b> uzsver, ka pas\u016bt\u012bt\u0101jam \u0101rk\u0101rtas situ\u0101cij\u0101 ir normat\u012bv\u0101 b\u0101ze un pien\u0101kums nodro\u0161in\u0101t vesel\u012bbas apr\u016bpes un dro\u0161\u012bbas iest\u0101\u017eu darbiniekus ar kvalitat\u012bviem IAL savlaic\u012bgi.<\/p>\n<p>Faktiski visu l\u012bgumsl\u0113g\u0161anas procesu var veikt vien\u0101 dien\u0101, jo neviens ties\u012bbu akts pas\u016bt\u012bt\u0101ju neierobe\u017eo ar nek\u0101diem termi\u0146iem, bet teor\u0113tiski iepirkumam j\u0101notiek \u0161\u0101d\u0101 k\u0101rt\u012bb\u0101: defin\u0113ta pas\u016bt\u012bt\u0101ja vajadz\u012bba; apzin\u0101ts iesp\u0113jamais pieg\u0101d\u0101t\u0101ju loks; izv\u0113l\u0113ts viens vai vair\u0101ki pieg\u0101d\u0101t\u0101ji, ko uzaicina uz sarun\u0101m un pieprasa iesniegt pied\u0101v\u0101jumu; izv\u0113rt\u0113ts sa\u0146emtais pied\u0101v\u0101jums; pie\u0146emts l\u0113mums par l\u012bguma sl\u0113g\u0161anu; nosl\u0113gts l\u012bgums; sa\u0146emta prece.<\/p>\n<p>L\u012bdz ar to \u0161aj\u0101 gad\u012bjum\u0101 attiec\u012bb\u0101 uz COVID 19 \u0101rk\u0101rtas situ\u0101ciju bija j\u0101vada no PIL 3.panta 8.da\u013c\u0101 noteikt\u0101 nevis j\u0101veic sarunu proced\u016bra atbilsto\u0161i PIL 8.panta 7.da\u013cas 3.punktam. Ir ar\u012b KNAB vadl\u012bnijas par \u0161\u0101du iepirkumu veik\u0161anu, IUB un FM vadl\u012bnijas. Un IUB ir sniedzis skaidrojumu, ka at\u013cauja neveikt iepirkuma proced\u016bru piem\u0113rojama, \u0146emot v\u0113r\u0101 labas p\u0101rvald\u012bbas principu, sp\u0113k\u0101 eso\u0161os normat\u012bvos aktus, tostarp Publiskas personas finan\u0161u l\u012bdzek\u013cu un mantas iz\u0161\u0137\u0113rd\u0113\u0161anas nov\u0113r\u0161anas likumu, likumu &#8220;Par intere\u0161u konflikta nov\u0113r\u0161anu valsts amatpersonu darb\u012bb\u0101&#8221;, Starptautisko un Latvijas Republikas nacion\u0101lo sankciju likumu, k\u0101 ar\u012b publisko iepirkumu regul\u0113jo\u0161o normat\u012bvo aktu m\u0113r\u0137i.<\/p>\n<p>Likums <i>&#8220;Par intere\u0161u konflikta nov\u0113r\u0161anu valsts amatpersonu darb\u012bb\u0101&#8221;<\/i> nosaka, ka nevar preci vai pakalpojumu nevar ieg\u0101d\u0101ties no radiniekiem un cit\u0101m likum\u0101 uzskait\u012bt\u0101m person\u0101m.<\/p>\n<p><b>DAIF Latvija<\/b> v\u0113r\u0161 uzman\u012bbu uz b\u016btisk\u0101m valsts dro\u0161\u012bbas interes\u0113m, kuru aizsardz\u012bbai izdots MK r\u012bkojums par PIL 3.panta 8.da\u013cas piem\u0113ro\u0161anu. Valsts dro\u0161\u012bbas intereses ir cilv\u0113ka vesel\u012bba un dz\u012bv\u012bba. L\u012bdz ar to faktiski visi PIL principi tika izv\u0113rt\u0113ti no cilv\u0113ka vesel\u012bbas un dz\u012bv\u012bbas prizmas.<\/p>\n<p>Tika nodro\u0161in\u0101ta pieg\u0101d\u0101t\u0101ju br\u012bva konkurence, k\u0101 ar\u012b vienl\u012bdz\u012bga un taisn\u012bga attieksme pret tiem. Savuk\u0101rt steidzamai nepiecie\u0161amo pre\u010du pieg\u0101dei bija iz\u0161\u0137iro\u0161a noz\u012bme. Mantisk\u0101s intereses, kuras nostiprina vienl\u012bdz\u012bgas attieksmes principi pret pieg\u0101d\u0101t\u0101jiem, nek\u0101d\u0101 gad\u012bjum\u0101 nav v\u0113rt\u0113jamas augst\u0101k k\u0101 cilv\u0113ka dz\u012bv\u012bba un vesel\u012bba. Un tika nodro\u0161in\u0101ta pas\u016bt\u012bt\u0101ja l\u012bdzek\u013cu efekt\u012bva izmanto\u0161ana, apzinoties, ka, finan\u0161u l\u012bdzek\u013ci ir ierobe\u017eoti, un to neefekt\u012bva izmanto\u0161ana var rad\u012bt situ\u0101ciju, ka pas\u016bt\u012bt\u0101jam vairs nav l\u012bdzek\u013cu turpm\u0101ko pre\u010du ieg\u0101dei.<\/p>\n<p>\u0160ie principi nav j\u0101nost\u0101da viens pret otru, iesp\u0113jams, ka tie ir j\u0101sarindo priorit\u0101r\u0101 sec\u012bb\u0101. Tipiska ir situ\u0101cija, kur\u0101 piem\u0113rojot PIL, konkurenti apgalvo, ka vi\u0146i var\u0113ja veikt pas\u016bt\u012bjumu l\u0113t\u0101k vai lab\u0101k, bet uzvar\u0113ja tas, kuram ir &#8220;blats&#8221; pie pas\u016bt\u012bt\u0101ja. Bet \u0101rk\u0101rtas situ\u0101cij\u0101 PIL nav j\u0101piem\u0113ro un \u0161\u0101di koment\u0101ri ir neviet\u0101.<\/p>\n<p>Tikai konstrukt\u012bvi un juridiski pamatoti p\u0101rmetumi l\u0113mumu pie\u0146\u0113m\u0113jiem uzlabos apg\u0101di ar IAL \u0101rk\u0101rtas situ\u0101cij\u0101s.
