P\u0113c proced\u016bras norises cits pretendents iesniedza s\u016bdz\u012bbu par to, ka iepirkuma norises gait\u0101 A veica kapit\u0101lda\u013cu ieg\u0101des dar\u012bjumu, kura rezult\u0101t\u0101 tas sev pievienoja B.<\/p>\n<p>EST nor\u0101da, ka no Direkt\u012bvas 2014\/24 28. panta 2. punkta pirm\u0101 teikuma izriet, ka saimniecisk\u0101s darb\u012bbas subjektam, kur\u0161 iesniedz pied\u0101v\u0101jumu, princip\u0101 ir j\u0101b\u016bt tam, kur\u0161 ir ticis iepriek\u0161 izraudz\u012bts. T\u0101l\u0101k EST atg\u0101dina, ka EST spriedum\u0101 C396\/14 l\u012bdz\u012bg\u0101 situ\u0101cij\u0101 v\u0113rt\u0113ja jaut\u0101jumu par to, k\u0101 \u0161\u0101das izmai\u0146as ietekm\u0113 sarunu proced\u016bru, iev\u0113rojot Savien\u012bbas visp\u0101r\u0113jos ties\u012bbu principus, proti, vienl\u012bdz\u012bgas attieksmes principu un no t\u0101 izrieto\u0161o p\u0101rskat\u0101m\u012bbas pien\u0101kumu, k\u0101 ar\u012b \u0161o ties\u012bbu m\u0113r\u0137us publisk\u0101 iepirkuma jom\u0101. Vienl\u012bdz\u012bgas attieksmes pret pretendentiem principa \u0161auras piem\u0113ro\u0161anas rezult\u0101t\u0101 tiktu secin\u0101ts, ka tikai priek\u0161atlas\u0113 izraudz\u012btie uz\u0146\u0113m\u0113ji k\u0101 t\u0101di var iesniegt pied\u0101v\u0101jumus un k\u013c\u016bt par izraudz\u012btajiem pretendentiem. Tom\u0113r EST nosprieda, ka, sarunu proced\u016br\u0101 likvid\u0113joties izraudz\u012btajai grupai, kur\u0101 ietilpst divi saimniecisk\u0101s darb\u012bbas subjekti, viens no tiem var aizvietot \u0161o grupu un turpin\u0101t \u0161o proced\u016bru, nep\u0101rk\u0101pjot vienl\u012bdz\u012bbas principu, ar nosac\u012bjumu, ka ir pier\u0101d\u012bts, ka \u0161is saimniecisk\u0101s darb\u012bbas subjekts viens pats atbilst min\u0113t\u0101s iest\u0101des defin\u0113t\u0101m pras\u012bb\u0101m un ka t\u0101 dal\u012bbas turpin\u0101\u0161an\u0101s \u0161aj\u0101 proced\u016br\u0101 neizraisa citu pretendentu konkurences situ\u0101cijas pasliktin\u0101\u0161anos.<\/p>\n<p>Konkr\u0113taj\u0101 liet\u0101 viena no pretendentiem sp\u0113jas palielin\u0101j\u0101s, ieg\u0101d\u0101joties citu pretendentu.
