P\u0113c Iepirkumu uzraudz\u012bbas biroja datiem, 2019. gad\u0101 96% p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumi finansi\u0101l\u0101 izteiksm\u0113 atz\u012bm\u0113ti k\u0101 veikti atbilsto\u0161i za\u013c\u0101 iepirkuma pras\u012bb\u0101m. Vai tie\u0161\u0101m gandr\u012bz visi p\u0101rtikas iepirkumi Latvij\u0101 atbilst za\u013c\u0101 iepirkuma pras\u012bb\u0101m? Detaliz\u0113ta izp\u0113te liecina, ka n\u0113.<\/b><\/p>\n<p>Sekojot l\u012bdzi noris\u0113m Eiropas Savien\u012bb\u0101 (ES) un ar m\u0113r\u0137i veicin\u0101t Latvijas produktu ien\u0101k\u0161anu sabiedriskaj\u0101 \u0113din\u0101\u0161an\u0101, Latvijas vald\u012bba 2014. gad\u0101 izdeva Ministru kabineta (MK) noteikumus <i>\u201cNoteikumi par vides krit\u0113riju piem\u0113ro\u0161anu un pied\u0101v\u0101juma izv\u0113les krit\u0113riju noteik\u0161anu p\u0101rtikas produktu pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumu iepirkumiem\u201d<\/i>, padarot za\u013co publisko iepirkumu (ZPI) piem\u0113ro\u0161anu k\u0101 oblig\u0101tu p\u0101rtikas pieg\u0101des un \u0113din\u0101\u0161anas pakalpojumiem. 2017.gad\u0101 \u0161\u012bs pras\u012bbas tika p\u0101rskat\u012btas un iek\u013cautas k\u0101 oblig\u0101tas MK not. Nr. 353 <i>\u201cPras\u012bbas za\u013cajam publiskajam iepirkumam un to piem\u0113ro\u0161anas k\u0101rt\u012bba\u201d<\/i>. Atbilst\u012bbu valsts regul\u0113jumam par ZPI Latvij\u0101 p\u0101rtikas produktiem var pan\u0101kt div\u0113j\u0101di. Viena iesp\u0113ja ir piem\u0113rot zem\u0101k\u0101s cenas principu, tad  iepirkuma specifik\u0101cij\u0101 j\u0101iek\u013cauj visi ZPI krit\u0113riji. Otra iesp\u0113ja ir izmantot saimnieciski izdev\u012bg\u0101k\u0101 iepirkuma principu, tad paral\u0113li cenu krit\u0113rijam j\u0101izv\u0113las viens krit\u0113rijs no trim krit\u0113riju grup\u0101m<\/p>\n<ol>\n<li> no p\u0101rtikas kvalit\u0101tes (biolo\u0123isk\u0101 vai integr\u0113t\u0101 ra\u017eo\u0161anas metode vai nacion\u0101l\u0101 p\u0101rtikas kvalit\u0101tes sh\u0113ma),<\/li>\n<li> nesatur \u0122MO un<\/li>\n<li> iepakojuma, pieg\u0101des vai sezonalit\u0101tes krit\u0113riju grupas.<\/li>\n<\/ol>\n<p>Tas noz\u012bm\u0113, ka iepirkums, kas piln\u012bb\u0101 atbilst Latvijas valsts ZPI krit\u0113rijiem p\u0101rtikas produktiem, var neatbilst Eiropas Komisijas noteiktajiem pamatkrit\u0113rijiem p\u0101rtikai  (2008., 2019. gads), piem\u0113ram, tas <i>var neietvert biolo\u0123isko p\u0101rtiku<\/i>.<\/p>\n<p>Saska\u0146\u0101 ar MK not. Nr. 353 visiem p\u0101rtikas produktu pieg\u0101des publiskajiem iepirkumiem j\u0101atbilst ZPI krit\u0113rijiem. 2017. gad\u0101 saska\u0146\u0101 ar <b>pirkumu uzraudz\u012bbas biroja<\/b> (IUB) datiem, iepirkumu veic\u0101ji 54%, 2018. gad\u0101 jau 90% no visiem p\u0101rtikas produktu konkursiem atz\u012bm\u0113ja k\u0101 ZPI.<\/p>\n<p>Raksta autores, lai noskaidrotu ZPI krit\u0113riju ievie\u0161anu un piem\u0113ro\u0161anu p\u0101rtikas iepirkumos, veica padzi\u013cin\u0101tu p\u0113t\u012bjumu. Autores izmantoja IUB datub\u0101z\u0113 public\u0113to inform\u0101ciju, kas apkopo visus pazi\u0146ojumus par publiskajiem konkursiem, k\u0101 ar\u012b apkopoja iepirkumu dokument\u0101ciju p\u0101rtikas produktiem izgl\u012bt\u012bbas iest\u0101d\u0113m, kas pieejama tie\u0161saist\u0113 pa\u0161vald\u012bbu m\u0101jas lap\u0101s. Autores analiz\u0113ja iepirkumus, kas tika public\u0113ti laika posm\u0101 no 01.07.2017. l\u012bdz pat 01.07.2018 &#8211; pavisam 97 publik\u0101cijas, bet da\u013ca no t\u0101m izsl\u0113dza no t\u0101l\u0101k\u0101s anal\u012bzes, jo dokument\u0101cija tiessist\u0113 nebija pieejama vai konkursi nosl\u0113gu\u0161ies bez rezult\u0101ta. Kopum\u0101 autores analiz\u0113ja 73 pied\u0101v\u0101jumus par p\u0101rtikas pieg\u0101d\u0113m, uzskaitot  piem\u0113rotos krit\u0113rijus, un p\u0101rbaud\u012bja, vai p\u0101rbaudes l\u012bdzek\u013ci ir pietiekami.<\/p>\n<p>Lai noskaidrotu valsts ZPI regul\u0113jum\u0101 piem\u0113roto krit\u0113riju noz\u012bmi vides aizsardz\u012bb\u0101, autori iztauj\u0101ja 10 Latvijas ekspertus, kas str\u0101d\u0101 ZPI jom\u0101, un, izmantojot aptauju, l\u016bdzot tos sarindot skal\u0101 no viens (maz\u0101k\u0101) l\u012bdz pieci (liel\u0101k\u0101 da\u013ca) valsts regul\u0113jum\u0101 p\u0101rtiks produktiem iek\u013cauto krit\u0113riju noz\u012bm\u012bgumu un efektivit\u0101ti. Aptauj\u0101ti vides eksperti bija <i>5 v\u012brie\u0161i un 5 sievietes<\/i>, visi ar augst\u0101ko izgl\u012bt\u012bbu, str\u0101d\u0101ja vides aizsardz\u012bbas jom\u0101 no<i> 5 l\u012bdz vair\u0101k nek\u0101 21 gadam<\/i>, un 50% no tiem bija augst\u0101k\u0101 izgl\u012bt\u012bba ar\u012b vides zin\u0101tn\u0113s.<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">K\u0101di ir izmantotie ZPI krit\u0113rijus p\u0101rtikas produktu pieg\u0101d\u0113m?<\/span><\/strong><\/p>\n<p>Visbie\u017e\u0101k tiek izmantots ZPI krit\u0113rijs, ka produkti nesatur <i>\u201c\u0122MO\u201d<\/i>. Oblig\u0101tie krit\u0113riji no \u201cp\u0101rtikas kvalit\u0101tes\u201d grupas tiek piem\u0113roti 28% iepirkumu; bet tikai 4% no iepirkuma dokumentiem izc\u0113la k\u0101 priorit\u0101ti biolo\u0123isko p\u0101rtiku. Liel\u0101koties no grupas <i>\u201cp\u0101rtikas kvalit\u0101te\u201d<\/i> konkursiem izv\u0113las p\u0101rtiku, kas ra\u017eota saska\u0146\u0101 ar integr\u0113t\u0101m ra\u017eo\u0161anas krit\u0113rijiem vai nacion\u0101l\u0101s p\u0101rtikas kvalit\u0101tes sh\u0113m\u0101m, vai sagrup\u0113 kop\u0101 visus tr\u012bs p\u0101rtikas ra\u017eo\u0161anas veidus, kas padara biolo\u0123isk\u0101s p\u0101rtikas pieg\u0101di maz\u0101k ticamu t\u0101s augst\u0101k\u0101s cenas d\u0113\u013c.<\/p>\n<p>Viens no bie\u017ei izmantotiem krit\u0113rijiem, kas ir \u0101rpus valsts ZPI ties\u012bbu aktu darb\u012bbas jomas, ir pien\u0101kums pieg\u0101d\u0101t\u0101jam \u0146emt atpaka\u013c izlietoto iepakojumu (k\u0101 oblig\u0101tie krit\u0113riji 6%, saimniecisk\u0101 izdev\u012bguma v\u0113rt\u0113\u0161anas krit\u0113riji 28%).<\/p>\n<p>Kopum\u0101, tikai 15% no konkursa dokumentiem satur\u0113ja vismaz vienu oblig\u0101tu krit\u0113riju no trim krit\u0113riju grup\u0101m. T\u0101d\u0113j\u0101di tie atbilda valsts ZPI pras\u012bb\u0101m p\u0101rtikas produktiem. Tom\u0113r dzi\u013c\u0101ks skat\u012bjums nor\u0101da, ka praks\u0113 atbilst\u012bba var b\u016bt v\u0113l zem\u0101ka. Krit\u0113riju un p\u0101rbaudes l\u012bdzek\u013cu nov\u0113rt\u0113jums atkl\u0101ja, ka krit\u0113riji ir formul\u0113ti nepietiekami prec\u012bzi: skaidri formul\u0113tu krit\u0113riju proporcija da\u017e\u0101diem krit\u0113rijiem ir no 20% l\u012bdz 100%. Piem\u0113ram, nereti pras\u012bbas ir formul\u0113tas v\u0113l\u0113juma izteiksm\u0113 \u201cv\u0113lams\u201d, \u201cdod priek\u0161roku\u201d. Bie\u017ei p\u0101rprasts krit\u0113rijs ir par viet\u0113jo p\u0101rtiku, piem\u0113ram, nor\u0101dot \u201catt\u0101lumu no izcelsmes vietas.\u201d Tikai 6% p\u0101rbaud\u012bto konkursu, kuros tika piem\u0113rots \u0161is krit\u0113rijs, bija pietiekami skaidri formul\u0113ti k\u0101 \u201catt\u0101lums no ra\u017eo\u0161anas izcelsmes vietas\u201d. Citos gad\u012bjumos nav nor\u0101d\u012bts, no kura punkta tiek m\u0113r\u012bts att\u0101lums, vai krit\u0113rijs pie\u013cauj abus: att\u0101lumu no ra\u017eotnes vai noliktavas. Tas var rad\u012bt situ\u0101ciju, kad praks\u0113 pat maz\u0101k pieg\u0101\u017eu atbilst valsts ZPI pras\u012bb\u0101m. Autori uzskata, ka, lai lab\u0101k uzraudz\u012btu ZPI \u012bsteno\u0161anas l\u012bme\u0146a kvantitat\u012bvos r\u0101d\u012bt\u0101jus (piem\u0113ram, cik liels % no vis\u0101m p\u0101rtikas produktu pieg\u0101d\u0113m (naud\u0101 vai kg) ir no biolo\u0123iskaj\u0101m lauksaimniec\u012bb\u0101m), jau iepirkumu izsludin\u0101\u0161anas f\u0101z\u0113 b\u016btu j\u0101paredz pras\u012bba veikt uzskaiti un pieg\u0101d\u0101t\u0101jiem vai iepirkuma veic\u0113jiem b\u016btu j\u0101nodro\u0161ina nepiecie\u0161am\u0101 dokument\u0101cija.<\/p>\n<p>Lai nov\u0113rt\u0113tu ZPI \u012bsteno\u0161nas efektivit\u0101ti, \u0146emto v\u0113r\u0101, ka ir vair\u0101ki at\u0161\u0137ir\u012bgi krit\u0113riji, autori l\u016bdza vides ekspertus spriest par ZPI  krit\u0113riju noz\u012bm\u012bgumu un efektivit\u0101ti. Ekspertu nov\u0113rt\u0113jums bija \u013coti at\u0161\u0137ir\u012bgs, tom\u0113r visaugst\u0101ko v\u0113rt\u0113jumu sa\u0146\u0113ma biolo\u0123isk\u0101 p\u0101rtika, ko p\u0101rbaud\u012btajos Latvijas iepirkumos k\u0101 krit\u0113riju iek\u013c\u0101va reti,  , bet viszem\u0101kie v\u0113rt\u0113jums tika pie\u0161\u0137irts krit\u0113rijam <i>\u201cbez \u0122MO\u201d<\/i>, kas iepirkumu konkursos tiek izmantots visbie\u017e\u0101k, visticam\u0101k, jo to paredz ar\u012b vesel\u012bbas jomas regul\u0113jums<\/p>\n<p><strong><span style=\"color: #2d5986; font-size: medium;\">K\u0101p\u0113c biolo\u0123isko p\u0101rtiku iep\u0113rk tik maz?<\/span><\/strong><\/p>\n<p>Analiz\u0113jot veiktos iepirkumus tikai 4% biolo\u0123isko p\u0101rtikas produktu ieg\u0101di pied\u0101v\u0101jum\u0101 izmantoja k\u0101 oblig\u0101tu, 1% k\u0101 l\u012bguma pie\u0161\u0137ir\u0161anas krit\u0113riju. \u201cBiolo\u0123isk\u0101 p\u0101rtika\u201d ir viens no ES ZPI pamatkrit\u0113rijiem, jo t\u0101 pal\u012bdz sasniegt vair\u0101kus m\u0113r\u0137us (samazin\u0101t eitrofik\u0101ciju, mazin\u0101t toksisku vielu izpl\u016bdi vid\u0113, paaugstin\u0101t dz\u012bvnieku labtur\u012bbu).<\/p>\n<p>Viens no biolo\u0123isk\u0101s p\u0101rtikas izmanto\u0161anas \u0161\u0137\u0113r\u0161\u013ciem ir t\u0101s augst\u0101k\u0101 cena. Latvijas skolu malt\u012btes da\u013c\u0113ji subsid\u0113 valsts (1,42 eiro uz vienu cilv\u0113ku), un viet\u0113j\u0101s pa\u0161vald\u012bbas nereti nev\u0113las palielin\u0101t savu da\u013cu, lai segtu augo\u0161\u0101s izmaksas par skolas \u0113dienreiz\u0113m, ko rad\u012btu liel\u0101ks biolo\u0123isko produktu \u012bpatsvars. Liela noz\u012bme var b\u016bt ar\u012b pieg\u0101des tr\u016bkumam: saska\u0146\u0101 ar Latvijas Biolo\u0123isk\u0101s lauksaimniec\u012bbas asoci\u0101cijas datiem organisk\u0101 produkcija aptver tikai 2% no kop\u0113j\u0101 valsts p\u0101rtikas tirgus<sup><a href=\"#fn1\" id=\"ref1\">1<\/a><\/sup>. Tom\u0113r v\u0113r\u0101 \u0146emams ir fakts, ka krit\u0113riju \u201cbiolo\u0123isk\u0101 p\u0101rtika\u201d \u013coti reti (1% gad\u012bjumu) izmanto ar\u012b k\u0101 v\u0113rt\u0113\u0161anas krit\u0113riju, lai, mekl\u0113jot ekonomiski visizdev\u012bg\u0101ko pied\u0101v\u0101jumu, var\u0113tu sv\u0113rt p\u0113c cenas un pieejam\u012bbas. Rezult\u0101t\u0101 ieg\u016bstam v\u0101veres riteni \u2013 biolo\u0123iskie produkti netiek iek\u013cauti nestabil\u0101s pieg\u0101des d\u0113\u013c, bet to ra\u017eo\u0161ana nepalielin\u0101s stabila piepras\u012bjuma tr\u016bkuma d\u0113\u013c.<\/p>\n<p>Liela noz\u012bme var b\u016bt ar\u012b visp\u0101r\u0113j\u0101s izpratnes tr\u016bkumam par j\u0113dzieniem \u201cbiolo\u0123isk\u0101 p\u0101rtika\u201d, \u201cintegr\u0113t\u0101 ra\u017eo\u0161anas metode\u201d un \u201cnacion\u0101l\u0101 p\u0101rtikas kvalit\u0101tes sh\u0113ma\u201d. Nesen veikts tirgus p\u0113t\u012bjums<sup><a href=\"#fn2\" id=\"ref2\">2<\/a><\/sup>  par\u0101d\u012bja, ka tikai 28% respondentu no pla\u0161as sabiedr\u012bbas (1004 dal\u012bbnieku) atpazina ES biolo\u0123isk\u0101s p\u0101rtikas mar\u0137\u0113jumu k\u0101 biolo\u0123isk\u0101s lauksaimniec\u012bbas produktu mar\u0137\u0113jumu. Liels skaits &#8211; 34% &#8211; respondentu k;a biolo\u0123isk\u0101s p\u0101rtikas atpaz\u012b\u0161anas z\u012bmi k\u013c\u016bdaini min\u0113ja Latvijas kvalit\u0101tes sh\u0113mas <b>\u201cZa\u013c\u0101 karot\u012bte\u201d z\u012bmi<\/b>. \u0160\u012b neskaidr\u012bba var b\u016bt iemesls ar\u012b tam, ka iepirkumu r\u012bkot\u0101ji visus tr\u012bs sertifik\u0101cijas sist\u0113mu veidus iek\u013cauj vien\u0101 krit\u0113rij\u0101, piem\u0113ram, <i>\u201ctas viss ir viens un tas pats\u201d<\/i>.<\/p>\n<p>Intereses tr\u016bkumu par labu biolo\u0123iskajai p\u0101rtikai var izskaidrot ar\u012b ar tr\u016bksto\u0161o viet\u0113jo politiku: da\u017e\u0101d\u0101s valst\u012bs veiktie gad\u012bjumu p\u0113t\u012bjumi liecina, cik svar\u012bgi ir skaidri politikas m\u0113r\u0137i un viet\u0113jo politi\u0137u atbalsts<sup><a href=\"#fn3\" id=\"ref1\">3<\/a><\/sup>. It\u0101lij\u0101, p\u0113tot pa\u0161vald\u012bbas ar labiem sasniegumiem p\u0101rtikas politik\u0101, secin\u0101ts, ka pozit\u012bvi faktori liel\u0101k\u0101m biolo\u0123isk\u0101s p\u0101rtikas produktu \u012bpatsvaram \u0113din\u0101\u0161an\u0101 m\u0101c\u012bbu iest\u0101d\u0113s ir: sabiedrisk\u0101s \u0113din\u0101\u0161anas uz\u0146\u0113mumu politika, vec\u0101ku komiteju spiediens un atbild\u012bgo valsts iest\u0101\u017eu p\u0101rliec\u012bba un motiv\u0101cija<sup><a href=\"#fn4\" id=\"ref4\">4<\/a><\/sup>.<\/p>\n<p>Autores secina, ka iepirc\u0113ju pa\u0161v\u0113rt\u0113jums nav piem\u0113rota metode, lai m\u0113r\u012btu ZPI \u012bsteno\u0161anas l\u012bmeni: iepirkumu veic\u0113ji daudz bie\u017e\u0101k savu publisko iepirkumu bija atz\u012bm\u0113ju\u0161i k\u0101 ZPI (54% \u201390%) nek\u0101 to kontat\u0113j\u0101m p\u0113c r\u016bp\u012bg\u0101kas izp\u0113tes (15%). Tom\u0113r pa\u0161u iepirkumu konkursu pp\u0101rbaude ar\u012b nav pietiekama, lai saprastu \u012bsteno\u0161anas l\u012bmeni, t. i., cik liel\u0101 m\u0113r\u0101 \u201cza\u013cie\u201d konkursi p\u0101rv\u0113rt\u0101s par \u201cza\u013c\u0101k\u0101m\u201d pieg\u0101d\u0113m. Skaidr\u0101ki kvantitat\u012bvie r\u0101d\u012bt\u0101ji un bie\u017e\u0101ka uzraudz\u012bba var\u0113tu pal\u012bdz\u0113t izm\u0113r\u012bt re\u0101lo \u012bsteno\u0161anas l\u012bmeni.<\/p>\n<p>Viens no ES ZPI pamatnost\u0101d\u0146u galvenajiem krit\u0113rijiem <i>\u201cbiolo\u0123isk\u0101 p\u0101rtika\u201d<\/i> \u013coti reti tiek izmantots Latvijas valsts iepirkumos p\u0101rtikas produktiem (4% k\u0101 oblig\u0101ts un 1% no v\u0113rt\u0113\u0161anas krit\u0113rijiem), un tam, iesp\u0113jams, ir vair\u0101ki iemesli. Tas noz\u012bm\u0113, ka no Eiropas viedok\u013ca, kur k\u0101 etalons tiek izmantoti pamatr\u0101d\u012bt\u0101ji, par za\u013ciem var uzskat\u012bt pat maz\u0101k nek\u0101 15% Latvijas p\u0101rtikas iepirkumu.<\/p>\n<p>Pa\u0161laik valsts regul\u0113jums par ZPI pied\u0101v\u0101 diezgan lielu krit\u0113riju kl\u0101stu, nenor\u0101dot to noz\u012bmi un ietekmi Tas var rad\u012bt situ\u0101ciju, kad iepirkumu veic\u0113ji izv\u0113las vienk\u0101r\u0161\u0101k\u0101s, bet videi maz\u0101k izdev\u012bg\u0101k\u0101s iesp\u0113jas. Krit\u0113riju skaita samazin\u0101\u0161ana vai skaidra krit\u0113riju pamatkopuma nor\u0101d\u012b\u0161ana var\u0113tu pal\u012bdz\u0113t mazin\u0101t \u0161o probl\u0113mu. Piem\u0113ram, krit\u0113riju \u201cnav \u0123en\u0113tiski modific\u0113tu organismu\u201d izsl\u0113gt no ZPI krit\u0113rijiem, jo tas jau ir pietiekami regul\u0113ts ar vesel\u012bbas nozares t.i. pras\u012bb\u0101s.
